  • Over his career, Jerome F. Buting has spent hundreds of hours in courtrooms representing defendants in criminal trials. When he agreed to join Dean Strang as co-counsel for the defense in Steven A. Avery vs. State of Wisconsin, he knew a hard fight lay ahead. But, as he reveals in ILLUSION OF JUSTICE: Inside Making a Murderer and America’s Broken System, no-one could have predicted just how tough and twisted that fight would be-or that it would become the center of the Netflix documentary sensation Making a Murderer, which made Steven Avery and his nephew, Brendan Dassey, household names and thrust America’s criminal justice system into the spotlight.
    Combining narrative reportage with critical commentary and personal reflection, he explores his professional and personal motivations, including a battle with a rare cancer that almost cost him his life; career-defining cases, including his shocking fifteen-year-long fight to clear the name of another man wrongly accused and convicted of murder; and what must happen if our broken system is to be saved. Taking a place beside Just Mercy and The New Jim Crow, ILLUSION OF JUSTICE is a tour-de-force from a relentless and eloquent advocate for justice who is determined to fulfill his professional responsibility and, in the face of overwhelming odds, make America’s judicial system work as it is designed to do.
    Moderated by Matthew Hendershot.

      If you think Buting is some sort of "heroic" lawyer, you're clearly deluded and do not really know how weak his arguments are ... there are very good legitimate reasons why he lost the case and he knows he truely lost the case .. the fact he's taking the chance to bask in the documentary's popularity is , to me, a sign that he's not a honest or heroic person at all ... he's miseducating people logical mindsets in order to bask in the glory of the biased show ....

    The thing that sticks with me about this case is there is no proof beyond doubt that she is even dead 'human bones' found, not positively tested as hers, not enough blood in the back of the car to conclude beyond doubt she died, one tooth found only...
    I know on the balance of probability the bones are hers, but that is less than beyond reasonable doubt which is the burden of proof in homicide cases..

    It’s not about getting the truth out. In America, the whole purpose of the adversarial criminal justice system is to ensure that the government prove guilt beyond a reasonable doubt using only lawfully obtained evidence and through a procedure that is scrupulously consistent with the defendants constitutional rights.
    if the government cannot do that then they may not interfere with the liberty of the defendant.

    • @meems4378
      @meems4378 5 лет назад +1

      I don’t think that’s the case at all. I think we are all asking the wrong questions. As Kathleen Zellner says, jury’s get it right when they have all the info. The problem is the judge didn’t allow in a lot of the information. And the jury felt heavily pressured. That’s a bad combo. You have to have all the info and all the freedom to give a proper defense. Dean came out in the last few months and said Avery is most likely innocent. But it doesn’t matter. He wasn’t treated fairly. Either way he should be free because the law didn’t treat him fairly. Plain and simple. Brendan Dassey even less so.

    • @88feji
      @88feji 5 лет назад

      Avery is clearly guilty, all the "conspiracy theories" as based on baseless "maybe this happened" and unproven "maybe that is planted". No, thats not how we prove things, thats flawed thinking .. its like the worst kind of logic to look at things ... there are so many unplantable evidence in the case which makes it very undeniable Steven Avery is behind the whole murder ... And this lawy Buting is only defending him for the publicity he can get but he knows deep down he's guilty. There's an interview where the lawyer is asked do you think Steven Avery is guilty, he say its not about what he thinks .. its about whether there are loopholes to exploit in the police works in order for him to get SA off the hook... thats not exactly what he said but thats clearly how he implicitly defended the case.

    I think what he talks about as having transparent court rooms with cameras at the same time as proper due court process in the US with freedom of political interfearance is living in dreamland and a barrier to justice. Have a court transcribed process but not docu drama trial by tv. I found the Tv channels constant interviews on daily tv feeds in Stephens case so damaging to a judge or police force it led political will to ensure a conviction. So too is media attention the jury hear which means a jury are far more likely to convict in high profile trials. They don’t want to let of people who may be guilty. Media deliberation of potential guilt will have an effect on conviction therefore. This is a crass trial process. In the uk we wouldn’t have trial by media, and at the end of it, people would be on same page if miscarriage. With frenzy of media in tv trials it kicks up media humbug to not being bothered if guilty or not. It just makes good tv. It’s just shallow. Surely you realise this Americans?

    They tried their best.Steve Avery is not their family, they have their own kids and family and career to think about as well.
    It is NOT at all easy to believe SA is innocent.Their is insane amount of circumstantial evidence backing up his guilt, you dont even have to go deep into foresnic.
    So my point is, just like these 2 lawyers, and even myself, a lot of people believe SA was probably guilty( you can see everytime Dean and Jerry are asked question if they are convined SA is innocent, every single time they give an indirect answer), but should not have been convicted becaus eof so much conflicting evidence.
    That is why they moved on, they cannot spend their whole lives trying to free a man who is 50% chance easily guilty.
    For them, its not about SA's innocence or guilt.It was about that unfair conviction.

      You do not understand how the system works. The idea is no person is able to rule another person is guilty of a crime. There is a process and a court that must make this ruling. The system is subject to shortcomings and might make a mistake pronouncing a person guilty. However, the system cannot make a mistake and pronounce a person not guilty, this is because the system ruling not guilty was correct based on the evidence presented and because no person can rule another person is guilty of a crime.
