I agree 100%. If you notice other points in the same law. None of those favor veterans. They are either for lawyers or Veteran Service Organizations, which don’t really offer us much. Congress is bought and owned by these people. They are lying, if they say that this law is for veterans, it’s not. We are better off doing our own. Seems like lately all the news is bad.
I'm filing an increase for mental health and submitted a private DBQ a week ago. Today I saw that my claim finally moved to evidence gathering. I checked my email and see that the VA wants to schedule me an appointment with Optum for a DBQ. I was seconds away from doing research to see if this was a mistake on their part. Then I see this video. This is crazy. In my experience, VA medical providers do not help veterans with DBQs at all. Excellent start to the new year..
I applied for an increase on my mental health in Sep. My private doctor diagnosed me as totally disabled. I submitted an overwhelming amount of records, statements and evidence. I was scheduled for a C&P exam in Oct. My exam lasted a total of 14 minutes and it was over the phone. The doctor said I was deficient in most areas a step down from total. Yet she checked all the boxes that would should have made me total. Still waiting for the outcome but from what I gather if you have already submitted a private DB prior to this news you should still be under the old system.
This isn’t new. For as long as I can remember, if you submit anything from private sector, the VA has and will schedule to meet with THEIR agents. I dealt with this a year ago. They are not obligated to take a private sector diagnosis solely.

Actually she is great. Yes, she is a company man so to speak. But, she is willing to let me try new meds and if I have issues from another departments in the VA she will try to help resolve the issue it she can. She is not the typical VA worker.
The government needs young men to join the military to protect the nation, however the VA/Government is giving young men reason not to join. When this information is put out in the media often enough, and disabled vets talk about the VA turning its back on them, others will stop joining the military. Time to write Congress and tell them that actions that harm veterans will result in votes against every member of Congress .

I disagree with ur timeline. I grew up in LA in SoCal. Went to VA often w my father. On the LAWN of the hospital, more often than not, was tons of homeless veterans waiting for their exams etc. My uncles and father had to fight for EACH 10%....and back then APPEAL EACH denial or random decrease. My cousin was part of the lawsuit against the Chicago VA Hosiptal which was caught (video recorded) BURNING service member's medical files. I'm not sure where ur "since Thanksgiving " comes from🤣🤣🤣, when the MAJORITY of veterans have had to fight for at least a decade before they get anything above a 10% rating.
Are they going to “Black out” the 38CFR Part 4 next? The rating schedule is in there. You need the symptoms listed per rating. But yes then a private doc cannot fill out the DBQ. Eliminating the Actionable and Sufficient DBQ using non-VA provided Medical. As Clay always says, Solid Medical Evidence is all that’s needed. I always used the VA’s hired Doc CP exam to get my claims approved.
If the VA Secretary takes DBQs away, the many veterans service organizations out there will do what they did before: ardently push back until the VA makes DBQs available again. We already went through this a few years ago. If it's on RUclipsrs radar right now, then there's no doubt the service organizations are formulating a response by communicating with elected officials and other decision makers about this new policy. Considering what happened the first time around, the VA knows now how past results are indicative of future outcomes. It's up to them if they want to waste everyones time again. Let the new secretary make that mistake.
@@AlonzoDodson It's both. The VA secretary is the one who is ultimately granted the decision-making authority (i.e., by this congressional legislation) to remove public-facing DBQs. The other question becomes: who in Congress is contriving this type of legislation in the first place? I really wish RUclipsr's would focus more on exposing the elected officials who champion legislation like this. Unfortunately, the primary focus of the ones creating content will always be making the catchy headline to get vets to click on the video (e.g., "...Public DBQs Deleted.." is misleading at best; they are not deleted because anyone can still download them from the VA website). Yes, Clay and Jason (from Veterans Info Tap) are benevolent, but vets need to understand that RUclips is also their personal business (the more clicks, the longer someone watches, the better for their sustainability and profitability).

Well it was actually signed into law 12/23/2024 so anything submitted prior to that date should be good to go. However...its kind of ironic how this went into law shortly after VA OIG made one of their recommendations, to streamline the process, to stop sending vets to C&P exams when there is a complete and actionable DBQ provided with the claim. Honestly I think they're targeting the VA Claim assistance companies providing DBQs. Odd how this is going to unfold.

@@brs293 there are lawsuits happening now against claim assistance companies VACI try to have theirs dismissed. The hearing was on December 10, 2024. One of the charges were dismissed and the other one that pertain to misrepresentation will proceed my opinion every bit of this DBQ topic has to do with stopping these claim assistance companies from profiting. There’s no reason to buy a DBQ that’s what your C&P exam is for.

