Great Video! I Just started getting divorce spousal benefits. I never knew this even exsisted till recently. I got divorced in 1987, I was married for 10 years 8 months and have 2 adult children, one who is disabled. They told me she is eligible for benefits. Right now they are in the process of working on her case.

My ex and his lawyer tried that on the day of our divorce hearing. My attorney pointed out to the judge that we would be three weeks shy of ten years if it was decreed that day. He made special instructions in open court that our decree should not be booked and paged for another month to make sure I was able to access benefits. He was so disgusted by the end of the long drawn out process my ex and his lawyer created.

You were so lucky to have had that particular judge. Not all of them are that knowledgeable or have the integrity to act on their knowledge.
That's why I advise people to go about a year before thinking of retiring & get an estimate of what you are going to get under your own & any spouse of 10+ years. You can also set up your paperwork about 3 months ahead of final date to get all your paperwork in order, to take effect on your desired month!!

After I sent everything in, the agent told me she had to talk to my ex-husband first before it was approved. I was married for 28 years and divorced for for six years when I filed at 63. Everything I’ve read said the ex didn’t even have to know you had applied. The agent said she was having trouble getting a hold of him so I had to call him and give him the number to call her.

You have great information. I am a retired Social Worker. Knowing this information when I was working would have been helpful to my clients. Hopefully, you do inservice training to those in the helping profession .

Thanks. I just helped my ex-husband get spousal benefit. He was denied, I helped him with appeal, and it was approved. He got 'back pay" for r 6 months. The Portsmouth NH DS office was outstanding and very helpful.

I tried to get one of my divorced husband’s SS but I worked for local govt for 18 yrs so they are taking a government pension offset out of mine SS and when I tried to collect my husband, they said that I would get even less than I am now. Are they allowed to take it out of what I would get from his SS?
Yes, GPO
The GPO was done away with just this month, so it will no longer affect you. It will probably take a good while for SS to catch up and start fixing these cases. They are supposed to give back pay to Jan. 2024 and then continue forward with what you are entitled to. I went on the website last night to put in my bank account information, but it says you have to call....ugh! Wouldn't it be easier on everyone if they would let us change it online?

No, you have to be married a full 10 years to qualify for IEDS (Independently Entitled Divorced Spouse) benefits. The SSA is very strict on this particular rule.

Can social security administration recoup Benefits paid to me from January 2024- May 2024 for over payment based on my ex husband’s estimated reported income or is it based on the total annual earned income, I was told today it’s based on monthly income. So they are saying I owe 2,400, for this year and are taking it out of my check starting Oct 2024 in the amount of $96. A month until 2027.

62 years old. Married 10 years. Divorced 2 years. Collect on your own record first.
I stumbled on this video somehow, but so glad I did. I was married for 34 years, and was mandated by the ex to be a stay at home mom. I had a few short term part time jobs over the years, but probably made a total of $10,000 if that much. The ex was very controlling and abusive, and constantly told me I'd never get a penny if I left him.
I escape in 2018, and divorce was finalized in 2019. In Georgia ( last state we lived in), the maximum period for alimony was 2 years. I feel like I should have been given way more for enduring 34 years of torture. Now, I am trying to survive on SSI Disability due to numerous health problems, many of which are a result of decades of constant stress. Meanwhile, he's still making 6 figures, buying new vehicles and whatever he spends his money on. The woman he's been with since before the divorce has told him to make her a beneficiary on his will(which he NEVER had while we were married, and have 5 kids together). I'm not sure what other kind of financial "arrangements " he has with her. My oldest son has told me many times that the woman has insisted that she will be the sole recipient of all of my ex's assets and benefits. He will be 61 in November 2024. Should I go ahead and start the process now of trying to secure my benefits from him? Also, since my own benefits would be next to nothing, how is that calculated? Is there a specific formula or maximum benefit I would receive? I would like to be able to actually live somewhat more comfortably, and not still be in survival mode. I lived in survival mode as an abuse victim for 34 years. My freedom is priceless, but unfortunately, I still have bills.

