    Why isn't the number #1 question to ask during a Traffic Stop is: "Officer, I have the time to be 10.23 pm is that correct?" to establish what is a reasonable amount of time to conclude the stop.

      Agreed - I’d video record, note the time of the stop, in 5 min intervals state the time and ask if I’m free to go.

      In most traffic videos I've seen, the officer refuses to tell the motorist the reason for the stop until the officer is given the driver's license, proof of insurance and registration. So, I suggest giving him all that straight away. Then when he returns after doing his date checks, ask him what the reason for the stop was, tell him you are taping the stop and how long you've been detained so far, and ask him what further is required to address the reason for the stop and how long that should take. You thereby establish a timeline for the search and what is required to complete the reason for the stop. And yes, every five minutes ask if you are free to go and if not what remains for the cop to do to complete the original purpose of his/her stoop. Unless the cop changes course and claims to have reasonable suspicion to support a possible new charge, he will come to understand he cannot continue his endless delay for a dog without undermining the any utility the dog might afford him and creating a basis for a civil rights action against him/her.

    Before law school, I covered police and later courts for a newspaper. I remember a sergeant telling me that, years before, they were SURE there was some illegal substance in a car. They took it apart, so to speak. Didn't find anything. So they planted it.

      Absolutely! They won’t hesitate to plant something just to get the arrest. They don’t care if you’re guilty or not.

      That's the scariest thing imo, it seems like there is no defense. A little shoddy 'camera work' by them to hide the planting and then it's your word against theirs about how drugs got in your car. They should have to show it being found on camera clearly for it to be considered as evidence to prevent this behavior, but fat chance. It's such an evil concept.

    I recall a case where a Police Officer was prosecuted, convicted and sentenced to prison because he was caught planting drugs in a car. Investigation showed that he had been planting drugs for years and many innocent people had been convicted and sentenced to prison as a result.

      I know a retired Cop who told me how he did that. He snickered when he was telling me that. I told him that he belonged in jail. He didn’t like that too much.

    I got pulled over for going 73 in a 70 and a dealer ring around my plate in Oklahoma. I sat there with diarrhea of the mouth and talked and talked. Told him where i came from where I was going how much money I had everything. Such a stupid idiot. I did this years ago and it was the biggest learning experience. After all that cooperation he asks to search the car and being completely innocent I said Yes. He leaves me in his car and i watch him search.
    He comes back and says Mr, $## do you smoke marijuana? I said No sir I absolutely do not. He said, well, I just found some in your car. This sent me into a panic and I said to him " I want to see it, where is it"? He says " I don't have to show you a damn thing" and I said " Yes, you do have to show me". He then grabs his pistol and screams at me to get out of his suv and put my hands on the car". I did as he said and he slammed me face first, hand cuffed into the side if the SUV and threw me in the back. He then tore my new car to pieces. He ripped the seats off of their frames, busted out both headlights and ripped the entire lining out of my trunk in my new car. Then, another officer pulls up and they are talking at my car. Then, the first cop comes back and takes me out and uncuffs me and says " I really didn't find anything, but since you wanted to question me I thought you were trying to fight me". I said " Sir, I never trued to fight you or raised my voice, I was just very concerned when you said you found weed in my car. So, where's the weed"? He looks at me for a second, then gets in my face and says " Get back in your car and get the hell out of here". This event upset me so bad I wrote the actual governor of Oklahoma and sent pictures of my destroyed car. Nothing ever came of it and they never responded to my emails.
    The point is, never consent to a search, because it's not going to make things better, it will make things worse, because you give them the opportunity to plant evidence or just simply harass you on the side of the road. Never consent. I will never consent again as long as I live.

    Was held outside of my car for 30 minutes before asked to search. Refused search and officers got his dog. I am north texas

    If they do ask you to get out of your car, make sure you roll the window back up and lock the door before you get out. I see so many people on RUclips who get out and leave the window up and the door wide open. The police now can go into your car to search which they always do as they can say in court that you were the one who left the door wide open.

      The windows should be up and door locked during the stop. Drivers side window cracked just enough to conduct the required business.

    I think you should add that people should video and audio record the interaction as it can be your own evidence and getting evidence from the government can be nearly impossible sometimes and often redacted severely when you do get it. Appreciate what you do here brother!

    I don't use drugs and I don't have any contraband in my car, and I still would never allow the police to search my car. I would also never talk to the police about anything unless I have an attorney present. Innocent people get railroaded by the police and accused of crimes they didn't commit all the time.

      My problem is that they can plant evidence during a voluntary search. They may do that to get credit for a conviction.

      Cops are not trustworthy to tell the truth. There is plenty of evidence on RUclips videos demonstrating that cops lie.