It wouldn't matter if they had 5 in each VA hospital. The goal of this rule is to circle the VA wagons preventing any veteran DBQ'S from being completed by private 3rd party non biased objective medical doctors that would positively benefit the veteran. This rule would only allow for VA employed or VA contracted doctors to complete a DBQ and they historically ALWAYS side against the veteran with an unfavorable opinion stating that it is less than 50% likely that the veteran's condition is linked to their service. A private doctor would be non biased and objective because the VA isn't paying their paycheck. THIS IS BAD FOR VETERANS! Especially for veterans seeking to get an increase due to a worsening condition.
This goes against the Mission act, right to choice of provider for the veteran! Where is the duty to assist? Insaine! These agencies are hired to deny veterans & have absolutely no clue what is going on with our overall healthcare in a half hour session! Insanity!
my DBQ was filled out at the time of my C&P exam by a hired vha dr ( that was virtual), if its va law now that vha providers must do it. i dont see how they can refuse like they might have refused in the past.
There needs to be a law that says every time a Veteran sees a C&P examiner and that exam gets sent to the VA, a copy if also provided to the Veteran. 100% of the time. No need for the Veteran to further ask for a copy and wait months for a FOIA to follow up. The request is inferred when the Veteran originally sought compensation. Too many bad C&P exams in my experience, riddled with errors from the RO sending the Veteran to a C&P exam for the wrong DBQ to just bad C&P examiner who didn't get the questions/answers correct.
@@jimmyjackson2361 Had to FOIA my C-file and only then did I realize 2 out of the 4 C&P exams were riddled with egregious errors. (They were so bad they even confused the VLJ at the BVA, but fortunately I had a copy of them for my appeal so I was able to speak to the errors.) You need to know that sort of stuff when you go to the BVA and are trying to say the RO got it wrong. Shouldn't have to ask for copies of everything some private contractor sent to the VA/Federal Government about YOU, the Veteran. The request should be inferred when the Veteran asked for compensation.

Every VA doctor from specialist like psychologist and everything have told me for years they cannot do dbqs or even give there medical opinions . They have always told me it was a conflict of interests.. they just said your getting seen and being treated so that's all they ever do . But that may be just my personal experience
they ALL say it, but it's not the law, and it's not even an internal "rule" , ask them to show you, they can't. It's all hearsay.. "my boss said we can't complete those".
True , My VA Primary told me on His retirement that He was prohibited from signing off on my Social Security Disablity forms. So now I have to go outside the VA find a doctor to review years worth on medical evidence. I will have to pay out the pocket in the thousands because a Doctor's time is expensive with no insurance covering the cost. In Nov of 2023 I lost the ability to walk and the VA interns said it was not a big deal only temporary. And those interns only do as they are told they want to graduate and move onto making real money that is not found at the VA hospital or clinic.
Knew this would come. Now days we have everybody on RUclips offering or claiming to be a claim service for increasing benefits if they pay this or they have connections with a medical professional/service for a DBQ or Nexus. It’s only going to get tighter and more complicated for veterans to file claims as long as these barrack lawyers exist.
This is going to heavily adversely affect the providers like Dr. sharma who is an excellent resource. Also the VA should be held liable for the DBQ it just doesn’t make sense

I needed public DBQ's to appeal 3 zero percent ratings that would have sank my medical retirement from happening. C&P examiner didn't notate pain on movement even though I expressed pain. I was lucky to find a doctor outside of the VA who served in the Army and understood how to properly fill out a DBQ.
Same here. I got lucky and got a Vietnam Vet who is now a Licensed Psyche who understood the intricacies of the VA. He did a thorough review of my records and turned it into success.
By the language, it should affect everything going forward from the passage date. But this is the VA were talking about, which has never been on the veteran's side.
Nobody will; answer definitively, but the current US Code clealry states ALL medical evidence must be considered, they will have a hurdle going against 100 year old US Code.
The VA isn’t under obligation to accept your DBQ. They could easily say they had a question about it and referred you to their own examiner. It’s a lose lose situation. It makes no sense to buy a DBQ when the VA will send you to their examiner anyway
@@Kenbot2 your correct in that, I used private DBQ's and the VA decided they would have me do a C&P exam on everything anyway. Then, they use whichever opinion most benefits the VA, meaning the one which allows them to not pay out through a higher percentage.
@@Krycius I have always viewed a personal DBQ from your doctor or one purchased from a Claim Shark was a waste of time. All the VA has to do is say they had a question on your DBQ or something wasn’t worded correctly for them and your whole DBQ was discarded then whatever questions they have for their examiner they submit those questions and get a new DBQ generated for your claim. I believe if the DBQ was from your doctor that you see on a somewhat normal basis, that is the one that should carry the most weight. The problem is a lot of these claim assistance companies will generate a DBQ for someone they’ve never seen before and submit it like it’s concrete evidence. Now most people would say the compensation and pension examiner has never seen me before. What’s the difference? The difference is that examiner has been hired by the VA whether we like it or not the VA makes the rules. We can only play by them. I have never once submitted a DBQ for any of my claims and all of my claims were approved because I had the medical evidence. Medical evidence is what writes your DBQ.
Better yet , I had the medical opinion of a Nurse Practitioner (family medicine) over ride the opinion of an MD that was board certified in that particular field. I googled the NP and they were fired from a state prison medical clinic 3 years prior and started doing C&P ACE exams for QTC
@ tell the VA that , my practicing physician wrote a nexus , an MD with over 15 years experience in his specialty. The VA requested an ACE and went with the NP’s opinion that was cut and paste , no medical literature to back up the negative opinion. My VA physician provided a DBQ as well .
As a 40 year government employee, MAY is a key word. Not worried here, everything looks great on paper but when you cut to he chase, STUFF happens.... I'm gonna get Hunter or his dad to do my next DBQ....
Member of Congress only care when it is time to get elected and thats is why I say primary every member of congress out next election cycle. Both the House and the Senate have to be cleared out.
So from my experience, I am 1 out of 3 when it comes to the actual VA when they perform the DBQ for a C&P Exam. Now my success has been with VES the contracted medical provider

