    Car manufacturers are taking steps to comply with these provisions by working on implementing alcohol detection technology in their vehicles. Some car companies, such as Volvo and Ford, have already announced plans to include this technology in their cars by 2024. Other manufacturers are also exploring similar technologies or partnerships with companies that specialize in alcohol detection technology.
    However, the implementation of such technology raises concerns about personal privacy and data protection. Drivers have a reasonable expectation of privacy inside their vehicles, and the collection of sensitive personal data, such as video footage and location data, requires proper consent and notification.
    There will be some form of technology collecting data while a driver is in the car's interior. The interior of the car is considered a place with a reasonable expectation of privacy even under the Fourth Amendment of the U.S. Constitution. New York v. Class, 475 U.S. 106, 114-115 (1986).
    The language of the RIDE Act bill states the following: To require the Secretary of Transportation, acting through the Administrator of the National Highway Traffic Safety Administration, to prescribe a Federal motor vehicle safety standard for advanced drunk and impaired driving prevention technology, and for other purposes.
    “For other purposes” is disturbing language because it attempts to provide a wide-net of oversight. In other words, anyone who drives a car would be under the surveillance technology of the bill. But the bill states the following: Technical capability.-Any advanced drunk and impaired driving prevention technology required for new passenger motor vehicles under subsection (a) that measures blood alcohol concentration shall use the adult legal limit for blood alcohol concentration of the jurisdiction in which the passenger motor vehicle is located.
    Does that mean breathalyzers for every new car? facial scanning technology? Something else? Likely some combination of both.
    Who has access to the data collected by this system provided for in this legislation? Will the police be given access to the data without a warrant? What about insurance companies, will they be granted access to the data in order to better understand what kind of driver is being insured, or worse, will they know with what frequency your driving habits “change” which could then be interpreted as impairment?
    When it comes to “driving prevention,” are we looking at the vehicle being locked in Park while running? Or will it not run at all? Soon enough the United States federal government could force automakers to install kill switches authorities can access and use to shut down any newer vehicle.
    The kill switch, which is referred to as a safety device, must “passively monitor the performance of a driver of a motor vehicle to accurately identify whether that driver may be impaired.” What does that actually mean? It means government agencies will constantly be monitoring how you drive and measuring whether you are a threat to the public safety. But should you do something the system programming has deemed to recognize as driver impairment, your vehicle could find itself just shut off at a push of a button, which could be incredibly dangerous.
    And returning back to legal interpretations, who defines and decides what the term "impaired driving" means? Currently it isn't defined by any legislation so does that leave that open regulators of the NHTSA or the DOT? Can you imagine the extent of algorithms written because you chose to pass someone or got to close to the line separating the lanes in a moment of brief distraction?

    Mandatory breath tests should be conducted for every Congressman to be allowed into any Govt session. We have way too much legislation that must have been created by drunk lawmakers.

      Hey Trilobite, I’d like to amend your proposal. I’d add “or impaired” in addition to drunk. They surely do all kinds of drugs, LOL. They should be tested for those, too! Maybe BEFORE any alcohol testing. Well, except for Barbara Botox and Nancy Piglosi of California.

    All police, CIA, FBI, DEA, ICE and all other government officers should have mandatory breath test before reporting for duty, and then every 4 hrs while on duty. Judges should do this before taking the bench, and congress and the senate should also have mandatory breathalyzer test every 4 hrs while working.

      A Rhode Island councilman was passed out cold in this car he tried to say he had sleep apnea. Reilly told officers there were no drugs in his car, the officers said they found crack laced with fentanyl along with other drug paraphernalia while searching his car. There was also a crack pipe beside him.

    My last job had this system installed in all the vehicles. I was monitored and the car told me when I was going too fast or if I had to sudden stop. I had to deal with a camera watching me and another looking at the road. Every week I had to endure my boss laughing at me every time I swore in Klingon about the traffic. I was actually glad that they fired me because I blocked the camera. I am now happily retired and don't have to put up with that crap.

