    Hi Ed , I reached out to you months ago about this exact situation. I filed for Survivors Benefits over 1 year ago and I haven't received any money to date. I had an appointment scheduled with social security to find out the person that scheduled the appointment doesn't even come into the office on the day my appoitment was scheduled. I have given my original documentation to someone at my local office to make copies only to find out 5 months later those documents were never upload into the social security system. At this point I have resorted to getting my State Representative involved in assisting me. I am beyond frustrated with social security to say the least.

      Don’t ever give them your original documents if they are irreplaceable. Make copies before you go!

      That's the best way to solve an issue like that. Contact your federal politician on their website. There's usually a button that says need help with a government agency. When I ran my social security office any time we got those, those were the highest priority.

    Thank you so much for your videos. You are so helpful to others. So many on RUclips who claim to know how the SSA works and they really don't. They are usually right but then make mistakes and people believe it. Then they lose out on their benefits. Again thank you!

      Keep hearing about if u remarry before 60. Then hear if married 3 times u can collect off the highest amount. Which is it?

    Mr. ED I have never heard anything of what you just said and my husband was 39 years old and he was a veteran...they also stopped my and my son's benefit as age 16 and he did a secondary...when he graduated he went to college...I have come to realize that I might as well let this matter go...I have learned a lot...thank you for your time 😊

    Thank you Dr. Ed! After getting advice from you in one of your live Q&A sessions last fall, I applied for survivor benefits. I was divorced years ago, and I didn't realize this was an option for me. I received my first benefit payment this week. I can let my own benefit amount increase until I am 70 and then I will be getting a nice raise! 😁

      @@vickijd22 only if that surviving person was remarried after the age of 60, or if any subsequent marriage prior to age 60 has ended in death or divorce.

    Hi - would this also apply to any surviving spouse (more than one spouse) in the case where there was more than one marriage meeting the requirements? Ex, first marriage lasted over ten years and resulted in divorce, second marriage to the same person lasted beyond death. The second spouse takes survivor benefits. Can the first divorced spouse also take full survivor benefits?

    Finally! I have been confused over DRCs and now you finally made it clear! It is based on whether the spouse is alive or deceased. I wanted to answer a simple question: "To give my surviving spouse the largest survival benefit, does it do any good to go to 70, or are my survivor benefits to my spouse capped at the FRA amount at 70?" As I understand it now yes, wait till 70 if your prime concern is ensuring your spouse gets the largest amount of survivor benefit.

      @@MyGovExpert I thought even if the Spouse that dies but didn't take SS until 70 the surviving spouse can only get up the FRA of 67 of the deceased spouse .. in other words the survivor does not get the 70 amount benefit...

    Oh I knew not to give original documents thus the reason for in person appointment, to which the representative didn’t even come into the office the day he scheduled my appointment. I waited 6 months to find out the person at SS who made copies never uploaded them. It’s been another 6 months since I went to a different local SS office and they assured me they uploaded the documents. Therefore, I reached out to my Senator for help.

    So I am still working my pay is around $50,000 can I still get survivor or widow benefits? my first husband deceased and was claiming SS and my second husband deceased but was not on SS can I still claim any benefits?

    Starting this year 2024 spousel benefits are going down 1% till eventuality all you can get is 33%. If you can please explain this situation. Thank you.

    My husband recently passed away on June 1, 2024. I will be 59 in July. I'm currently receiving SSDI. Can I wait until i turn 60 next year to collect? Or does the amount increase as I get older? I'm not wanting to decrease the amount.

    Thank you for helping so many! I have a question for you with the new laws. I have been on disability for the past nine years. My husband passed away a year before I received ssd. Away a year before I receive social security disability. So I'm receiving disability and / survivor benefits? I will be turning 62 in December of 2024. Will they automatically roll me over for the same amount of money? Do I need to do anything on my part? Thank you!

    Excellent vlog episode Ed! I’m a Survivors Benefit beneficiary but still able to learn more things by watching your videos. As a Survivors beneficiary I do have question regarding getting married again. I’m past my FRA period so I’m aware I can get married without any penalty/issue with my benefits. If I do get married again and become deceased sometime in the future thereafter, will my surviving spouse be able to receive the same Survivors benefit? Even though the answer will likely be YES - the reason the question was asked was based on the fact that my own benefits was based on my deceased partner’s social security record. Personally I couldn’t qualify for any SS benefits based on my own SS history being short of the required 40 units. Of course that didn’t matter for my own sake as I was very fortunate to have been able to use my deceased wife’s SS history record to qualify for my Survivors benefit.