    Great advice! Especially the part about being detained only for the process of giving the ticket. How many judges are going to be available to sign a warrant in the time it takes a motorist to be reasonably detained?

      That's the cops' tough shit. There are judges on call for precisely that purpose. Either the cop(s) have probable cause or they don't. As the attorney warns, "consent" CURES ALL (for the cops), so DON'T. And record, Record, RECORD the encounter, no matter how "huffy" the officer(s) get about it, so they won't be able to LIE and claim you consented to be searched.

    The police in our small town hassled the heck out of my youngest, and they never got him on anything other than speeding. Every time, they asked if they could search his vehicle. He always said yes because he had "nothing to hide". I warned him about it because I just don't trust the cops. I hope he's paid attention.

      "You might have nothing to hide that you're aware of, but that doesn't mean the police won't give you something and then find it." Refusing voluntary searches helps mitigate that danger quite a bit.

    If a cop come up to your window yelling, "Where were you going so fast like that?" You say, "Why did you pull me over?" and the officer angrily replies I'll get to that later but first Why were you.....? You then say, "Am I being detained or am I free to go?" The officer says, "You are being detained. You are not free to go." You then say, "I am invoking my right to remain silent" or should you say "my right to not answer questions"? In the latter case you could ask questions but in the former case you said you were going to remain silent. Then, if the officer asks for permission to search, that is a question. Should you answer that question or should you just remain silent? If it is important to answer the question, its seems prudent to say, "I don't consent to searches" before invoking your right to remain silent or not answer questions. Also, in the state of Texas it seems that police can arrest you for traffic violations so someone challenging an officer like this might actually get taken to jail in handcuffs.

      ALWAYS and I mean ALWAYS VERBALLY REFUSE A CONSENT TO A SEARCH even if you've invoked your right to remain silent. Without verbally refusing a search they might argue that since you didn't refuse that gave them implied consent to search you and/or your vehicle. And it's probably a good idea to specifically say "I invoke my right to remain silent" as well. As long as you tell them you are invoking your rights they can't use that against you.

    In NJ cops use all kinds of threats and intimadation to get people to give consent to a search. One is, I can hold you here for an hour if you refuse. Another is, Im calling a judge to get a warrant. And yet another is, if you dont give us permission to search your vehicle, were going to tow it! That one happened to me in Oradell NJ.

      They may act like your friend but they’re not. Everything they say or do is just an attempt to criminalize you so they can take your freedom, make your life harder, and extort as much money as possible from you.

    If you do get pulled over for an actual traffic violation, you do have to provide them with your driver's license registration and proof of insurance. But how about if there is a passenger in the vehicle? Do they have to provide police with their identification? A police officer has to have reasonable articulate suspicion that you have done a crime, or that you are about to commit a crime before you have to ID yourself to them. Sitting in your car eating at 11:30 at night in a parking lot, that is not a crime as I see it. But the police do have a Loop hold called, suspicion of... but you should be able to beat that one in court if you are not guilty of any crime.

      Unless the circumstancs would support reasonable suspicion that the passenger may have committed a crime, (h)e need not identify himself nor be bodily searched against his will.

      I had to go through with that on the way home from a camping trip. One of the guys was a hippy type and refused to identify himself.
      We had been pulled over for speeding.
      I talked our way out of it the cop was cool becuas we all worked together.
      But yeah a passenger can louse it up for you.

    Mr Jeff, I appreciate the work that you are doing here for us all. It is important work and I am appreciative that there are those like yourself that wants to educate those like myself, that really (at one time had NO CLUE). Thanks to you and a couple of others like you spreading the word I am more intelligent as I deal with Law Enforcement now than I was in my youth. But questions remain, and I would like to ask you an off (this) topic question, that you sir may, or may not decide to address.
    .
    My question concerns audio recordings. In Tennessee I live in a 'two party consent state', I may be wrong here, but I think Texas is a 'single party consent state'. But this question still needs some clarification in my mind either way. Allow me to give a realistic, but hypothetical example, and then ask my question.
    Now that I am retired, I have spent three years rebuilding and custom building a motorcycle to tour our nation on. The wife is not as excited to go out touring as I, so I expect to spend some time alone as I go. But should some accident befall me while away, I wanted a system that could possibly give her the data needed for her to know if I made a mistake or if someone else's inattention was the cause of my misfortune. I did this, by setting up a forward and aft shooting all weather cam with audio recording system that streams to the Cloud in real time (as long as I have cell signal). It will temporarily store data locally, but only if there is insufficient, or no cellular signal. It seeks to dump all that accumulated data as soon as cell signal is reestablished. The design also will awaken to stream live events if I am away from my bike and it detects sustained near proximity motion, vibrations, or loud speech. The system will awaken to record what is happening, and then powers itself back down into sleep mode 3 minutes after that stimuli has gone. This system records audio, as well as video. In order to ensure I do not find myself afoul of any states 'consent' laws, I will have this message air brushed upon my windscreen's bottom in 1 inch lettering. 'Warning Audio around this vehicle is being recorded.'

