Even a regular Citizen could get away with drawing their licensed firearm.. especially since the suspect was "Concealing his hand while approaching your vehicle". What people fail to realize or even think of is a Majority of Law abiding Civilians legally carry.

It baffles me that with all of those charges, he gets probation. I dont have a single thing on my record, and I know if I had those charges, I'd get at least 5-10 years. But, I guess money gets you places.

@CosmoJ You don't seem to understand how things work. Pulling a weapon to defend yourself against a possible aggressor is not threatening someone, you are literally defending yourself. You are not saying, "I'm going to hurt you." You are saying, "I'm going to defend myself if you attempt to hurt me." Those are extremely different statements. What likely happened here is that the off-duty officer also called 911 once this dude started following him. And once this dude fled from a traffic stop by continuing to chase the off-duty cop, he was the primary target. Everything was decided right at that moment. The off-duty officer did everything right, the idiot on drugs did everything wrong.
He's been arrested 4 times already, and now number five...and they dismiss most of his charges and set him free. Once again! And judges are not held accountable for any of this.
It may be because their friend pulled a weapon when he probably shouldn't have. Any normal person does that the cops would have been trying to slap as many charges as possible on that person... when their friend does it then it is "he was in fear for his life"... letting the dude go lets their friend not face any scrutiny.
You can’t be on meth and drunk, and then road rage, then be aggressive, then make demands then ask for a lawyer. This guy is seriously messed up. He put himself in this position, one. Second, he’s not accepting responsibility for his behavior which led to these actions. It doesn’t matter who called 911. It matters why.

It was just an overall sh*t-show and I regret soooo much that I cannot tell you. Please listen to my years of experience. Stop drinking. Best case scenario is that you're a functioning alcoholic who experiences some of the things listed above. Worst case scenario is that you KILL yourself or someone else while drinking and driving. I am so thankful that never happened to me.
@@kelts895 Try to imagine this. 3 teenage girls, about 15 yrs old. We called them the witch's coven. Always together and addicted to huffing gas fumes. If one got arrested, the other two would wait outside our police station until the curfew on their probation order went by so we would arrest them and put them in jail together. The guards in central remand would often complain about them because they were so seriously addicted and unpredictable. Life is hard in northern Canada.

This also applies to this video of how he got arrested so many times before and after this. @@kelts895 If I understand your question correctly, you are asking why offenders are arrested multiple times and don't seem to be held accountable to a significant degree. Once the police make an arrest and send the evidence to the prosecutor, the rest of the judicial process is out of their control. The prosecutor decides if there is enough evidence to take the case forward. If not, they will withdraw the charge. Next is politics. If the prosecutor is trying to keep the political boss happy so those people get voted back in, they might only prosecute those casses that they feel will make the public happy. This is why you saw so few prosecutions in Seattle for instance during the riots. If a case gets to court and the accused pleads guilty, there is often a deal made to drop other charges and minimize punishment. Again, this could be effected by the political mood of the day. Politicians want to "fix" the problem of having too many people of color overrepresented in jail. Finally, the judge decides guilt or innocence. They may have their own biases that play into their findings and punishments. in this way, offenders can end up going right back to their criminal activity, requiring the police to arrest them over and over as the rest of the system keeps letting them back out. The only reason why I know about this issue is because my brother used to work as a CO in a jail. They have to take transported inmates from another jail in the city because of the capaticy issue and this said jail lets go up to 100s a day.

In a road rage incident and YOU get out of the car and approach the other car then YOU are the aggressor, regardless of who started the incident! And the car you approach has every right to defend himself against YOU!
Depends which state you’re in or referring to, just because somebody approaches you doesn’t mean you can brandish/use a firearm in the majority of states, especially when you can easily remove yourself from the situation, or drive away.