      No, your new spouse would not be entitled to a surviving spouse benefit because it is based on your previous spouse's work record, not yours.

    Hi Ed I have a question I was a approved for SSDI quite a while back for end stage Glaucoma I'm blind however since that time got a life threatening autoimmune disease called Dermatomyositis with Myopathy code M33.12 I was speaking with my clinic recently I informed that you know I don't even know if SSA is aware of the Autoimmune disease but the doctor said yes they are aware of all your conditions ever so often they subpoena for my records ok no they didn't use that strong of language but said it's routine they inform the SSA of all new conditions is this true or did they doctor just say that sadly my condition is very serious when applying for SSSI you know how hard it is to meet a listing both of of my diseases are listing level conditions

    Very few even get that $255 burial payment. They told me my Mother needed to have worked the last quarter. She had lung cancer and couldn’t work!? She was 3 months from turning 81. And was on SSI since 65.

      Yes, you do have to be insured for Social Security to get the lump sum death payment

      @@MyGovExpert She had Medicare A & B, And some Teachers Insurance company. Then when she got lung cancer, her home health nurse switched her to Medicaid. She was married to my Dad for 62 years at that time. And he was a 100% Disabled Veteran. I couldn’t understand how she got Medicaid, being married tona 100% Veteran.

      Hello, not sure about the Veteran's benefits. But if you're at least 60 years old and we're married to him for at least 10 years, then yes.

    I applied for SSDI and Retirement at the same time at 64.6 (my FRA is 66.6). My disability was approved but... they made the onset date one year before my FRA. So, I rec'd SSA Retirement for one year. How do they factor that when my ex passes and I am eligible for his (much higher SSA) widow benefits? I technically only took SSA one year early (the second year I was on Disability). My ex started SSA at his full FRA. He now has cancer... very unwell so, it won't be long before this becomes important to me. We were married over 10 years. I figure that since my widows FRA changes my FRA by 4 months I really only took SSA 8 months early. What do you think? Thanks!

      Anything over the annual limit will be withheld $1 for every $2 over.

    My wife recently passed at 64 three months before her 65th birthday and when she planned to claim SS benefits. I retired about 2 years prior to her passing and was receiving my pension benefits. I applied for and was awarded survivors benefit but the benefit was reduced to zero because (as it was explained to me) my pension benefit - 75%, was more than the awarded survivor benefit. That's when i was made aware of the GPO. (Government Pension Offset) The rule that says a government (federal, state or local) employee who earns a pension, and you DON'T contribute to SS...
    My issue is I've been contributing to SS while working at this same job for nearly 40 years. I never stopped contributing to SS and it was never offered to me as an option to stop. Am I missing something? I've since submitted a "reconsideration" application, but I've not heard from SS yet.

    What about both having a relatively good income. Does the lower earner only get 1/2?
    That would make sense to get divorced for both to receive the insurance amount? Am I correct?

      Yes, they only receive half if they wait until their full retirement age

    My sister's husband age 49 passed away in December. She recently applied for SSA survivor benefits and is currently receiving approximately $2500 for her and $2500 for their 6 year old. From what we understand her $2500 stops for my sister when their daughter is 16 (10 years). My niece's stops at 18.
    My question: Will my sister still be able to claim SSA survivor benefits at age 60 or 62+ as well or is she giving up that right since she is taking benefits now? Thanks for the help!

      she can't remarry before 60 to qualify she can claim@60 but has to look at the earnings limit because she won't be full retirement age

      At 51 I was awarded 71.5% forever, my husband was 53 when he passed away.
      I'm disabled and I receive SSDI with widows benefits.
      She can remarry @60 unless she's disabled then she can remarry @50

    When to switch from widower benefit to your SSA is not easy. My widower benefit is about $700 less than my own.
    Would love to see a graph on this. Like they do with SSA 62-70

      @@MyGovExpert but I gain about 5% a yr and a larger cola by waiting. Also I’m a born in 61 so I hit the donut hole. I missed the 2 big cola. Like 14.7%. With no indexing. They need to fix that!

    My young husband passed away in 2013. I went to SSS office and they told me that I can claim SSS benefit when I reach 60 even if I get remarried in future. I am also a worker and have a current husband who I married in 2018. Can I apply for SSS spousal benefits now that I am turning 62? I intend to file for my own SSS retirement on my 67 years old?

