Thanks for sharing. Termites date back more than 120 million years to the time of the dinosaurs. They are known as "silent destroyers" because of their ability to chew through wood, flooring and even wallpaper undetected. Each year, termites cause more than $5 billion in property damage - costs that aren't covered by homeowners' insurance policies. This is why being vigilant about termite control and termite extermination is so important.
I deposed then former technical director for then national trade association in the late 1990's or early 2000's. I asked him if he knew the source for the estimate for how much damage termite companies do each year. He said it was 'laying around' at the office and he adjusted it each year for increases in the consumer price index. In other words, they made it up. But it is certainly true that termites do a huge amount of damage each year.

Realtors are a main cause of new home owners heart ache. They get the cheapest termite company to inspect cause they don't want their bottom dollar affected. Often leading to papers just bring written up and home owners thinking they have a bond but they only got an inspection. Lots of times homes will have active termites or excessive damage. I've seen this happen way to many times to people in Chilton county Alabama.
That’s Bull crap. Each state sets minimum standards for termite treatments. The realtor has nothing to do with it.
I would like to see the actual WIR report with the house graph to see if they marked the previous infestation .also the report has a back page that mentions that company can only do visual inspection and cannot remove wall coverings or move heavy appliances to inspect

In Australia we have a lot (and i mean a lot)of Termite companies large and small....We've had our place inspected 3 times by 2 two companies and both missed the Termite infestation in our garage...We've since completely removed and replaced all timber in the walls and replaced the 8 trusses in the roof....Both companies charged $300 with one company spending 1 hr and the other 2 hours.....Prior to these inspections we had a liquid barrier installed by the 1st company, we didn't pursue because the laws in Australia are not favourable for the homeowner in these cases.
I'm a tech with a local company in South Alabama. I can't count how many times in the 2 years I have been in this field that our small service has received calls from customers of "mainstream" termite control companies wanting us to inspect their work, since we do free inspections. I'd say 30-40% of the time, they either have an active infestation or damage that they were never informed that they had.
It's sad that people get ripped off by companies they trust their homes to.

@@skyplanet9858 I don't know where you are located, but it's best to research Pest Control Companies that are local to you. The BBB is a excellent resource on ANY company you hire to do termite work. Also make sure that they are bonded and insured and "guarantee" their work (meaning that if you are termite free and said company treats your home for protection, they will cover treatment and repairs up to X amount if your home ever incurs damage from a infestation or if you have an infestation actively, they will come out as many times as needed to eradicate them and then bond afterwords).
As far as the "big companies", Orkin would be my recommendation. And honestly it depends on the area management if they are on point or not, but they are definitely one of the few good companies. The one I would recommend that you avoid like the plague is Terminix. They are a absolute scam company and do not care about you, your home, and will rake you over the coals financially. They won't admit fault when they do bad work and your home is destroyed either.
You could also do a treatment yourself if you are tool savvy and don't mind a little dirty work, but you won't have the bond to fall back on.

@@flowdadonmuzik Thank you. I have several properties across the US and one of them is located in Chelsea near Birmingham. I took it out of a Stark contract because they weren't doing anything special other than inspecting the baits once a year and I installed Sentricon myself. I want full inspection and liquid barrier installed and I'm in need for a trustworthy company. I'll lookup Orkin but if I recall I've seen some negative comment about them in one of termitetom's videos.

@8:34. What if you have a Monlithic slab/concrete basement walls that are 7' tall (i.e. 7' down in the soil). Are they going to dig 7' down?
then again u have to consider that each state has its on regulations. in c.a it's really strict
Great Monday morning quarter backing,no type of inspection is exhaustive and no inspector is able to pry or cause secondary damage to look for damage.
Exactly.. Anyone can go into a gutted home and find termite tracks... Termite inspections apply to visible and accessible areas.