There are a ton of vets that rate SMC, and are too stubborn or ignorant to file for them, losing hundreds of thousands over a life time.

There really is no such thing as poking the bear, it's actually a disservice to veterans to even use that term, that is a VBA term, it's taught to VSOs nationwide, it's not taught by accident. It is taught to champion FEAR, and prevent veterans for filing for just deserved compensation and quality of life. How is a veteran supposed to access deserved higher level of compensation commensurate with their severe disabilities or disease if they don't ... poke poke poke? Would you tell someone not to file a claim for benefits? Have you? Ya know what is better than repeating VBA propaganda? Learning the rules of the game, and moving forward with education and knowledge, confidently while helping our fellow veterans. I am literally over 1000 helped veterans to date, all for free. Not only this, but VA providers are also now refusing to fill out any sort of Nexus letter. How are we supposed to submit a claim with the Nexus letter as a supposed “requirement” but VA doctors aren’t allowed to fill them out?
When I was working phones in the benefits call center 4 years ago they were pulling this shit. I'd get a couple of calls a day asking why they got a C&P exam letter when they submitted their dbq's. If that happens, ask the agent to send a "SERVICE REQUEST" stating that you have already submitted the dbq's and provide the date they were submitted and how you submitted it. You may get a letter saying the dbq was insufficient and that's why the exam is being scheduled(most common) or the exam actually gets canceled. Be nice to them though most of the people in the call center are Veterans too, but stuck with the most assinine rules and what we can and can't say leaves their hands tied alot because they make the call center employees feel like they'll be fired every month if they talk too long or give good information but get scored down because it sounds like advice.
Wow just wow! I am sure glad I got my private DBQ done for PTSD back in 2023. Pretty sure it's what helped me get to 100% P/T. I feel sorry for the future veterans who will need this and can't get any help from their VA providers .You are so right these VA providers will not touch these things. The ones I have don't want anything to do with VA benefits. They are good providers and they take care of what I need but I think they think it's a conflict of interest or something.
It won't even affect most guys next year.. it just gives the Secretary "The Right" to deny private DBQs, because of the scammer Claims Sharks, messing it up for the rest of us, who refuse to give them out Back Pay.
When I filed for sleep apnea the VA sent me to a specialist and I had to sleep there. They hooked me up with all the gear on the head and chest and video. They wouldn't let me do it from home like before. But if you have it you still need a connection to service. Also they'll try to short you on the percentage. They gave me 30% when it should have been 50 because I need a CPAP. The Dr should recommend one or not in the write up. GL
Me too, I was just diagnosed with obstructive severe sleep apnea with 68.8 apnea as per hour from an overnight sleep study at the VA. My private physician just filled out a Nexus letter linking it to my already 70% for my back hip and knees, but it hasn’t been submitted to the VA yet since my VSO has been out for the last month. Looks like I might be in an uphill battle, but I’m not gonna give up.
The law should be that the VA providers do everything in thier power to help the vet. That includes filling out DBQ's and Nexus letters. My VA doc said no to providing a nexus letter and told me the C&P examiner would determine the nexus.
So the deck is stacked against the veteran. Neither the veteran or a private doctor can know what the criteria is. Removing the DBQs won’t prevent fraud, all it will do is add obstacles to getting claims approved.
If I go to the VA site the DBQs will not be available to download? If I can still download them then I can still take them to my private doctor and have them use it to do an examibation/record their examination results...
Yes, 100% of the time that is what they are supposed to do during your c&p exam. Ironically, there are many instances where the c&p examiners did not fill out a DBQ, or did not fill one out thoroughly and properly for the RVSR to adjudicate the claim accurately. And thus, why DBQ’s were released publicly to be filled out by your private physicians. Now it’s looking like the VA may gatekeep DBQ’s again. SMH.
THIS new law specifically? No. But you do realize, you are always at risk, until you hit 20 years, right? Defend yourself. Current Symptoms of Severity is HOW you defend yourself. You either match the Severe rating criteria, or you don't. Consider SMC, for your future claims, it's the other 2/3rds of the $$$ .

