  • The plaintiff hired the defendant to stage his house to put it up for sale. However, the defendant quit the day before she was scheduled to work, so the plaintiff is suing for breach of contract. The defendant claims she was forced out of the deal by a competing realtor, and there was just too much drama. The defendant believes she is not responsible for the plaintiff's inability to sell his home in a bad market.

    I was looking for a painter and it took me months just to get someone to return a call. I think he's in the right. He took certain actions based on the contract. That cost him money. It's summer premium time for house sales in MA. I'm sure he couldn't find 1. I will say he should have better records.

    I think she - the realtor should of paid something - afterall she got him to vacate tenants and then breached - he could of kept those tenants another month or two until he found a stager - milian and real estate agent are lame

      I agree with you. Normally, I agree with JM. This man was left with nobody to do the work at the last minute. Anyone who has ever renovated or built anything knows you can't just pick up the phone and get someone on the job immediately. I think the defendant is a ditzy blonde.

      She told him facts. If the tenants were living there on a month to month lease, he has to give the tenants a month notice to vacate if he’s wanting to remodel.

Or, she has the power to make changes in a case in the interest of justice at her discretion. So she could have ordered a judgement against the Defendant for punitive damages.

    I don't get why her former company could stop her since she doesn't work for them anymore.
    Also for a handyman company, you can only charge up to $500 for work without a license. They were charging $16000.
    He should have gotten at least the lost rent for ending the lease early because she said she would start at a certain time. Then she bailed after the tenants left.

      Her previous employer contract with the company she left may have had a no compete clause that was specific to its direct competitors or geographic location.

      @@YolandaAdamsfan I did think about that. Depending on what state they are in even tho there is a non compete clause there is a right to work law also. She could not seek out her former . clients to get new business. Also she didn't mention there was one to the judge. She took the job in the first place. Her excuse for backing out was being strong armed by a competitor. If he picked her to stage the house then there is no competitor. She already had the job. She may have said as a false excuse so the judge could see it her way.

      Because people don’t get money for disappointment and dealing with unprofessional behavior, they’re meant to be made whole. She said if he brought estimates and proof then she could award something, but he’s all words right now and she can’t simply take his word for it. Even with the landscaper that he DID hire and pay for, he didn’t bring the proof of that.

    I know what he's talking about with the contractors. It doesn't matter how much you can pay, the contractors won't believe you anyway. I've gone months trying to get contractors to show up and that's if they even returned a phone call.

    While there is no world he’s gonna get 4 months of missed rent and anything else he was definitely out at least one month of rent solely based on her backing out. Also you think he just said oh well and didn’t look for people to finish the staging? That makes no sense.

    I didn't like the defendant. She was bitchy. At the end she said she would stick to the kind of clients she is used to. That was an unnecessary diss to the plaintiff. Especially when her staff are her daughter and the daughter's boyfriend.

      @@tamarajackson6080 Not sure. She says she has been doing it for three years so he is not her first client. She has a warehouse containing her specialised furniture. I don't see this as saying she will stop with the staging. I think it was an unnecessary diss to the defendant.

    Judge Millian doesn't understand what it's like in the post-pandemic, Gen Z world where no one wants to work. In any area that has seasons, if you don't line up a landscaper in the late-winter/early-spring, they all have projects scheduled out for the entire spring and summer. And any competent painter will also be booked out for a month or two. I'm sure he could have gotten some unlicensed handyman, but I totally believe this guy.

    Many of you don’t seem to understand that court is meant to make someone whole in a loss. If someone isn’t professional like this defendant you don’t have to hire or recommend them again, but they don’t automatically owe you money because you’ve been inconvenienced.
    Was she wrong? Yes. But he brought NO EVIDENCE of what he was actually out monetary wise, not even for what he paid the landscaper, let alone what he “might” have to pay in the hypothetical future when he finds the right contractors and painters at the right price. The plaintiff has the duty to attempt to mitigate his damages. It’s fine if he felt everyone else was too expensive, but that’s not her problem. However, if he actually PAID someone more expensive, then it can be her problem, but he can’t be awarded money on no proof but his word.
    And it matters that he “could” have found someone new to hire but simply didn’t want to pay for it and still wanted her to pay a hypothetical difference that for all we know he could pocket in the long run.

