    I am 4 plus years sober and got very lucky to have only spent a little amount of time behind bars. Driving around like this used to unfortunately be an every day part of my life. I am very blessed to lead a better life but sometimes I am just so glad to be off paper.

      As a alcoholic who managed to avoid any accidents or arrests it is easy to blame people like us. I wonder if that much jail is going to help or hurt. BTW - four years sober.

      @Bobk857 I'm glad you managed to get sober BUT ... as a retired paramedic that has had to deal with the carnage of drunk drivers, I. Don't. Care. What that amount of jail time does to him. Whether it hurts or helps.
      There's a difference between alcoholics who do nothing but hurt or drink themselves to death vs one that gets behind the wheel and inflicts their disease on others.... I have empathy for the former and nothing but disqust and loathing for the latter due to the traumas of what I and others had to deal with.

      I think she ends up with a lot of clients nobody else will take. So on the one hand I only tend to see her in cases where she’s got basically no shot, but on the other hand if she can only get that type of client (and she’s not appointed counsel) it may be because she’s not the best atty around.

    Drinking after an accident is a tried and tested way to try to pretend that any alcohol on your breath was from the drink you had to 'steady your nerves' afterwards.

    My little brother was killed 2 weeks before graduation by a drunk driver. I don’t like watching ALL these videos of drunk drivers getting away with it, sometimes the DUI’s are even dropped!

    I remember this case from a few months back -that attorney asking for probation was insane back then. I still am floored she asked for it.

    He has a history of DUI and he hasn't stopped yet!
    Failed probation again and again.
    He wouldn't be in trouble if he stopped drinking.

    This is a no brainer and he should feel lucky he got 5 years. The Judge didn't care if he was tested or not because it wasn't going to change his mind and didn't want to add anymore.

      It was really silly though when the judge said he couldn’t smell anything, as if he is going to smell alcohol on a person’s breath while being that far away from them. 😂

      Why is the judge so clueless though? It’s obvious to anyone that the point of the guy immediately going to a bar to drink two huge 32 ounce beers right after he crashed his vehicle was to try to get out of a DUI, because he thought then the state wouldn’t be able to prove that he was drunk when he was driving. Many others have gotten out of DUIs by using that exact tactic (noticeably drinking immediately after they crashed their vehicle).
      The only reason that it didn’t work is that the state was able to prove that the amount of alcohol in his system didn’t match having two 32 ounce beers. His BAC was obviously way too high, and the state was determined to prove it/hold him accountable since it was his 3rd time.

    A drunk I was acquainted with finally got help and ended his drinking because he was told he smelled not only of stale booze, but cigarette smoke, B.O., and skidmark. And he didn't know it. Embarrassment has its purposes.

    Stevens had decided on jail by the time it came to have him tested and he realized that all it would do is delay the sentencing if he was over the limit. Saved him a contempt charge and saved the court time and money. More than reasonable if he wasn’t showing signs of impairment.

    I reckon the reason he took off from the scene and bought 2 large beers is because he _knew_ he was going to get caught. He _knew_ his BAL would be tested then he would argue that and say ‘No, no! I wasn’t drinking! _After_ the accident I got beers to calm myself down. You can check with the store and I have receipts.’ 😂

    There Shouldn’t even be a conversation, much less a F’ing Debate as to what he should be sentenced to, which Should be a Minimum of 20 years, with All those DUI’s, & Wreck. He’s No doubt, on course to Unalived someone, with averages Aren’t that He will be the one taking a Last ride in a body bag. How does that lawyer even Stand by him, lie her head off For him, while he Wreaks of alcohol IN COURT?!? I Despise Drunks, & have No Empathy, Or Sympathy. They do Nothing but Destroy Others’ Lives, Before Finally Wrecking their own.     Texas requires Interlock as a bond condition, most other states let them drive for years until the court date comes up. PS If you think MADD is doing anything about it, think again. They have no clue.

    Judge Steven's, way back when I was young, a guy got into an accident in the road in front of our house. Someone in our house told him to drink a few beers before the police got there. So they would not be able to tell if he was drinking before the accident. So there is that.

      He wanted to be able to argue that he didn’t get drunk until after the crash. Here in England, if someone leaves an accident and makes it home, they cannot be charged with DUI even when the cops know he was drunk. The solicitor (Lawyer) will just immediately argue that the drinking took place after the crash. Their is no way to prove that it was before.

    I can have sympathy for addicts, I am one myself 5 years sober. That being said, I lose sympathy after a person demonstrates that they care less than I do. 1 drunk driving offence is 1 too many but should be the rock bottom and often it’s nowhere near the bottom for most. When your addiction starts seriously impacting everyone around you, outside of the people you know, that is beyond selfish. Your addiction does not justify you bleeding from your wound all over everyone else. Probation often requires treatment, offers free inpatient if needed, mental health resources, a whole village of people that are trying to keep YOU accountable, but if you’re not interested in being accountable for yourself, why should they be? Recovery is hard, if it was easy we wouldn’t have addicts, but being this deeply involved in the legal system should be a wake up call. You have all of these people here trying to clean up after you and you’re not even holding a broom.

    I really like Judge Stevens. He is a wise man and a great judge.
    I watched a case the other day where he laid down the law while sounding like the "disappointed dad" and what he said should be played for young teens. I wish I could remember the name of the video.

    There is no reason to shave, sober up, or put on a suit when facing six years in prison. It is much more important to be fully relaxed. Judges and prosecutors would never be influenced by such petty issues.
    In case it was not clear, that was sarcasm. I am a retired cop and a retired attorney. Judges and prosecutors are human and can be influenced by such issues even though they know better. I have spoken with judges about this. There are a lot of things a defendant cannot control in criminal court. Grooming, attire, and sobriety are under a defendant’s control. Showing up for court hearings is another issue a defendant can control. A defendant can enroll in a drug or alcohol treatment program before appearing in court. A defendant can be polite and speak formally in court. All of these can go a long way toward convincing a judge and prosecutor that a defendant is taking things seriously and is making real efforts to change.

    That defense attorney fumbled hard. She’s got to work on that. I think 6 years is a bit much but I do believe prison is justified. 2-3 years. The guy is just going to get out and drink again. $106,000 per year per inmate to house them. Make them go to intensive rehab and make them pay for it instead of the taxpayers.

    He was violated on probation for the weapons charge bc of being arrested for assault and given 4 years in prison. The assault charge was subsequently dropped but bc he had already been violated, he had to serve the time. I know quite a few ppl who were on probation or parole that were violated and sent back/sent to prison, only to have the charge(s) dropped shortly after. Idc whose side you are on here but ppl need to understand that.

      I dont agree with a ban but a 12 oz beer with 13% is a bit much.

      🙄 So you didn’t pay attention in school apparently, because if you had, then you would know that we’ve already been there and done that with Prohibition, and you would know why it didn’t work out, and why it was repealed.
      I am pretty sure that Absinthe is still illegal because it has too much alcohol in it, isn’t it?

      I thought he looks clean cut and presentable for court. He looks like he’s a handsome guy and could make a nice living and have a nice life… if it wasn’t for his addiction. I was married to an alcoholic for 8-1/2 years. Same as this guy, he couldn’t stop, started young, wrecked vehicles, and was violent. He never changed.

    In the 80s my father was followed home by the cops (he had been drinking 😮) he got out of the car walked in the house grabbed a 5th of whiskey and started downing it in front of the officer 😂 they were speechless 😂
