Last year, I received a copyright strike on my RUclips video from a third party representing an online design platform. I had disputed it, since my demonstration video didn't contain proprietary content. The third party said the online design platform initiated the strike. When I asked for clarification on the infringement, the issue was escalated and the design platform eventually acknowledged no copyright breach, removing the strike. So I say challenge the strike!!
Your thumbnail does not fall under fair use for 2 reasons. 1) For fair use to be applicable, in the way you imply, you have to be doing a review or critique of the copyrighted work directly. In this case that is the logo, which is a copy written entity itself. You aren't allowed to use their logo as a placeholder for the company as if they are one in the same, they aren't. Instagram and their logo are separate copyrights. So if you were doing a review or critique of their logo, then fair use may be applicable. However, 2) your thumbnail is not a review or critique itself so it's not applicable anyway. Your thumbnail is not your video. So why did you get targeted when so many other people use Instagram logos in their content? It's because you're using the wrong logo. Instagram allows the use of their logo if you follow their assets policy. Google "Instagram brand assets" and find the meta page where you can read the rules and download the 3 acceptable versions of their logo. The version in your thumbs is not permitted outside of official company usage. Sorry.

Kia ora everyone, it’s me from the channel mentioned at 5:47 I want to publicly apologize to Dominik and his team - I've also reached out to them directly. Here's what happened: I bought some thumbnail services from a seller on Reddit without realizing they were just repurposed from Dominik's content. As soon as I found out, I tried to get original ones, but the designer disappeared on me. My channel's still small, so I thought I could use the copied ones temporarily. That was clearly the wrong call, and I'm sorry for any disrespect it caused to the HeyDominik team. I've removed those thumbnails now. I believe in fair and creative content creation, and I've learned a big lesson here. Let's all support each other's growth in 2024!

Imagine, how manny people would be taken down, for actions they took sometimes years ago where the boundary’s weren’t that strict, that is an unfair position to be put in, coming after someone years later, at least they should done it back then, so you would get a chance to correct yourself on time,
I remember that a few years ago, something like that also happened (at least some German RUclipsr talked about it). Some random small agencies from all around the world claimed to work for Sony Music or something like that and claimed every piece of music in the videos, even if the music wasn't from Sony but free content music or the license was bought by the RUclipsr. There were tons of copyright claims from these agencies, who were definitely not working for a bigger company but just trying to claim as many videos as possible. I don't exactly remember what they would gain from it, but they bet on the fact that the RUclipsr wouldn't fight against it...
My suggestion is to make sure you don't retaliate with the content creator who steals from you out of anger over IG coming down on you. I support whatever decision you make. Just make sure you feel justified and can sleep at night over your actions.
As far as I am aware, with symbols of companies, to breach USA law you need to basically misrepresent the logo, i.e., you say you are the company, or a product has a symbol on it close enough to fool people into buying the product under the disguise of that symbol being the "REAL" company. Referencing the company would be a hard case to win. As you aren't misrepresentating anything, the symbol is used to refer to the real company. If this claim stated was true, everyone saying follow me on "this app" could be sued. Which is totally ridiculous as this is exactly what the app is promoting. All you would need to prove is the app is promoting the use of the symbol for normal usage associated with the app.
The system is broken and good luck (sincerely) to you. I no longer create content, because of impossible algorithms/analytics and ridiculous censorship...I've also noticed the inconsistencies with the moderators, makes it very hard to work online. Sending my support!

try using a repeating pattern watermark on the background of your thumbnails to stop them from copying and pasting your thumbnails onto their videos, it doesn't have to cover the whole thumbnail just parts of it and you can make it as discrete or bold as you want, it might not stop them using it but at least if they do they'll be promoting you for free, or it will force them to create it from scratch and that's at least gonna eat away at their time. think of it just like any other design element and merge it into your branding. hope this helps