I agree, but what would have sent a red flag to me and had my guard up was at the front door as I walked in..then wasnt there another area too that was showing some tunneling b4 they opened it up

lawyers don't normaly chargein something like this they get a % isually 1/3 of the recovered amount
I am a retired Timber Pest Inspector in Sydney, Australia. Reasonably good information. Some of these areas would have been inaccessible at the time of Inspection. There are various methods in treating this property. A Full Termite Barrier treatment would be difficult owing to the methods of construction. Exterra, Sentricon or Arsenic (if applied by fully licensed/expert.
Heros take many forms. These men are heros in their profession and live by the principles of honesty and old fashioned work ethic. There are also heros who are exterminators. Unfortunately, the ones who inspected this house are not of that ilk.
Stay off of Termite Tom’s radar by inspecting and treating properly and videos like this won’t be so scary.
Hell, Terminix and Orkin stay on his radar. They are the worst by not doing the work properly
I watched this video for the first time and found it down right comical. As a Termite inspector it's a visual non invasive inspection. We are not allowed to dismantle, damage or disassemble anything as he suggested. Agreed the termite inspection was substandard and the inspector missed highly visible areas of infestation. Also in most cases if the termite inspector misses something the the home inspector usually catches it if it's visible. As far as treatment techniques all the ones he mentioned are on the label for most chemicals but most of the chemicals like Termidor also have perimeter treatments on the labels as well. TERMIDOR HE for instance 2inch deep 4inch wide trench. I feel bad for the home buyers for sure but there's one rule when buying a home most people seem to not care about and that is old house old problems. In Arizona we call it lipstick on a pig. If the company put a termite baiting system in place then what would he say? Termite baiting systems claim that they are colony eliminators so answer that question for me. The only thing this lawyer discovered was that the termite inspection was substandard and nothing more.
My main thought through this, is that the epa regulates how much termiticide technicians are able to use in certain areas or one location. Thoughts?

yes they do. only allowed to use termidor SC once every 9 months. epa is strict on chemicals and for good reason. havent been many new ones made in the past few years due to how expensive it is.
I HAVE A QUESTION IF YOU MIGHT CAN HELP PLEASE . WERE IN THE MIDDLE OF REPLACEING OUR SHOWER. WELL EVERYTHINGS BEEN TAKEN OUT BY THE CONTRACTORS . THE SUPPORT BEAM LOOKS JUST LIKE THOSE FIRST BEAMS AT THE BEGINING WHERE U SHOWED. AT THE BOTTOM. ALMOST IDENTICAL. THE TERMITES TUNNELS WERE BLACK. ALL THE WOOD. SO THE TERMITE PLACE COME OUT AND DRILLED HOLES , SPRAYED ALL THAT IN THE SHOWER AREA WHERE THOSE BEAMS WERE CLOSE. IS IT OK TO NOTTT REPLACE THE 3 BEAMS SIDE BY SIDE. WE THINK THE BEAMS SHOULD BE REPLACED. BUT THEY SAID AFTER ALL THAT TREATMENT THE BEAMS WOULD BE OK. IS OK TO LEAVE THE BEAMS. WEVE CLEANED THEM UP GOOD WIPEING THEM OFF. nope.... a lot of what is being said here is not correct. drilling bricks for example. Also, some of the stuff he is claiming is not in accordance with the product label...WHICH IS THE LAW!

The treatment promised for this home was a comprehensive Termidor treatment. This video was shot a few days after the alleged treatment. Alabama regulators inspected and found all of the treating deficiencies mentioned in this video. Hence, comments that the treating techniques mentioned were not required are wrong. The termite company dos not challenge the state’s factual findings and complied with the state’s directive to provide the conventional post-construction treatment.
Ok , so the termite company issues a warranty that requires that the roofer did a good job, the stucco guys sealed the house, the a/c is not creating condensation, the siding doesn't touch the ground, and all the rooms are empty enough to do a good annual inspection.....and the crawlspace is foam insulated...........why would we offer damage repair warranties....no one else does????

