^ i had this situation happen to me once. a female new hire came into my office on the first day. for some reason, she sat too close to me and showed an abundance of cleavage. i told her i had a meeting to attend and for her to leave, then i immediately called the vp (my direct supervisor) to tell her about the situation. i kid you not, the vp called me after work to say the new hire reported me for sexual harassment because i was staring at her breasts and making her uncomfortable. prior to the report, the vp had already pulled cameras. they showed the new hire going into the restroom, coming out a couple minutes later with her cleavage out, walk into my office, then move the chair literally two feet away from me, after which i told her to leave. the vp informed the new hire of the video footage, and then informed her that i was suuuuuuuuuper gay. she never showed up to work again after that, after three days of no call/no show, she was officially terminated. never heard from her again.

She sexually harassed him, on video. Pre meditated. Then she slandered him for personal gain. Charge her. Sue her. Shut her down.
Premeditated….? What she did was wrong 100%, but that’s not exactly the way the law works. Sexual harassment would be a difficult thing to prove, legally speaking. Impossible? No, but it would be too difficult for the court to take that up as a criminal offense.
He does possibly have some recourse civilly, but that is difficult as well in terms of the recording. I’m not familiar with Georgia laws specifically, but did scan them real quick. If it is true that she had a “photographer”&he was not(or she) part of the conversation then that would not apply to the one party consent for audio recording. It’s a private business, so that makes it a little dicey since it is open for the public. That could be a possibility, but it would probably be an iffy one honestly.
As for slander(it would be libel unless on her posts she spoke it as well, but that’s splitting hairs sort of) that’s also a difficult thing to “prove” in the legal sense. She could very well claim that she “believed” he was a pervert. It is hard to prove what someone’s intent was since that is locked inside of the mind.
In a “common sense” aspect, it’s easy to see what was happening. But as we say, “the law&common sense doesn’t not always align.” I truly do believe we need better protections against this sort of thing, &push for it. She was 100% in the wrong&we need recourse for this sort of behavior&action. I am just purely speaking from a legal aspect of it all to show people how it would play out with how difficult it is to hopefully get more people on board with pushing for better protections&laws against this sort of schmuckery that we have to deal with now.
The courts would see this as not worth it to spend the money&time on a case that doesn’t have a good chance of conviction criminally under current laws. In a civil court case, it’s up in the air but I honestly don’t think he would have a great chance unfortunately, with my limited knowledge of Georgia though. He could have a few other possibilities civilly, but it wouldn’t be “worth it” monetarily&i couldn’t see many lawyers going pro bono on it.
Best thing we can do is push for our elected officials give us recourse&punishments for this sort of thing. They serve the will of the people, so we need to let them know what we want until we get it.
@@halvorson566 Premeditated is specifically for certain crimes anyway, but in layman term, what she did could count as premeditated. It only means "planned" / "having thought about". If you go vandalize someone's house after saying "i'm gonna go vandalize this house", it's premeditated, since you planned to do so. But last i checked, there's no such thing as a "premeditated vandalism" charge, because it's been decided it doesn't or at least shouldn't make a difference morally whether it was planned or an impulse. For ending a life, it's a lot more important to know, so we make the distinction.
But it's still just a word with a definition that can be used like so in layman term.
@halvorson566 Don't most work places have their own cameras? I wouldn't doubt the workplace caught the footage of the whole situation instead of just her short clip. Also just the fact she had the camera set up in the first place could be used against her. She recorded and posted a video of someone without their consent as well as recorded in her own workplace which is usually prohibited by most places as the company can be held liable for anything their employee posts on the internet. If you can't take action for sexual harassment, there are plenty of other wrongs to take legal action against her for.

Even though this would be considered a libel case, it's still not worth the time. Defamation lawsuits are mostly intended for people who are financially stable enough to actually afford it, not your average 9-5 Walmart employee. These people are generally people who have alot to lose if there name is dragged through the mud. I.e. content creators, professional athletes, doctors, professors at prestigious schools. This woman probably has more money than this dude, and can probably afford better lawyers a defamation case can be open and shut but still last for an extremely long time. I hate to say it but the best thing this dude probably could do would be to a) start a go fund me if he wants to pursue legal action b) never make a video in the first place because if it goes viral guess what: more attention and traffic to this woman's only fans, she gets more money and profits off of weirdos that just want to spend money on virtual women.
