    My two Fav Atty's, Judge Gauthier who is from my hometown of Cheboygan, and Judge Middleton who I feel is the most Caring and Fair Judge Iv'e seen.

    Judge Gauthier is a good guy. He had a live stream with the Cheboygan prosecutor and one of the public defenders to talk about what their jobs are like and answer questions that people sent in. He wasn't wearing his robe and told the lawyers that since this wasn't court to call him Aaron. The defense attorney said "I'll try your hon....I mean Aaron". it was cute.

      Michigan judges don't play. They are kind and level headed, but don't disrespect them. I had a judge put my phone in jail for 3 days because it went off in court. I wanted to be mad, but I couldn't stop laughing

    Back in the '70s, my Mom worked for the Allegheny County court administrator for the civil division located in Pgh, PA. I got out of work earlier than she & I would stop in to watch hearings. Civil hearings were boring for the most part, so I'd walk over to the criminal court & watch them. There are a lot of nasty criminals out there. I didn't realize that until watching criminal trials. Most didn't make it into the newspaper or the 5pm news.

    I’ve heard you refer to Judge Gauthier before but didn’t realize it was Aaron Gauthier from Cheboygan. I remember him growing up while I was working with his mom for many years. Very nice family and he’s always been a pleasure and has grown to be a fine young man.

    The SWAT team showed up to my place the other month looking for my ex-gf (not standard practice here, but apparently she bit a first responder), had to inform them she was in jail one county over! 2021, don't we have computers for this?

      SWAT over biting a first responder? Doubt it was SWAT or a similar unit for something that trivial unless she was on parole and her officer violated her for it because that’s totally something a basic officer or officers would deal with.

      @@KirbyJ89 We don't have SWAT per se (rural living and all), but I call it that when six sheriff's deputies surround my home wearing full tactical gear, facemasks, and shields. Because she bites. I really don't care whether or not you believe my story, the cops don't consider that "trivial", nor should they.
      In CO, 1st degree assault is breaking bones, 3rd degree if she'd bitten me, 2nd degree is now reserved for LEOs and firemen and paramedics, but you don't want that on your record -- they gotta round you up, they're coming in force. Especially what with COVID nowadays.

      @@KirbyJ89 No big thing. I know a lot of places use SWAT mostly to serve warrants, where one LEO will suffice. But get a 2nd degree assault in CO, they gonna come in force and best of luck in court! Huge red flag. Especially for biting!
      Here, every LEO has "SWAT" gear in the trunk, just in case. No regular SWAT unit -- if it's warranted, all units (including forest service lol) respond and go all tactical / shotgun / AR-15 and you're lucky to be tasered. ;)

      The issue is there's 50-100 counties per state, and many have ancient computer systems and no budget. Jail status may be the Sheriff e-mails everybody a Word document every morning. There is a service, VineLink, but counties have to participate, and often don't update it in a timely manner.

    Livestreaming while driving with a suspended license. I can imagine the defendant during that court appearance would say something like: "Your Honor, I'm a good driver. Just give me a chance."

    This is circuit court, not like Middleton's district court. Stutsman in Middleton's are used to do RUclips but I think he stopped. Anyway, this is big boy court and apparently they don't fool around. To be honest, I would have put him in contempt for 3 days the first time he failed to appear. I don't have the patience these judges and police have.

    That was truly great, the comedy goes up several notches when you do live streams.
    One of the things about court proceedings I find strange is the initial statement "The people Vs" ? I'd love to know how that came about. Why not "The law Vs"? or "The constitution Vs"?. Is it a euphemism for "state law" or something ?

      Mike made an explanation a while back why he doesn't always reply so all good there.
      I have the impression the term "People vs" could be a hark back in history to the scholars who actually wrote the law so, "the law makers Vs whoever" or "The law makers challenge whoever" so it's not every person in the country or state Vs whoever it's just the law makers or the law Vs whoever. I'm probably wrong but it does beg the question: What is the context of the word "people" when used as "The people Vs" ?

    Meth-heads often can not make appointments. If I had a court date, I'd be going the day before just to make sure - for practice. I've done the same thing for job interviews. BTW, I have never had a court date and I'm in my 60s. So it looks like the opportunity is waning. This reminds me of a recurring dream I've had where I went to the wrong place for a college exam.

    I watched Judge Middleton and Debra get really upset today. It was definitely warranted. And sad. I had to go binge watch King of the Hill then saw this. I'm not a fan at all of having podcast type videos (regarding Ragical joining) and more than two people talking. Artie is fun to watch with you but more than you and one other person is too much for me. Not complaining about your content in any way. I just don't want to see you being like Schroedinger and a lot of other channels that have multiple people on at the same time. Don't be mad at me 😔. It's just my input. 💕🧔🏻‍♂️✌🏼

    In my line of business, or any for that matter, using a word like "tomorrow" to indicate when something needs to be done is USELESS. For example, your email to Arty - the first one came the same time as the second one. What if you had sent it yesterday? Tomorrow would have meant today, but since it's already today he may not have shown up for your shared stream until tomorrow. Which we all know would have been too late. Do attorneys actually do these things?

    You’re in court driving a car while suspended license and you’re on your phone while driving and the sound of the turning signal gives it a final conviction. Just go ahead and drive yourself to prison.

      @@LawTalkWithMike I saw him sentence a guy to 4-10 years on negligent homicide for a boating accident involving the death of a child. Sentencing guideline was 28-57 months. It had been years since the death - defendant pled, was 78, respected in the community, had no criminal history, and had reconciled with the dead child’s mom so even the mom asked the judge to just give probation I think.

    As a French speaker I pronounce the Judge’s name as it’s said in French speaking countries; however I defer to the Judge who knows how he wants his name pronounced. He certainly knows how to proceed with “Hammer time.”

    At least being incarcerated is a legally valid defense against failure to appear, since an inmate has no freedom of movement, it is up to the Department of Corrections(here in CT at least) to ensure inmates are brought to all court appearances.
    The issue, though(in my layman opinion), is that logic dictates that for the defendant to be incarcerated at the time of a court date, this failing to appear, he must have picked up new charge that put him in county jail after he already had a court date scheduled for a previous offense. So while a valid legal defense to FTA, it's not a good look and likely a bond violation, so still contempt.

    Mike, Arty, I'm perplexed at HOW THE FLYING F... anyone doesnt know what date they have to be in court? You get served a notice. Then one comes in the mail. Your initial reaction (of an ordinary person) might easily be that your heart rate hits the roof at the prospect of not only being a defendant, but the possibility that if you're late or dont show, police will arrest you! Maybe it's just because I'm a normal law abiding Dad who's life doesnt include court and jail as commonplace happenings. Maybe that's it. But still. Its ON PAPER! HOW IS THAT DATE AND TIME NOT FRONT AND CENTER OF ANY SANE PERSONS MIND EVERY DAY TIL THE DAY ITSELF? I call BS on this guy. He didnt get confused. He knew damned well what he was doing. Consequences dont register with some people. SMH. Am I crazy here? I hope it's not just me

      @@LawTalkWithMike the black young man Deante Jenkins (judge gauthier) is from California, he stole a car there, drove it here, took police on a high speed chase across Mackinaw Bridge where Jenkins broke through the bridge toll barrier, he was chased north towards Ridyard on I-75

    I like Judge Gauthier. Strict, but also looking out for defendants. Some other judges responses/non-responses remind me more of a drama show.