That rule if not seeing drill holes might only apply to areas of the county that subterranean termites are common. So that's pretty misleading.

Termite inspections don’t require to open up all your walls to see if there’s any damage or infestation. Or are they required to do that during a inspection?

It's not completely true, it's a lawyers commercial hidden in a how to video, the termite company didn't cause the damage, and all latent damages aren't as easy to see as they make it seem. It borders on fraudulent information itself. By a lawyer, funny, ironic, stupid?
in indonesia, to protect those timber we brush them by used car lubricant. for best result, the next day brush by solar oil.. effective and cheap.

I’ve been in the Pest Control industry for over 14 years now and I have some issues with this video. Some of the things he says on here ARE true ( such as treatment methods)while some of the other things are just simply wrong or just plain ignorant . As with ANY contract ,termite contracts also have exclusions. At the end of the video where he mentioned if the soil barrier has been dug up or even if you haven’t paid your premium, and you have termite damage, you should call a lawyer. So a chemical barrier is applied around the exterior of the home. Then the customer ( or their dog)digs up that barrier and get termites. Who’s fault is that? I work for a pest control company and that is a very common exclusion on all contracts. The only thing I could think of is if the homeowner said something to the company and they did not go back out and spot treat( for a charge of course). Also, as with anything in life, if you don’t pay your bill you don’t get the service. That’s just plain and simple. How are you going to sue the company when they haven’t paid them their annual renewal fee to keep the bond in the first place? If you quit paying your homeowners insurance and then get hit by hurricane does the insurance still cover your house? Absolutely not! Also he says to call them if the company will not remove parts of your walls to find damage? We have a device called a Terma-trac now that uses sonar to detect activity inside walls without tearing them up. If I was a customer and someone knocked a hole in my wall just to “see” if there was damage ( or even activity) I would not be happy. Especially if they were wrong and nothing was there!! You can’t just do that kinda stuff!!

I've actually seen termite tubes hanging from a home's ceiling.
They are not required to go up there,, if they can't walk in it, most don't go. When I go up there it depends on how the. Attic situate and my safety

if the support beams are so important, then why are most of them in bare wood? why aren't covered by a layer of joint compound or concrete mix?

What good would either do? Moisture would get trapped in the wood, wood destroying fungus would cause dry rot & invite termites. Termites only need 1/32" wide crack to enter a structure.

How do you know if the house was pretreated during construction
By law, a company that sells a termite bond cannot make assumptions that prior treatments provide protection. As your questions demonstrate - who knows what was done and when? So this company had to provide a liquid treatment (the service it sold) that met the state minimum standards - here a comprehensive/conventional Termidor treatment. Regulators inspected the house and seized records, and concluded that a grossly deficient treatment was done and that even the perimeter treatment failed to have the requisite trenching and treatment. Even if this 1950's home was "pre-treated" with Chlordane, that treatment would be completely worn off by the late 2010's - even Chlordane does not last 60 years. THe point is that even if a company assumed a pretreatment was done, they knew there was no prevention in place from that treatment.

If you are inspecting for termites you need to put on a big suit and go under the house and you will come up filthy. If you came to inspect without planning to get filthy then you don't plan to inspect.

Question, termite damage in an attic is guaranteed to mean a leaky roof. Are the roofers being sued ? The previous homeowner may have known the roof was leaking and ignored it, is he being sued ? The builder most likely left wood debris under the house, is he being sued ? The previous homeowner may have had a new garage or carport slab poured, will the concrete company be sued ? What about the company that installed the shelving ?

Termites return to the ground when exposed to the air so they will not dehydrate and die. TERMITE TUNNELS ARE MADE BY LIVING TERMITES. THE DEAD ONES STOP MAKING MUD TUNNELS.