      "They" already do. If your car has any form of "connectedness", the ECM and various sensors and GPS are sending data all the time. If you have a cell phone, even a 'dumb" phone, your location is tracked, your texts can be monitored, as can your voice calls. This was happening 20 years ago...

      how much do you think its going to cost to have somthing like this installed? then every month you have to take it in for maintenance? not to mention all the hidden fees of owning one even though you are forced to?     This isn't about drunk driving, it's about government sticking their noses into the lives of the citizens. This will be used to enforce laws outside of drunk driving, and will leave citizens with no place to have privacy whatsoever. This is another step of tyranny against the citizens, and should be opposed on all fronts. ANY company that abides by this should be boycotted to the fullest extent.

      This is what I see. They are going to limit mobility and monitor what you do. The open highways are essential for a free poeple. This technology will essentially give a government agency absolute authoritarian control of free movement.

      This is about out of control lobbying (MADD). They claim to be “against drunk driving “ but have lobbied for people already convicted of drunk driving to (in lieu of having a suspended license) be required to install breathalyzers. So you are required to install it… you aren’t allowed to take a plain suspension.
      When you follow the money you see that MADD quietly invested in these companies that monitor and install these devices which they then lobbied courts to reverse their original laws requiring suspensions and force install these devices instead. They have now increased these businesses revenue by billions in a few years.

    I recall a D.A. situation where shutting down my car would have left me at the mercy of my abuser.

      That is what I was thinking. A person trying to escape a dangerous situation and not being able to get away. What if a person is out camping and has some drinks; a bear shows up? Now the car won't start.

    Only politicians should have mandatory daily breath tests and weekly drug tests . They should also have IQ tests and polygraphs regularly. They should be audited constantly. The results should be posted publically

    My car has “lane assist” in it, which almost killed me. I was able to finally disable it and it is permanently off!
    When I brought it into the dealership after the above incident, they gave me a bulletin from Mazda, stating it was a “known” problem.
    Cars do collect data on your driving. Cops need a search warrant to tap that information. My car shows the current speed limit, BUT it also picks up speed limits from the signs on the service road. At one part of I-29, where the actual speed limit is 65, my car states it is 25mph. That is why I cannot do one of the insurance company discount plug ins.

    I just saw this for the first time. Just imagine if someone is trying to get away from somebody who is trying to kill them. However, this law needs to be challenged before the US Supreme Court. Unlawful Serch and seizure. I hope the Supreme Court would squash the police state.

If you cant buy politicians then they have to answer to the voters. My guess is that you didnt support these plans and vote for Bernie Sanders. He was the only presidential candidate to want to take money out of politics and rebuke corporations and still is. This is why the media ñies about him...he wants to remove corporate control over our media so they are free to report the truth.

    It is appalling that they think our freedom is something to play with. This idea was not well thought out. Besides the disregard for our rights, mechanical things beak and malfunction. Electric "self driving" cars have taught us that software can do things that lead to accidents. If you were shaky from a large cut, loosing blood, and were trying to get to the hospital, this would not be a good idea. Imagine washing your interior windows with a window cleaner that has alcohol as an ingredient... In an emergency you would not be able to move your car. I often "straighten" the curves so my passengers are more comfortable and my lane departure alarm goes off. How would this system react? What happens when your vehicle gets old and the thing breaks? Boeing found out the hard way that software does not fix every problem, adding more complexity to an already complex machine is not smart.

    The first thing I'm thinking is that finance companies will have access to that kill switch as well. They already have systems that can be installed by lenders or dealers for high risk borrowers (mostly buy here, pay here places) but now it's going to apply to everyone.     I rented a car to drive from the south midwest.
    The car had a lane assist feature.
    Mapquest took me on a route with construction. So traffic lanes were paved on what was previous the side of roads, while construction occurred in the middle lanes.
    I was constantly fighting the lane assist as it tried to devert me back to a lane under construction.
    This stupid " lane assist software " tried to make me run over obstacles in the road.
    I am surprised, I was wasn't charged with car undercarriage ! damage.

    The really scary aspect of this law is the precedent it makes for spying on citizens in places where they have a reasonable expectation of privacy.     In Alaska, a special ferry run used to be scheduled just before the start of the legislative session each year to transport legislator's cars from the south central area of the state (Anchorage region; highest population) to Juneau (the capital). The reason for this was that many of the legislators had DWI convictions and they could not drive through Canada to Haines, the location with the shortest ferry trip to Juneau.