its not as fun as it sounds. I went to jail about 25 years ago for possession with purpose of trafficking. I had to stay in north fraser on the medicated and immigrants unit. It was super max security, they have you go through about 6 checkpoints before going to your unit. When searching you they touch your entire body from your crotch to the bottom of your feet. No toilet seat, no pillows, basically everyone on your unit is at the worst point in their life, most are the worst of society or the most abused. I was there at the same time as willy pickton too. My stay was not bad but it could have been terrible and I was only there a month. This is canada too btw. Anyways it sucks having a 300 pound door shut behind you and if you make an enemy it can be a fight and then getting locked in solitary. However I agree with you they should tighten the system (especially against theives and rapists and murderers) I am not so much thinking drug users should be in jail as its a social and medical issue. i was never a theif (mostly) so ............anyway just typing as I am coming off frugs and trying to clean up my life

Irregardless, a person approaching your vehicle shouldn’t necessitate aiming a firearm at them unless you feel you’re legitimately in danger. Unholstering it - absolutely have it ready, but don’t aim it at an unarmed person otherwise you might very well contribute to a shootout - which could have happened here when he returned with his gun. It by far and large antagonizes a situation.

While I fully understand your point of view about repeat offender. I think it's appropriate for some charges, but not all to get a longer sentence. There is the human element, and there is the severity of the offences. Non violent offenders should not get hit with that. Especially if the are class (degree) 3 or lower.

@@CarsCatAliens I agree that low level crimes don't deserve years of prison time unless the offender continues to break the same laws. Where I live we have what's called habitual offender laws meaning if u commit certain crimes more than 3 times, misdemeanor charges can be enhanced to a felony. Like shoplifting I had a buddy who used to steal beer from gas stations and he was arrested 3 or 4 times for shoplifting, the last time he was caught he stole a 24 ounce tall boy beer. And since he had been convicted of the other shoplifting charges that one beer got enhanced to a felony and he was sentenced to 3 years in prison. Laws like that should be nationwide. Like I said I do agree with ur comment until the offender continues to break the laws.

the difference between you and the officer is you would have been charged for pointing your gun at the drunk guy. the off duty officer wasn't. there are rules they have to follow and it doesn't sound like this off duty officer did that. he simply got away with it. off duty or on duty, policer officers should not be above the law. my statements don't in any way excuse the drunk guy's behavior. the off duty officer should have pulled him over then he would have been 100% justified in his actions. he was more worried about getting to work on time than protecting the community from a road rage driver or drunk drivers. A case could be made that the off duty officer was negligent in his off duty responsibilities. the on duty officers on scene were very professional in how they handled themselves.

When I was about 17, I had a friend who would anger really quickly. One day we were hanging out and he was very silent which was strange. When I asked what’s up, he told me a story that I made sure to remember. He was driving and a guy blew by him and cut him off on a small no passing back road. He got so pissed (and he had some right to) he passed the guy and stopped his car and got out holding a pry bar and started walking at the car cursing and raging. It was at that moment the guy pulled a gun and got out and pointed it at him. He got in his car and left. You could tell it effected him. He wasn’t the cause of the initial incident, but his response and actions almost got him killed and they guy probably would have gotten away with it as self defense and nobody would have ever known. He was lucky in that this taught him a valuable lesson. I never saw him flip out bad again. Every time I’ve had an issue driving, I think of that story and how escalation or revenge with road rage is never an option
Valuable lesson learned. Unfortunately, most folks aren't as smart as u and ur friend and require many instances before they change..or die, whichever comes first
some people need that kind of a wake up call. If you decide to get out of your car and confront someone you have to accept the fact that you can get seriously hurt, killed, or go to jail for doing that. The people who react like your friend don't worry me, it's the ones who make a decision to accept the consequences win, lose or draw you need to be worried about.
Great story, your friend was a very lucky guy and learned his lesson well. We all have our moments of raging anger over-shadowing our normally calm and cool temper - especially while driving these days. Keeping a cool head is a smart basic survial practice.

