  • What is the end game for the ACC in their legal battles against Florida State University? Should the conference consider settling sooner than later? In reality, the ACC needs to fight to protect their grant of rights for as long as possible because if that crumbles, an FSU exit could set a precedent for others to follow. Then, the conference would be in a terrible position for the renewal of their TV deal with ESPN. And even if the ACC sees settlement with FSU as an inevitability, they’d much rather settle from a position of strength.
    Hosts Alex Donno and Kenton Gibbs break down the significance of Florida’s State’s Tuesday win in court against the ACC. The Leon County, FL judge felt the ACC rushed to file first in North Carolina as a method of “forum shopping.” Donno and Gibbs take a look at what could be a crazy NCAA transfer portal window next week. The NCAA is no longer able to enforce transfer restrictions, meaning players are essentially free to jump from school to school as much as they like.     This will get settled faster than you think, because the ACC and ESPN have made it clear that they can not allow discovery. This would destroy the entire conference since FL requires all information to be made public.

    Kenton, good stuff but I think your argument for fighting FSU and Clemson to the end is flawed. To make that strategy viable, you would have to believe that ESPN would renew the contract and commit billions of dollars before they have certainty over what teams will actually be in the conference.
    They won't let that happen. I believe it's possible the ACC is on the clock and needs to offer some level of certainty by February of next year. If the ESPN contract ends, the GOR also reads like it ends.

    The end game is bigger than the ACC. The B1G/SEC will break away from the NCAA to form a premier CFB league, creating a deal with the CFP. FSU & Clemson have P2 invites, with UNC & UVA possibly. The rest of the NCAA will become a developmental minor league. Miami has misplayed badly IMO.

    Blame FSU and Clemson all you want, but If the ACC wanted to save itself, it should have paid FSU and Clemson what they were worth by adopting an unequal revenue-sharing plan earlier. Instead, they decided to rig the vote by adding three absolute non-factors in CFB to delay the inevitable, which is the ACC’s relegation to G-5 status. Jim Phillips all but codified the ACC’s inferiority by accepting a lower percentage of the CFB playoff payout than the Big10 or SEC.

    All this who files first assumes that both suits are exactly the same thing. They are not and in the end, if the ACC pushes it, the GOR part cannot be held in Florida or South Carolina.

    ESPN has to renew the contract by Jan or Feb of NEXT YEAR. so the longer this goes the riskier it gets for the ACC

    If FSU gets out everyone can get out. Who's staying and what's their value? Some of these teams have no where to go without losing tens of millions per year. Not too mention the self protection of the conference administration..

    As of today 4/15 a settlement has already been reached. It will be made public over the next 3 months. FSU will play a B1G schedule in 2025.

    Its about money. ESPN has been getting ACC content at below market rate for years. Thinking ESPN wouldn't renew the ACC's contract at a discount with the raising costs of sports rights doesn't make sense.

      They would either have to pay more if FSU and Clemson go to the SEC or lose that content if they go to the Big 10. Notre Dame doesn’t factor in because they have their own TV deal with NBC for Football. With the new schools ESPN would be essential pay for SMU since the PAC-12 deal was $30M/per school.

      ESPN would rather pay FSU and Clemson $30M each per year and stay in the ACC then have to pay each $70M per year if they go to the SEC.

    Maybe I’m missing something and correct if wrong but isn’t the ACC done regardless of if FSU and Clemson stays? I mean, how can those teams and fans not realize that they won’t be competitive long term if they’re $30M in the hole EVERY year compared to their peers. Won’t be long until all the sports suffer and fall into irrelevance regardless. Blows my mind that all the schools aren’t trying to get out, even if it’s only the B12 that wants you. Better than this dump.

    When a player has already transferred once and tries it again let him languish in the portal. Multiple tansfers is a huge red flag.

    Because the GOR is a share and share alike agreement between 14 schools and to let anyone go whose leaving could damage the contract benefits to the Wakes and Cuse type teams. If the ACC does not fight for the teams with no place to go then they are liable to them.

    Kenton’s logic is flawed, considering the ACC’s claim to FSU’s media rights wholly depends on ESPN’s TV agreement with the ACC. If ESPN doesn’t opt in to extend the deal next year then there is no way the ACC can stall this out for an additional 2-3 years.

    63-3. They have to win something. If it was a game they would have quit. After this season of disappointment, FSU won't hold any credibility to be wanted in any division. The possible playoff window has closed.
