The cops were basically waiting for him to do something to use as an excuse to “protect and serve”. Just hostile for no reason. Nothing worse than bored cops.

This country's been on a bad path for the better part of a century, and it's only going to get worse.
My husband is an ex convict who has taken care of his family for the past 22 years without reoffending. He is constantly harassed by the cops in our county who have been so petty they've hemmed him up sometimes for over an hour for a tailight being out among other stupid things. If anyone thinks these animals are on your side or won't single you out think again.
Yea, there's no justice anymore. If a person serves their time for a crime, they should have a clean slate, not be harassed for the rest of their lives.

Extending a traffic stop after the original basis of the stop has been completed is an illegal seizure of your persons. Rodriguez V US is one of the many cases that have verified this.

The fact that an officer can slam you to the ground, taze you, restrain you by the neck and claim it's because you're "not listening" and this is not unconstitutional shows how truly broken the judicial system is when assessing the 4th amendment.
It shows you that police departments create illegal policies and police unions back them up.
Why are they allowed to turn off their body cameras? That's extremely suspicious and problematic.
Because when they interview witnesses and CI’s they don’t want that on camera. That’s the legit reason…then you have the bad cops that turn it off when they are about to break the law. Body cams should only be turned off in the situations I mentioned above and when they use the restroom. If they turn it off any other time, they should get fired.
I wonder if anyone has ever gotten a person who is great at lip reading to try to find out what these punks are trying to hide!
@@FloridaCatholicGuy I'd take it one step further for documentation purposes. The control of the cam should not be in the officers hands. They should be remotely operated, automatically turned on at the beginning of a shift, & only able to be turned off by requesting it through dispatch or some other channel. That way it is officially documented that the officer had his body cam turned off. Then there can't be no gray area as to when & why the body cam was turned off. Making it much easier to ascertain if the cam was turned off for a legitimate reason or not.

We need to investigate them for suspicious behavior. They need to be held in cells for our safety.
1. This is for a seat belt
2. The guy is not fleeing
3. There is no danger presented by the guy
4. Multiple officers have him pinned down already.

It wasn’t really for the seatbelt though. Police don’t pull someone out of the car over a seatbelt violation. The cop just didn’t like his attitude. He didn’t receive overwhelming amount of ass kissing and it hurt his ego.

This whole encounter is infuriating, but IMO the worst part is that they added charges AFTER they found out he was lawyering up. They had to double down their bad behavior by trying to punish this person for perusing his constitutional rights.
Yep, a clear reflection of the DAs office....they have about the same level of integrity as cops.
At least the DA dropped it when he did. Sometimes the DA will drag it out as long as they can only to drop it after everyone is there to go to court. Since this case has had a lot of exposure that may be why they dropped it so soon.
If they wanted to call it what it is "witness intimidation", it would stop real fast.
Any time an officer tells someone that they will raise charges if the person seeks to sue, it should really raise some red flags for internal affairs and courts. The fact that it doesn't, and so many officers get to walk away from doing something illegal just shows how terrible the system is
More than that it’s an outright admission of a retaliatory civil rights violation. They cannot give unequal protection as a consequence of seeking redress. The constitutional case should be open and shut. The fact that it’s not means the people have a lot of housecleaning to do in the judiciary. Maybe the first step is abolishing the bar.

But there's no proof, the bodycam was off. Not by accident, either.
Internal affairs is the last entity that needs to be investigating - themselves. Hence the redundant lack of accountability involving these matters. It's all a direct result of premeditated perniciousness which involves zero-accountability for certain entities. That's precisely what's been taking place over and over again, yet people still think IA will ''investigate'' themselves properly and hold themselves responsible. It's just beyond ridiculous!

At 9:10, the officer says, "If he'd just shut up.". This officer, actually, both of these officers are a liability to the PD. But, I suspect with both of them going full force so quickly, this holier than thou attitude likely comes from the top. The good thing I can see is that the officers weren't allowed to watch their body cams prior to writing up their report because they made a couple of glaring errors, ie "95 him!" was in the report as telling him he was under arrest. Given what took place, I thought a "95" must be "take him to the ground "

That is such a great point and well said. When someone puts their hands on you, it's a natural reaction to defend ourselves, regardless of who the person is and whether he's wearing a badge and carrying a gun.

It depends on the cop. For most cops, it takes something pretty big to get them fired, or even seriously reprimanded. But if you happen to be the unpopular cop who believes in actually doing their job properly without fear or favor, then it won't take much to get shoved out the door.
This is what i've been saying too. We hold McDonalds employees to a higher standard than cops. A McDonalds employee can't even sit down to rest their feet for 5 seconds without immediate termination, yet a cop can kill people and get away with it with promotion and bonuses. Why do we accept this?

