This young man had problems, and could have been helped. The judge could have held the kid in custody. So many little things and both people would have a future.

This story breaks my heart. Christie shouldn't have been let down like this. And her mother needs to understand it wasn't her that caused this. She did all that was humanly possible to see her daughter was safe. The only one to blame was her killer, who I will not grant the decency of a name.
No. Lawmakers are also to blame. So is society. If they didn’t have a law that forces judges to grant bail to men who commit violent acts against women just because they don’t have any prior convictions - not even arrests, but specifically convictions - this little asshole never would have been granted bail to begin with. Society first and foremost, though, since we put less value on the lives of women and do jack shit to curb violence against women. If we didn’t treat women like property and second class citizens at best, there wouldn’t be loopholes in the law that allow domestic abusive men to walk free to continue stalking a woman until they kill them.

That’s the thing. Sometimes it’s better to plead guilty. At least 25 years has an end date. You plead insanity, you may be held in an institution for the rest of your life. Let’s hope. For the Marceau’s sake.

@A SR yes that is some comfort. I don't pretend to have intimate knowledge of either prison or an institution myself but as a New Zealander I'm uncomfortably aware of the reputation of our prisons as rather cushy in comparison to that of other countries. So I can only surmise that a psychiatric unit is somewhat less oppressive. But again I'm only going on my emotions here not actual research. I just hope he's not enjoying his life. As terrible as that may sound.
I don't think that is bad to say at all. We need to protect the victims.. He should have lost his right to bail, my gosh, he had admitted to what he had done. I feel the same , he manipulated the system and I can just imagine how easy it must be for professional criminals..damn scary.
I think we true crime lovers all have cases that really hit us. I'm not ashamed to say how much I hate Josh Powell and his sadistic family. (He killed his wife then later himself and their 2 boys)
The second judge is completely useless. She should have researched the case before releasing him. What is the point of having judges if they are not going to do their jobs properly. She should also be imprisoned and lose her job for life
Imo it should have been enough for her to read his allegedly contrite letter wherein he clearly wrote that even his victim thought that it was all her fault.
I think the second judge was a "he" not a "she."
The judge who denied him bail was a woman. The judge who then granted him bail was a man. He did not do his job properly. She did.

The second judge didn't give a flip. This can't be the first time he willy nilly granted bail which resulted in tragedy. Defense attorneys should defend their clients but they should never be allowed to defend them at the expense of allowing harm come to the victims.

That’s not the fault of the defense attorney, that’s the fault of the judge that was too stupid to read his clearly indignant letter and New Zealand lawmakers that passed the law that allowed him to be granted bail to begin with.

That judge should be re-assigned a job as a road sweeper. There are circumstances under which bail should never be granted and this was one of those.

I've often thought that lawyers arguing for these violent pieces of s**ts to get bail should be held responsible for what happens afterwards.
The judge is the one who ultimately made the decision, Judge David McNaughton. He should be arrested.

I'm always stunned that authorities think its ok to release a predator on bail to stay with their mum, as if most mothers are qualified to control, handle, or detain a dangerous, and often mentally unstable, person! If anything, the fact that their child has become a predator would indicate that, as a parent, they lack that kind of authority or control over that person. It's crazy.
A very sad story... The murder didn’t have to happen. I hope the judge who granted this monster bail suffers with guilt every dysfunctional of his miserable life...

I couldn't keep listening anymore after Christie was killed. Everyone failed her and I am feeling unbelievable rage at the the system that failed and at the POS that killed her. I googled up his sentence instead and I am just enraged. POS should have rotted in jail.

If I was his mother I’d be so ashamed of myself for allowing this to happen. To agree to watch him while he was on parole and then go to work and not bother, is bloody terrifying !! She should’ve been locked up in prison. The judge should never have given him parole AT ALL , let alone left his poor, terrified younger sister to ‘look’ out for him - he could have murdered her too…. 🤬🤬🤬🤬 I do think that the Judge was unaware of the ridiculously tiny distance between the perpetrators and victims home, as well as how young his sister was… This absolutely affected his application for bail. His mother’s actions are unforgivable, to say that she didn’t realise she had to watch him is absurd…

And in spite of all those things that went horribly wrong, I am deeply impressed with the NZ justice system! Starting with taking the victim's feeling into account, and ending with finding all those inside the system, including Judges as having done wrong … exemplary. Seems to me that next time, they will handle these things way better, whereas in, say, the US, far worse outrages happen all the time and there does not seem to be light in sight yet.

