    At my assessment, the assessor said, she could see that I was in pain, but said "it's just pain and pain can be managed, I'm sorry it just can". When I quoted her a PIP court case where it had been judged that doing anything in pain was not an acceptable reason to deny benefits, she just said that was irrelevant. I told her that I would be asking for a copy of her notes and that I insisted that she included my comments. She got angry, but did as I asked. I did get awarded ESA. You have to know what you're dealing with. Nobody should go into this process unaided there should be adequate, free advise and representation for the whole process. Nobody should be asked to defend themselves in front of a panel of judges, with no experience of the law. It's ludicrous and demeaning.

    They're weaponising poverty, then using that weapon to cause as much pain as they think they can get away with. Utterly vile!

      They're also weaponising disability. I wonder how they would feel if they were to wake up one day and find they can no longer cut their own toenails or, worse still, can't wipe their own backside anymore. I can do neither of those things now, yet I've been turned down for PIP twice!

    The 'nurse' that did my phone assessment didnt even know what agoraphobia was...how can you assess someone for something you know nothing about...just shows how dodgy it all is...thanks again Richard for keeping us up to date.

      Honestly, I had the same problem when I had to claim a couple of years back for the same situation. My agrophobia was through the roof and I couldn't leave the house. The person assessing me didn't understand how it affected me and turned around and said because I don't go outside my mobility isn't affected so therefore I wasn't allowed the higher rate. A few threats of court action later they soon change their mind... Absolutely biggest belief!

    It took 2 1/2 years for my tribunal to be heard. I was in front of the board for 1 minute and won the award what a waste of taxpayers cash

      Sometimes you just want them to do the bloody assessment and be told 0 for everything and let them have no money for food and electric etc. I'm truly sick of how the DWP treat people and people are now starting to wake up to the reality of it.

    My Mrs half sister went for a job for the DWP she got offered the job so she asked what does the job entail the woman interviewing her said to reduce benefits her sister stood up and said stuff your job my sister is disabled what kind of people are you true story people I can assure you they are after the indigenous people only too

    Be aware, they watch you sometimes with binos, getting in and out of the car, or you walking to the building, the buildings are specifically built to test you, i.e dwp assesor-can you press that button on the wall to open the door please, thats another one. Your watched to see how long you can sit while waiting to go in, your watched to see if you arrive alone. Basically the whole building and the assesment is designed to get you off benefits. This info comes from a good inside source, one bit of advice i was told, s++t or pee yaself in the assesment, your will be hurried out and get the award. Just remember they are not their to help or care and they dont, they are their to stop your benefits, simple as that.

    My friend was denied PIP after a 20 min phone call, how the hell can anyone assess a disabled person over the phone, thanks to we are digital she got her award

      When I had pip assesment 3 years back now for my MH they said I sounded upbeat and dressed well .... I was on the phone ... 🤣🤣

    it's disgusting you could see that the lady in that film deserved pip I'm fed up to the teeth trying to fight pip now from start to finish it makes you feel worthless,so degrading lower than low,and we all shouldn't have to fight for this for cash that were entitled too getting. Pip needs either a shake up or scrapped and redone something needs to change for the better Richard than the worse!!. I've done my letter and will keep you posted if they don't listen or don't change it I'll take it higher up to my local MP who is brilliant she fights for people and doesn't like the DWP or our local council

    Whenever you go for PIP or any appointment with the DWP, and record the whole interview,when you’re recording it they have to do everything by the book and if they don’t you carry on and point out they are being recorded after a while they forget they are being recorded and if they do treat you badly the power of social media is on your side also it’s your right cos they are recording you from the minute you set foot in any office,it also records the audio of every interview, ask them what qualifications they have that are relevant to your claims again this is your RIGHT
    I can’t stress enough how important it is to get their names and qualifications. and never give up on your claim they are counting on you giving up, I know it’s hard and you’re made to feel worthless, but in the end you get what you’re entitled to and you can always complain after your claim has been accepted, the evidence is yours and can’t deny it. Keep up the good work

    It would be a different scenario if it was one of their relatives or 1 of their parents. That is been assess for a pip claim. And yet we are all equal aren't we !!