    So now my question. Do you think that will be sufficient to keep me out of trouble in both one and two party consent states? Thank you sir for your time.

    If you, the driver, ask for a supervisor on scene, can this be used by the police to extend the stop, by claiming that a supervisor will take, say, 40 minutes to arrive?

    2:01 at that point, you need to be aware of Rodriguez v United States (the police can only detain you long enough to effectuate the reason for the stop). Holding you to wait for drug dogs violates that SCOTUS ruling.

    A reasonable amount of time? Who decides how much time is reasonable? A simple traffic stop is usually at the most 15 minutes. That is without any search. If you refuse a search and the police say okay we're going to get a dog over here and we don't have a dog available right now it's going to take him 45 minutes to get here. Is that considered a reasonable amount of time. I don't think it is. It is not the driver of the vehicles falt that they do not have a dog available or near the area. So who decides what a reasonable amount of time is? The term reasonable is open-ended, different people Define reasonable amount of time differently than other people.

      I'm not a lawyer, but everything I've read would lead me to believe that 45 minutes to wait for a drug dog would fall into the "unreasonable" category.

      any length of time outside the domain of the original stop, ie, a traffic stop, would be considered an unreasonable amount of time.🙂

    What happens if you refuse the search - have nothing incriminating in the car, none whatsoever- just out of principle you say no, yet they insist to search! Then they bring the K9 and warrant - and of course nothing comes of it? Other than just the schadenfreude feeling and big smirk - what else can one do TO them for wasting your time and putting you through stress!!??

    In Texas, do they commonly want to search at traffic stops? Is it just a general desire to search all cars?
    So the dogs always give an alert? Is it a total disregard of the constitution?

    My case is almost 4 yrs. old. Judy trial is in a month. I was arrested Marcy 2020, during a welfare (wellness) check a neighbor called in. I had been parked for an hour at my friend's upscale residential neighborhood and fell asleep for 20 min as I felt ill & was on a doctor's care. The deputy sheriff tapped on my window, I awoke & let him know I was ok, but feeling unwell. He jerked me out of the car, I did 2 DUI tests and passed & on third test I got sick all over myself. The other officers had already searched my car. I told them they COULD NOT search my car. As I was soiled they ordered me to undress there in the public street!!! and they grabbed clothes in back of my car to change into.... and found drugs in the car. This car had just been bought & the seller's left clothes & drugs in car which I didn't know.
    MY question is: Is this an illegal search & seizure and can I get it either suppressed or dismissed? Was yanked out of car as Dep Sheriff assumed I was 'high' (not isick). Really appreciated your reply as my PD has been useless in this matter. Thank you.

    ya know what mr. Hampton, i commented on a different video you made about you saying allow them consent if you have nothing to hide that you did about a year ago if the "police stopped you car? follow these steps! (2022)" and wondered why, maybe you just misspoke in it. it wasn't the drug dog video but i'm glad you made this video to clear just about all of it up, and agree to always deny consent to search anything of me and mine, warrant or not (but obviously still let them do what they are gonna do but make it clear you don't consent in all cases and deal with it later in court if it goes that far).
    would love though, to get your thoughts on my other comment, its in regards about planting evidence if that helps you find it, so if you do happen to read that comment a response would be great, if ya don't mind.

    I was pulled over by a state patrol on a night that the temperature plummeted a good 30-40 degrees and negative degrees were forecasted, it's also important to add that I live in my vehicle. I was pulled over for speeding, which was never addressed, had a fta warrant for possession, and couldn't find my proof of insurance, which I got a ticket for. I said no to consent repeatedly and then eventually it got to the point where I was told my choices were consent to a search right there or my vehicle would be impounded and searched at impound. I felt like I had no choice but to give consent. Is there anything that can be done in a situation like this?

      You can but you better revoke before we find something. Best bet is to never consent at all.
      Lastly all I need is reasonable suspicion to search. Meaning don't keep drug paraphernalia, open containers, smoke weed in your car.
      In my county when I pull you over I'm not looking to search unless you give me a reason. I have way to much to do and get mad when I have to search a car from stupidity😅

    In my state, especially my county(very small county) they always have a drug dog close and will hand signal it to “hit” on your vehicle. I’ve seen it and had it happen to me.

