Great interview! Dave is the real deal. A huge percentage of my IT clients are lawyers, so I spend a lot of time talking to them and bringing up self defense law whenever I can. Although anectdotal, I spend a lot of time educating myself in 2A and self defense law and have come to the realization that I wouldn't want to be near a courtroom with 95% of them in a self defense case, even some who are friends. It takes someone like this, who has slogged through years of these exact kind of cases to be able to represent you effectively.
Man listening to this makes me not want to carry a gun period. Just take my chances. It’s horrible just defending yourself can turn out crazy, and the self defense is bad enough. Even having insurance doesn’t seem to be the answer. Scary really.
I also recall the prosecutor commenting about the defendant in the Trayvon Martin case that the defendant had suffered a wound from his head being pounded on the pavement that would only have required a bandaid, suggesting that he was required to wait until he actually suffered a life-threatening wound before he was entitled to use his firearm to stop the attack.
I used my 2A tool. My public defender was working for the prosecutor. When she said it will save the county lots of money by not going to trial. Disorderly was dismissed. Pled on the obstruction charge. Wife recently had radical hysterectomy & I would walk out without paying anything.
@govt had no case. Everything I did was a lawful action. I couldn’t even find a local attorney to help me fight the issue? I think my statement that govt has no duty to protect the people per case law would not bode well for the state. (The complaining party)

Watch some videos about the difference in AOR attorney on retainer compared to USCCA
Infuriating that we might have to go through all these gyrations just for saving our own lives. Something needs to be changed. Forcibly. And people who victimize us for merely wanting to continue existing be made accountable.
After listening to the video and reading the comments. It seems better to just run away than to have to defend yourself from the assailant then defend yourself from the government.
Here's the thing. How many cases has uscca not plead out and their client doesn't go to prison? From what I've seen, is none. They don't fight, they plead out
Good info. Side note: In many states you can CC in places that have over 50% alcohol sales IF you have a permit like here in AZ. AS long as you’re not consuming obviously.
District Attorneys are politically motivated, not by justice. A crime involving a gun is a way to make a name for themselves! Victims are charged immediately with one or more felonies, that if they win will remain on their record. They can not recoup the costs of defending themselves, so attornies are more likely to NOT represent you! The "system" is flawed (~95% of cases are decided by plea), as clearly pointed out!
Me, myself if I was ever in a self-defense situation, it's a no brainer that you will be taken to the police station to speak to a detective. At that point. Me: 911 Please send police and hurt wagon to address, then hang up. Police: Do you need to the paramedic? Me: Yes Detective: Miranda Rights read, then so let's talk about tonight, what happened? Me: Am I being charged? If so, I want my lawyer, if not, I want it in writing from DA and signed then we will talk.
I've heard of somebody who clearly has a self defense case and they were terrible to deal with as lawyers. That made me nervous to join. My dad is a member tho
Get something. Just for representation during the interview if nothing else. You can choose your attorney on most of these plans. Pick a high profile criminal attorney. Few attorneys can make a living just handling self-defense cases in a small geographic area. Too infrequent so its likely going to have to be a competent criminal defense generalist.
This is why I'm it's important If you're in a self-defense shooting to have a lawyer not an insurance company Attorneys on retainer is the way to go Not an insurance company I've heard a lot of bad stories about USCCA If you don't believe we just look it up Attorneys on retainers the way to go Look them up too don't take my word for it
Tell them you were attacked, be upfront about that! Some guys were silent for days in jail until they said that, then the evidence matched the story, then police released them. Also stay a long way from dei cities.
Wait, you own your own firm with attorney's who work for you and that's how you have a jury trial every week? Because there's no way you're a solo attorney with jury trials calendared every week. That's impossible.
Thanks for this. We (for a few years more pending retirement pensions) live in California though not in a big Blue metro. Our legal system is now so messed up. Much stronger protection for most criminals and very little protection of someone who must protect themselves. The very idea of actual justice has been pretty much lost.
Letter and semantics of the law vs. Natural law and the spirit of the law. God gave us the right to defend, not murder. Murder is what criminals do defend is something law abiding people do.
So...is this topic simply a response to the plethora of complaints against the USCCA for not providing what they claim they'll provide? Attorneys on Retainer seem to think so.
The fact that this is an issue is why we need some sort of reform that separates self defense shootings from everything else. It should not be treated as a crime.