    I bet the DWP will try and claim they overlooked it and forgot to send in their evidence. The tribunal should tell the DWP they are outside the time they had to send in their evidence and find in the claimants favour.
    If the DWP refuse to give the claimant the money they should send in bailiffs, after giving them a set period to pay up, and get them to get the money from the DWP.

    Yep, that's exactly how I feel. After 18 months (including waiting 9 months instead of the usual 14 weeks for a DWP decision) which all came to nothing. I would rather struggle financially than go through that whole process again. It's humiliating. At the end of it I asked "what happens now?" They said it starts again from the beginning. I told them where they could stick their 'start from the beginning' shenannegans, I'm not putting myself through it again. I don't know where I am at the moment and they seem very confused themselves. I don't think they know what to do with somebody who refuses to go through the process again. I'm still sick and have received the minimum income all the way through this. Paying national insurance contributions seems to be a scam. I've paid them all of my life and when it comes to reporting sick I am effectively refused the sick pay I should be entitled to. It's f****d up.
    Edit: Most of the way through this process, they made a big deal of asking for sick notes that they didn't want to see until they refused to accept anymore. Then after the assessment refusal they're back to asking for sick notes. Again, they don't want to see them, they just want me to keep getting them. Can somebody explain the logic of that? I'm about to explode on the next robot who asks for a sick note.

      I wish I could honestly explain it but the DWP seem to have idiots are us working for them, it's like they attract the most uneducated and bully ISH people on the planet to work for them.
      I would just keep them saved regardless incase they do ask because that's what they are like it makes no sense to anyone.

    Appeal means "to beg" and that is how they will treat people that appeal. I hope I never have to deal with these people, because I will have no problem telling them where to shove their paper work.

    I have anxiety/depression/health anxiety and agoraphobia...i havent taken meds since 2015 because i have a huge fear of side affects and doctors (health anxiety)...the assesor Said...me not taking medication shows MOTIVATION..its so degrading and discriminative towards mental disorders.

      In same position but not all meds have side effect, trust me, ......have you tried sertraline? If not , well worth giving it a go!.......if no joy, stop talking it😊

      @@margo.3466 ALL medication has side affects because ALL medication is toxic chemicals...sertraline and others also don't help or address underlined issues...as generational/childhood trauma causes anxiety disorders and depression.
      So for me..its not just the toxicity of medication..its the fact its useless aswell.

    I was told years ago they watched you from the moment you enter assessment centre they rather give the money away it should be up to your doctor

    Its horrendous ...i cant go thru this ...i have had my account closed on Monday . I have mental illness and very fragile . I have loads of non visible problems from previous ops etc ....that's why I was on PIP

    My partner was asked to do a few weeks on a course despite arthritis in her lower back,after just 7 days of the course her lower back was in pain,sleepless nights with taking more prescribed pain killers,all this despite the DWP seeing all the evidence of her condition,including Dr letters, specialist letters, medication taken with a DWP agent saying ..."my god that's a high dose"....currently in the process of making a official conplaint

    Fairly new to the channel here, but this has been going on for a long-ass time .. back in maybe 2000 I went for a PIP (What was just disability) back then, and received 3 points .. When i spoke to people afterwards they all asked if I'd received a certain 'person' because that person was known for just turning down people on claims .. I had to take that to tribunal and ended up with 20 points .. bit of a difference, but the absolute months of hell i had to go through to get there, ?I was sleeping no more than 15 minutes at a time because of stress, had no money to live on, barely had anything to eat, no heating ... I really can't stand the DWP - whatever they say, we all know that the truth is to block people from getting any form of support they need, however they can ... and even when they cannot deny you support they will purposely make out that you need 'less' support so that you'll receive a lower income / payment.

      im so sorry to hear this i truly am they are horrific to people, i wish id of studied and become an MP when younger now haha then i would tell them straight about their bullcrap they are doing to people, its horrible that government don't care about people any longer. hope your getting the help you need now and are managing better xx

    Always sickens me the time duration your made to w8 under UC. This is why there is so much poverty and hardship as people are made to w8 SO long for cash they are needing now. It also is no shock when we talk waste under this government as over the past 4 years alone there is over 100 billion lost to reckless spending but cuts to areas for the most in need.

