Several moments where Mannix proves he's the sheriff. Introducing himself as such to everyone in Minnie's, as well as asking the hangman about a guy who was going to be hanged, and always upholding the law with everyone he talked to pretty much proves he's the sheriff.
This scene shows that mannix really is the sherrif, because if he wasn't he would have shot joe gage, because everyone except warren wants to kill him anyways so there would be no point in continuing the lie.

My personal idea is that Jody was actually just a coward. Killing unsuspecting people is easy, but when he faced being shot, he didn't want to come out until his bitch of a sister was in danger.
