My Art was Stolen on Etsy

  • Hey everyone! Here's a breakdown of a 3D piece I originally made in 2D back in 2016. It's my rendition of a Disneyland attraction poster for "It's a Small World". Unfortunately, it's since been taken and sold without my permission a few years ago. I've moved on from that, but I thought I'd share the story of what happened. To make this scene, I used Blender 3D with Grease Pencil to create something 2D/3D.

    I think that a title that evokes more that this video is a story more then just your art project could attract more people. Thank you for sharing your journey.

    ugh how frustrating. this is DEFINITELY an issue that is happening to other artists. breaks my heart especially knowing how much you put into your art!

    Internet art theft is such a dumpster fire. It really sucks that companies like Etsy will start so real craftspeople can make and sell their art and then companies and 'snakes' come in and just sell garbage.

    I hate people who think they can steal something and call it their own. Essentially this is youtube shorts in a nutshell! But keep up your amazing work and I wish you good luck moving forward.

    this is why I try to establish my own OC and I see many others do too because many art thefts are making a profit off of hard working artists.

      Yeah I'd agree that it's extremely important to establish your own original OC or IP.

    I had this happen too and basically stopped posting my art on social media all together. My work has been centred on Polynesian Maori culture but with cartoon style so very niche. It's kind of ironic when I think about how our land was stolen and our peoplwiped out through sickness infected blankets and now my art is being stolen and sold on blankets 😅

      Sad to hear it. Fill the DMCA. Almost all sites have place where you can send it. While it can take time, but it is a small way for artists to fight back

    Hey wish u're doing well , Please respond , So i really liked your animation "Magic Book " toooo much !so i wanted to do the same one but medical theme for explainer videos about diseases , anotomy and stuff so is it normal to make the same scene ? But for sure i use my own illustration but is it normal to do the same textures and bright colors ? . + I think if u make cloth brand where you put u're designs not just a logo it gonna be soo cool .

    Contact a lawyer, they might be able to help. Etsy is FULL of stolen art, i recognise tons of art from deviantart. And nowadays it’s full of ai carbage too.

      Yeah it’s definitely the platform I see most of it happening. Maybe at the time, I could’ve been more proactive, but I honestly just didn’t care enough 😂. I think it’s because I never imagined selling something based of another company’s IP as a business. But I’m sure it happens to many artists out there that create original pieces which is concerning.

      ​​@@kevandramI think that's even more reason to at least get a cease and desist written up and emailed to Etsy. Those shops are financially profiting from your work. The park ride might not be your IP, but your fanart shouldn't be a cash vow for strangers treating it like public domain.

    AI upscalers have gotten very good, so simply uploading a low-res version will not offer much protection from unauthorized use of your work.

      Haha yeah 💯. I do think at the time though, 2017, upscaling methods weren’t optimized. But definitely now - lowering the resolution wouldn’t do very much.

      I noticed when upscaling too much it changes the style too much, so hopefully it protects it somewhat. I wish people wouldn't use AI for evil.

    Kevin I wonder if somebody create something on youtube. Does he have the Ip or has he to register to have the ip ?

      If you created a video and it’s being reuploaded to RUclips by another channel, not really since the platform has an established process for identifying copyrighted content. This generally happens as soon as the video is uploaded a second time by another channel. Then, the original channel can take action depending on how much (percentage of screen coverage) and for how long the taken footage is used. But, if it’s being uploaded to another platform, that’s where it can get tricky since they have their own process.
      I feel like it’s important to register an IP if it’s more intangible like an idea/prototype or something visual that represents a company or brand. It depends on the country but in America, we have IP laws like “first to use” which grants some protection if you’re the original IP owner.
      The problem I had was I wasn’t the original owner since it was fanart. So Etsy doesn’t hold any obligation to take action.

      Sorry, I hope I didn't discourage you. I think with any platform, there are pros and cons. And with Etsy, there seems to be growing cons. But, if you can see it working for you right now in terms of helping you open a store, I think it's worth trying for a little bit. Then, you can decide to move platforms later.

    Etsy is being… not so good lately. It always was, the last half of the year especially. And they make you confused. While you don’t own IP, but you own the art (confusing part of fanart). You need to fill DMCA and etsy need to comply. Just make accent it is you who draw the art
