      Yeah, Law By Mike can say "I want Jimmy as a client", but this doesn't serve as any kind of contractual obligation and I'm sure Law By Mike would do his own due diligence over any hiring contract. 😆

    The decline in the sales of Mr. Beast Burger would've probably been caused by the millions of customers displaying outrage on social media on how shitty the food was, not by the Tweets Jimmy made.

      The lawsuit itself would've likely caused the sales to plummet. But I don't think a lawsuit can be covered under disparaging conduct. Otherwise you couldn't sue at all.

      thats the case with anything. mcdonalds cant ensure its food safety 100% either. unless youre the one cooking the food, youll never have that 100% for food safety. vdc had implied duty meaning THEY are the ones who should be responsible for the food being put out, theyre the one managing it. mrbeast cant control vdc, but with the contract its obviously implied (and maybe even written) that theyll do their best to uphold quality.@@topogigio7031

    I found it interesting you did not mention some other alleged points of the complaint from Mr. Beast. One is that he states he has not been paid a dime from VDC when profits were meant to be shared 50/50, the other was that they could only use his likeness with express written permission before use in any new marketing or material. They instead filed several trademarks for the Mr. Beast burger brans in europe without his express written permission.

      I think an argument could be made that the name Mr Beast isn't part of his likeness, since that's not his real name. Since MrBeast hadn't been trademarked in the realm of food in Europe, anyone could trademark it, including VDC.

You couldn't just open up a restaurant called "iPhone" or "Samsung galaxy", even though those trademarks are intended for electronic devices. MrBeast has had an international trademark on clothing apparel since December of 2019. I'm pretty sure that even if the name isn't part his likeness, using the name as a company that historically borrowed his full likeness implies that the name by itself continues to carry the full weight of his likeness. Besides, it still violates the good faith clause inherent to contracts.

    The problem with Beast Burger was it was so inconsistent. I'd order from what appeared to be the same Virtual Kitchen, i.e. showed the same address and delivery time in Grubhub, and one day it'd be the best fast food burger I've ever had. Then I'd order like the next day and it was utter trash.

    Ima be honest, the food def had a downfall and was not bad. I got a burger a couple days after he launched beast burger and it was actually one of the best burgers I had, shame that vdc ruined it

      I wouldn’t say it was the BEST burger I’ve had, but I also ordered some shortly after it was launched and it was definitely better than any other fast food joint. That was the only time I ate it though, so I can’t speak on its downfall from experience. My guess is Jimmy will win this lawsuit handily.

      It wouldn’t have been doomed if Mr beast actually negotiated the contract before blinding signing all his rights away. If he done more research or asked the community first he would have realized and be more careful.
      Ghost kitchens can work but only if the brand owner gets ultimate control of what happens. In a healthy contract the brand owner should determine whether to suspend or terminate a product if issues come up. Or at least have clauses that explicitly states quality thresholds that need to be met for the contract to continue.

    The case sounds like it will depend on if VDC was in process of sufficiently resolving the problems before Jimmy went public with the issue. If they weren't doing enough and weren't responding to him then he would have to take alternative action to resolve the problem and protect the customers from getting further physical and financial harm from the product since some were getting food poisoning.

In fact, this video is exceptionally unbiased--all of the facts were laid out and all potential results were part of hypotheticals. He says several times in the video that depending on the stipulation of the contract terms or how they plan on pursuing legal action, both could have potential cases. There is no "siding" when it comes to law, it is just whoever you are paid to defend. So if Mike is paid by Mr. Beast to represent him, then he is, if he's paid by the other party to defend them, then he's on their side. Nothing in this video indicates one way or another, just placed in a fast paced theme that any user can enjoy.

    Jimmy is in the right he is a genuinely good person and would never intentionally do something bad like breaching the contract
    VDC had the obligation to make actual good food
    Honestly I’d love to see mike be his lawyer
    If the VDC succeeds in this then Jimmy will lose basically everything and won’t be able to help millions around the world
    What the VDC is a company that has the ability to take this hit. Jimmy has a lot more to lose the VDC
    So my question to you mike is. is it possible for a law suit to be seen unreasonably harsh by the court?

