  • The plaintiff lived in the defendant’s basement for two years. He claims the defendant got mad at the plaintiff’s friend, and then evicted him. He claims the defendant made a ridiculous list of damages and now the defendant refuses to return his security deposit. He’s suing for the security deposit, emotional distress, and punitive damages. The defendant argues he had a valid list of damages.

    I'm so sick of hearing people say they didn't get a receipt because they paid in cash. If you pay cash at any store they always give you a receipt. The lack of common sense is astonishing.

      In fact, paying in cash is the reason TO request a receipt. If you paid via debit or credit, your bank statement would be the receipt.

    What really bothered me is how the defendant felt it was his right to dictate when the plaintiff could have his friends come over. If he wanted his friends to stop by everyday so what. That’s his space that he is paying for. The defendant seemed like a nut case and a liar.

      The defendant has a point. It's his house and renting to one person being the plaintiff. He doesn't care for people coming and going all the time and probably staying there too if they're not tenants. If I were this landlord I wouldn't appreciate it either.

    This landlord has no right to say who someone can have in the place they rent! What I mean by this statement they can not restrict a tenat from having guest and a peaceful enjoyment of the rental.

      They can’t stop the tenant from having a guest, but they can’t stop them from having a roommate. The plaintiff messed up in the beginning, and started to say he had a roommate which leads me to believe he had a roommate.

      I think the Plaintiff called his witness his roommate because they're probably sharing a place now. Secondly, the only type of rental agreement can have slightly more restrictive parameters regarding guests is when it's a roommate situation, as in the leaser & leasee share common areas. Not so much in a multi-family unit with individual apartments. There shouldn't be any "traditional" rental situation that limits a tenant from having a visitor for less than 72 hours in their own apartment. That's the standard timeframe for most leases. The landlord may charge more for extra utilities used like water, gas & electricity during that time but, the restrictions can't unreasonably impact the renter's peaceful enjoyment of their domicile.

    I also would like to add NEVER EVER live where the landlord lives near by because they will use the lack of distance to say ohh l was in the neighborhood and come in whenever they feel like it.They will watch you but not do what's right and fix anything because they don't want to spend money they don't like personally.lve experienced this or seen this exact thing with every landlord lve ever had.They get drunk on power then justify their creepy by saying ohhh lm only looking out ...for my property.

      How do you know what gender he identifies with? I never heard him speak on it , and he even used the pronoun “he” when referring to his friend/ witness. He also referred to his significant other and used the pronoun “he”. Every person is a unique individual. At the end of the day just everyone else, it doesn’t matter what gender you are in court.     The Judge glossed over how the plaintiff's friend was doing business in the home (makeup 'for hire'). Maybe that's why the door was left unlocked, and people were always coming and going.
    Unless otherwise specified, most residential tenancies don't allow business to be operated in the home.

    Folks as a Landlord I can assure you that the cost for damages is extremely reasonable. Material cost money. Tenants are always causing damages and then want the landlord to eat up the cost. It's unfair. JM is completely unreasonable. She comes up with these fictitious numbers that do not align with the actual cost of material.
    My recommendation is to tenants if you're gonna rent someone's place, have the common decency to maintain it, and return it in the same condition it was released to you. No one should be eating up the cost of damages you inflicted on a property. Be responsible enough to take ownership of your negligence. If you don't trust the landlord, then get a contractor that is approved by the landlord so that you can .pay them directly. Just remember the landlord has a right to say no tonyour contractor as it's their property, and you can not force them to use your contactor.

      As an EDUCATED former renter 20 years ago during my FINAL year of LAW school, that there was the following: painting (ironic, the last year of renting the place by the landlord), carpets need replaced, I shampood them twice a year, Windows are dirty ( I hired a deep cleaning service 2days prior to moving out), LIGHT BULBS, batteries for TV remote, fire alarms, garage door opener, all i replaced beforehand...The SIDEWALK WAS UNEVEN!! YEA, THE LANDLORD PULLS A BUNCH OF BULLSHIT TO REFERBRISH THEIR RENTAL $3200 worth...try again! Some of us ACTUALLY take care of our homes whether a rental or not!

    Arguing load enough were the person that lives upstairs can hear you, allowing in anyone to come and go as they please while someone lives upstairs, not to mention the damage done to the apartment. But for some reason what he identifies as is the reason he was evicted. The plaintiff is ridiculous.

    It seems the plaintiff is confused. The place was full of holes and it was filthy. The Landlord was generous offering him 300 but greed took over and he ended up with 200.

    Even though the defendant lied Milian still allowed him to keep $700 and return $200. Nonetheless when living with someone else renting or otherwise you should always treat the place as if it was your very own. But folks seem not realize, understand or respect that.

    What do landlords expect a tenants house suppoed to look like after someone lived in it. Like i know my shit is lived in. We painted the walls, the wooden floors are scratched because of ppl traveling, furniture moving, etc like he shouldn't have brought him to court and ya house looked lived in.
