- The plaintiff purchased a tractor from the defendant. He says the tractor didn’t work, so he bought a new battery and tires for it. He left it on the defendant’s property, but then the town took possession of it because officials thought it was abandoned. He’s suing for the cost of the tractor and the supplies he bought. The defendant argues the plaintiff left the tractor for over a year and she got rid of it because he never picked it up. She’s countersuing for what she’s owed.

how do you figure that when she didnt have to give the renter a break. Let me educate you on rental laws. when you rent, you are only renting inside of the property and the outside is separate. so, even the property was a house, you are renting the HOUSE, and the house is whats inside and not what is outside. so with that said, she didnt have to give the tenants a break because the tenants was not renting the property but instead renting the livable space.
Now, had he been a lawyer, and had the judge been professional, by law, if she wanted to remove his tractor that he bought from her regardless of how long it was there, she would have to give him notice that if he didnt remove it from her property, it would be towed. Its similar to trespassing laws and the property can not be considered abandoned unless the the land lord knew explicitly that he did not intend to retrieve the property but this is what happens in small claim court where the laws gets circumvented by a judge because they can and the plaintiff and defendant arent attorneys.
Wow... What an entitled 'minister' 😂 Shame on him. Not only did he take advantage, but it's possible the people of his town will look at his character differently. Collateral damage.

The Plaintiff says the tractor was still there because it needed repairs. Tractor should have been towed to his place and do the repairs there. After the first complaint that the tractor is a eye sore. She should have gave him a 30 day notice or there will be storage fees. Defendant did say she paid the tenant 80.00 because of the tractor.
This self-entitled plaintiff got less than he deserved in a judgement against him.
I'm not a religious person, but I find it especially sad when religious leaders in the community take advantage of people like this & have the nerve to sue the victim in court.😤😤😤

This plaintiff comes off looking like a very entitled person, shortchanging the defendant, getting free storage for over a year from her and then suing her for more than the truck (which, from its size, sounds more like an earth mover that might not even have been suitable for plowing a church parking lot) was worth when the city finally took action.
I think she should have gotten the plane ticket too but glad he didn’t win lol
Milan is cheap and annoying.
After 30 days she should have sent a registered letter telling him to move the tractor or it would be towed. She was crazy to just let it sit there for so long and bother her tenants. I'm not sure what the law is where she lives, but in most places it's considered abandoned after 30 days.

She should have counter sued for the amount she was docked each month from her tenants as a result of the trailer being there. I'm almost certain Milian would have given her that.
No, she wouldn’t have won. That was an agreement between her and the renters that was her choice.

@@jwbuckmiller82jb She could certainly try but her discounting the tenants rent was a deal between her and the tenants. It was not a deal between her and the plaintiff. If you could hold the plaintiff accountable for things that were affected by him leaving the tractor there you could make up a whole slew of things to blame on him. Plus, she could have gotten that tractor removed from her property a few months after they made the deal but she chose to let it sit there. He is not responsible for choices she made that he didn’t agree to. It’s not that I disagree, I’m just saying what the law would state.
I can't believe that minister came into the courtroom & lied like he did. Tried to say that he changed the price from $1500 to $2000. Just from the fact she had to chase him down for the remaining $500 & leaving the tractor on her property for an entire year should've kept him from suing. I mean, did he think she wasn't going to say anything to defend herself?
I felt like the defendant should have been awarded something. That's pain and suffering from having to reduce rent because of the eye sore.

I feel this about some cases but winning is the real victory. Also, they get a fee for appearing on the show so at least she gets something for her aggravation and time even though it's not enough.

I just hate it when the judge asks a litigant a specific question but instead of answering they jump into a narrative of what happened, usually to show how evil their opponent is.
That’s how they deflect. Most likely they were wrong or gonna be wrong so they start explaining.
So the point of a court & judge isn't truly about who is wrong or who is right but about what u can prove and convince a judge to believe. 99% if ppl who know they in the wrong go to court trying to bs their way thru it to minimize their punishment or win

Why do people throw around the word 'pastor' expecting it to earn them privilege?
Unfortunately, it does afford privilege and prestige in many parts of the country, irrespective of whether or not the "pastor" is a decent human being. It certainly appeared that the plaintiff earnestly believed that he deserved unlimited accommodation due to his job title (although he at least had the common sense not to verbalize that in court). He was arrogant and indignant throughout the entire case.
Because some people actually treat pastors demigods and give them that privilege.

Tractors aren’t cheap, and they are usually are kept in use until they absolutely can’t be used. She could’ve sold it for much more, even if she had to have some repairs done on it. (My opinion only)😊