@@TheCivDivHi. I am a Vietnam vet, rated at 70% for diabetes, ED and peripheral neuropathy. Recently I have been working on a claim for Parkinson’s Disease. I filed my “intent to file” back in February 2024. I did my actual filing in June 2024 for Parkinson’s after my neurologist ran tests (MRI, CAT SCAN and DAT SCAN) and the final results were positive I have Parkinson’s Disease. I had an initial C&P exam several months ago for Parkinson’s with my VA PCP and have another C&P exam coming up on the 13th of January with the VA psychiatrist or psychologist. My neurologist also did a DBQ early in December for Parkinson’s and they sent it to the VA. MY QUESTION: where do I stand? Do I file an extension on my initial Parkinson’s because it is not completed yet and I have not gotten the results. Thank you.

Ft Harrison VA in Montana filled out most of my DBQ's. The rest I got were done at C&P exams. If they stop filling these out then call your congressmen and senators. How did this pass in the first place? Was this part of the pork?
I just got a dbq filled out from my private Dr a few months ago that I haven’t submitted yet. Is it a bad idea to still submit it with my claim that im finishing up?
I would think it couldn't hurt your claim to include it. The worst they'll do is disregard it in favor of their own at your c&p. I think they're using this law to try and crack down on claim shark companies. Your private doc should be just fine. I'm sure it helps if your intent to file date is prior to this law taking effect. I don't know for sure though so take my opinion with a grain of salt. I wish you luck with your claim!

It depends on the Secretary for sure; but I would point out in some respects this was already the case prior to the law. As I'm sure you know, initial PTSD DBQs are not public use since 38 CFR 3.304 directs that "fear-based" grants may only be completed by VA providers or their trained vendors. That's an example of where I'd anticipate this being applied. At the same time, nothing precludes someone as qualified as yourself from diagnosing PTSD in a more traditional medical record/examination format and submitting medical evidence on a Veteran's behalf. A DBQ is only required if there is not sufficient available evidence to decide the claim which most often you would still be able to provide.

You will be fine...submit your shit man, don't wait. ITF is only as valuable as the DIAGNOSIS date, otherwise without a Dx date , the ITF is just talk... The VBA can NOT pay prior to a Diagnosis date by law.

I would not even ask my VA CBOC Dr of 18 yrs . GLA VAMC would be mad. Its hard to even get Bkfld CA VSO to file a FDC claim. We will have to fight against this. Happy New Year. Right.
Will they still be available to view? I have never used a private institution to complete one, but I do use them to prepare for C&P exams. I’m thinking yes, but I’m not really sure after listening to this. The verbiage giving the secretary this much power is very concerning.

Clay this act DOES NOT eliminate private DBQs! It is saying that the VA wants to administer DBQs in a way to allow them to weigh the medical evidence equally. No fear mongering needed nor warranted.
Sounds like trying to bring everything in house, but I have a feeling it will end up like the organization that investigates itself and finds no wrong doing... Ideally since the VBA and VHA are separate, in theory this should work, however forcing in-house docs to do the DBQs will drastically increase doctors visit times. I hope they have a way to either massively increase doctors or find more efficient ways to speed it up. Also what exactly happens to pending claims from third party companies or what happens to those third party contracts now in general? If we submit a claim and are forced to see an in-house doc but the claim is for a specialty condition which the most recent appointment that can be made is 12+ months out AND they will need to do an initial consult as a specialist before doing the DBQ appointment... it honestly sounds like it could create way more burden on the current system especially for docs that are not equally compensated to their private counterparts while also dramatically extending the time for claim information can even be reviewed. At the Hampton VA med center, if I wanted a basic eye exam their soonest available time was December 25, when I checked in November of 24... None of this will lower the burden on the current system
When I go for an eye exam, when it’s over, I go to the scheduling desk and schedule my next appointment for 1 year and 1 day in the future. It’s extremely difficult to get one on short notice

I just finished reading the bill. Either you or I are misunderstanding what it says of what you highlighted. What I read is that is allowing the Secretary to withhold DBQs from the website that are NOT EASILY able to be completed by someone outside of the VA. Nowhere in the parts you highlighted on say that outside medical professionals cannot complete DBQs.