      Almost every lawsuit with large sums of money being thrown around are seen as overly harsh. With just about every case not settled out of court ending in a much lower cost than what was asked
      (EX: plaintiff sues defendant for 150 million and wins. The courts would almost always lower it to 1-5 million unless there’s really high amounts of animosity/negligence/whatever plaintiff sued over.)

    My dad and I got beast burger once. The burger was so burnt that when he took a bite of it, it cracked hit tooth.
    He tried to pursue legal action to get them to pay for his dental fees, but they said that because he willingly ate it despite seeing that it could be bad, it's not their fault.

    There’s a ghost kitchen near my house, and almost everyone I knew, said the food was crap whether it was from MrBeast burgers, or from a different company that the ghost kitchen was serving.
    Those workers literally don’t care about their job. I used to do Uber eats and it would take them so long for them to actually finish the food. I actually overheard their conversation (while me and a number of other drivers were waiting) and they were wondering who was going to the gas station down the street, to buy a Fanto cigar pack to roll up their w33d later in the kitchen… The most ghetto thing I ever heard.

      They essentially are scams because you can't find them or walk into them, or be sure who is cooking your food AT ALL. Meaning they have 0 accountability if they KILL you with food poisoning. Oh and you can't be sure that the people making your food are even doing so safely and within the safety standards of your local area.

      Some actually do that. Some also rent small buildings and just cart in mobile kitchen appliances to cook with. Many of them don't even follow the FDA regulations and can cause food poisonings, etc and who is actually going to be held liable for this? (A ghost kitchen can be shut down or renamed, so it's hard to know the actual owners.) It doesn't help that some 'restaurants' on Doordash or Uber share the same location, sometimes 10+ restaurants are from one location and as I stated earlier, they aren't always actual physical kitchens, they are just buildings with appliances temporarily brought in to be used.@@mariotheundying

    I used to work for one in London WW, it was called reef kitchen. Management was hemmorghing money, in Wandsworth they left the kitchen vacant for 6 months (renting the ghost kitchen was about £5k a month including service charge,rent and utilities). Then they got it back ,but the staff they hired were all druggies for minimum wage. Food quality was awful , h&s was ok but management top to bottom was rotten

    I posted on a pds video about this topic. The quality of beast burgers has noticeably declined. My family ordered from them every so often until the last time (which was a while ago now), we had commented on the fact that the location our order was from had changed, but other than that, placed the same order we usually did. The quality was like half of what we had experienced previously. I personally didn't finish my food because it was esentially just char on one side. That was the last time we ordered from there; and i don't hold it against Mr. Beast as a brand because I'm vaguely aware of how those sorts of contracts work on the food service end; but i still won't order again. Lol

    This is the same issue some franchises have (McDonalds, Jack in The Box, etc). The individual restaurants serve food that isn't up the the franchise snuff or the service times are not within franchise standards. I found it kinda of funny that a McDonalds in France serves food the tasted EXACTLY the same as it does in America. If Mr.Beast didn't make his contracts solid, that is on him.

    I woukd argue that by counter suing, VDC has damaged Mr. Beast Burger and their own reputation far worse than Mr. Beasts deleted tweets that only came after a ton of bad reviews.

    IMO, it is VDC's duty to make food that, at the very least, is safe for customers to eat. Failure in this duty that results in material damage to any partners is their responsibility. Even if the actual number of inedible burgers was low, the high profile nature of the situation resulted in material damages to Mr. Beasts' brand name and reputation. VDC should be responsible for any damages the occurred as a result of their oversight.

    I worked at a ghost kitchen and to be honest that’s not the only bad thing they did they had horrible house keeping and terrible health inspections I really don’t know how they could no prove that they in fact did damage the mrbeast burger brand I have a lot of info and victims around working conditions and management of REEF ghost kitchens I got pictures as well 😊

    I think the reason the quality became so bad is that these ghost kitchens are no longer ghost kitchens. During the pandemic a lot of restaurants became ghost kitchens to make money when people wouldn't come there in person. But now that covid has settled these employees are basically working for two restaurants at the same time. They now have to do all the work from the restaurant they work for, and they have to make food for Mr. Beast Burger. A lot of these restaurants just probably don't have the man power to work as a ghost kitchen when the focus has returned to their restaurant.