This is so typical and sad that a person who racks up multiple charges has most dismissed and serves little jail time. It's almost as though there are no consequences for criminal behavior.
He paid 25k to a lawyer he said, and got 2 years porbation with CONDITIONS. He gets caught with a pipe again goes to jail for breaking it, he blows anything over .00 goes to jail. And I bet he has x months to finish a rehab stent and show courts the certificate of completion lol. But it was a 1 year probation he broke lol
The pipe or paraphernalia found in his pocket was illegally searched he was not under arrest at that time. Police can only pat you down while detained for weapons. Them finding the pipe gave them the hunch for possible drugs etc in the car. Resulting in them using the k9 believing there’s more and of course there was. However all based on the item found illegally on him.
The deal here is the guy was mostly right about the stuff at the beginning. He wasn't miranandized so most of what he said didn't matter, and he was frisked on reasonable suspicion, which is only for weapons, not meth pipes. He probably only got OWI and battery since everything else got supressed.

Those are extremely different statements.
What likely happened here is that the off-duty officer also called 911 once this dude started following him. And once this dude fled from a traffic stop by continuing to chase the off-duty cop, he was the primary target. Everything was decided right at that moment.

If one got arrested, the other two would wait outside our police station until the curfew on their probation order went by so we would arrest them and put them in jail together. The guards in central remand would often complain about them because they were so seriously addicted and unpredictable. Life is hard in northern Canada.

@@kelts895 If I understand your question correctly, you are asking why offenders are arrested multiple times and don't seem to be held accountable to a significant degree. Once the police make an arrest and send the evidence to the prosecutor, the rest of the judicial process is out of their control. The prosecutor decides if there is enough evidence to take the case forward. If not, they will withdraw the charge. Next is politics. If the prosecutor is trying to keep the political boss happy so those people get voted back in, they might only prosecute those casses that they feel will make the public happy. This is why you saw so few prosecutions in Seattle for instance during the riots. If a case gets to court and the accused pleads guilty, there is often a deal made to drop other charges and minimize punishment. Again, this could be effected by the political mood of the day. Politicians want to "fix" the problem of having too many people of color overrepresented in jail. Finally, the judge decides guilt or innocence. They may have their own biases that play into their findings and punishments.
in this way, offenders can end up going right back to their criminal activity, requiring the police to arrest them over and over as the rest of the system keeps letting them back out. I hope that answers your question.

The only reason why I know about this issue is because my brother used to work as a CO in a jail. They have to take transported inmates from another jail in the city because of the capaticy issue and this said jail lets go up to 100s a day.

its not as fun as it sounds. I went to jail about 25 years ago for possession with purpose of trafficking. I had to stay in north fraser on the medicated and immigrants unit. It was super max security, they have you go through about 6 checkpoints before going to your unit. When searching you they touch your entire body from your crotch to the bottom of your feet. No toilet seat, no pillows, basically everyone on your unit is at the worst point in their life, most are the worst of society or the most abused. I was there at the same time as willy pickton too. My stay was not bad but it could have been terrible and I was only there a month. This is canada too btw. Anyways it sucks having a 300 pound door shut behind you and if you make an enemy it can be a fight and then getting locked in solitary. However I agree with you they should tighten the system (especially against theives and rapists and murderers) I am not so much thinking drug users should be in jail as its a social and medical issue. i was never a theif (mostly) so ............anyway just typing as I am coming off frugs and trying to clean up my life

Irregardless, a person approaching your vehicle shouldn’t necessitate aiming a firearm at them unless you feel you’re legitimately in danger. Unholstering it - absolutely have it ready, but don’t aim it at an unarmed person otherwise you might very well contribute to a shootout - which could have happened here when he returned with his gun. It by far and large antagonizes a situation.

I think it's appropriate for some charges, but not all to get a longer sentence. There is the human element, and there is the severity of the offences. Non violent offenders should not get hit with that. Especially if the are class (degree) 3 or lower.