Okay but what happens when the SAME C&P examiners ALSO work for private organizations that write the DBQs\Nexus letters and submit the references indicating that they worked for these VA Contractors. Many of these C&P examiners WORK both sides.
No, this is to prevent Nurse practitioners from doing audio exams or mental health. It's targeting the DBQ mills from being able to get false symptoms counted. I had one set i reviwed where I called the DBQ mill provider and asked if the Veteran had been hit by a car since their last exam 3 months ago to explain the drastic change in symptoms. They could not explain the limitation of motion to the point of ankylosis medically, so Zero probative value assign to their DBQ and a new exam from the VA.
I’m soooo happy this happened. Watching RUclips and getting 100% was far too easy. My uncle got 100% from buying a dbq and nothings wrong with him (admittedly). These channels/forums “I’m not saying lie but…and here’s how u get a dbq” HAS to stop somehow. I wonder how they will deal with newer recruits still in? From these videos, I can reverse engineer 100% 10/10 times. My 19 year old son “just once a year say ur having nightmares and in 4 years we’ll buy a dbq and get u 100%”
Just like the other guy just said “I’m glad I’m already 100% P&T and done with this BS. Got my own DBQ,s from my own doctors and the only thing that got me to 100%P&T. The other things you must do are personal statements and buddy statements. They work!

I agree 100%. If you notice other points in the same law. None of those favor veterans. They are either for lawyers or Veteran Service Organizations, which don’t really offer us much. Congress is bought and owned by these people. They are lying, if they say that this law is for veterans, it’s not. We are better off doing our own. Seems like lately all the news is bad.

I'm filing an increase for mental health and submitted a private DBQ a week ago. Today I saw that my claim finally moved to evidence gathering. I checked my email and see that the VA wants to schedule me an appointment with Optum for a DBQ. I was seconds away from doing research to see if this was a mistake on their part. Then I see this video. This is crazy. In my experience, VA medical providers do not help veterans with DBQs at all. Excellent start to the new year..
I applied for an increase on my mental health in Sep. My private doctor diagnosed me as totally disabled. I submitted an overwhelming amount of records, statements and evidence. I was scheduled for a C&P exam in Oct. My exam lasted a total of 14 minutes and it was over the phone. The doctor said I was deficient in most areas a step down from total. Yet she checked all the boxes that would should have made me total. Still waiting for the outcome but from what I gather if you have already submitted a private DB prior to this news you should still be under the old system.
This isn’t new. For as long as I can remember, if you submit anything from private sector, the VA has and will schedule to meet with THEIR agents. I dealt with this a year ago. They are not obligated to take a private sector diagnosis solely.

Actually she is great. Yes, she is a company man so to speak. But, she is willing to let me try new meds and if I have issues from another departments in the VA she will try to help resolve the issue it she can. She is not the typical VA worker.
The government needs young men to join the military to protect the nation, however the VA/Government is giving young men reason not to join. When this information is put out in the media often enough, and disabled vets talk about the VA turning its back on them, others will stop joining the military. Time to write Congress and tell them that actions that harm veterans will result in votes against every member of Congress .

I disagree with ur timeline. I grew up in LA in SoCal. Went to VA often w my father. On the LAWN of the hospital, more often than not, was tons of homeless veterans waiting for their exams etc. My uncles and father had to fight for EACH 10%....and back then APPEAL EACH denial or random decrease. My cousin was part of the lawsuit against the Chicago VA Hosiptal which was caught (video recorded) BURNING service member's medical files.

But yes then a private doc cannot fill out the DBQ. Eliminating the Actionable and Sufficient DBQ using non-VA provided Medical.
As Clay always says, Solid Medical Evidence is all that’s needed.
I always used the VA’s hired Doc CP exam to get my claims approved.
If the VA Secretary takes DBQs away, the many veterans service organizations out there will do what they did before: ardently push back until the VA makes DBQs available again. We already went through this a few years ago. If it's on RUclipsrs radar right now, then there's no doubt the service organizations are formulating a response by communicating with elected officials and other decision makers about this new policy. Considering what happened the first time around, the VA knows now how past results are indicative of future outcomes. It's up to them if they want to waste everyones time again. Let the new secretary make that mistake.

The other question becomes: who in Congress is contriving this type of legislation in the first place? Unfortunately, the primary focus of the ones creating content will always be making the catchy headline to get vets to click on the video (e.g., "...Public DBQs Deleted.." is misleading at best; they are not deleted because anyone can still download them from the VA website). Well it was actually signed into law 12/23/2024 so anything submitted prior to that date should be good to go. However...its kind of ironic how this went into law shortly after VA OIG made one of their recommendations, to streamline the process, to stop sending vets to C&P exams when there is a complete and actionable DBQ provided with the claim. Honestly I think they're targeting the VA Claim assistance companies providing DBQs. Odd how this is going to unfold.

@@brs293 there are lawsuits happening now against claim assistance companies VACI try to have theirs dismissed. The hearing was on December 10, 2024. One of the charges were dismissed and the other one that pertain to misrepresentation will proceed my opinion every bit of this DBQ topic has to do with stopping these claim assistance companies from profiting. There’s no reason to buy a DBQ that’s what your C&P exam is for.