OK... I know you're an attorney... and this is all GREAT information, but, you forgot a HUGE bit of information.... there is NO NEED to drill the bricks or the concrete OR to dig a trench. There are Termite Colony Elimination techniques that doesn't require any of those holes you suggested was needed.
A Termite company, with the proper equipment and training can replace all of those dangerous holes (that weakens the structure of the home) and all of that liquid termaticide that is simply a BARRIER between the termite colonies and the home... that liquid, by the way, would be diluted when it's poured in the ground or injected into the foundation... it ALSO is weakened by the solar dimunition of the chemicals, or the further dilution caused by rain and the soil... that chemical is at it's strongest the very moment it was released from the Termite company's containers... OR, they can hire a termite control company that can offer TRUE termite colony elimination techniques that are safer around your home.
AND, there are some things the contractor can do when the building is built to slow down the progress of termites into the wood contents of the home.
Phillip Swindall wonder how any homes are still standing with all this weekening of the structures due to 1/2 inch holes and some 1/8 inch holes in vaneer of homes....sounds like a good pitch for bait stations. All except the fact that it takes months, sometimes over a year to control an infestation. Bait stations have their place, but they are far from the one stop shop of termite treatments youkf have people believe....
interestingly, using bait stations can require more chemicals INSIDE your home than using a liquid barrier. Ever seen that large boxes screwed into interior walls with big " do not touch pesticides inside" written all over them?
We disagree with everything Mr. Swindell says. This house was given a clear resale inspection report two WEEKS before this video was done. The termite tunnel on the front door ws discovered four HOURS after the company issued a clear pre-sale inspection report and claimed to do a conventional Termidor treatment which does require drilling the brick veneer and all concrete blocks behind the brick and the cold joints around the entire exterior perimeter inside the home and all cold joints under partition walls.
@@tomjones9767 Using a baiting system as the primary means of control requires zero soil termiticide application. It is incorrect that baiting systems require chemical applications inside the home. However, baiting systems are ineffective in all but rare situations. Consumers should be told that none of the "baiting" systems use a bait. None of the stations attract termites. Take the label for the Sentricon toxicant and Dow's (Sentricon's manufacturer) labels. Those labels expressly state the product does NOT attract termites. Termites explore randomly. and have to find the stations randomly.
@@TomFCamp lol, OMG ..you speaking on the old systems. I agree stations are just that, monitoring until they hit. Most can not afford liquid treatment and there always gonna be a spot you have an exclusion for. The main reason people get termites because of conductive conditions they refuse to correct and the termite guy not doing a proper inspection, to include the inside, attic and crawl space every 6 months or according to the label bait stations . Whomever inspected this home probably didn't even go on those area or the house

Tell me how are you planning to get the termidor in the soil down to the footers without doing the trenching and covering it so that it remains under the soil
....you may just convince the Termite industry that its stupid of us to warrant the work of all the previous trades involved in the construction process. ..........then where will you be? Ask a doctor or a lawyer for a warranty......Alabama should disallow damage repair warranties.....as control is not likely in a house that has a single leak...see Formosan termite habits.
You don't have to give them a repair warranty. Most of the big company do so they can charge people an outrageous bond
This is a very one sided video produced by lawyers. After watching this video I have more questions than answers. Not mentioning where you filmed this is a great disservice to your clients. The United States is a big place. The termite issues you get in New Orleans are different than the termite issues in Miami, which are different than the issues you get in Los Angeles. It’s very easy open walls and accuse the termite company of negligence after the fact. This is also a VERY subterranean termite centered video. In my area we predominantly have dry wood termites. Dry wood & damp wood termites were not even mentioned in this video. Formosan termites were mentioned which are EXTREMELY rare, practically non existent in California. No mention of correcting the faulty grades. Not a word on dry rot. I would not hire this company to represent me if I lived in California. Oh, when I show up in a polo shirt and nice shorts I have at shirt and a crawl suit I can change into. Not a problem. Also, the attic board thing he did is still dangerous. They showed a single story residence. I inspect 3 story homes with vaulted ceilings. One mis step in attic and I’m falling thirty feet. I’m not going to trust some board system some inspector in another area invented that may or may not work. Also, if I can see the house is riddled with termite damage it would be naive to assume the ceiling joists aren’t shot. I’m sure his process is not OSHA approved.

