    Pretty hard to trust people after being mistreated without any consequence to the abuser. How do we know the competence of the investigator?

    I was in similar situation. I made a complain in writing then got suspended with no pay and terminated. I suing for wrongful termination and retaliation. When they make “investigation” you have to know that they are doing a risk assessment against you vs the company. All you can do is document in writing particularly with emails and look for justice.

    I didn't get angry, but I did get upset. It was a conference call with 3-4 managers on the call. I am off work with pay. What you aren't saying is what the likely outcome will be? Are most people fired? Are people usually called back to work after an investigation? What I did is what probably most people do that work in a productivity environment. You need 10 more accounts to make quota. You stay an extra 30-60 minutes to make that quota so you won't be written up. Then, you are in trouble for being off the clock. It was never a problem until now.

    I was shocked that I'd be suspended from Chang's in November 2018. I asked what happened that had me suspended. Management told me they can't go into details as they are investigating. They did the usual, escort employees out of the building. They clocked me out on my behalf. A week later, I got a call from HR (who was a grouch, BTW) about why I was suspended. Someone came across an offensive online story wishing two people the worst. My motives were discussed, these employees were jerks to me. They had to terminate me because my story had strong language.

    Currently my job suspension case is in the ER(employee relation) stage. I didn’t do anything. A female associate filed a report that I have touched her butt at lunch break while other associates and 3 supervisors were at the presence. I didn’t recalled and felt my hand I have touched anything or any persons. No one will do this under this situation when supervisors are there. I was just eating lunch as usual. The woman associate were eating lunch with her group of friends, 6 ft on the left table away from me. Nothing happened, then she filed the report after the lunch. I know it is a mistake, and may be she planned it. I didn’t meet any investigator . Still saying under investigation for almost a month. My supervisor supported me. She is from the other team. I know I didn’t do anything. That may be is her planned setup? Should I fight it legally? Means, find a lawyer?

      Hi, I see you posted this a while ago and hope your situation has improved..if you are asked to go into a meeting with upper management, never go alone. Take a support person, try stay calm and yes, it may be a set up to try begin an exit strategy...This is very difficult to prove on her end unless there are 2 or 3 legit witnesses that aren't her friend. An update on your situation please

      Has management said anything to you as yet? The woman has an agenda for sure..I would get an independent support person to attend any meeting before you spend cash on a lawyer...lawyers can be just as out for your blood in a different way

After the lunch break, I went back to the production line (car assembly), suddenly I was called by a supervisor lead me to the HR room(the HR guy and a security was inthe room). HR guy said I was reported by a female that I have touhed her butt. I asked him: when? who? He said about an hour ago at cafeteria. Wh reported me? HR guy said: he can't tell me. That's the way they conduct the business. I have to think the possibility when I was walking and who was near me? I called out her name. The HR guy said: yes, that's her. It may be an accidental touch.may be not. Anyway., he announced: my job is suspended and will go through investigation. I was escorted out by security guy. took my badge. I had been staying at home. have no access to email and many things, hopelessly. After I keep on chasing the HR guys by using personal email. After 1.5 months, the investigation is completed and I went back to work. There is no evidence and proof. I must be framed or set up by this female associate. I am trying to get my wage back by going through EDD I have done nothing ! It is a false aligation. and they warn me cannot talk to this female, it will be treated as retaliation and I can be fired. This is bad, if any female dislike you can file a false report and I can only stay at home waiting for the investigatin? It can go through months and I lost my income?

      With my false accusations and 2 day suspension withiut pay. I proved to HR i was innocent. Well... i still didnt get back pay muchless a were sorry. Nope. Just went into a file and a few months later to be added to the next susspension and false accusations of which there is no rule or regulation broken. And once again going to see HR again.

      @@semperfi-1918 I am being accused by multiple employees of saying things I never said about superiors. One employee is manipulating other employees by giving them favors so that they favor her and would lie for her. I am currently on suspension with pay. I am calling a lawyer first thing in the morning and submitting my account via email of what happened

    Is it lawful for an employer to put someone on an investigatory paid leave for one month + without telling what the reason is ? Union could not get any information from HR either.

    hello guys? I was suspend from work during the situation HR TOLD me I will notified within 48 hours(keep in mind pass more than 48hs)I come back to work I went back to my regular routine at work...to find out I drove 40mins to get there worked for 15mins just to find out I'm still suspended ahead back home..I feel like the company wasn't following the right procures toward the investigation) the only reason why I'm in this situation because I didn't know how follow the new procures for our new mental detector, I got call in for the HR Office, I was trying to understand why is the sensor going off on me twice on my break( state law that I have to take 20min break) (lost prevention team ) "response that i look suspicious "I got angry didn't wanted explained my story because I was upset...one thing if he tells me my actions were suspicious would be different I wanna get someone professional guidance before taking with lawyer(I live in Delaware )I got terminated for not following safety safety procedure(also two security guard were standing right next to each other why this safety thing only applying to me? its tough times right now I need help I lost my appeal termination.its my first experience going through something like this thanks..

      This os generally not governed by law. employers are free to suspend for however long they want or terminate or remove the suspension and allow the employee to continue working. This is a matter of internal decision.

    If it is in your organization’s policy to notify the accused of what the allegations are, and the organization fails to do so, is this a breech in policy?

      It would potentially be company's policy violation but this alone will not form a basis for a legal case against the company. Violating internal policy is not illegal.

In terms of proving discrimination & wrongful termination, can the 'violation' (failure to notify employee of allegations, failure to explain process of investigation to employee, and failure to explain options for employee) be used in conjunction with the fact that the employer has been transparent with the 'victim' and not so with the 'accused' (which policy dictates it should be), show favoritism/discrimination based on gender/race? In addition, if it is an organization's policy to place both alleged 'victim' and 'accused' on a no contact order, but it was only the 'accused' who was placed, would the combination for all of these constitute any legal case of discrimination? Or if both parties violated the no contact order and only the 'accused' was terminated? Thank you.

      @@jogabonito13939 Absolutely. And this is a good point. Alone, this would not be sufficient to provide discrimination, but in conjunction with other and preferably more direct evidence of discrimination or retaliation, it can be used to prove a case.

    There are a lot of people that me and the FBI are going to throw in serious prison time really soon we all kmow who stole my car parts due by flying the drones. Hackers and the ppl who are involved usually get sentence to life we all know who they are according to the FBI. I also have a 9 round hip pistol. But suspended from the job due to the lack of respect and stupidity to my fellow partner and police men.

      I lost my badge, police guns, and warrant. I really need my badge and warrant again. But I usually have two fellow FBI vans following me around listening and watching everyones movements. Vans are 2/3 miles away. The plan is to get more hackers to hack so we can track them down. If the hackers stop hacking that's when the plan will fail because we cannot track them or arrest anyone anymore.

      In some cases, it's ok and even necessary, but generally being interviewed regarding the allegations against you isn't the best time to talk about your accusations against others.