The goal of this rule is to circle the VA wagons preventing any veteran DBQ'S from being completed by private 3rd party non biased objective medical doctors that would positively benefit the veteran. This rule would only allow for VA employed or VA contracted doctors to complete a DBQ and they historically ALWAYS side against the veteran with an unfavorable opinion stating that it is less than 50% likely that the veteran's condition is linked to their service. A private doctor would be non biased and objective because the VA isn't paying their paycheck. THIS IS BAD FOR VETERANS! Especially for veterans seeking to get an increase due to a worsening condition.

my DBQ was filled out at the time of my C&P exam by a hired vha dr ( that was virtual), if its va law now that vha providers must do it. i dont see how they can refuse like they might have refused in the past.
Yours was a VA contractor...same same. This law addresses PRIVATE non-contracted medical opinions.
There needs to be a law that says every time a Veteran sees a C&P examiner and that exam gets sent to the VA, a copy if also provided to the Veteran. 100% of the time. No need for the Veteran to further ask for a copy and wait months for a FOIA to follow up. The request is inferred when the Veteran originally sought compensation. Too many bad C&P exams in my experience, riddled with errors from the RO sending the Veteran to a C&P exam for the wrong DBQ to just bad C&P examiner who didn't get the questions/answers correct.

@@jimmyjackson2361 Had to FOIA my C-file and only then did I realize 2 out of the 4 C&P exams were riddled with egregious errors. (They were so bad they even confused the VLJ at the BVA, but fortunately I had a copy of them for my appeal so I was able to speak to the errors.) You need to know that sort of stuff when you go to the BVA and are trying to say the RO got it wrong. Shouldn't have to ask for copies of everything some private contractor sent to the VA/Federal Government about YOU, the Veteran. The request should be inferred when the Veteran asked for compensation.

Every VA doctor from specialist like psychologist and everything have told me for years they cannot do dbqs or even give there medical opinions . They have always told me it was a conflict of interests.. they just said your getting seen and being treated so that's all they ever do . But that may be just my personal experience

True , My VA Primary told me on His retirement that He was prohibited from signing off on my Social Security Disablity forms. So now I have to go outside the VA find a doctor to review years worth on medical evidence. I will have to pay out the pocket in the thousands because a Doctor's time is expensive with no insurance covering the cost. In Nov of 2023 I lost the ability to walk and the VA interns said it was not a big deal only temporary. And those interns only do as they are told they want to graduate and move onto making real money that is not found at the VA hospital or clinic.
They can't do the DBQ, but they can add the evidence in your records to include a medical opinion.
Knew this would come. Now days we have everybody on RUclips offering or claiming to be a claim service for increasing benefits if they pay this or they have connections with a medical professional/service for a DBQ or Nexus. It’s only going to get tighter and more complicated for veterans to file claims as long as these barrack lawyers exist.
This is going to heavily adversely affect the providers like Dr. sharma who is an excellent resource. Also the VA should be held liable for the DBQ it just doesn’t make sense

What gets me is to C&P examiners act like they are for you at your examination and then you get shut down.
I needed public DBQ's to appeal 3 zero percent ratings that would have sank my medical retirement from happening. C&P examiner didn't notate pain on movement even though I expressed pain. I was lucky to find a doctor outside of the VA who served in the Army and understood how to properly fill out a DBQ.
Same here. I got lucky and got a Vietnam Vet who is now a Licensed Psyche who understood the intricacies of the VA. He did a thorough review of my records and turned it into success.
The good news is that a DBQ is not required to be submitted with your evidence to file a claim.
This is true however, in a case where you don’t have any evidence in your past service treatment records the private DBQ can be crucial to your claim.

By the language, it should affect everything going forward from the passage date. But this is the VA were talking about, which has never been on the veteran's side.
Nobody will; answer definitively, but the current US Code clealry states ALL medical evidence must be considered, they will have a hurdle going against 100 year old US Code.
The VA isn’t under obligation to accept your DBQ. They could easily say they had a question about it and referred you to their own examiner. It’s a lose lose situation. It makes no sense to buy a DBQ when the VA will send you to their examiner anyway
@@Kenbot2 your correct in that, I used private DBQ's and the VA decided they would have me do a C&P exam on everything anyway. Then, they use whichever opinion most benefits the VA, meaning the one which allows them to not pay out through a higher percentage.
@@Krycius I have always viewed a personal DBQ from your doctor or one purchased from a Claim Shark was a waste of time. All the VA has to do is say they had a question on your DBQ or something wasn’t worded correctly for them and your whole DBQ was discarded then whatever questions they have for their examiner they submit those questions and get a new DBQ generated for your claim. I believe if the DBQ was from your doctor that you see on a somewhat normal basis, that is the one that should carry the most weight. The problem is a lot of these claim assistance companies will generate a DBQ for someone they’ve never seen before and submit it like it’s concrete evidence. Now most people would say the compensation and pension examiner has never seen me before. What’s the difference? The difference is that examiner has been hired by the VA whether we like it or not the VA makes the rules. We can only play by them. I have never once submitted a DBQ for any of my claims and all of my claims were approved because I had the medical evidence. Medical evidence is what writes your DBQ.