      They delay payments for 1 simple reason its to try and force people off benefits but what it does is create poverty and hardship. The story this week of a woman who killed herself because the DWP went after her for overpayments sums up the lack of actual care in the so called system. You cannot expect people with nothing to live on to w8 months for payments. IF nothing else if Labour do get in i want that shit sopped in the benefit system asap@@DynamicDuoUK

    Hi guys just letting you know that I didn't get pip upset fed up that I keep have to keep trying to get it tried a few times in the past never for it wrote my mandatory reconsideration letter trying this for one last time and giving up on it was only awarded 6 points for the standard rate pip added in my letter the points that I disagree that I should of had for medications etc that my mom administers them to me because I took a overdose in the past xx

      Hiya Kim I'm so sorry to hear that it's totally out of order and your trying so hard and it's unfair your being punished this way, just remember to the DWP though it makes no difference what medicine your on, there supposed to award you based on how the condition affects you, they do seem to forget this quite a lot however !       Currently estimated over a year maximum 2 years it's honestly so bad due to the amount of people waiting.

      @@DynamicDuoUK mine should have been sorted June 23 but my GP who i have never actually met gave the wrong information on my UC medical report, when i found out, i got the GP to correct the information, and then sent this to the appeal. I hope this helps my case. Its not a good feeling when people don't believe you, even with evidence, and i bet I'm not the only one.

      It takes well over a year but my advice is to stick with it and wait because chances are you will be awarded and any backpack you are owed.

    Our case was the same , we submitted a MR 2 years ago, debt recovery started lost mandatory reconcideration , submitted a Tribunal, DWP failed to respond in 4 weeks
    After 8 weeks we asked the judge to make a direction …
    At this point DWP put up the white flag and that the person was eligible for the benefits five years earlier.
    However that’s all they said , they made no attempt to repay the monies deducted by UC debt recovery (£1518) over 2 years
    We made a formal complaint and a claim for the debt, and compensation as , during the two years ,the person and her two teenage children , were made homeless and the claimant missed her dad’s funeral due to poverty.
    There has been a refund if the £1518 , but no interest, no compensation for “ loss of amenity “ or apology as per the document “ small mistakes , big consequences “
    Her benefits were correctly paid, then stolen back after a nationality motivated witch hunt three years after they were paid. Compensation for similar case studies is around £5-10,000 in that document from the independent case examiner.
    I’m not sure if we should go to the I.C.E or an ambulance chasing lawyer… we still haven’t made that decision..
    We have 3 years from the complaint to start legal proceedings.

      I truly think the DWP and their staff need the assesment themselves for their inability to function and use cognitive ability to make decisions, let them score a couple of points for that hey! 😜 Sorry the experience you've had your not alone that's for sure , by doing these videos we are highlighting in detail the true struggles.

      @@DynamicDuoUK I have been reading up , and it is mandatory to pay 8% interest on late payment according to the financial ombudsman. Also to compensate for the fact someone has to request it, and put them back in the position that they would have been in.
      We will not give up on this case

    I have multiple conditions ,I receive pip but it’s been a struggle had to get it ,I have to get a mandatory reconsideration ,because the person who ws doing the assessment was a paramedic and knew nothing about my conditions ,I took my daughter with me ,he told her to be quite when she tried to help me ,and what I told him and what he put in his assessment was complete lied about my health

      That's disgusting, their own policy states on any assessment people can speak for you on your behalf, the assessor not allowing that in the first place has breached their own guidelines so they shouldn't have even used their report.
      Paramedics nothing against them active or retired but they don't have a clue about mental health or how it affects individuals because it is different with everyone and never the same.

    I have info from the ME/CFS association you are supposed to describe how you are for over 50% the time or most of the time, not just your worst day. You need to present an honest picture overall.

    yep my uncle claims pip and hes out working in peoples gardens painting and weeding etc ,me how ever i have a fracture in my spine due to a work injury and gets no help what so ever ,i used to work 12 hour shifts ,its caused huge division i cant even look at him now without wanting to hit him

      I'm sorry to hear that the situation with you. It truly isn't fair and I completely understand the division or divide that could be caused. I've experienced that myself and a lot of people do experience it to this day, it's a tricky one because they are saying he's entitled to it based on either evidence from a GP etc. But then at the same time you should also qualify because of your condition. It just beggars belief that they don't understand that.