@@jer280My issue is less "the customer is always right is bogus" (which it is) and more the fact that expectations for cops is outrageously low in terms of how they interact with people and respond to things.
I was a medic in the Air Force. After I got out, I worked at a call center, in retail, as a receptionist, and now in a hospital setting.
Nothing the cops are hearing is any different or worse than what you get from some lady who was late to her appointment and blames you for it, or from someone pissed off that the coupon their trying to use is expired. But while retail people and receptionists must remain calm, courteous, empathetic, and polite or else they can lose their jobs, cops can immediately use force and arrest people.
I don't think its unreasonable to expect at LEAST the same amount of de-escalation and self-control from a cop that one expects from a cashier at Target.

I think we need a federal standard that contradicting the police report and body cam footage is subject to a 250,000 fine and a lost of the ability to be a peace officer anywhere in the USA.

A police report is a legal document, holding the same weight as testimony. Therefore, it's perjury. And yet, no officer has EVER been criticized for lying deliberately on his report.
It's already a crime. It's perjury. You need DAs willing to prosecute dirty cops.

That would be a slippery slope. The cop is going from memory when he writes the police report. I mean it could be as simple as "subject walked up to me and said hey" and body cam footage shows he walked up to the cop and said "Whats up?" I mean would the cop get fined for that? It's by definition a contradiction with the body cam footage.

How is that not blackmail for them to say "Take this to court and we increase the charges"? At the very least they are trying to intimidate him into not saying them and that can't be even remotely close to legal.

Because it is illegal. But courts don't often actually enforce the few consequences for cops that they are supposed to, so is it really a law if it isn't enforced?
Judges also have certain restrictions in what they are allowed to do, but if they ever violate those restrictions it never gets inforced either, because a council of judges has to enforce the consequences for those violations, and that almost never happens either. And it is much, much scarier when you have a corrupt judge who breaks the rules.

Well elsewhere in this video it's mentioned of an officer getting away with dragging a young teenage girl by the neck for two minutes, so really, why fear any repercussions at all? Seems like cops can do whatever they want so long as the media and general public don't raise much of a fuss, and even then a cop will just get paid leave and join a new department in a different location.
Imagine sexually assaulting someone, then beating a young teen to the point they lose concious and are hospitalised, you are found guilty. You then get transfer to another department along with a promotion as chief. I no longer get surprised with the level of corruption within the Police force noth here in the UK and the US.
How are the additional charges not seen as retaliation for the lawsuit? Even without being a detective that deals with these things every day, that is a clear and easy outcome to come to after seeing the dates on the tickets

Can we talk about the horrible precedents in the 11th circuit on the use of force? Those cases basically give cops full reign to speak with their weapons first and cases like this one are open and shut abuse and wrongful use of force without those ridiculous precedents protecting these thugs.
A lot of these precedents were set before video footage and interpreted with bias to the advantage of the government.
The 11th Circuit Court covers Alabama, Georgia and Florida; which is basically lawless swamp land. So, it tracks.

@jaywinner328 Agreed, specifically the ones who precided over the cited cases. I was strongly considering a family vacation in Georgia but it was postponed by the pandemic until 2024. After hearing those precedents, I'm doubtful I'll resume planning.

These are the kinds of people, you do not ever want near a position of power and authority. This is why we need better mental/psychological testing for these positions.

The WORST part is that internal investigators / superiors didn't find any misbehavior. Regardless of the legal outcome, there seems to be no one interested in being a professional, trusted, deescalation-focused police force whatsoever.

So, subject is on his back with a 200 + pound officer holding him down and the other officer TASES him because he is not putting his hands behind his back. Well THAT makes sense. They sure protected and served the crap out of him!!!! And they wonder WHY people hate them.
But, again, it shows another problem. That cops don’t call out their badly behaving colleagues. They stick up for each other instead of saying “Dude, that doesn’t make sense. Every time a 'crime' occurs AFTER a cop shows up, when there wasn't a crime prior to cops arrival IT IS THE COPS DOING. No one decides to commit a crime in a police officer's presence. It is ALWAYS because the cop NEGLECTED TO USE DE-ESCALIZATION TECHNIQUES and/or INSTIGATED ESCALATION THEMSELVES.

Well, there was that video of the girl trying to stab another girl and her father assaulting another girl after the cops showed up. That's the one where the cops shot her, and the black community got all butthurt. You remember that one? There hasn't been an acknowledgement of the officer's threat of filing felony charges if the defendant fought the misdemeanor charges, and the vindictiveness of them filing of new charges when the defendant actually hired an attorney and a started a legal defense. And the officer thought he was trying to obstruct justice and decided to pound the shit out of Filipe’s face. Filipe had to fight back the urge to return the favor (Filipe was a X Green Beret) and the officers precinct investigated themselves and found that there was no need for further investigation since “no constitutional violation was violated”. They patted themselves on the back and went to their houses feeling like heroes for beating up a guy who literally got stopped because the officer had to speed up to catch up to Filipe s truck. The officer said he was going 120 MPH to catch up to Felipe who was suspected of going 112 MPH. Truly sickening tbh.

Informing an arrestee that they are, in fact, "under arrest" should be a more fundamental requirement than reading them their Miranda rights. Without this, the state of being "under arrest" exists only in the police officer's head.
I was on a jury where I successfully argued that a resisting arrest charge shouldn’t hold because there was no evidence presented that he was told he was under arrest.