Better yet , I had the medical opinion of a Nurse Practitioner (family medicine) over ride the opinion of an MD that was board certified in that particular field. I googled the NP and they were fired from a state prison medical clinic 3 years prior and started doing C&P ACE exams for QTC

@ tell the VA that , my practicing physician wrote a nexus , an MD with over 15 years experience in his specialty. The VA requested an ACE and went with the NP’s opinion that was cut and paste , no medical literature to back up the negative opinion. My VA physician provided a DBQ as well .

When I was working phones in the benefits call center 4 years ago they were pulling this shit. I'd get a couple of calls a day asking why they got a C&P exam letter when they submitted their dbq's.
If that happens, ask the agent to send a "SERVICE REQUEST" stating that you have already submitted the dbq's and provide the date they were submitted and how you submitted it.
You may get a letter saying the dbq was insufficient and that's why the exam is being scheduled(most common) or the exam actually gets canceled.
Be nice to them though most of the people in the call center are Veterans too, but stuck with the most assinine rules and what we can and can't say leaves their hands tied alot because they make the call center employees feel like they'll be fired every month if they talk too long or give good information but get scored down because it sounds like advice.
Wow just wow! I am sure glad I got my private DBQ done for PTSD back in 2023. Pretty sure it's what helped me get to 100% P/T. I feel sorry for the future veterans who will need this and can't get any help from their VA providers .You are so right these VA providers will not touch these things. The ones I have don't want anything to do with VA benefits. They are good providers and they take care of what I need but I think they think it's a conflict of interest or something.

Thank you. This is crazy. I have a claim I'm working on and my doctor just filed out my dbq for sleep apnea
When I filed for sleep apnea the VA sent me to a specialist and I had to sleep there. They hooked me up with all the gear on the head and chest and video. They wouldn't let me do it from home like before. But if you have it you still need a connection to service. Also they'll try to short you on the percentage. They gave me 30% when it should have been 50 because I need a CPAP. The Dr should recommend one or not in the write up. GL
Me too, I was just diagnosed with obstructive severe sleep apnea with 68.8 apnea as per hour from an overnight sleep study at the VA. My private physician just filled out a Nexus letter linking it to my already 70% for my back hip and knees, but it hasn’t been submitted to the VA yet since my VSO has been out for the last month. Looks like I might be in an uphill battle, but I’m not gonna give up.
The law should be that the VA providers do everything in thier power to help the vet. That includes filling out DBQ's and Nexus letters. My VA doc said no to providing a nexus letter and told me the C&P examiner would determine the nexus.
So they want to control everything or monopolize the ability to decide if someone gets benefits by using they own people!!!
They were leaning that way even when I put in my intent to file. A disgrace for those who served. 😢

Yes, 100% of the time that is what they are supposed to do during your c&p exam.
Ironically, there are many instances where the c&p examiners did not fill out a DBQ, or did not fill one out thoroughly and properly for the RVSR to adjudicate the claim accurately.
And thus, why DBQ’s were released publicly to be filled out by your private physicians.
Now it’s looking like the VA may gatekeep DBQ’s again. SMH.

THIS new law specifically? No. But you do realize, you are always at risk, until you hit 20 years, right? Defend yourself. Current Symptoms of Severity is HOW you defend yourself. You either match the Severe rating criteria, or you don't. Consider SMC, for your future claims, it's the other 2/3rds of the $$$ .

Huh? DBQs aren't going away. This simply gives the VA Sec power to make that happen. Providers will still be able to incorporate symptoms into medical opinions and other forms.

Recently I have been working on a claim for Parkinson’s Disease. I filed my “intent to file” back in February 2024. I did my actual filing in June 2024 for Parkinson’s after my neurologist ran tests (MRI, CAT SCAN and DAT SCAN) and the final results were positive I have Parkinson’s Disease.
I had an initial C&P exam several months ago for Parkinson’s with my VA PCP and have another C&P exam coming up on the 13th of January with the VA psychiatrist or psychologist.
My neurologist also did a DBQ early in December for Parkinson’s and they sent it to the VA.
MY QUESTION: where do I stand? Do I file an extension on my initial Parkinson’s because it is not completed yet and I have not gotten the results.

Ft Harrison VA in Montana filled out most of my DBQ's. The rest I got were done at C&P exams. If they stop filling these out then call your congressmen and senators. How did this pass in the first place? Was this part of the pork?

I just got a dbq filled out from my private Dr a few months ago that I haven’t submitted yet. Is it a bad idea to still submit it with my claim that im finishing up?
I would think it couldn't hurt your claim to include it. The worst they'll do is disregard it in favor of their own at your c&p. I think they're using this law to try and crack down on claim shark companies. Your private doc should be just fine. I'm sure it helps if your intent to file date is prior to this law taking effect. I don't know for sure though so take my opinion with a grain of salt. I wish you luck with your claim!
None have been taken down as of right now but this gives the VA Secretary the authority to do just that.