I was involved in a situation where a guy pulled a knife and even bring the one that called 911 i was super surprised when i was the one taken to jail and the other guy seen by paramedics because he had a panic attack…later the police kept trying to blame it on me cop after cop kept coming to me asking me the same thing and saying “no i think you assaulted him” i was pissed…. In my ACC class the prosecuting attorney advised us to only say that you've experienced a traumatic event and not in an emotional state to speak to anyone at this time and request a lawyer. Unfortunately you'll be pressured to talk by law enforcement but remember that anything you say will be used against you in the court of law. Be respectful to responding officers but stand firm on your right to remain silent until your lawyer is present even if they suggest that only "guilty" people say that. He also said that don't be surprised if the family of the attacker will lie, claiming that they are grieving over their "angel" that wouldn't hurt anyone while in court. Be smart, play your cards right and don't give any incriminating evidence to the prosecutor who can turn it around and make you look guilty while you exercised your 2nd amendment rights legally to protecting yourself and your family. They'll try to turn it around to get a conviction no matter who was right and wrong so it is best to not talk and give any bogus "evidence" that will unfortunately waive your rights and put you in prison for a manslaughter charge 😏
This talk is awesome Colion... I've never shot a firearm, but want to get into it as a sport. Having said that, I just bought my first rifle to get started. I plan to take a three day class to learn firearm use, in addition with self defense classes. My first step- getting insurance before actually shooting and joining USCCA. The "classic" definition of Hearsay is information provided by individuals who were not present as "witnesses", and was related by another to them of their experience "as a witness"
Why isn't it applied both ways. In 2003 my father was shot to death by the police in California on the 911 call my family made to get my father help before he was shot they said if they were too come they weren't taking him alive well they showed up and did not take him alive they shot him to death right in front of my little brother ,my grandmother and myself there was a 20 million lawsuit for wrongful death we moved back to Michigan with my mother and our grandmother uncle and Aunt were taking care of the lawsuit four years went by to be told if we wanted something done we had to do it ourselves. I have discovered a newspaper clipping that said the lawsuit was decided suicide by cop March 20th 2003 when the incident took place March 8th 2003. Which is a lie because we didn't even have my father's funeral yet so someone's lying about something I reached out to attorneys and they can't help me I looked up police records court records and can't find anything.
I’m not sure what the point of this video was beyond plugging USCCA subscriptions. After the central thesis that the legal system is broken and politicized was established, I don’t trust that a collection of online training materials will be sufficient to adequately address the wildly varying legal situations that we’re all subject to. As others have said, there is an open question about the legitimacy of the claim that the company in question will provide as advertised. They brushed over the topic superficially, in my opinion. All in all, I did not gain any insight into the overall subject and, I’m less likely to subscribe to USCCA. There are several other companies that are more focused on assuring legal services than producing and marketing training.

Because they know how absurd it is to criminalize someone for defending their own home again'st a intruder or a group of intruders with a fire arm.
Last place you will find justice is in the justice system. The people you expect to protect you are working very hard to harm you.
I've heard so much of this, so the big question is, then why carry if at the end of the day, you're damned if you don't and damned if you do?
Goes back to the old adage "better to be judged by 12 than carried by 6".
It's not perfect but it's easier to defend yourself a second time if you're not already dead.
So you don't get eliminated 🤦♂️
So you can live to tell your story. What’s the alternative?
15 minutes in and this seems like the longest USCCA commercial ever.
I know i was he cut this shit about USCCA !
I guess you missed the point of what they were talking about.
@@moreforme74 I am tried of his USCCA and his ear buds that don't work.
It’s dumb. USCCA is bad
Reminder that USCCA will drop you the second you’re charged with a crime. Read the fine print. Be a member if you want, but always retain a good defense lawyer. There are memberships for that too. USCCA is no such thing.
What about the self defense thing "Attorneys on Retainer"?
Liberty Girl does ads for them sometimes.
@@troy3456789 yeah you can go with them if you’re comfortable dealing with a organization that’s out of state, assuming you don’t reside in AZ. I haven’t vetted them myself. It’s certainly among the most affordable options and I know they link you up with a local attorney. However, it’s probably not as good as establishing a professional relationship with an attorney practicing in the county where you reside.
To be clear about USCCA, there is plenty of value in the service for the money you’re spending. Their news letter and training resources is probably the best thing about the service. But most people sign up assuming that they’re “covered” in a self defense scenario. I just believe that’s a misrepresentation of their service. “Covered” is vague in scope and broad in translation.
Heard about that as well, I was a member but after reading several instances about them dropping members in their time of need I ultimately decided to cancel my membership
@@troy3456789 what self defense thing?
Exactly. That's why I dumped them years ago. It's a scam company.
This is one of the best interviews so invaluable thank you!!🙏👌
Great interview!
In FLORIDA of all places…
I used my 2A tool. My public defender was working for the prosecutor. When she said it will save the county lots of money by not going to trial. Disorderly was dismissed. Pled on the obstruction charge. Wife recently had radical hysterectomy & I would walk out without paying anything.