Subterranean termites rarely ever get to the attic much less damage anything unless there was a previous roof issue.my WIT report doesn't even include attics as the back page excludes all inaccessable areas that require anything moved or pulled losse to inspect

As an experienced termite inspector and licensed operator this video can be helpful in some areas but it is really full of misinformation, half truths, and misleading statements, remember this video is for the benefit of lawyers who are looking to sue so their perspectives will be idealistic not realistic in some instances. Also look into state laws rules and regulations before you make any judgements about termite treatments and or inspections because your potential law suits may be invalid according to law.
We don't have this issues.

@@Trd2020 Termidor HE was NOT used for the faked termite treatment. THey claimed to have used SC. However, even if HE was used the trenches were fake as independent state regulators who inspected the home confirmed.

This guy is a typical ambulance chasing lawyer trying to encourage people to sue so their law firm can make money from the pest control companies insurer. There is rarely a need to drill thru the exterior brick wall unless you need to access a bath trap or other plumbing areas that are not accessible from inside the structure. I've been in the pest & termite business for 32 years including 15 years with the biggest pest company in the world and have virtually never seen anyone drill thru exterior brick walls as he describes. If you apply the right amount of product such as termidor to the soil around the perimeter of the house, the termites will forage thru it and become contaminated. As for the separate slab in bath area, it should have technically been treated but if it were covered by flooring you wouldn't know it was there. The mud tube under cabinet on the wall was scraped away and evidently the inspector saw no activity. I don't see ANY live termites in this entire video so I am assuming the damage was caused years ago and the house has already been treated. The previous homeowner is required by law to disclose any termite activity to the buyer.
As for the crawl boards, they can be useful but it is still impossible to reach and inspect the perimeter edge of many attics because of the roof slope.
The slab around garage should have been drilled but as you can see it is a new pour and I don't know if it was there when the house was treated. Having said all this, it does seem as though the technician who did the treatment did not trench as he should have. There are many situations where trenching is impossible because of shrubbery and tree roots, so they those areas need to be treated with a rod. I could go on and on about wrong this jerk is. If you did everything he says should be done in the inspection and treatment process it would add hundreds of dollars to the inspection and treatment, thus meaning you would be out bid on most every job.
People like this dude is a prime example of why I DO NOT DO WDI REPORTS! You are asking for trouble because unfortunately our country has been mind conditioned by these unethical and scummy law firms to sue decent hard working people for easy money.

Lol, everybody looking to get paid, this is why we pest control companies in Alabama starting not to do any termite work and we having issues on finding insurance companies that will cover the termite portion. I think the problem is when the client call the company and they don't come by out... also the Realtor, I wrote what I saw on my WDIR and the Realtor wanted me to re word it. When I said no, they basically didn't use me anymore,🤣🤣. I am not getting sued for you or no one else!
In most brick houses the brick only goes to the visible ground so trenching the outside perimeter of the structure would get the termidor down to the footers,so drilinv the brick would be useless and might even harm the appearance of the brick

Everything he said is accurate however also incomplete. This covesr liquid treatment of subterranean termites. Liquid treatment is not the only treatment method. Sentricon baiting works well and is not an exterior only treatment there are interior bait stations for active infestations. Also there are Dry wood termites wich would not be controled by either method. in addition permits for teh addition should be pulled if a legaly required preconstruction treatment was not done then very little will make an effective barrier. it could be remedied after but if it was never done you will get problems. If doing a liquid treatment Termidore is the best but not legal in all states, Premise is also good. Personaly I prefer sentricon. it kills the nest and is inspected annualy. you can not inspect a liqud barrier. Home shoulkd also be inspected annualy in any area prone to termites because no treatment is perfect in all conditions
The client was sold the Termidor treatment which mandates drilling, trenching, and filling. Evidence of such would have been visible immediately after the treatment & for a long time after. The state asserted the company didn't perform the service sold to the client. The state also seized the pest control company's records.