    Part 2 I’ve uncovered a trend in my city of local bars and restaurants that serve alcohol but not so much the big corporate chains that these establishments are 2 separate corporations. First corporation owns the properties, buildings and equipment. Second corporation owns the business name and most likely soft on hand daily inventory only. It’s my opinion this to protect them from major liability lawsuits if they over serve a customer and said customer goes out and causes an accident or inflicts body harm on somebody or property while being intoxicated. So the 1st corporation is a leasing company to the 2nd corporation. So if the worst happens the 2nd corporation declares bankruptcy closes down and just looses the soft inventory. Then the principal corporation owner just starts back up under a new corporation with the restaurant or bars name again. The big looser in this is the plaintiff in all this because at the end of all this litigation finds out their is vary little if any hard assets to recover from all this.

    I participated in a focus group over 15 years ago that tested consumer reactions to these same invasions of privacy. Insurance companies have pressed for similar data collection to prevent paying claims. Blanket laws that affect everyone to avoid improper behavior of a few should not be allowed.

      Usually stuff like this is hidden or reworded as some new invention or feature. And often people fall for it without reading the fine print. Like when those new smart thermostats cam out in early 2010’s. Of course people were stoked about controlling their air conditioning from the cellphones or pc. And had eco friendly systems in place. Of course in the fine print it mentioned that once you sign on the power company can have direct access to the thermostat and over ride any settings at anytime for what they call saving power on the grid. Now you have Biden pushing the ev cars on everyone.

    Here is an issue with the car taking over steering. My new Subaru has it and tries to take over the steering when I’m on an ice road. It’s very dangerous because it tries to basically kill me. Luckily I can turn it off. If I can’t turn it off then no more skiing for us. The new tech is not smart and it makes it unsafe like never before.

    I live in Australia - people are very used to random drug and alcohol tests at roadside, all hours of the day and night, at different places on the roads and highways. I am surprised they don't just mandate breathalyzers in every new and used vehicle. What I am opposed to is the use of roadside FST's done so often by police. I would not be opposed to these, given the amount of drunk drivers on the roads. Those should be outlawed in favor of breathalyzers and oral drug testing tests up front.

    I'm glad you made a different type of video. Strategically, it might just be your most important post so far. Lots of great comments below - some suggest making Congress, cops, judges... live with it themselves for a few years before it goes into affect for everyone, but I don't want to open the door to accepting such a system after authorities live w8th it for ANY period of time. Just like income tax creates jobs for tax lawyers and H&R Block drones, some creative entrepreneur will (hopefully) figure out how to spoof the system. Disabling it is sure to get you charged with a big fat fine and a felony (check the penalties for not having a tax stamp for your short-barreled rifle or DIY suppressor), but even if that happens, given the illegality, it will certainly be EXPENSIVE, like street drugs. A new underground industry is born. We're living in the real 1984/Minotity Report already. Smart phones already provide your GPS (or nearest tower) location constantly. Interesting that Biden & company were inspired by communist China. Where is Robert A. Levy when you need him? If the 'service' were strictly opt-in or an option on a new car and used car buyers had the RIGHT to opt out, I think that would be an acceptable compromise.

      The policy is outlined in section 24220, titled "Advanced Impaired Driving Technology," starting on page 1,066.
      The policy dictates that within three years, the Secretary of the Department of Transportation, through the National Highway Traffic Safety Administration, should do the following : "issue a final rule prescribing a Federal motor vehicle safety standard... that requires passenger motor vehicles manufactured after the effective date of that standard to be equipped with advanced drunk and impaired driving prevention technology."
      According to the bill, this technology should do the following:
      "Passively monitor the performance of a driver of a motor vehicle to accurately identify whether that driver may be impaired; and prevent or limit motor vehicle operation if an impairment is detected;"
      "Passively and accurately detect whether the blood alcohol concentration of a driver of a motor vehicle is equal to or greater than the blood alcohol concentration described in section 163(a) of title 23, United States Code; and prevent or limit motor vehicle operation if a blood alcohol concentration above the legal limit is detected."
      Or a combination of the two.

    What happens if a driver uses hand sanitizer or an alcohol wipe? What if you are using the vehicle off-road or where sudden collision avoidance maneuvers are required? What about driving in snow or weather related slippery conditions where automated vehicle take-over could be deadly (on a mountain road avoiding a rockslide for example)?