It depends on the Secretary for sure; but I would point out in some respects this was already the case prior to the law. As I'm sure you know, initial PTSD DBQs are not public use since 38 CFR 3.304 directs that "fear-based" grants may only be completed by VA providers or their trained vendors. That's an example of where I'd anticipate this being applied. At the same time, nothing precludes someone as qualified as yourself from diagnosing PTSD in a more traditional medical record/examination format and submitting medical evidence on a Veteran's behalf. A DBQ is only required if there is not sufficient available evidence to decide the claim which most often you would still be able to provide.
@@greghoenig2207 Great points and reminder. I agree completely - if it does come to that, I have a plan on how to adapt my medical opinions to include all necessary information from the DBQ in the required order. We will make it work. Thank you for your advice!

You will be fine...submit your shit man, don't wait. ITF is only as valuable as the DIAGNOSIS date, otherwise without a Dx date , the ITF is just talk... The VBA can NOT pay prior to a Diagnosis date by law.

I would not even ask my VA CBOC Dr of 18 yrs . GLA VAMC would be mad. Its hard to even get Bkfld CA VSO to file a FDC claim. We will have to fight against this. Happy New Year. Right.

@@TheCivDiv I guess we can still use the CFR’s to plan claims and plan for C&P exams. I learned about using the CFR’s from you and they have been very helpful.
I’m somewhat confused, all my DBQ’s have been done by the VA, and I’m at 90%. I guess what I’m asking is, are they no longer accepting them?
Many DBQs ARE completed by VHA , IF... your Exams for claims are done at the VHA VAMC, this is more common for older veterans.
So I assume the VA than will not send you out to contract doctors outside of the VA? If so the backlog for appointments would be overwhelming!!!

Clay this act DOES NOT eliminate private DBQs! It is saying that the VA wants to administer DBQs in a way to allow them to weigh the medical evidence equally. No fear mongering needed nor warranted.

Sounds like trying to bring everything in house, but I have a feeling it will end up like the organization that investigates itself and finds no wrong doing... Ideally since the VBA and VHA are separate, in theory this should work, however forcing in-house docs to do the DBQs will drastically increase doctors visit times. I hope they have a way to either massively increase doctors or find more efficient ways to speed it up. Also what exactly happens to pending claims from third party companies or what happens to those third party contracts now in general? If we submit a claim and are forced to see an in-house doc but the claim is for a specialty condition which the most recent appointment that can be made is 12+ months out AND they will need to do an initial consult as a specialist before doing the DBQ appointment... it honestly sounds like it could create way more burden on the current system especially for docs that are not equally compensated to their private counterparts while also dramatically extending the time for claim information can even be reviewed. At the Hampton VA med center, if I wanted a basic eye exam their soonest available time was December 25, when I checked in November of 24... None of this will lower the burden on the current system
When I go for an eye exam, when it’s over, I go to the scheduling desk and schedule my next appointment for 1 year and 1 day in the future. It’s extremely difficult to get one on short notice

It's about the VBA fighting back against VA CLAIMS SHARKS like VACI , it's less about trying to hurt legit veteran claims via private medical opinions.

Either you or I are misunderstanding what it says of what you highlighted.
What I read is that is allowing the Secretary to withhold DBQs from the website that are NOT EASILY able to be completed by someone outside of the VA. Nowhere in the parts you highlighted on say that outside medical professionals cannot complete DBQs.

Okay but what happens when the SAME C&P examiners ALSO work for private organizations that write the DBQs\Nexus letters and submit the references indicating that they worked for these VA Contractors. Many of these C&P examiners WORK both sides.
I assume it depends on whose flag they are operating under. Many nexus letter providers right now were former C&P examiners.

No, this is to prevent Nurse practitioners from doing audio exams or mental health. It's targeting the DBQ mills from being able to get false symptoms counted. I had one set i reviwed where I called the DBQ mill provider and asked if the Veteran had been hit by a car since their last exam 3 months ago to explain the drastic change in symptoms. They could not explain the limitation of motion to the point of ankylosis medically, so Zero probative value assign to their DBQ and a new exam from the VA.

I’m soooo happy this happened. Watching RUclips and getting 100% was far too easy. My uncle got 100% from buying a dbq and nothings wrong with him (admittedly). These channels/forums “I’m not saying lie but…and here’s how u get a dbq” HAS to stop somehow. I wonder how they will deal with newer recruits still in? From these videos, I can reverse engineer 100% 10/10 times. My 19 year old son “just once a year say ur having nightmares and in 4 years we’ll buy a dbq and get u 100%”
Just like the other guy just said “I’m glad I’m already 100% P&T and done with this BS. Got my own DBQ,s from my own doctors and the only thing that got me to 100%P&T. The other things you must do are personal statements and buddy statements. They work!
