    The ACC objection to spending hours (money) on discovery is actually silly, since the discovery in NC will be the same.
    Zero chance of motion to dismiss granted in FL. I agree that a dismissal is possible in NC, but not likely. If I were the NC judge, I would definitely issue a stay, as no judge wants to deal with sovereign immunity of a foreign jurisdiction. Let the home state deal with its own sovereign immunity issues. Too dangerous for an NC judge to make a ruling on that aspect of FL law and then watch the FL courts rule differently.
    I agree that laches should not apply. Interesting that if laches is argued the ACC must claim that it is seriously harmed by FSU actions, at the same time that the ACC is arguing that they did not need a vote, since the FSU actions are not material. Bit of a contradiction.
    In addition, if the ACC is arguing anticipatory breach by FSU, then the ACC knew about that for weeks, if not months, so they had plenty of time to get their vote.
    One minor problem with the ACC "suspending" FSU, that started prior to any vote related to the FSU litigation. Seems that it was probably a unilateral ACC decision without worrying about the members.
    There are probably 10 ACC teams with nowhere else to go, so they vote that way.

      Probably all the Carolina schools and new members and maybe a BC and Syracuse; basically anyone that would be left homeless if the conference folds.

    Why is the ACC fighting so hard? It's inevitable FSU and others will leave. Just live with that fact. It's just like the playoffs, it was inevitable and people who were fighting against it were delusional and delaying in the inevitable.

      @@RobMacQYeah, but once FSU leaves, the ACC is no longer a viable conference and will implode, which begs the question, to what end is the ACC trying to get money? What is the end purpose? Is it just for the ACC leadership to get as much money for themselves for their golden parachutes since the ACC will no longer exist? Or is it to continue as a viable organization (which they've done a terrible job of keeping the ACC relevant when compared to the power 2 and Big12). If it is the latter, the ACC should be doing everything in its power to get more money for its members instead of saying they will not get its members more money and they will sue its members if they complain about it.

      @@user-rs6tt9nr8f The ACC need no implode, since there are so many teams with nowhere else to go. Add WaState and OrState and there is a conference of 10 to 12 P4 schools. It will be the weakest conference, but the remaining schools might receive many hundreds of millions from exiting schools. That is a band aid, but not a terrible one given the other possibilities.

    Is there a way to find out which 10 ACC schools voted to suit Florida State? it will be curious to know which ones did not. Could give an insight to where they’re leading as far as their membership..

      I mean, fairly likely to be any grouping of these:
      Duke
      Wake
      Cuse
      BC
      Pitt
      UVA
      VT
      GT
      NCSU
      ND
      UL
      Miami, Clemson, UNC are probably less likely but could do it just to not end up having the ACC come after them too.

      Clemson and Virginia are now in exploratory phases with their attorneys to possibly through the ACC. But, why would they do anything until they see the result of what happens to Florida State? It's just prudent to wait and see. It sucks! That's for sure but I have to admit I would do the same thing.
      Also conference realignment rumors maybe keeping them from filing as well. If Clemson in Florida State get invites to the SEC and/or the Big ten then The ACC is done.

    The motion to dismiss in NC is not a winner. More likely is the beginning of a lengthy multi-stage process that leads up to a 2025 trial in NC with no decision until 2026. Then the appeals begin. If FSU leaves before a final decision, they will leave without their media rights.

      @@dougsligh1820 the purpose is to prove that the ACC did not act within their bylaw mandates and didn’t act in the best financial interest of the member schools. This breaks any obligation FSU has to the ACC if they can prove it in discovery
      I am just waiting to see like everyone else

    Im FSU fan for years,to be honest, im tired of hearing relinement,changing conferences, playoff BS,it's all scam to change, ESPN has there sticky fingers in everything, and i disagree paying players, this is not NFL,this is college to learn,not a money making league, shut everything down all colleges and get ESPN out with sticky fingers, and colleges need to clean out there sticky finger boosters and alumni

    The ACC is a non profit corporation which was referenced in the first FSU amended filing in Leon County. The points the FSU attorneys are bringing up could be more important than being discussed. The bylaws and mission statements are relevant and these could be a problem if a Federal court is involved. The IRS can revoke or suspend the non profit status if they deem violations have occurred. While this is rare, it does happen. My guess is the FSU attorneys are adding the extra details if this proceeds past the state level. Almost all non profits require a board or committee to sign contracts, loan agreements, and other legal documents. It seems hard to believe the ACC isn’t aware how non profit structures work.

    It doesn't seem right to force a school to remain a member when they want out. ACC looks bad by suing a member. Hope, hope the ACC goes belly up or just becomes the conference it raided-the Big East. The ACC practically forced USC(my school)to withdraw in the early 70s. Was glad at the time because I was so POed about the way USC was treated. Later USC realized its mistake and tried to get back in but the ACC gave USC the middle finger. Now that bad karma is coming back to haunt the ACC and USC is a member of the nation's best conference lapping the ACC's payout. This was a lot of legal mumbo jumbo but what it boils down to, IMO, is FSU is gonna get out without having to pay trillions of $s.
    When FSU leaves, Clemson, UNC, Va, Miami, ND are likely to follow thus destroying the ACC.😁😁
    Hope FSU, Clemson, UNC and Va become SEC members.

      Fsu is leaving the acc for financial reasons, it's like making a lateral move to go from the acc to the big 12. The acc & big 12 are being treated like step kids. Their going to one of 2 spots. Sec or big 10. Period.

    Wouldn’t the contract in question be governed by the Florida Statute of Frauds? The contract would have taken in excess of 1 year to complete. If so, doesn’t the fact that the signatory had no authority to bind the University invalidate the contract as failing to comply with the SOF?

      There are questions, mentioned in the FSU suit, the FSU BoT and other members of the administration, were never told about the extension with ESPN in 2016.
      Also, obviously you don't know about the private equity firms we have spoken with so one way or the other Florida State will be out of the ACC. And it won't be for 570 million I guarantee that.
      Why would the ACC want to keep a program that obviously does not want to be in your conference?

      Not so fast my friend. The contract was signed by the president of FSU and not by the BOT which is required by FSU. So that contract isn't legal!!