I have to say though, why in the world would her mom only after one month after he’s been released, she didn’t think it’s not smart or safe to open the door without looking to see who it is first?
Only before this insane nightmare could she use the reasoning that she was thinking it might be the package delivery man.
At that point their world was different and she should have thought, acted and reasoned different.

We all should remember that the justice system is more system than justice. And defend your family accordingly. Judges rarely live in close proximity to perpetrators, and pass judgement accordingly. So Judge David McNaughton suffered no pangs in granting bail to Akshay.

This one has me sobbing. The fact that she raced over to his house in an attempt to stop him taking his life the first time shows what a compassionate person this girl was. Only to be senselessly taken later. My heart goes out to her family. So tragic.

Wow literally every single person involved failed Christie. This one is really upsetting because her murder easily could have been avoided. But everything that had to go wrong did go wrong... smh. Rip
Murphy's law at its worst. I don't believe for a minute this guy wasn't completely rational at the time of the murder, he planned it he snuck the knife he didn't do it when his mother was home, he had the wearwithall to hide the knife, he waited till his mother had left, he knew he had to show Tracy's mother or whoever opened the door the knife or he wouldn't get in, and he had no trouble knowing where Christy was it wasn't like he didn't know where to find her. He was maybe schizophrenic, but even schizophrenics know right from wrong. This was not somebody who ran out of their house with a knife and just started stabbing somebody anybody, this was a planned and targeted attack on a specific person at a specific place at a specific time. And above all, it was successful.
If I was Christy's mother I would never buy this not for a minute but for their sanity I'm glad they do.
I was so hopeful (though suspicious because this IS casefile) when they pushed so hard for him to not be near her when awaiting trial.
I thought this was a good sign.
Cases like this stick with me forever. To think her final moments were pain and pure terror and all because everyone in her life failed her. Life isn’t fair, it’s cruel and unrelenting. Cherish every moment you have with your friends and family.

To totally avoid the problem of suspects behind bars for serious violent crimes being granted, for whatever reason, bail they should be one law that applies in every province or state. There should be no bail issued for those who
1) threatened to, or committed, a violent attack on another + who also has a serious mental illness
+/ or has a past history of committing serious violent acts, or murder, of others,
2) anyone who has requested that the court issue an order of protection against someone + that person has violated that order then bail should be revoked permanently.
These should become laws + it would protect so many innocent people, who have gone through the trauma of being attacked stalked or threatened by another, from further attacks by a suspect arrested initially + then issued bail before the court case.
This gives the suspect time to intimidate or kill the main witnesses who are set to testify against them.
The issue is false accusations. If someone falsely accuses you of x violent crime, then based on the above, no bail would be granted.
Which is unfair to the accused.
It’s very tricky. As we our innocent until proven guilty.
But in this case he admitted he did it. So IMO no bail should hand been granted.
@@mispelling Usually in a violent altercation 911 is called + based on who is injured, + the extent of the injuries, that determines who is charged + arrested.
If the suspect has a history of violent behavior + his version of what happened isn't supported by the evidence, but supports the victims version, then that says a lot about the defendent.

This is one of the most heartbreaking cases of injustice I have ever heard and it makes me so upset and also very angry. So many people failed Christie and her murder could have been prevented. 😢

one reality is our courts are overflowing and there isn't enough ressources/manpower for prosecuting people on time anymore. The overall effect of all this is the laws are created with any excuse to release people early. In Canada, they release violent bikers and hitmen who committed murder because the trials ''did not take place fast enough'' and they give them 2-3x time served. So people known hitmen are released after killing in 3-8 years on parole etc .
On the other hand, if they create more jail supply, people criticize ''the system'' for being a prison industrial complex and privatizing prisons for profit. You can't win really...
but also if you're worried about someone coming to your house to murder you why would you open the door to strangers/when someone you aren't expecting randomly shows up????????

Seems like criminals have more rights than victims. Chand was faking crazy, and should be in prison serving hard time! The second judge has so many excuses for granting bail instead of apologizing for making a bad call and taking some responsibility for Christie's murder. Too bad the parents couldn't sue the judge personally for endangering their daughter's safety.
Was Tracy just stupid...she could have prevented her daughter's murder just by looking out the window or peephole.