Not a great way to start the year.. copyright and IP Law is something that’s been hairy for a long time. The sad part is that it’s not being honestly spoken about lately and, sadly, there are people and organizations either abusing it or spreading information that could lead people into situations where owners are within their rights to sue/strike. I think this happens more when companies are strapped for cash or selectively when it’s an unfavored creator. A company might not mind something one days because it also benefits them, then it could turn around and retroactively hit you for historical use. This is why I never charge for stuff that I either know has an IP holder - because they could be fine with it today, but the strike later at a time when I can’t afford to lose the little that I have. Worse still you could come up with something and still have to fight with someone stealing outright that knows they would win a legal battle ( or something more sinister). You almost don’t wanna bother “creating”. I’m sorry this is happening to you, Dom, especially with all the people you’ve helped - including the platform itself by driving traffic. HNY
Actually it is legal to use audio music from instagrams’s music library to use in stories and reels. The music there is already pre-cleared for use therefore the user won’t have any copyright issues. It’s better to upload music that way than to upload a song as an original audio. That’s when you have a copyright issue. I’m on instagram a lot and find it very common to see a lot of content creators use songs in their content as original audio when they should be using it from the audio library on instagram. They don’t even have the decency to credit or mention the artist of the song. I don’t know if it’s due to ignorance or if they simply just don’t care but it’s a practice that needs to stop. Also what about reposting other people’s images and content without their consent is a common practice too on instagram. Just because there’s a repost app doesn’t automatically give you permission to post someone else’s content without their permission. Instagram has a copyright rule for that as well.
Puh. My feeling is when I read the instagram brand guide, you did nothing wrong in terms of "Balance the instagram brand with your brand". Your face/brand is always predominantly in the thumbs I see. Reminds me of a case in germany a few years ago, where a outdoor company sued lots of etsy shops, that stitched a paw/claw on pillows and stuff. In the end it was a PR disaster for the outdoor company, but the outdoor company argued, they have to protect their brand or they will lose their rights on the brandmark all-together. Can’t beliefe Meta itself really started that sh*t. And what kind of bad brand-monitoring is that, they figured years later ...
On the Meta "Instagram brand assets and guidelines" webpage, it says if you want to use their logo in a web series or any video not part of a series, you need to submit a request to use it via their approval process. The logo is their intellectual property.

This same happened to me too on Christmas day! They took down three of my videos for having the Instagram logo in the thumbnail. Maybe I’ll make a video about this too in hopes it will help your case
I posted a Reel yesterday on IG and almost immediately said its against their monetization policy. I wonder if someone reported it, just to be a hatter. It surely soured my mood, but I will request another review and see what happens. Hopefully, you can fight this nonsense that is happening to your channel back. We need more transparency on creators' rights. Otherwise, why should we even bother to create content.

Puh. My feeling is when I read the instagram brand guide, you did nothing wrong in terms of "Balance the instagram brand with your brand". Your face/brand is always predominantly in the thumbs I see. Reminds me of a case in germany a few years ago, where a outdoor company sued lots of etsy shops, that stitched a paw/claw on pillows and stuff. In the end it was a PR disaster for the outdoor company, but the outdoor company argued, they have to protect their brand or they will lose their rights on the brandmark all-together.
Can’t beliefe Meta itself really started that sh*t. And what kind of bad brand-monitoring is that, they figured years later ...
On the Meta "Instagram brand assets and guidelines" webpage, it says if you want to use their logo in a web series or any video not part of a series, you need to submit a request to use it via their approval process. The logo is their intellectual property.
A thumbnail is not really a broadcast I would say. Also the brand is more than just the icon or logo. The word is also the brand, so you shouldn't be allowed to say it?

You didn’t get sued. You got a request from RUclips for using the Instagram logo. They are different things.

This same happened to me too on Christmas day! They took down three of my videos for having the Instagram logo in the thumbnail. Maybe I’ll make a video about this too in hopes it will help your case

Using a logo is absolutely okay but its something i know other companys have gone after youtubers for the same thing, man...

I posted a Reel yesterday on IG and almost immediately said its against their monetization policy. I wonder if someone reported it, just to be a hatter. It surely soured my mood, but I will request another review and see what happens.
Hopefully, you can fight this nonsense that is happening to your channel back. We need more transparency on creators' rights. Otherwise, why should we even bother to create content.

I think this is called "Apple mentality", with a specific company suing farming and grocery companies over using apples in logos or marketing.

Maybe because they're not profiting from the information you are giving they are wanting only official Instagram people or meta people to be giving out this sort of information? 🤷♀️