      Yes. "Am I free to go" this implies to the officer that you have a good understanding of your rights. They rely on citizens not knowing their rights. Sad that civics is no longer taught in school

    You should also say "i would like to be on my way..." to specify that you're not consenting to the wait... as well as the search when they extend the stop.

    Regarding the too long of time, can't the cops just lie and claim something about your behavior or that they smelled what could have been weed or some other bs to keep the stop going because now they have a separate and new reason to keep you there?

    Say they do a false hit . search my car and dont find anything. impound it and take it to a place to where they can search further . Now they plant evidence and I catch a charge and they keep my car. They just lied about everything but how do I prove it ..what gives them the right to now take ownership of my property.

    If they detain the trafic stop and at any time prolong the issue of a warning or regular ticket. So keep track of the time and st least turn on your phone to record. Then it will not be allowed.

    :Responsible time" is subjet to interpretation. The government should articulate a specific time. Such as 10 or 15 minutes to check your your info and issue a citation if in fact a traffic violation did occur.

    The bad thing about it is oh, and I have seen this happen a lot. Somebody refuses the search of their vehicle so they bring the drug dog and the drug dog does a false alert or alerts to the area where the police officer gives the dog the command to Alert to. So they're still going to search your vehicle and then at the end say it was a false alert by the dog. I have seen this happen many times. So never give permission for a search, be ready for them to bring the drug dog and be ready for the drug dog to a false alert and the police search your car anyways. That is a loophole the police have for vehicle searches. I have never seen somebody take one of these false alerts and false searches when they find nothing in the vehicle to court. How much training did the dog have, why did the dog false alert,? That dog should be taken off Patrol until he gets more extensive training! If anyone has heard of somebody doing this and winning let me know. I'd appreciate it! Thank you!

      But the drug dog has to be close by. The cops can’t wait 30 minutes to an hour for the drug dog for say a speeding ticket.

    But those guys were tormenting me last night

    I stop you for a traffic infraction. I start to do some paperwork and then got on another thing. Anyway, we spoke for an hour about tulips while the dog was on the way, and then I continued, and the dog arrived while I just finished the paperwork. There was no delaying going on because we just kept talking about tulips. LoL

    if pulled over, have a stop watch, tell officer you're on the clock and will charge him for down time at $3.95 a minute- if asked to search your car- of course you can after you give me in writing waving all charges of any and all criminal activity you might find or plant in my car- plus your still on clock at $3.95 bill that will be sent daily to city or county you work for- and file complaint to the state if not paid-

    what is "reasonable suspicion" ? I ask because I was pulled over for expired registration and when asked "is there anything in here that I should know about?" my response was "have you ever been in my car before?" he replied "no" I said "then theres not a damn thing in here that you should know about" he said "I'm going to get the drug dog get out and go stand over there" { is that a lawful order?} I said NO for your safety I'm going to stay right here. didn't have to wait the dog was already there. 3 squads 6 police and 1 dog for an expired registration. So is the dog sniff considered a search?

      In most instances, it's best if you roll up the windows completely, and lock the doors as you are exiting the "vehicle".
      It may be a good idea to acquire, a second remote control, or key to "squirrel away", so that you can leave the key/s in the ignition switch, if your car has one that you insert the key into, or somewhere else in the car if it doesn't require the key in the switch.

    I dont do drugs and dont ever plan on it. However, I will not ever consent to a police search of my vehicle. Im a uber driver and you never know when some passenger could accidently drop their stash of weed. lol Of course I always check after every uber driving shift to see if any passenger left anything.

    I have heard from a couple attorneys who say to give consent to the officer and because you have the right to stop the search at anytime you than immediately revoke consent by saying I want the search to stop and revoke my consent to search my vehicle. That way you are giving them permission and than vocally removing that permission. Not sure if this helps or not.

    Great Video, Sir. I have a question. If we permit and agree to the search, can't we revoke that consent to the search also? So, why not consent and just as soon as they start, revoke that consent. Tell them, "I changed my mind, I revoke my consent. So Stop now".
    Wouldn't that action in itself, protect us, as they can not legally continue to search, unless they go get a search warrant?

      I think that's a pretty good question. But if you're not close enough to their mic when you say " I changed my mind ... ", all they'll have on tape is that you consented to a search. You'd be screwed.

    What about the case in New Mexico where the kid and his mom got busted with a sh!tload of drugs? The officer claimed he was contracted through DHS and since he is a federal officer, he has the right to search the car including the locked luggage in the trunk.
    Is this a BS cop lie to do a search?
    Is it a real possibility?
    If so, how can you verify he is DHS, especially when driving a State vehicle?

    You should also learn to quote case law. That can strip cops of their qualified immunity. Rodriguez v US is the case law on “reasonable time for a traffic stop”