    I would NEVER use that woman as a realtor. However I think the plaintiff was greedy and seeking way too much in damages. It is frustrating when you deal with someone who betrays you and breaches a contract but he really had no case for 5k. Judge Milian should have awarded him more than $1 though.

    and yet in other cases, Judge Milian has accepted that contractors take months to get to a job. And THEY're not held in breach of contract. There's nothing like screwing over an Asian fellow and then laughing heartily over it. I sure wouldn't contact yon Plaintiff. Harvey is wrong when he said there are no damages. Clearly there were, the Plaintiff just didn't have proof in writing.

    judge got it wrong. My landscaper dropped my business in April of last year, I contacted close to 13 companies, none would accept the job. Had to pay a random person to do somewhat of the job...it is difficult to find services at the height of that season

    It’s really hard to find people to work. We have a landscape business and can’t find people willing to work regularly- and every restaurant around here has “hiring” signs. So many small businesses can’t find workers. So finding someone to do work can actually be really difficult!

    He should have won something much more than $1, because she breached the contract and made him vacate his tenants early, so he is out money because she breached! The judge didn't even want to understand that finding a stager and landscaper that will do the work at the last minute, is impossible...

    He should have hired her to list his house instead of hiring her previous employer, whom she had issues with, and which she did tell him about. He also could have listed it without staging the home first.

Many people in business do not call back because they are so busy… they can’t be bothered to be courteous, therefore the client( me for example) is unable to secure their services in a timely manner. Also, when someone does call or come out to look at a job, when you ask for proof of insurance/ bond they are unable to. At that point I as a homeowner cannot have them on my property because of the liability. Thought this would clear it up,for any new or non homeowners.

    The defendant would have had to pay something if the plaintiff had brought proof of the cost of the delay and of the work that he got done, if it was over the price that the defendant quoted him. He brought nothing so he got nothing. Period.

    The defendant didn't seem to have any remorse at all. She took no accountability for her actions blaming her former company for being unable to do the work whatever that means. She's NOT reliable at all.

    SHe has no professionalism. I think the guy would have a good argument for "reliance" damages. He should have said "in reliance" on her promise to do the work, he terminated his former tenants who would have stayed on but for his notice to terminate. Then she cancels. Well, in his reliance he lost out on the rental he would have collected from the former tenants for at least one month (since it was month to month) and he could or should have collected at least one months rent. In equity there is such a thing of reasonable reliance. Since the "stager" needed the house to be vacated of renters to stage it by a certain date, then she unprofessionally and unexpectedly backed out, he is entitled to at least one months payment. The judge should know that and since she seemed eager to grant him the win, she should have found he reasonably relied on her and terminated his tenants, so she owed him some money. That b -word did not even apologize to him for her lack of professionalism.

    I'm curious as to what happened with the defendant. Why did she have to fight the real estate company? What happened between them in specifics....
    I'm surprised that the judge didn't ask because she goes into detail when it comes to people romantic relationships but why didn't dive more into this.

And living in the Northeast, he's speaking facts about contractors... I'm actually surprised it was a LANDSCAPER that he DID find to get to do work!!!

    There are some circumstances that do not change, they stay the same. Your mind must be renewed by the Spirit in order to learn how to navigate the situation in a godly and successful manner. Whenever God is not changing your circumstances, it means that he is changing you. What God is doing in you is much greater than anything that the enemy has done to you.

      Wrong, he definitely had damages because he lost at least one month's rent since he sent notice to vacate to tenants at HER REQUEST because she claimed she needed that to do her staging, but she never did the staging so he relied on her, and in reliance damages he totally deserved at least one months rent or more. I thought the judge was smarter than that!

    I am just reading the comments. I don't personally agree with the verdict but the guy didn't do anything to remedy the situation. He wanted to stage his home, his first stager backed out, go get another one. He didn't do that, he just wants money for all the months his property stayed there and says to the judge, "Please believe me that I did all this work to remedy my situation", but he can't prove anything. No phone records, no statements by anyone else. This is a court of law, I do believe he should have gotten more than $1 but with no evidence and just wanting the rent money and other expenses he would have done anyway. I think she made the right decision based on the evidence presented.