There is bad termite inspectors out there that are lazy and take short cut.
But just like good and bad lawyers out there some are lazy too and take short cuts- the easy way out.
You said in other comments that this video was shot 2 weeks after the inspection. So in 2 weeks the buyer completed their diligence inspections, completed all loan closing reqs, funded loan and completely gutted the interior? Sounds like a house flipper or homeowner was already planning on gutting the house and knew they were going to screw over the pest co to help fund the reno. Do they have you on a permanent retainer for the other properties they've committed this form of insurance fraud?Maybe a counter-suit is in order against you and homeowner for conspiracy to commit fraud. Love how you present your theories as facts. As an example - you will never notice drill holes in the brick mortar joints - most joints in your video already show the mortar has fallen out between the bricks. This Lawyer is terrible he has No idea what he is talking about. Everything he is saying about the treatment would depend on the type of product being used. Also I don't see any active termites here so the odds are if the other company used Termidor or a non repellent they got rid of the termites. So this Lawyer went and tore the house up for no reason. This is the kind of firm that would help you sue a place because you spilled your coffee on yourself.
This house was given a clear resale inspection report two WEEKS before this video was done. The termite tunnel on the front door ws discovered four HOURS after the company issued a clear pre-sale inspection report and claimed to do a conventional Termidor treatment which does require drilling the brick veneer and all concrete blocks behind the brick and the cold joints around the entire exterior perimeter inside the home and all cold joints under partition walls.
Would you want to buy a house that had been given a clear report? And then this happens? Sure, there are ways to miss some of this action of the termites, but some of the stuff is so obv that It would require me to throw up the red flags and get dirty taking care of this and a lot of paper work.

Termite bait stations do do leave drill holes in a garage. This home could have been treated previously using such a system and have been removed. A timbor pre construction treatment could also have been performed and it would not be visible.

However for Tom to raise the damage costs high enough for his company to make any money, they have literally gutted the house to replace structurally sound studs. Meanwhile the home owner is either living in a hotel, orrentimg a house, because of unnecessary repairs. This process takes months...not a few days, months of people coming in and out, of schedule changes in your life of living out of a suitcase.

If a expansion joint in the slab is further than a few feet ( which most will be) there simply is no rod long enough to ouch through 10-16 ft of soil to reach the targeted area.
If you have a problem with a company, call them first, tell them that you will pursue matters if you are not satisfied. Next call the department of agriculture, they have a division that handles complaints. Request the name and number of the company's insurance provider. They will in most cases take care if the issue, so as to keep a simple 5k dollar repair from ballooning into a 12-18 month long 50k dollar settlement that you will untimatelly not see much of. Once these avenues are exhausted, then call a lawyer it is well within your rights and that option is always open to you.

Oh and the drywall installers " SHOULD HAVE KNOWN" there product would hide termites and moisture problems, sue them too. Oh and as attorneys, you "SHOULD HAVE KNOWN" that you are providing information and marketing materials that represent you as experts in termite control but none of you have the required licenses so you are in violation of state laws.
The #1 reason pest companies get sued is from doing termite inspections on home sales. In my state , our regulators will tell you that you can do everything correctly in an inspection and a lawyer will still sue you and win. I quit doing termite letters for this very reason . Every termite man knows that when you do an inspection you are only going off what you can see at the time of your inspection. All of this evidence could have easily been not visible during inspection. If you really watch the video you can see they are reading a script the whole time so they don't actually know what they are talking about. This is garbage. You are misleading people. The treatment should follow the manufacturers standard for the chemicals used. All chemicals have different standards and regulations. A fipronil treatment has very different specs than a chemical with a repellent in it. Tell the WHOLE truth Tom.
