- Johns Hopkins All Children’s Hospital was found liable for the death of Beata Kowalski, the mother of Maya Kowalski, who was the subject of Netflix’s “Take Cara of Maya” documentary. Beata took her own life after the hospital and its staff filed a report that she was abusing Maya - which ended up forbidding her to see her young child. The Kowalski family was awarded $261 million in damages. Attorneys for the hospital have since filed several appeals demanding a new trial claiming there was alleged misconduct among jurors.

This is unbelievable! These defense attorneys are just nasty!
It's tempting to see it in that light - however the defense made some solid points on how the plaintiffs presented arguments/evidence that yes got a verdict from a jury but doesn't actually add up to common florida law. On one side its easy to think why on earth cant the Defense accept the L? But the other side if the law is not stacking up why would you accept the claims against your client? I think the defense objected very selectively during trial to almost let the plaintiff's muddle their arguments to prove this exact point.
It’s their fault she was under DCF care to begin with. They never tried to help her AT ALL!
I admire this families strength with all they have had to endure. I wish them nothing but happiness for the rest of their days.

What I find telling is how much emphasis the plantiffs have placed on Maya's ability to get good grades in high school! Sydney Powell got good grades in high school too before she flunked out of college despite being intelligent. Much to do about nothing.

I feel like the judge almost must interview the juror, because if he doesn't, it would not look good on appeal. Just my oppionion.
Talk about “opening a door”. I cannot imagine the extreme blowback if the juror is questioned over this. I honestly think jury selections will become a lot harder. There is a good chance that any potential juror will not want to be selected if their personal information and background info becomes fair game. Nobody will go for that.
@kimberlyphillips1138 If there is suspected juror misconduct, it has to be investigated he has to be questioned. What are they supposed to just ignore it? The judge needs to do what he has to do so that everyone is satisfied that there wasn't any. If not, what about people on trial in the future? They have a right to believe they are receiving a fair trial.

The Los Angeles County Medical Examiner's office on Friday revealed that the late "Friends" actor's death in October was an accident, with the cause being "the acute effects of ketamine." Contributing factors were drowning, coronary artery disease and the effects of buprenorphine.
The coroner also found the ketamine in his system was caused by recreational use of the drug and not from the infusion therapy he was undergoing a week prior for depression and anxiety. So actually the transfusions were fine.
@@eloisecromwell4201 you are mistaken taken, he was infused 4 days prior then used a prescription written by the same doctor for the nasal spray ketamine. Not recreational K. He was being treated for former addiction and depression.
They also didn't state he was on ketamine for his depression and it wasn't for recreational use.

@@kittikat2318 The juror and his wife did not MAKE videos on YT. The wife made comments on other people's streams, which as a member of the public (just like all of us) she is allowed to do. The juror only made comments on other people's streams AFTER the verdict, which was after he was released from service and specifically told that he was free to talk to (or not) anyone he wished. That is not proof of anything improper.

I’d like to know how being a victim of the threat of a crime without the threat being carried out is the same as being victim of a crime.
They checked backgrounds prior in California. My son just had jury duty. Some states don't ask criminal background prior bc they run one after selecting them or at least where my son lives.

Usually to be in jury pool rhey limit it to non felony convictions only which is quite sufficient considering people who have had very minor misdemeanors or things that happened in early adulthood (especially for elder jurors). Juries should represent the community these cases are heard in. Surely nearly everyone knows someone who has had some sort of crime in their lives (speeding tickets are a crime too).

Agreed. I’m pro Maya and I think the verdict would have been the same if they swapped out juror 1 for the alternate. But jury duty is solemn duty and his and his wife’s behaviour looks bad and was irresponsible. It’s opened the door for JHACH to carry on like this. The fact that he and his wife now turn up in all the chats indicates that they don’t get what they’ve done. They come across as wanting attention.

wow its almost like going through a trial is a stressful process which would impact your willingness and ability to doll yourself up to the nines - also, winning probably helped reduce that stress? This is a toddler take, you clearly have no life experience whatsoever if you think it's unusual that someone would look better after receiving positive news or look worse during a stressful period of time. The defense also tried this BS by publishing the photos from her prom, like have you ever lived around other human beings or do you draw all your conclusions from what you see at face value? People look different on different days, my employees would be shocked if they saw how ratty I am on the weekends.

He hasn’t yet. I believe it’ll be about 2 weeks before it’s announced. I know that IF the court (judge… not attys) questions Juror #1, it’ll be on Jan 3rd but the decision on whether he'll even be questioned or not won’t be until right before then. HTH. 🙂

I have lost all respect for Judge Carroll. He is now letting the defense use him as a puppet and talking head for what they have done, and have done done with all JHACH records!!
He should have recused himself when he worked with Ms Cruells and the fact that Mr. Altenburn for the defendant, presided over a family court matter for this judge when the judge was a minor teenager. It’s a total conflict of interest. It’s clear that the judge is biased toward the hospital.

Juror 1's wife is a loudmouth that was running around trying to be important. I watched her do it. That said, I have no knowledge of communication between the two. But she's caused him problems and put shame on his name via the appearance of impropriety and by association hers, by trying to be a big shot.

Appearance of impropriety is subjective. She’s a free citizen and was free to do as she wished. She was not bound by the rules of the jury since she wasn’t a juror.

A postmortem examination concluded Perry died from the “acute effects of ketamine” while contributing factors included “drowning, coronary artery disease and the effects of buprenorphine” - also His last known treatment was more than one week prior to death, but the medical examiner determined "the ketamine in his system at death could not be from that infusion therapy, since ketamine’s half-life is 3 to 4 hours, or less."

In pretty much every civil trial, once the trial has concluded, the person who lost attempts to appeal. Why wouldn't you? Are you saying that if there was a $261 million verdict against you, that you would smile and accept it? I would remind you that everyone has the right to appeal. Judges make mistakes during the trial. Sometimes, juries award way too much money or there were errors made during trial. These are sorted out during appeal.

This will set a new precedent for jurors, not only , not to want to be a juror but it will also take away their power of determining awards. All lawyers now will contest awards they disagree with if nothing else just to tie the award up…… sad day in our justice system if Defense wins this for all, not just the Kowalski’s

Or get this, the weight of the case being ongoing and no closure in her mothers passing took a mental and physical toll on her...the verdict gave her closure and was alot of weight lifted, thus less stress, thus a better appearance.

@@kittikat2318 The defense was allowed to put on evidence about all of this and they did try to. There just isn't much. Even if there was MCA, that still doesn't excuse their treatment of Maya. There are laws about this and JHACH broke them.
