      The nice thing is, if the guy sues and the case gets to discovery, missing evidence not turned over in discovery has to be seen in the worst light for the side that failed to produce it. Meaning, if they don't turn over the body cam footage from the stop, the jury must conclude that the missing footage would have been damning of the Tempe Police.

      No, the prosecutor didn't even go that far. They dropped it stating that it is unlikely they'll get a conviction, not that they disagreed with the stop or the person in this story was innocent. There's a clear difference between "we can't get a conviction" and "this person is innocent."

      Because in Arizona the police or prosecution or anyone involved in corruption can no longer be criminally charged after 12 months.
      The playbook there is to stall everything past statute of limitations.
      They will stall for years so they can't be held civilly liable too

    They asked for jewelry. Civil forfeiture anyone ? He was alone, so no witness for the alleged squeaking of tires. it is harrassment to hand out fines that are not justified. maybe it was apparent from the vehicle that the drivers was from out of state ? Again an easy target, because it would be harder to take care of legal affairs.

    They usually pullover rentals, specially with black/brown drivers to investigate drugs "rentals used for running drugs"
    this time it was a cop and they had to cover their backs with some bogus charges and case got kicked out, now they are delaying everything.

    This has been going on in Arizona for so long it’d make your head spin. When I was young, the excuse was “an escaped mental patient!” Sounds like fiction but I was stopped in Flagstaff as an 18 year old white girl traveling with a black guy and a white guy, all of us hippies. It was easy to stop young folks with long hair in the 1970s. Discrimination of blacks was a way of life forever and still is. Don’t pretend we’re not racist. We are.

    Exhibition of speed is a catch all charge. It's a charge that is vague. Arresting someone for this charge is ridiculous, keeping the Body camera evidence or even redacting it for the length of time they are saying is nothing but a delaying tactic.

    In 1999 NYPD falsely arrested myself and my partner. We were both NYC Correction Officers at the time and the officers knew that. Instead of doing the right thing, they decided to arrest myself for felony assault 2 and my partner of course with resisting arrest. None of this happened. After 6mos/7 court appearances, the charges were dropped. After 3yrs the departmental charges were finally dropped. No accountability back then and these kind of incidents still occur. Very sad.

They once came to my door, demanding I open T o which I refused. They were outside threatening me with every thing and I still refused to open. Turned out they had the wrong address.     There is no back log Tempe. If this out of state cop did it, Tempe would had pulled out the video and the DA would not had dropped the charges.......This is a clear example what Cops should not have Qualified Immunity.

      Immunity needs to stay in place. People have been screaming brutality and rape as long as cops have been pulling cars over. My version of Immunity has a caveat. Immunity kicks in just as soon as the Leo proves it is a legal stop . Body / dash cams and witnesses given as much if not more merit than the officers testimony. Immunity is still needed but operating at about a 75% decrease in it's over riding authority. ..... Just a thought .

If the LEO is doing his job correctly and has not violated Department SOP, Patrol Guide, Rules or Regulations, etc, yes QI should come into play. But for having no QI in the first place will prevent most of them for violating or stepping over that line. They need to pay for insurance just like any other profession (i.e. Doctors, Lawyers, Cab Drivers, Hair Stylist). Having QI has created corruption in every police department in the USA.

      There was a black undercover cop planted in a protesting crowd to report any crimes. Three white officers not knowing he was an undercover cop pulled him out of the crowd and beat the s*** out of him.. he won a civil lawsuit and got paid, but It should have never happened to him or any other.... this is America.

    My brother was a police officer in Ohio. He stopped at a bar with friends in a different county and decided to walk home after drinking beers. Two officers in that town stopped and questioned him. He told them he was an off duty officer walking home instead of drunk driving. They beat the hell out of him and put him in jail. All charges were dropped and the officers reprimanded.

      @mattheww8059 No, it's not difficult to prosecute. The feds came in, and they did an investigation. The report shows evidence of lots of crimes. Why are you patting them on the back for doing a report when they did not follow through and prosecute anyone for any one of the crimes that they uncovered? Why advocate for doing a report on any other agency when we just realized firsthand they aren't going to do anything about it anyway? They can move on from the Phoenix investigation once they start prosecuting people and putting them in jail where they belong. Otherwise, there's no point except for taking our tax dollars. I guess the second point is to rub it in her face that we are living in a police state.

    Welcome to OUR world Mr. Cop....I was pulled over for going 4 mph over the speed limit...69 mph on a 65 mph highway is what he said, at night, without another car within half a mile of me in any direction. (If we are being honest, it was a fishing expedition.) When he walked up and saw two doctors in the car, me in a black tuxedo and my wife in a beautiful dress, it was obvious it was a waste of time. He let us go and told me to slow down. Cops earn the hate one interaction at a time !

