I think that he is mistaken, because it is not possible to "use legal loopholes" to "go around regulation" by being clever at law, if the regulators themselves do not adhere to the legal framework, like they do at the United States torture programs. Otherwise it could be said that it is possible to "navigate around" the various Chicago Mafia "agreements" in situations, where the mafiosos do not accept the "naviated-around-solution". I do not think that the Marc Andreessen is willing to start a civil war in America, but if the federal government acts like an ordinary mafia mob, then rules of civil war are the only rules that actually hold and can be "navigated in". The way WikiLeaks, true journalists (Glenn Greenwald, Jeremy Scahill, Julian Assange, etc.) and Tor developers are harassed is an evidence to that. Most of these software magnates have a hole in their heads when it comes to art, literature, music, etc. If by the time you're 50, and you still don't have anything interesting to say about such subjects, you may be a touch pathological. A little more interest in science wouldn't hurt either. Only if they demonstrate some growth in those directions am I ever convinced that they're about something other than money and power, no matter what pretensions to modesty they put on. Indeed, it would be a relief to see any of them send themselves up with overt displays of egotism, since at least that much comedy would indicate the glimmerings of conscience that go with the humane cognitive style that can emerge only from an empathetic disposition. It's one thing to be a little too wrapped up your work, and quite another to climb with Napoleonic obsessiveness that in the end only dissipates in a combination of unrealistically extravagant schemes for conquest and paranoid delusions about the motives of others for checking them by law. In this interview Andreessen shows all the symptoms of that with a weirdly naive lack of sagacity, but that is nothing compared to some of his earlier slips on the Charlie Rose show and in Wired around 5 years ago, which were so mad that I had the impression that to confide too much to him about human nature would be like giving Hitler the bomb. And he's not even all that bad compared to creeps colossal as Ellison, Jobs, and Zuckerberg. Jeepers!

I personally found the Netscape discussion interesting, as someone born after that time it can be difficult to conceptualise how all these things developed... it will be increasingly difficult on a historical level to understand how we got where we are...