Appeal the denial.
The IRS over paid my mother in a tax return one year, and she questioned it. They told her it was correct. The next year, they told her she was over paid the year before and kept her refund which covered the over payment. Th next they kept it again, she finally had to contact out Senator. He took care of it quickly.
10:21 I’m sorry but you have not been at a SSA office lately. They never answer the phone number and also if you talk to one of the regional offices they tell you that they don’t have time to answer your questions cause they can only spend 5 minutes per client.
I have been trying to survive for 2 years and have been treated so badly. When I was a young person I would have lost my job for treating elderly folks the way that I’ve seen them do at Social Security offices. I had to go out and struggle to get and keep a job cause I can’t get any more benefits than what I had before my divorce (it sure isn’t half of his benefit amount). Please don’t mislead people into thinking that anyone can live off the tiny bit that Social Security gives out. I was married 30 years and now I’m back out competing in workforce again as long as the Good Lord gives me the strength to carry on!

Hello let’s write this again sigh. Married 20 yrs, was very ill no one could figure it out until a dozen years after to which I had multiple tumors on my pituitary and they chopped it off, 3 brain surgeries later. Now I live on a pill to survive. When we were married he worked for his father was to get the business but left me high and dry . While he bought a house for a half million. I raised our three kids and worked when I could but became so sick I had to quit. Lost my sss cause it had no name until 12 yrs later. I get under a grand a month to survive it wasn’t even a couple years he got the business. Can I get it and retro? I was screwed hard had no one to help me.

If you aren't Disabled, you have to wait until you're 60, then to collect Survivor benefits.
Please tell me how you can help my mom. My father filed for a divorce in 1985. Mom was granted a partial divorce. She was married to dad over 20 years. My dad died 14 and a half years later Dec. I work for a school, and was told SS will take 2/3 of my 1/2 of my ex-husband’s SS, simply because I didn’t pay into it (I did when I worked other private sector jobs- was told I won’t get Social Security I had paid from them either). Can this be revisited by Social Security and revised ? -is there a way to get this started?
If my husband had died and I had to draw from his Social Security, they still would’ve taken 2/3. Why would any Public employee marry someone who pays into SS, knowing they’ll never receive survivor benefits?

@mlou7432 You may be in luck because that law just changed! It's called the Social Security Fairness Act and was signed into law January 4, 2025.
I don't think it's fair that a woman divorced after 30 years of marriage only gets half! If i could go back, i wouldnever get married.
My x husband worked for the uprr. It has all kinds of deep stuff to understand. I waited forever and never got married because my dad thought I was going to get all this money but we think we figured it out that since I’m divorced I can’t get the amount of money I would get if I was married still. I finally just got married and I’m going to take my money from my own working record.
I'd still try to get the ex's benefit amount. It doesn't impact his benefit amount and may increase yours.
If you're currently married, you can't collect IEDS. You must be single.
UPRR workers aren't eligible for SSR benefits. They have their own retirement system.

They're very rude too at the Rock Hill, SC SSA office.
And the Battle Creek, Michigan office is full of liars besides extremely rude.
They said they do NOT do in office appointments at all, when I requested an appointment.
While waiting for my ride home, 3 men came out of the building with papers in hand.
I was the only person in the front at the reception window and no one was in the waiting room except the guard who made a smart- mouthed comment to my request. I wanted an in office appointment so I could see what the worker was looking at on the computer screen, and be able to view my file, and know who I'm speaking to.
Another woman entered & exited while I waited for my ride. She was told the same, no in office appointments too. But she watch 2 of the 3 men come out of the building also.
@@denisewilson8367 The security guard at the Rock Hill, SC Social Security office is very rude too. I've been several times and he's been rude each time. Once I talked with a rude heavy man who acted like I was a nuisance, and another time the person attempting to help me could barely speak English.
They have been rude in Greensboro, NC too. I went during my divorce to seeif I could get disability. After hours I finally saw a lady. She only talked to me for a for a minute. She said I didn't have the required work credits in recent years, so I wouldn't qualify. I asked her what do women like me do. She said, "your husband will be your disability payment, and your attorney will make sure of it." My attorney was horrible. She was yelling at me at mediation that I had to accept the offer from my ex or come up with an additional ten thousand dollars for her just to step foot in a court room. I was crying. She had told me it wouldn't be any problem to get permanent spousal support. I signed and only got ten years. She had been paid twenty thousand that my mother gave me. She took a loan out on their house. My dad was deep into Alzheimer's. It's been a nightmare. My ex makes several hundred thousand a year. I'm trying to find an attorney to help me. We have something called change of circumstances here. I'm destitute.