      It's been this way for decades, sadly. And it's frustrating because there are good officers who just want to do their job, and their forced to cover for bad cops and their behavior. Bad officers use that "thin blue line" bullshit to blackmail and browbeat good officers into towing that bad line. "You don't want to be seen as a traitor, so you have to reinforce that blue line."
      And it's sad that this thinking is going to get good police officers killed in the line of duty due to the paranoia and mistrust bad cops generate. Some otherwise good kid's going to freak out after getting pulled over and shoot a police officer thinking he's going to get dragged out of the car and beaten to death. Two people's lives destroyed, and the bad cops don't care.

    Im black and received this same ticket. I fought it and it was dismissed after the officer was caught lying in court and fudging documents when he wrote the wrong date on ticket. It’s only a shake down to look for cash to seize. Sorry officer, look at my gas gauge, you see my check engine light lit up like a Xmas tree. 1987 Oldsmobile. Yea it drags in the back when I come out of driveways and the tires jumó and chirp. I don’t have any money. Save yourself some time.

    I have lived in Tempe for 28 years. I have had maybe half a dozen interactions with the Tempe Police and they screwed up every single time. They can not get anything straight. From their emotional easily offended 911 operators to the cops on the street who loudly blame victims for causing crime. My neighbors (HOA) and I have long ago decided we would rather take care of problems ourselves than call the Tempe Police. Every time we called TPD, things just got worse. Every single time. I can not understand how these cops went thru the Phoenix Police Regional Training Academy, like I did, and still can be such idiots. I will follow with examples.

    A few things:
    1. I used to live in Tempe in the 90's. I have NEVER driven a vehicle that would be even considered close to a sports car. Between the bricks used in the cobblestone of Mill Avenue and the railroad tracks, it is VERY easy to squeal your tires accidentally. I did it in a 1981 VW Rabbit Pickup. Diesel Rabbit with a top speed of 70-75 MPH, provided it was downhill and there was a tail wind.
    2. Asking about Jewelry? Sounds like they were sniffing for more than a criminal conviction. Don't they know that we have a law on the books (that Doug Dewsy signed into law) that makes civil asset forfeiture illegal?
    3. Place your bets now: Will the Tempe Police have that bodycam footage 14 months from now? This is a delay tactic to get the news cycle to forget about the incident. But yeah. It's going to mysteriously disappear.
    4. As for the Illinois police officer, I doubt that he didn't know "Exabition of speed" was a thing. Pretty sure Illinois has a similar law on their books. Sucks that he got caught up in Tempe PD BS for "driving while black".

      Exhibition of speed from a stand still is usually called "Improper start" (at least here in New York). IF one swerved while doing so, the operator could also be charged with reckless driving. Still, all that these would warrant are traffic violations ... NOT an arrest and impounding the vehicle. These cops really screwed themselves. And 14 months to obtain body cam footage is a far stretch of reality.

    Sounds like the DoJ has a police department to look at. All of that is inexcusable. I will never go to Tempe, just disgusting.

    Clearly he WAS targeted and discriminated against. Police officers should not be endowed with a blank check written on taxpayer pockets. They have to be held personally accountable.

      Bool Shed!! Tempe PD and every PD in America should be wholly and ONLY responsible to the voters inside that city's limits. The federal government has never made anything better. The reason the modern police department is a sucking mess is because of federal mandates for hiring. Can you spell DEI?

      No, no no. The federal government has never made things better, and they will turn it into a federal police force, answerable to the head DEI hire in Washington. The people of Tempe are the only ones that should correct their own police department.

    Try going to Flagstaff AZ. Went there once for my bday, new to the state, & ill never return. You can literally FEEL the hate radiating from most everyone. Some made noises, others stared with fire in their eyes like you did something to them while puckering their lips. Ive never felt so terrified of a stranger in my life.
    The location is indeed breathtaking & beautiful. The people there, not so much.

      I've been pulled over by the cops many times in AZ. Local and DPS never had any problems. Even cut me a break several times. However, if you start getting lippy and resisting who knows what may happen.

    I don’t know about in Arizona, but in Texas there have always been multiple meanings for “Exhibition of Speed.” It could at one time be used to issue a ticket for racing, but more often it’s used for spinning, or smoking the tires, going back at least 50 years that I know of.

    It does not take 14 months to download police cameras how is it it takes 14 months but when the police do something wrong they got the body cam within hours