      It depends if they actually paid into Social Security. Give SSA a call and check. But probably not...

    I claimed Survivor benefits based on my wifes SSN. That is in place now. I have not claimed any benefits under my SSN since I am till under Full Retirement Age. By claiming Survivor benefits, have I effectively locked in my benefit amount, or will that continue to increase until I claim, say at 70 years old.

    So overwhelming. My wife just passed away 03/2024 and she was the bread winner. I am 49, we have three boys all under the age of 16. How in my scenario do I handle apply? (I have been unemployed for over a year due to my own health issues I am currently working on). Hoping the survivor benefits will be enough to pay the rent etc. My situation is fairly unique and any chat about math or numbers and its all greek to me. Thanks!

    Hi Dr.! I am 65 almost 66. Since a work related injury almost a y ear ago in August, I can only work part time 2 days week. I earn roughly $800.00 a month. Do I add what I get from SS and my employment for the maximum I can earn before I have an overage or do they just count what I earn only and not a total of both for the max.?

    My husband and I were living apart when he passed away
    He was still working, and was 64 when he passed in 2021
    We were married 25 years
    I know this sounds crazy, but
    He married someone else without divorcing me, I have not been able to find any divorce papers
    I am 60 and on disability since 2012
    Will that affect my application /benefits?

      If you were married for at least ten years you can draw off of him AND if second wife was married to him at least ten years BOTH of you can draw off of him..

    Thank you so much for this excellent information. Please could you answer my question. My husband's social security is approximately $2200.00 per month. Mine is $1800.00 per month. If he dies how much (ball park) should I receive? If I die how much approximately will he receive? We are in our early seventies and applied for social security when I was 64 and he was 66 years of age. With the example you gave I'm not sure how the $1000.00 was figured out.

      If he passes first, you will receive $2200. If you pass first, then he will won't receive anything. Because his benefit is higher than yours.

    Hi Ed. How do you find the time to answer all these questions?
    Mine is this..... my plan is to possibly file for survivorship benefits from my dead exwife but continue to work. I understand that if I earn to much that I can lose some or all of the benefits to a later date. Where does this repaid amount go? Would it be added to even my own account which i plan on drawing on when I turn 70? Essentially, how do I maximize working through survivorship and later my own account. Probably it is better not to work while drawing?

      If you continue working and don't receive those checks, then they add them back in there once you hit your full retirement age. So rather than having a full reduction because you filed early, it's recalculated later. That's one hundred percent automatic.

      @MyGovExpert I don't see the drawback to filing early then as I will then get the penalties back later even while working. If I wait to file on the ex's existing account... I lose all this money anyhow. To be clear... does this penalty money get factored into my own account at 70 and beyond? Or is it better to wait until I quit work to apply for a higher monthly amount.

    My spouse of 30 years was on disability and passed away at 51. I took early retirement after 28.5 years at the County I live in. I chose to get a higher amount of local government employees retirement until I’m 62, I’m 57 now, and the pension amount will reduce by my projected SSA benefit amount. I know I can draw on my husband at 60 and I can switch to mine one time. Can I keep drawing his benefits past 62 and wait until mine is more than his to switch? Will I get 100% of his at 60, 7:03 or a lesser amount? Does it make any difference he was on disability? Thank you.

      When you file early, it's almost always reduced. But you can file on his and then switch to yours when your benefit amount becomes more.

    I’m disabled 59 and receive survivors, and had 2 sons that are now of age. They where receiving as well. I’m receive it a considerable amount less than what each son got. I’ve called and they said I’m drawing maximum. If my sons drew full amount I still do not receive 71 % of what they drew. Does this sound right? I might add my spouse was not drawing SS but passed from cancer at age 53

      A surviving child receives 75%. A spouse depends on how early you file. But there's a widows cap that might get you more. Try requesting a reconsideration and ask them to evaluate the widow's cap, they call it the RIB LIM. Good luck, Ed....and sorry for the late reply.

I recently contacted SS regarding survivor benefits after watching another one of your videos. I was told I would not be entitled to survivor benefits because I would not have been living with him when he passes, which they stated is required to receive survivor benefits. Did I misunderstand what you said? Is there a way to file even if he is still currently living so I don't have to keep contacting SS to see if he has passed? Can I ask for a letter from SS confirming my request? Thank you for all your help!

