    I’ve followed my claim to the letter and they’re going to great lengths to prove I’m a fraud, even though I’m no longer able to resume the high level of fitness and acrobatic activities I once had. 3 years now and their still dragging my case. I now have permanent restrictions and being treated like a criminal. This all because I got injured doing the work of 3 employees during the pandemic. The system is so corrupt.

      It took seven years for Shriners Hospital/Zurich to settle my case. I had a WC attorney handling my case the whole time. I was followed by a Zurich person all around Shreveport, and on the first occasion, when I walked out of the store, he nearly ran me down in the parking lot, speeding away. Zurich cut off my benefits saying the statute of limitations had expired on my injury and my attorney filed a penalty on them. I wouldn't wish all of the harassment/bullying that I endured on my worst enemy.

      @@lynnwoodcarter3486 I was able to receive my workers comp wages which is the only way I survived. Shriners initiated my case due to repetitive motion nerve injury to my carpal and radial nerves. Otherwise I would be homeless myself. I pray that you get a favorable outcome for your case. Being honest doesn't seem to be valued by employers anymore

      Thanks guys. Forced to return to work with permanent restrictions and still busted up 2 years later. regardless if you’re working within your restrictions they’ll still attempt to label you a fraud simply because you can do (carefully)the work within your permanent restrictions…. Over 2 years ago( almost three years now ) I was performing acrobatic high-fitness level regimens, which I’ll never get back and my body reminds me daily of my limitations. This is a nightmare, but I refuse to believe all companies lack compassion, so I keep the faith.

    Some of these PI’s are so bad. I had one follow me to Lowe’s and he was peering through the aisles and was so obvious. I walked up to him and told him he needs to hit the books again.

    Hi, my son had a slip/fall work related injury pending surgery, after submitting his claim to the employers insurance, surgery was approved. While it was being scheduled they change and denied paying for the surgery, finally they terminated his employment. He has a work compensation lawyer, but the communication from the attorney side is not the best. If he switches attorney does he have to pay his prior attorney any fees? Sorry for the long question.

    • @workerscompnewyork
      @workerscompnewyork  11 месяцев назад +2

      Hi Nellie. I am terribly sorry to hear what is happening. It is possible in certain circumstances for the insurance company to change course and object to a claim that it otherwise had already accepted. It is difficult for me to give you more information without the specific facts of the case. Your son should have an open dialogue with his attorney. If he is unsatisfied with his representation he may switch attorneys at no additional cost to him. This is the rule here in New York State. The attorneys will either negotiate a fee split when the time comes, or the judge will determine how fees will be awarded.

      The problem is there are so many people filing fraudulent claims that insurance companies will automatically deny most claims, and the worker then has to get an attorney. It's a joke system. I've never heard of an insurance company paying an injury claim without a fight. Which should be illegal.

    I think that the best way for to avoid this problem is...... be honest. I understand that some people, truly deserve a workers comp lawsuit, but everyone of us most likely knows...... a piece of garbage that is/has committed fraud in workers comp. Eventually the insurance companies will wise up and offer cash, for everyday people...... who turn in the ones who are attempting fraud, and they get CONVICTED! Hopefully SSID, will adopt that idea. 🙏 We (our country) would save a fortune