USCCA would have made you pay everything back because you took that plea deal. You are very lucky you were able to even get that plea.
@govt had no case.
Everything I did was a lawful action.
I couldn’t even find a local attorney to help me fight the issue? I think my statement that govt has no duty to protect the people per case law would not bode well for the state. (The complaining party)
Best episode yet Colion! 👍
AOR for coverage. USCCA for education.
New Law:
If person A is found to be in defense of their life, other's lives, or anyone's property at the time of the incident, no charges may be filed and person A will have no record of the account recorded anywhere.
Amendment II
A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.
Feel bad for anyone that has USCCA after the numerous people who where dropped and researching it more I dropped my plan with them.
Who do you have?
@@jeffclyburn9394 AOR I really like colion but hate that uscca is a sponsor for him. Uscca is an insurance just like GEICO you can get dropped. Most of the time in any self defense case you get charged right away with something anything. You ran a red light to avoid the contact with a road rage incident then you had to shoot well guess what you just got charged for running the red light and then fired on someone it is included in the case dropped. Watch some videos about the difference in AOR attorney on retainer compared to USCCA
Same. I switched to ccw safe
What do yall think of Right to Bear?
Get attorneys for freedom they're not insurance they're a team of lawyers. Once you get charged they won't drop you.
what a grrrrreat and timely interview with a well spoken guest who brings out many good points. THANK YOU COLION.
Infuriating that we might have to go through all these gyrations just for saving our own lives. Something needs to be changed. Forcibly. And people who victimize us for merely wanting to continue existing be made accountable.
Agreed.
🙌
Anyone else think it’s very “sus” that in NYS concealed carry insurance is “not legal”? Just throwing that out there.
Maybe in the 50's when there was no CSI. The dead men tell no tales, it's old and shouldn't be repeated.
After listening to the video and reading the comments. It seems better to just run away than to have to defend yourself from the assailant then defend yourself from the government.
Here's the thing. How many cases has uscca not plead out and their client doesn't go to prison? From what I've seen, is none. They don't fight, they plead out
Thank you both for doing this. Fantastic information!
Thank you both for taking the time to inform the public on these important issues.
Simply put, its my constitutional right to carry a firearm, i want my lawyer
As you're speaking, I'm looking up how each point applies in my state just because I want to know.
Me, myself if I was ever in a self-defense situation, it's a no brainer that you will be taken to the police station to speak to a detective. At that point.
Me: 911 Please send police and hurt wagon to address, then hang up.
Police: Do you need to the paramedic?
Me: Yes
Detective: Miranda Rights read, then so let's talk about tonight, what happened?
Me: Am I being charged? If so, I want my lawyer, if not, I want it in writing from DA and signed then we will talk.
This was an excellent and informative interview.
Get Attorneys on Retainer
This is why I'm it's important If you're in a self-defense shooting to have a lawyer not an insurance company Attorneys on retainer is the way to go Not an insurance company I've heard a lot of bad stories about USCCA If you don't believe we just look it up Attorneys on retainers the way to go Look them up too don't take my word for it
Thank you! I just posted something similar to what you said. I don’t know what is so difficult for some people to understand why the USCCA is so bad.
Thank you for this! Excellent discussion and very informative!
get a lawyer get a lawyer get a lawyer dont talk to the cops until you get one.
Tell them you were attacked, be upfront about that!
Some guys were silent for days in jail until they said that, then the evidence matched the story, then police released them. Also stay a long way from dei cities.
THE best segment EVER
That's My MAN Dave McDermott!
Wait, you own your own firm with attorney's who work for you and that's how you have a jury trial every week? Because there's no way you're a solo attorney with jury trials calendared every week. That's impossible.
He represents Illinois I believe. Not surprising he’s got cases for the year lined up.
I guess im in a different place. Both times, went straight home.
Thanks for this. We (for a few years more pending retirement pensions) live in California though not in a big Blue metro. Still, if I ever have to use a firearm or even pepper spray in self-defense, I fully expect to be arrested and charged. That is life behind the Iron Curtain: "Show me the self-defender and I'll show you the crime!".
This was a really great video. This guy is incredibly knowledgeable and it’s no wonder everyone wants him on their case.
Would love to hear him again in the future
Thanks for this. we could have gone 3 hrs on this. In addition, I would love to hear details of his court experiences
Such an important subject needs Time Stamps young man, and thank you
Great info again. Ty
Great content and information here. Video everyone who carries should watch!
I understand USCCA is a sponsor, but the title looks like information But, this podcast here feels like a midnight infomercial for USCCA. Colion, I like your firearm reviews sometimes and I like your information about events/happenings. I'm just saying, I'll watch the local on-air channel at 3am to see an infomercial. hope you go back to your earlier content.