      Hello, you won't be entitled to the LSDP of $255 if you don't live with him when he passes. But you will be entitled to survivor benefits if you are not currently married (or married after 60) and your benefit amount is not more than his amount. Too many new employees at SSA! Sorry!

      You can't file for survivor benefits until your ex is actually deceased. They are also not going to accept your request to notify you when he dies. That will be up to you to figure that out unless you have actually filed for Social Security benefits on your own work record. When you do that, they will ask you about previous marriages. If you provide them with the marriage certificate and divorce decree that will be entered into your file. Then when he does pass you should receive a notification from them.
      This is all assuming that you haven't remarried, or you are single again, or you remarried after the age of 60.
      You didn't mention your current age and his current age. If you are both at least 62 and you are single you are potentially eligible for a spousal benefit. Do you have your own Social Security work record?

      @@byronmill thank you! We are both receiving SS benefits according to SS. I am on my own benefit becauae it is more than one half of his benefit amount. I have not remarried. If he remarried would that effect my benefit? Considering how much misinformation I have received from SS I don't trust them notifying me when he passes. I do not have contact and he lives in another state. Is there a way to protect myself if they don't notify me when he passes from losing benefits? Can I request they confirm or deny my eligibility in writing?Would they put a letter of request in my file and send me a copy? I asked the last representative at SS multiple times about my eligibility after learning I was eligible according to what I learned from Dr Ed. She insisted I was not entitled to survivor benefits since I no longer lived with him. I hate having to call SS every 6 months to be sure I don't miss out on benefits but I will certainly do that if that is my only option. Thank you for your help.

      If your ex was to remarry it would not affect your eligibility for surviving spouse benefits in any way. Also, since you are past the age of 60 it would not affect your eligibility for surviving spouse benefits if you were to remarry. Remarriage would only affect eligibility for spousal benefits in your case, but as you described you're not eligible anyhow because your PIA is greater than 1/2 of his PIA.

    Hi Ed, I wrote to you earlier, but I'm not sure I understood you correctly when you were talking about the survivor's benefits at 82.5%. My husband was on S.S.D.I. for decades due to many severe illnesses, and he passed away about one week after my 60th birthday, and so I was able to get survivor's benefits, of course at only 71%. My question is, can I still go in and claim the cap benefit you were talking about, and get the benefits increased to 82.5% now that I am 62 and a half??? I sure hope so because I am getting less than the average amount for Social Security and can barely get through the month, especially since I live in AZ where the temperatures get up to 115 degrees, and the air conditioner is very expensive to run, even if I only cool it down to 85 degrees! Please write back to me and let me know, because I don't want to go down there to the office only to find out I can't get it. Thx.

    Hello Ed. I have a phone appointment on March 20th to set up Widow's benefits. Will it be possible to also set up an in-person appointment with SS? I just want to confirm that the amount I will get is correct. I don't want to end up with an overpayment issue. Also I have heard you can only have 2K in your bank account. What happens if I get a part-time job at some point and I go above the 2K limit even if it is just for a few days. Can I take some of the money and just put it in a savings account in order to keep my checking account below 2K. Can I divert some money to my retirement account?

      If you're on a State Medicaid program, that is what the $2k resource limit is for. Many people confuse the terms Medicaid and Medicare (which is tied to your SS benefit)

      From what I was told...no. you never get both. When you reach full retirement age you can collect the higher of the two.

    Hi Ed, my wife, same age as me, has not worked many years so we’re hoping for 150% of my benefit. Say at 67 I get 3000 and at 70 3800. And family max is 5000. If I retire at 70 do we get 1.5x3800=5700 or just 5000? Thanks!

    Hi Ed. Thank you for you YT channel. I'd like to ask a question if I may....I have been doing a lot of research for a friend in Indonesia whose husband worked for an American company and has since passed in Jan 2023. A long story short, but, a family friend of hers found out that the FBU in Manila handles 40 countires in Asia. A forrm was completed in November 2023, but to date only one phone call back from Manila and she has no idea when and how long they will take to before she will receive her benefit! To make things worse, she has no job and two daughters 15 and 21. What basically I am asking on her behalf is how can she move forward quickly to resovle this? Thank you in advance.

    Hi Ed, I am confused with your information. My dad passed away when he was 88. He got his social security and his disability around 65. My mom only gets her own social security. When she filed for survival social security benefits, they told her that hers is more. Therefore, nothing changes. She doesn't get anything out of dad. Is this correct?       If he was receiving SSI, then he might not be insured because that's the welfare program. If he was receiving SSDI, then you should be good.

