    Mom (Jenni) was found alive and initially charged with ignoring a subpoena to appear. When she did finally appear, this douche was in court and she testified that nothing really happened and denied even what she said on 911 call or to trooper. Just as Ms. Davis was going to play the 911 call, his defense attorney pulled her off into a breakout room and when they came back, the compromise was 2x DV and 93 days. Judge was so not on board with this, but went with it and dropped charges on Jenni. Let's hope she got the heck away from this guy.

    Those poor children. What a showcase for the total professionalism of the attorneys and judge. The look on Keith's face when he came back from the breakout room says it all. We need to follow-up on this. Where is mom?

      @@streetracer2321The two of them colluded together. Law enforcement did their due diligence; he knew where she was, but declined to mention that. He lied about seeing the kids, and the kids’ living situation- he was supposed to have zero contact with them, yet they had been residing with him. He was out on bond, with the original charges involving choking, pistol-whipping, and threatening her with a gun. And there was a 911 hang up call from her. Statistically, the likelihood that he murdered him was extremely high…and the two of them sure did absolutely everything possible to make it look like he snapped and killed her.

    I just watched the pre-trial hearing on this case. The defendant and Jenni who was presumed to be missing were talking on the jail phone and she asked if she should stay in hiding. She continues to not cooperate with the court and is facing charges of contempt.

      My gut was telling me the same. Sometimes women go back to their abusive partners. And they won’t be honest with the courts b/c he would be in violation. Women like this need to stick with a decision. He’s either abusive & u want him out of ur life & need the courts to help or u don’t. I have no respect for her lying & pretending she’s missing. She should be in trouble with the courts as well. She’s an adult & should be treated as such. Is it up to the court system to decide for u while u go back & forth a bunch of times? I keep thinking of the $ wasted. All that time & effort on the Courts behalf.

      I appreciate no jokes through this. A break from the usual but so appropriate. It seems pretty likely she is dead. A warrant is needed to search the house and property for more guns, and dead body.

    I watched this on Judge Middleton's court channel yesterday and it's literally like a episode of Law and Order. It shocks me that this is coming from Judge Middletons court. I am scared for this missing woman and I am praying she is found. My heart breaks for the kids.

      He's been accused of spousal abuse, but at the point we see him in the video, they didn't even have sufficient evidence to actually claim that he'd done anything wrong with respect to her disappearance. The lawyer told him that he was a suspect in a murder and to keep his mouth shut. He did so while being all but accused of a crime he did not commit. Of course he was upset. She's fine, in case it matters.

      He was most definitely a suspect in a crime he didn’t commit and damn well should have been. It’s one of the very probable outcomes in this circumstance. Thankfully he did not commit murder but I wouldn’t be surprised if he committed other crimes to disrupt the proceedings against him. Meanwhile he admitted to a bond violation which is more than sufficient grounds to hold him. It’s the system operating as it should.

    You can tell Keith did NOT want to be there but being a good attorney he had to advocate for his client. If he hadn't advocated properly he could probably gotten in major trouble with the bar association. He was probably thinking the same things that Deborah and the judge were thinking but he has a requirement to advocate properly for his client. I feel for Keith having to be in that situation.

      Keith and other public defenders have such a thankless job. People shit on them for defending bad people. Defendants often shit on them for reasons of their own. But heaven forbid if you get into a fix and can’t afford an attorney and need one, they can be your best ally in court

The one that comes to mind recently was the PD in the Parkland, Florida trial that gave the finger in court in front of the victims family & would laugh with the accused, all on camera. But I agree, Keith is amazing!

    This made my stomach drop, watching the demeanor of the man on trial gave me a terrible feeling. There is too much going on for this to end well. I pray that I am wrong, especially for the children involved. I really have a bad feeling though. Ughh

      @@63076topher What do republicans have to do with this? It's not republicans fault that his wife refused to press charges the first time. Once he WAS charged with a crime, he was ordered to get rid of his weapons as part of his bond agreement. He didn't. That he broke a condition of his bond is also thru no fault of those that support the 2nd amendment.

      In another comment I pointed to the car in the driveway as a clear piece of evidence in his favor. How stupid would you have to be in order to murder someone and sit on their car? He also clearly said, in one of the few things we heard him say during this short hearing, that that isn't the car she drives. So, what kind of arrogance? The kind that had nothing to do with her disappearance. That was 100% her own decision to flake out. She is alive and well.

    She was found alive and safe, staying with a friend in Virginia.
    I gotta say, he's clearly smarter than the average idiot. He knew he didn't kill her and he likely hadn't heard from Acres either. But he stayed quiet and let his lawyer do the talking. He took it on the chin and let it play out.
    On all fronts this was handled the way it should have been.

    I watched this yesterday - I have a very bad feeling about the situation, as I'm sure most of us do. Mr. Schwartz's body language is suspect, as well. Not to mention he's lied multiple times already, including straight to Judge Middleton's face.

      Reading meaning into someone's body language is pretty perilous. We're not good at telling when people are being dishonest, and nobody, including trained interrogators, can convincingly show that they're able to tell when someone is lying or what someone is thinking based on body language. I 100% agree that it looks really bad for this guy, and if you asked me to put money on it, I'm not looking for him to get out of jail any time soon. That said, I have no idea how I would be acting if I were in a situation like his on either side of guilt.

      @@jasonpatterson8091 I disagree, some body language can be very telling, maybe not 100% accurate on every person but the telltale signs of lying are pretty consistent, it shouldn’t be thrown out all together.

    I see a lot of speculation in the chat of whether or not you could stand up and defend Mr Swartz. But I truly believe that If someone is not capable of defending the indefensible when someone is innocent until proven guilty, they should not be a defense attorney.

    This is horrifying. Please follow this if possible. Thank you Mike. So, as for the daughters gun? Who in the heck let’s a young child own a gun not safely contained in the gun safe? Also, no mother leaves her children with her abuser, leaves her car, leaves her phone, to go anywhere. She may be at her dad’s, yah, and Judge Middleton wasn’t born yesterday. Mr. Stickler’s facial expressions pre and after breakout room says it all.

      I think it was an adult child but not completely sure on this. I hope this mom defies the odds and is still alive and safe somewhere, but it certainly does not look good at the moment.

    All of the lying from the defendant does not bode well for the outcome. Plus the car, the phone, and no contact with kids and family from the victim makes it highly probable that foul play has occurred. I see the bad moon a'rizin'.. I see trouble on the way.

    One way or another this can only end badly. If the mother has met with foul play the kids lose both their parents. If she hasn’t her fitness as a mother comes into question for allowing them to be in the care of a man who she claimed both attempted to strangle her and threatened her with a gun.
    Thank you Mike. It’s important to be reminded that Judge Middleton and Ms. Davis don’t just get idiots and drunks. Their jobs really can be deadly serious.

    My cousin married into the Schwartz family and all my family grew up and live in Marcellus mi and surrounding area. I visit my mom and family for every holiday as it’s 90 miles away from me.
    Update: my cousin said the family is very big and this is no one she’s met in her 30 years of marriage.

    I actually managed to view this one live and stayed up until 4am Melbourne time. I had seen this bloke and Middleton not long ago where he obviously lied and Middleton gave him a break, so I was invested.
