    It is accused that a woman was severely beaten to the point of requiring hospitalization by a man while he was defying an existing court order. Defense says victim is making it up and there is a letter from the man's best friend saying that he is a totally cool dude so he should have a personal recognizance ($0) bond.
    It's a real conundrum! 🙄

      Those outside the home often know nothing about what goes on behind closed doors, and victims are too frequently their own worst enemies in these cases either because of what they are afraid of losing or because they fear retaliation from their abusers.

    It amazes me when attorneys talk about their clients bond agreement/arrangement. They’ll point out the things they’re not permitted to do, that they haven’t done….as though that’s an admirable and praiseworthy thing to adhere to conditions of your bond. “He’s had no contact with her” (the victim) Well he’s not _allowed_ contact with her.

      @Mouse_Lyne 22 дня назад +4

      Totally agree, I love the adversarial system. That said, I think he was doing too much… the attorney basically spelled out his entire case on an emergency bond hearing when apparently he doesn’t even have all of the discovery, and it exposed to the judge a weakness in his client’s story. He could have made his point by simply stating that the case is largely based on shaky testimony and he has no criminal record, instead he started spouting bullshit and insulted the court. Sometimes the best defense is an understated one!

    • @CindyLouWho77
      @CindyLouWho77 22 дня назад +3

      I was a criminal defense attorney for years before I decided to change my career; there is zealous representation of the client, then there is over-zealous representation on crack. This particular defense attorney is the latter, to the detriment of his client.
      The attorney, by way of his hubris, is a blustering buffoon. Because he has convinced himself that attacking the victim, questioning why isn’t she at the hearing (victims don’t attend bond revocation hearings, as Judge Simpson is well aware of); repeating the victim may have stated “He’s never done anything like this before!” (it stands to reason there’s always a first time); his client was driving, he wasn’t driving; his client claims he was intoxicated so unable to drive, his client was driving but there isn’t proof he was intoxicated; his client didn’t leave his apartment, his client followed the victim home, at her behest, to retrieve his car keys (which he’d have if he was driving his car); the victim was in a collision because she was intoxicated and that’s how she received her injuries, etc.
      The attorney was so myopic about disparaging the victim, he made up conflicting scenarios he wasn’t able to keep straight in his mind. In his savage attempt to discredit the victim by any means possible, he forgot his singular responsibility of defending his client.

    Judge Simpson has more self control and patience than most other judges. Attorneys know not to disparage the court. He could be charged for contempt. Sounds like the client lacks any kind of judgement, self-control, and integrity. Revoked for under the influence, intoxicated, violent behavior, and blamestorming to deflect punishment. Piece of work!

    It's less about the lawyer's actions... but more about the co-counsel or more likely the paralegal's behavior that triggered the judge. That woman is just taking up space on the defense counsel's desk to do work on other cases and managing that lawyer's time... actually pushing active public defenders out. Even her body language and mannerisms are entirely disrespectful of the court. In the subsequent hearing, she triggered the judge by constantly passing notes to the lawyer at the podium. I suspect she used to be a court clerk and has not adjusted her behavior to be in line with counsel-- she acts like she 'owns the room'. I see a direct court sanction directed her way in the near future. She gets close in the subsequent hearing on this case.

    This attorney's arguments & voice are so boring. Overly long winded, drones on & on. He blames the victim. But the victim was taken to the hospital & rather significant exams were undertaken because of her obvious injuries. The attorney has called his client law abiding but the defendant already had a license that was restricted & he was driving outside of allowed times, doesn't sound law abiding to me. I have never seen Judge Simpson so angry at a defense attorney that he had to stop the court proceedings. If I were the defendant I would be out looking for another attorney.

    Yeah, might not be a good idea to impugn the integrity of the court or insult the court while defending a motion against your client that could land him in jail. Not the best course of action particularly with Judge Simpson. He is one of the fairest and most compassionate judges I’ve watched and I’ve watched many. He works overtime to help folks out of money problems or housing issues and for this Cretan to come to his court suggesting he plays favorites with the prosecution is extremely insulting. I understand he’s trying to do the best job possible for his client but this was unhelpful to that end.

  • @paulgoodrich1592

    As usual Judge Simpson although furious was still fair to the defendant. Prosecutor didn’t get her ridiculous $150k and he didn’t walk out scot free, $35k is a fair number for his charges and victim’s injuries. He should be able to do a property bond or something like that and be out shortly anyway