    I have a question if my husband is filing for disability. Because he has really bad diabetes.
    We've been married for 24 years, but never divorced. We also have a disabled son who is 21 years old. He's been disabled since he was 3. I am not able to work because i take care of my son if he gets approved. Am I entitled to any benefits from him because of my disabled son?

      @@vickijd22 at 60 you will receive 71.5% of his PIA (his theoretical FRA benefit), not 71.5% of what he was receiving. You would be entitled to a maximum benefit of 82.5% of his PIA, but you would need to delay the start of benefits until the month that you reach the age of 62 and 8 months. Each month that you were to delay past the age of 60 will gradually increase that percentage from 71.5% until you reach the age of 62 and 8 months. Passed that date the benefit would never increase any higher.

I was denied survivor benefits being told by the SSA agent that SSA does not recognize a disabled veteran, disabled according to SSA and will have to wait until I am 60 to file.     Help me.
    I am on ssi
    I will be 62
    In December.
    My spouse is 65 in july.
    Soon......
    Been married 6 years.
    Seperated alot
    Does that matter
    We still married
    Can i get off ssi
    And get half his that turns to retirement at 65

      Once he files for benefits, you can get up to half of his full amount. He also needs to see if he has to enroll in Medicare since he's turning 65. Does he have health insurance from current work?     My husband passed away do I qualify for benefits even though I'm 59 and we were married 11 years. He started collecting at 62.

      You can start collecting survivor benefits at sixty years old

      if you were only married for 7 years you get 0 only if you have minor kids or 10 year marriage you get survivor benefits You can call SSA direct & ask them was he a Veteran? exMilitary?

    Im confused i read in 2016 the law was changed. No longer making the 10 year marriage rule for every case. Also im not finished watching your whole video.

    Is it true that you cannot have more than $2000 in your bank account or the IRS can seize it on you and take it a while from you and you cannot get it back I was told this by one of my children do not keep more than $2000 in your bank. You cannot keep it in your savings either Regards

      Not for survivors benefits from Social Security income. It's from what was paid into by deceased's employment. You may be thinking of Medicaid.

      Only limit SS Has on assets is when you collect SSI (low income not retirement benefits) with retirement benefits there no limit on savings. If you on SSI than there is a 2000 limit on savings.

      It really depends on what type of benefits you're receiving. If you're receiving welfare type benefits, then there are resource and income limits.

      75% but, there is a family max. If other people in your immediate family are also receiving benefits.

    I am from the Philippines. 72 years old, my husband died last year in the US. I applied for survivor benefits at the SSA office in US Embassy in Manila. I've never been in the US. I was told I cannot be paid because of my residence.. Can you help me how to claim the benefits due me? My husband worked for more than 25 years there and was already a pensioner. Any help would be appreciated. Thank you.

      Unfortunately, that sounds right. You have to have some type of U.S Citizenship or green card, etc..

      It depends when you called and a lot of variables, so if you haven't filed yet I would definitely file and then ask them if they are able to give you any retroactive pay.

    Cparification: you can make a million dollars a month after full retirement age and still receive SS, but you will be taxed on all but 15% of SS, right? Getting taxed on SS is a huge blow to many people. My parents always said SS wasn't taxed....Not True

    My sister is the only surviving relative of her 8 yr old grandson, she has tried everything to get his Social Security Number every door closes on her,she lives in Florida his other grandmother was getting it and someone is getting his money but not the boy what can she do please help her

    A lady at social security told me I was only entitled to 50 percent of my deceased ex spouses.
    If I was receiving social security disability off my own record and then later on, at age 57 also filed for my deceased ex spouses, how much do they reduce my benefits for collecting his early? Do they reduce it even if I’m disabled?
    No one at social security told me my benefit would be reduced for filing at age 57. And I’m find the people at social security are not very knowledgeable about social security guidelines.

    11:40 row three, disabled. I see 50 through 59; (71 1/2%). But I don’t see survivor benefits percentage for disabled persons age 60 to FRA? Thank you.

    I went to Social security office I got 3 answers.
    My husband took Early retirement. 7 years ago he passed away. For what age I will get his maximal SS ?
    One officer told me when I'm 60. But I will get less.
    One officer told me when I'm 62+half
    The Third one told me I have to wait until I'm Reach fully retirement age. 66+4 month.
    I'm very confused. Please could you help me to make right decision.