If you didn't get any useful content out of this interview you're more biased than you think he is.
@@gabriel-uc1uzthat sounds biased
USCCA dropped 15 people in 2023 for loophole reasons. They will not help you! They are an insurance company first; they will do everything they can to keep from having to pay.
@@RED_MBDcompletely false. Where’s the evidence of this?
@@RED_MBDExactly. That’s why Attorneys on Retainer is the way to go
I don’t cross state lines with firearms but if I did I would research the laws every state I passed through and investigate ccw reciprocity with my state.
My opinion on the Chicago client story.....his mistake was being in the $h1th0le known as Chicago. I went there once for my son's Navy bootcamp graduation and I'll never go back. The whole state of Illinois has stupid gun laws.
The area around Great Lakes Naval Base is a total crap hole.
I've had this man's business card in my wallet for almost 5 years. This is who I'm calling if I ever need a lawyer. I went to one of his seminars a few years ago. The information provided was invaluable.
@NotYourTypicalAttorneys Hey Brother I am beyond proud and excited to see you on this podcast. I called you many times about many things over the years. I pray that I never need to call you on a self-defense event. But if I do, I am thankful that I have you covering my six. Love you Bro
Great and informative interview. Thank you.
Yes but the donors make more off of victims and criminals.
If your anti firearm you shouldn't get to be a judge.
This is good information but it also appears to be a USCCA reputation rehab effort. I’ll continue to avoid them like the plague.
Get Attorneys on Retainer into
So...is this topic simply a response to the plethora of complaints against the USCCA for not providing what they claim they'll provide? Attorneys on Retainer seem to think so.
When you are in an emotional state you can't think at a high level you are in survival mode
The fact that this is an issue is why we need some sort of reform that separates self defense shootings from everything else. It should not be treated as a crime.
Bruh I just became a uscca member today 11/21/2024
so this is a USCCA ad.?
Self defense cases are unique in the fact that the only way to claim self defense is that you have to admit you are the one that killed the person
Found out the kid was military and the cops were trying to help him out… Guy never showed to trial because he split from his gf due to domestic violence…. PS it wasn’t a 4in knife it was a dam Kbar 😂
Sorry to hear that happened to you. That’s why everyone needs to join Attorneys on Retainer. Those attorneys especially Marc Victor would have been all over that sending their own investigators to get that sorted out
@@1watersthree agree… at the time i was in a rough spot monetary wise thankfully a firm let me do monthly payments and helped me thru all that nightmare
2A and USCCA all the way.
Remember, if everything goes according to plan, it's your word against the word of a dead man.
At this rate, straight up murder will have a lesser penalty than defending yourself.
1. Wear gloves when loading a firearm or magazines.
2. Dont stick around after the shooting.
3. Dont talk to the cops. They are the enemy. They are not your friend.
What a wonderful hard core education you gave me that I had NO idea. You etched that information HARD into my brain. THANK YOU. i WILL BE PASSING THIS ON TO OTHER PEOPLE.
Dude, quit banging on the table. 😂
This was a great podcast
This talk is awesome Colion... I've never shot a firearm, but want to get into it as a sport. Having said that, I just bought my first rifle to get started. I plan to take a three day class to learn firearm use, in addition with self defense classes. My first step- getting insurance before actually shooting and joining USCCA. I love experienced advice, and this is top shelf.
P.S. I'm 65 and appreciate this new knowledge because it helps me see most precautions to take heed towards.
I 'd listen to a few more hours of conversations this educational.
This is a wonderfully important conversation to have. Thank you for sharing!
If this guy shows up as my lawyer I am getting another lawyer.
Why? 😂
A very interesting discussion !
This was very informative to the point where I have changed the way I do things (just didn't know some of the stuff ya'lls discussed) so thank you both.
The "classic" definition of Hearsay is information provided by individuals who were not present as "witnesses", and was related by another to them of their experience "as a witness"
Fear for your life just to fear life in prison
Thank you for the insight gents
Lawyer immediately
I think us law Shield is pretty good
Why isn't it applied both ways.
California is a stand your ground state?!! That's crazy, I never knew that!!
Only inside your home. Castle doctrine is within your walls in California.
Don't say anything to Police without a Lawyer.
This was an very informative and incredible podcast interview.
Great Job.
I got 7 minutes in and got “don’t talk” the rest was an advertisement for USSCA
I self snitched on my self when I was accused of aggravated assault in Pennsylvania as an armed guard! Despite the cop never recorded my self snitching, & the "victim" vanished, but they seized a defense tool, the police had to release me from police custody! Imma go get my property back from their custody which requires a hearing!!
Seems like we might as well pursue a life of crime, since we would be treated as criminals if we defend ourselves.
No such thing as dead witnesses.
