    What would happen if the President of the United States went to jail or prison? Can he or she actually? “America is great because she is good. If America ceases to be good, America will cease to be great,” wrote French political scientist Alexis de Tocqueville in his 1835 book, “Democracy in America”. The USA, he believed, offered equality that was not seen in other nations. The founding fathers of the U.S. had created a form of ruling that was not able to be tyrannical, that was chosen by the people and served the people, and if it failed to do so it would be removed. This America was a long way from absolute monarchies and from authoritarian government presided over by powerful dictators. It was supposed to embody what Thomas Jefferson wrote in the U.S Declaration of Independence, that, “all men are created equal.” With that in mind, welcome to this episode of the Infographics Show, Can a U.S. President Go to Jail?
    If all men are created equal, perhaps that means that all men should be treated as equals when it comes to matters of justice. That’s why there are laws, and no people in a democracy should be immune to punishment. We could argue that the scales of justice do seem to be tipped in favor of those that have more money, to avoid close scrutiny by law enforcement or to hire brilliant legal teams to perhaps undo wrongdoings. Notwithstanding the sometimes mindboggling chicanery a very wealthy person might employ to get them out of trouble, everyone in the USA should be answerable to the same laws. This must mean an American president can surely go to jail, or prison. Just so you know, jail and prison are sometimes interchangeable words, but in the USA, jail is usually the place you go to for a short stint before you have a court hearing or you’re just serving a very short sentence. Prison is the place you go to after you’ve been convicted of a crime.

    Indicted 3-4 times, has 70+ criminal convictions, broke bail conditions in one day. Judge fired a warning shot (means he avoided jail) and most likely never be sent to prison.

      Citizenship doesn't define whether you can be arrested that way. The only situation I can think of would be with regards to direct treason charges or not reporting taxes on income earned outside the US.

      Krissy keyword: think. It means I’m not sure entirely. I do think that a president needs to get impeached first if they do imprison him, but then again, I’m not totally sure. I’m just looking at it from my opinion and what I can make from this video too. And FYI Krissy, just because something is made for somebody doesn’t mean it will always work. The Republicans made the two term presidency to benefit them, but now even they have to follow that rule too, so your call

      The video never once mentioned Trump. The examples were of Bill Clinton, Spiro Agnew (not a president but has basically the same protection from removal as a president and same immunities of office), Jefferson, and other characters in history.

    What I don’t like is that there are some wealthy people or people in power that are able to get away with almost anything. Such as sexual assault, murder, drunk driving etc. It’s not fair. Just because they have the world of lawyers doesn’t mean that they are the boss. I hope the President is able to go to jail if they do anything wrong.

      @Optic500 "Can" and "Will" are two different things, yes any judge can deny bail but if they will deny they will not get $$ for their next campaign and if the family is rich enough they would dump their money to the judges opponent.

    Arguendo, after impeachment (charged by the H.O.R) the President would then be tried, and, if so, convicted by the Senate. If convicted the President would thence be removed from office. However, one can speculate that the Vice President, who would then become the President, would pardon the former President.
    We don't know since it never happened before. No President has ever been removed from office.
    We can look at what had happened with the former President of Peru (President Fujimori) as an example. I do believe that he was convicted but was later pardoned because of poor health.
    FYI, I am currently a second year law student and we have just discussed this matter in my Constitutional Law class a month ago.

      Most absolutely his successor will pardon him. The President's power to pardon anyone creates such a stupid loophole. If the current President does a crime and knows he's not gonna get away with it, he will just tell his Vice President: "hey, I will give my chair to you, in exchange can you pardon me?". They both get out for free.

      Ya Vang Perhaps not divine law, but the courts here and in places like Europe or Asia are not as simple as Divine Law. Divine law would in this case be the Ten Commandments found in scriptures of Judaism, Catholicism, and even Islam based on my research.

      If a president is impeached, s/he isn't really sitting any more, at least temporarily .
      The impeachment proceeding is conducted by the Senate, and if the Senate decides the president didn't do anything wrong the president can be returned to office. While the president is facing impeachment the vice president becomes the acting president, and the president temporarily has no political power until s/he is cleared by the Senate.
      If, on the other hand, the Senate finds the president guilty, the president may be removed from office and face a judge...

    This brings up some very good points. I wonder though, what the law says about EX-presidents. Like if Trump is not impeached in the next two years, because the Mueller Investigation continues until then, would he be subject to indictments/prosecution for his innumerable offences?
