When did you receive your decision? There is a concession where you would still be under 5 year if you can show that your income was above £18600 before March 2020. You may need to write to the Home Office to challenge the 10 year route. The problem with applying for ILR after 5 years is they might refuse it on the basis that you are no longer under the 5 year route. So best to get a confirmation from the Home Office first before submitting your ILR.

You upload it with your documents under Other Category. As for the form, follow the instructions online. There is no such thing as FLR (m) anymore because everything is online. The computer will ask you questions and you need to answer according to your circumstances.

You can switch anytime, but just make sure that you do meet all the requirements. If you have just started earning £19k per year, you need to show that throughout the 12 months prior, your annual income is equivalent to £18600.

The solicitors may all be correct if you have adverse immigration history which will disqualify you from applying. Adverse immigration examples: criminal conviction, overstaying and other breach of immigration rules. If you have none of those, then you are free to switch to 5 year route anytime as long as you meet the Mandatory Requirements: English Test and income requirement of £18,600 but if you and your wife both require limited leave to remain, then the required amount increases to £22,600 per year before tax.

You need to make it clear in your cover letter what documents you are sending to show you meet the requirements because sometimes the caseworker might miss it as they are not used to receiving applications using savings. If you want to use your income jointly with wife, you both need to earn an income of £1,550 per month before tax to meet the income requirement of £18,600 gross pa.

There is no category to apply to regularise your stay in the UK unless you have other reasons such as having a child or partner (but even with this is difficult). There is a category for Private Life 20 years residence.

Switching only benefits if you were on 10 year route initially and then comply with requirements on second renewal. This will save you 2.5 years of time as well as money on fees. When did you get your first Limited Leave to Remain?
If you are already 5 years in your 10 year route, it wouldn't save you time and money by switching because you would need to be on the 5 year route for 5 years to be eligible to apply for ILR.
@@kingj8825 You can do the Life in the UK Test but wait on the English Test because it expires after 2 years. Only do the English Test when you are closer to applying for the ILR.

My wife has almost finished 5 years of the 10 year route and due to submit next application for the third 2.5 visa, can I submit an application with these two requirements and it would mean that she has completed the 5 years and can directly apply for Indefinite Leave to Remain? Did you apply inside the UK? Did you overstay? If you overstayed, that would be the reason you are placed on the 10 year route.

Yes, if the initial grant and renewal grant confirm the 5 year route. After 5 years, he/she can apply for ILR.

@@vietcongboi10 In this case, application for ILR will fail because when you renewed you did not meet the mandatory requirements so the HO placed you on the 10-year route. You will need to renew again until you are resident in the UK for 10 years and then apply for the 10-year long residence settlement.

You can switch anytime, but just make sure that you do meet all the requirements. If you have just started earning £19k per year, you need to show that throughout the 12 months prior, your annual income is equivalent to £18600.

The solicitors may all be correct if you have adverse immigration history which will disqualify you from applying. Adverse immigration examples: criminal conviction, overstaying and other breach of immigration rules. If you have none of those, then you are free to switch to 5 year route anytime as long as you meet the Mandatory Requirements: English Test and income requirement of £18,600 but if you and your wife both require limited leave to remain, then the required amount increases to £22,600 per year before tax.

No, it is not necessary to have an income, as there are several ways to meet the financial requirement, such as savings of £60k. You need to make it clear in your cover letter what documents you are sending to show you meet the requirements because sometimes the caseworker might miss it as they are not used to receiving applications using savings. If you want to use your income jointly with wife, you both need to earn an income of £1,550 per month before tax to meet the income requirement of £18,600 gross pa.

I was granted leave to remain in the UK in June 2019 on ten years partner route and my visa renewal is due in December 2021. My question is if i apply to switch ten years route to 5 years and my application gets approved, will homeoffice consider my stay in the UK since the day I lodged the application to switch ten year partner route to five years or they will consider my stay since June 2019?
The 5 year route will start from the date of the grant, so if you were granted on let's say Feb 2022, that will be the date the 5 years start.

There is no category to apply to regularise your stay in the UK unless you have other reasons such as having a child or partner (but even with this is difficult). There is a category for Private Life 20 years residence.

You should continue to apply under the parent route and then address the switching in your cover letter and ask to be placed under the 5 yr route.

Switching only benefits if you were on 10 year route initially and then comply with requirements on second renewal. This will save you 2.5 years of time as well as money on fees. When did you get your first Limited Leave to Remain?