When I call Social Security to get an answer on something when I’m done I hang up and call back the second time because they’re wrong so many times I was married for 10 years. I’m eight years older than my husband. He just turned 61 August 19. I turned 69 July 1, Social Security is telling me that I make more than him and they literally told me he’s got to die before I can. I’m not kidding. I don’t know what to do. I know I can’t do it until he turns 62. That’ll be next year. I know he worked up until we got a divorce and that was2010 my divorce was final. I don’t know about now thank you. I think you do a really good job. We need you.
What about a new wife? (2nd wife) if ex wife is entitled to get her ss benefit from her ex husband then what about his new wife?
You only get so much total benefits all together one will cut down another alot there not going give you any money back

Both spouses are eligible its Not one or the other
SSI ends at age 65 yrs old and then they would change you over then to a percentage of his amount if you were married the 10 yrs and his payed more than your retirement security

@@DebLindley-xg8gz SSI is for people with disabilities. My disabled son is 35 and has been on it for years. You can take your own social security as early as 62, but the age for full benefits is different depending on when you were born. It's so complicated that I think it is important to learn from an expert like Dr. Weir so you at least know what questions to ask to make decisions for your particular circumstances.

I'm 60 years old. i was married for over 25 years. Seperated 2 1/2 years. Before the divorce, I had no income. No alimony. He agrred to court pay 2k a month. I quit my job in Az for his contract job to IA. 3 uears later he filed for divorce. I had to gett a job to support my self. I'm planning to filed S.S. benifits in 2 years.. when I turn 62. If you take your or his it's quite a bit less itz around 38% of his full benefit amount I just checked this for myself.

My ex tried that in the divorce decree. In mediation I told the mediator, who was a retired judge , told me the same thing that you stated. It is Federal and divorce decrees cannot change that divorced spousal benefits.

No that's a different thing than social security spousal benefit that's a survivors benefit 2 different things but you get less if you claim both they only give you so much and not alot!!!

I have the same problem. I have been trying to get a consistent answer for several years. I was questioning if my ex has to be 62 for me to draw. He's only 59.I have gotten every imaginable answer, even "I don't know." I asked if he's trained to know these answers, he said he was, but didn't know this, and for me to just come in. I recently found out that I could have been drawing on my own, even though it's much less than his. I really could have used it. My internet and water has currently been cut off because I couldn't pay it. I have a forbearance on my home. My electricity has been cut off twice. I'm 2 payments behind on my van, and it goes on. It would be great if the folks working for SS were properly trained. I know it's a difficult job, but they could do better. I have a phone appointment this week.

You got some stuff that don't really divide your dinner plate very good that's because you got one third plus one third where I come from 2 that's called 2/3 don't forget to mention your meal ticket somewhere somewhere or another included with your dinner plate cuz you got to take the ticket and take a seat and wait to be called to see if you still qualify for your meal

I just barely had a representative tell me that my ex has to apply before I can get my ex-spousal benefits. What can I do? I was told just last year that social security requires me to apply for spousal benefits since I am on SSI. and 62 years old.
If they told you wrong like that, then ask to see a supervisor and tell them you want to file for Independently Entitled Divorced Spouse benefits and start them when you first asked last year. Take care, Ed

I have recently filed for S.S. I turned 62 five months ago. I filed because of a chronic illness that prevents my working. (Yes, I have applied for disability as well).
Question; case worker asked me to send my marriage and divorce papers from my first husband. ( married almost 15 years).
Am I correct in understanding that because I remarried ( second husband passed away after almost 6 years of marriage. And because I remarried after his passing, that disqualifies me from receiving spousal benefits from my first husband?
Just wanting to have clarity in order to plan for living expenses (regardless of disability qualification).

If you are not now currently married or you remarried after the age of 60, you might be eligible for benefits on your first husband. That is probably why they asked for the documentation. To determine that eligibility.

I was told by as that I earned too much money to get survivor benefits. I’ll be 62 in December. They said that I’ll have to wait until I get to 67. Is this accurate?.

When he turns 62 years old you can file off his but it's about 32% of his benefit amount only.