@@CarsCatAliens I agree that low level crimes don't deserve years of prison time unless the offender continues to break the same laws. Where I live we have what's called habitual offender laws meaning if u commit certain crimes more than 3 times, misdemeanor charges can be enhanced to a felony.
Like shoplifting I had a buddy who used to steal beer from gas stations and he was arrested 3 or 4 times for shoplifting, the last time he was caught he stole a 24 ounce tall boy beer. And since he had been convicted of the other shoplifting charges that one beer got enhanced to a felony and he was sentenced to 3 years in prison. Laws like that should be nationwide. Like I said I do agree with ur comment until the offender continues to break the laws.

the difference between you and the officer is you would have been charged for pointing your gun at the drunk guy. the off duty officer wasn't. there are rules they have to follow and it doesn't sound like this off duty officer did that. he simply got away with it. off duty or on duty, policer officers should not be above the law. my statements don't in any way excuse the drunk guy's behavior. the off duty officer should have pulled him over then he would have been 100% justified in his actions. he was more worried about getting to work on time than protecting the community from a road rage driver or drunk drivers. A case could be made that the off duty officer was negligent in his off duty responsibilities. the on duty officers on scene were very professional in how they handled themselves.

When I was about 17, I had a friend who would anger really quickly. One day we were hanging out and he was very silent which was strange. When I asked what’s up, he told me a story that I made sure to remember.
He was driving and a guy blew by him and cut him off on a small no passing back road. He got so pissed (and he had some right to) he passed the guy and stopped his car and got out holding a pry bar and started walking at the car cursing and raging. It was at that moment the guy pulled a gun and got out and pointed it at him. He got in his car and left. You could tell it effected him.
He wasn’t the cause of the initial incident, but his response and actions almost got him killed and they guy probably would have gotten away with it as self defense and nobody would have ever known.
He was lucky in that this taught him a valuable lesson. I never saw him flip out bad again. Every time I’ve had an issue driving, I think of that story and how escalation or revenge with road rage is never an option

Valuable lesson learned. Unfortunately, most folks aren't as smart as u and ur friend and require many instances before they change..or die, whichever comes first
some people need that kind of a wake up call. If you decide to get out of your car and confront someone you have to accept the fact that you can get seriously hurt, killed, or go to jail for doing that. The people who react like your friend don't worry me, it's the ones who make a decision to accept the consequences win, lose or draw you need to be worried about.
Great story, your friend was a very lucky guy and learned his lesson well. We all have our moments of raging anger over-shadowing our normally calm and cool temper - especially while driving these days. Keeping a cool head is a smart basic survial practice.

I'm seriously so grateful for the good cops out there. Their job is so hard and stressful. It takes more patience than I think I could ever have. Thank you to all of the officers who do this crazy job every day.
There are no good cops, they're the biggest & most dangerous gang in America! Even in this case he goes into work as if he is better then having to stay & give his side of the story, freaking ridiculous... We all have stressful jobs, there job has been proven to be not dangerous & most make 6 figure incomes..

1) don’t drink and drive
2) when drinking and driving don’t drive with road rage (although don’t do #1
3) don’t pursue road rage against off duty cops

This is so typical and sad that a person who racks up multiple charges has most dismissed and serves little jail time. It's almost as though there are no consequences for criminal behavior.
He paid 25k to a lawyer he said, and got 2 years porbation with CONDITIONS. He gets caught with a pipe again goes to jail for breaking it, he blows anything over .00 goes to jail. And I bet he has x months to finish a rehab stent and show courts the certificate of completion lol. SHit sounds easy but for an addict with a meth pipe, weed, and booze on him, its gonna be stupid hard to do lol
And they can toss him into prison for max sentence if they want once he violates it. My father had sweat heart deal like that for being SO had to do therapy out his own pocket, and a few other conditions that were stupid hard. He ran like hell from state, got arrested and sent back to the state, judge gave him max sentence for the previous crimes he had deal for pleading guilty on, and he tried to sue twice for it being too mean, as he had a plea deal he broke lol Both times the cases were thrown out at the start by judges lol He ended up doing 8 years and 2 years on parole. But it was a 1 year probation he broke lol

The pipe or paraphernalia found in his pocket was illegally searched he was not under arrest at that time. Police can only pat you down while detained for weapons. Them finding the pipe gave them the hunch for possible drugs etc in the car. Resulting in them using the k9 believing there’s more and of course there was. However all based on the item found illegally on him.
The deal here is the guy was mostly right about the stuff at the beginning. He wasn't miranandized so most of what he said didn't matter, and he was frisked on reasonable suspicion, which is only for weapons, not meth pipes. He probably only got OWI and battery since everything else got supressed.
