Other little details about this tape:
    - It has a record tab on it. This means that, unless the consumer breaks it off, he'll have to press Play every time he puts the tape in because it won't play automatically. It also means that somebody could record over it if desired unless the tab gets broken off.
    - It's in EP mode, which uses up less tape, but also degrades the quality.

    • @BKDBrian2
      @BKDBrian2 Год назад +8

At first I thought it was a blank tape, since there was no label on it and it had the recording tab intact. Also, the tape is actually in LP mode on a T-30 tape, not EP mode.

I have a feeling that this was a case of mistaken public domain. The 1948 Max Fleisher cartoon of the same name was in public domain at the time, and was featured on many public domain Christmas compilation tapes. I think the company heard that "Rudolph The Red Nosed Reindeer" was in the public domain, they just assumed it was the 1964 Rankin/Bass version. It's not like they could check on the internet in 1988.
Companies that put out public domain material are not always careful to check that they're issuing the correct movie, and not one with a similar name. Mill Creek had to discontinue many of their 50 movie DVD packs because one or more of the movies that they assumed was public domain turned out no to be. I have a DVD that I bought at the dollar store that has Wes Craven's "Chiller" from 1985, and Ken Russel's "Gothic" from 1986, both clearly not in the public domain, and clearly unauthorized. I think the company that issued it mistook these movies with pretty generic titles for early works that WERE in the public domain. DVD's in particular were so cheap to produce that if they did have to recall them, they would probably still make more money from the ones they sold than they'd lose from the ones they had to destroy. And many of those companies would be out of business anyway by the time anyone found out and served them with a Cease And Desist order.

If I'm not mistaken, isn't the copyright status of the Rudolph special kinda in a weird rights limbo? They didn't correctly date the copyright in the opening titles, meaning it's copyright status is up in the air. It's why Goodtimes got to make that awful unofficial "Island of Misfit Toys" sequel. Although I believe Rudolph himself is in the public domain due to him originating in the song/book which is copyrighted.

Mill Creek had a lot of movies that had dodgy copyright. I've seen a pack by them called "50 Drive-In Movie Classics" that has the Creepers version of Phenomena (1985) and a "Comedy Legends" pack had a early Seth Green film called Willy/Milly. They did re-release some of their packs with the copyrighted films replaced with PD alternatives. They also own the rights to films by Crown International Pictures, some of which came out in the 80's.

    About Trans-Atlantic Video:
They were almost exclusively a public domain distributor (one of many headquartered in New Jersey). They were known for their releases of cartoons from the Golden Age of Animation whose copyrights had lapsed into the public domain. Their tapes were duplicated by a company called ATI Mark V, LLC. In 1989, the two entities merged to become TAV/ATI… which lasted for less than a year before becoming Diamond Entertainment Corporation. They lasted well into the 2000s and started cranking out public domain stuff on DVD before being acquired by an African pharmaceutical company (not making this up). They still exist as an in-name-only unit of said company, although they have been dormant for the last 15-20 years.
Also, they did release one other non-public domain Christmas special. It was the 1977 Canadian TV special “A Cosmic Christmas”. There is a Soviet Russian cartoon by the same name which IS in the public domain, so Diamond probably got the two mixed up.

If it is a case of mistaken copyright for the Fleisher studios cartoon, OR for the film's own weird copywrite limbo... I want to know one thing: Why is The back of the tape is advertising the Rankin/Bass version of Little Drummer Boy? It clearly is that version, as it is advertising that it features Jose Ferrer in the cast. That film would 100% NOT have been in Public Domain at the time and could not have reasonably been mistaken for a public domain work. As far as I have been able to research the Rankin/Bass special is the earliest documented adaptation of the song as a film- and it was made 4 years after Rudolph. I can't find if the vhs had actually been published, if it was it seems to be considerably more rare... But it feels weird to either 1) Advertise a film that is not in your catalogue and that you didn't publish or plan to publish when the only avalible vhs version is coming from your direct competators and 2) Do it with a film that still would have not reasonably been public domain due to the copyright act of 1979 and which you know you cannot just publish.

I agree with FlopsyHamster. Strongly agree. They must of confused it with the 1948 Max Fleischer cartoon of the same name. Hence, this kerfuffle. This reminds me of a true story.
I remember I was at a children's store in Saudi Arabia with my family, when I was six. I looked around and they had more than just Disney cartoons, Warner cartoons, and other cartoons from the big Hollywood studios. Also they had animated films from other countries (e.g. anime and Sweden's PETER NO-TAIL), live-action family films (e.g. MARY POPPINS and The Muppets), as well as documentaries like National Geographic specials. Mind you, it was the 80s.
When I looked around that section of the children's store. I found out that there was the 1966 BATMAN movie as well as the live-action Spider-Man films from the late 1970s like SPIDER-MAN STRIKES BACK (1978). OK, then what's this? The original KING KONG? I was amazed and shocked. Something that monstrous, yet that awesome appear in a children's video store! It was like: One of these things is not like the others!" I didn't buy it, but a decade later, I saw the tape and it was the 1938 censor's cut that was shown when it was re-released in the 1940s and 1950s. I was 16, but I was glad I got the uncut version on my 10th birthday. Going back, the reason why this tape ended up on the children's video store in Saudi Arabia, was because the distributor, Al-Mansoor or Video Lena, confused it with the Rankin-Bass KING KONG cartoon from 1966! Also, there were a lot of cartoons that parodied or homaged it. Kids love monsters, specifically boys. Boys always got a kick out of classic heroes like the big three, Batman, Superman, and Spider-Man. There was also the contemporary action cartoons that are devoid of humor and had the theme music steal the show like HE-MAN, G.I. JOE, TRANSFORMERS, THUNDERCATS, SILVER HAWKS, and THE REAL GHOSTBUSTERS. A live-action movie, like the original KING KONG (1933) that is something.
This comes to show that in other countries, video distribution companies CAN make mistakes.

      @@KingLaneCreations oh OK
Btw it's actually pretty insane that a public domain company released a rankin bass special even when the special was already copyrighted

I have a CRT, I just don't have a VCR to connect it to. The one I have is way too big.

@KingLaneCreations that shouldn't be a problem, does the VCR have the wrong inputs?

No wrong inputs I don't think. In theory, I think I could hook it up to my CRT. I just don't have any shelf space for it.

Does your tape, by any chance, also have the background talking during the scene where Rudolph's father forces him to put on the fake nose?
