Mayor khalid Questions Police Confiscations

  • At a May 9 Special Called Meeting, South Fulton Mayor khalid questions the South Fulton Police Department (SFPD) on its 400+ cases of confiscation of citizens' cars, money, jewelry and other property. Under Georgia's Asset Forfeiture laws, police can seize the property of anyone it suspects is involved in or an accomplice to a crime, and does not have to ever return that property - even if that person is never found guilty or is never brought to trial.
    February reporting by Atlanta's WSB-TV 2 revealed that, since its inception in 2018, South Fulton Police had never reported the property it was taking from residents to the State of Georgia as required by law. The Georgia Bureau of Investigations (GBI) is now investigating all of SFPD's asset foreiture cases. Mayor khalid is proposing that all seized assets be held in trust until a trial verdict as been rendered; and that all persons found not guilty have their items returned and that reparations be made from police funds for any income lost because of such seizures.

    Asset Forfeiture is a violation of the 4th, 5th, and 14th Amendments. This needs to be addressed by the Supreme Court immediately.

    Civil forfeiture in the state of Georgia needs to be removed from the books immediately. It's wrong it's malicious and it's not conclusive it opens the state to Federal scrutiny as well as lawsuits from victims that have committed no crimes whatsoever. It needs to end now

    It's so beautiful to hear that you're a police chief. You're at the highest position and law enforcement that someone could reach and yet you have no idea that you and your police department are breaking the laws even though You're the law enforcement and you're supposed to know and enforce the laws not break them it's just beautiful. It gives me such a warm and cuddly feeling to know that the biggest criminal organization is enforcing laws

    File a Federal RICO complaint. Go to the next meeting and initiate a citizen's arrest of all the offenders. Let the judge sort it out.

    Civil asset forfeiture needs to STOP! This doesn’t happen with just vehicles. You could be traveling down the road after selling something and have cash on you. If they cops pull you over and find out about it, it doesn’t matter what it’s for or how you got it, or what you plan to use it for, they WILL take it under civil asset forfeiture, and not even charge you with a crime. They will simply say that they think you plan on using it for drug money. No matter what. This shit needs to stop.

    This sounds like organized crime to me...seize the property, sell it and keep the money. They need to be prosecuted under the RICO statutes

      Many times the JUDGE IS IN ON THE "DEAL". It appears U R a RARE MAN who can understand something I PROVED by the decision of the TOP COURT IN New Mexico. back in 1994. Rather than send U the entire case, I will send U excerpts & I believe U will C what I proved. To me, there were many 'interesting statements' the Judges made & all agreed on. ONE statement WAS/IS, > "The law is developing." AND the law in the year of 1994 had DEVELOPED to the point that a Judge has the authority to enforce an invalid, made without authority court order via the contempt power of the court. Here is excerpt # 1.
      OPINION
      BOSSON, Judge.
      "This case presents two interesting questions. The first is whether a court exercising criminal jurisdiction and acting sua sponte may include in its sentencing order an injunction against further criminal conduct. The second is whether the injunction, even if invalid, insulates Defendant from a contempt citation for its wilful violation. We hold that the district court's injunction exceeded its authority, but we nonetheless affirm the citation for contempt."
      Excerpt # 2 "Having determined the district court lacked authority to issue its injunction, we must now decide whether that order was enforceable, nonetheless, by the court's contempt power."

    Civil asset forfeiture is unconstitutional, the fact that the government doesn’t have to prove you committed a crime in order to confiscate your property is just theft. You shouldn’t have to sue to to prove your innocent,to get your property back, they should have to prove you did smothering wrong.

    Asset forfeiture is one of the most un-American things that I can think of. I don't care if it is an il-gotten gain. Also, violates the 5th Amendment, there is no 'due process' in this activity.

    Asset forfeiture without successful prosecution should end up with removal of qualified immunity and lawsuits against the specific people involved in governmental theft.

    They should have to bring charges before seizing property and then they shouldn’t be allowed to sell it without a conviction otherwise they should have to return it to the rightful owner. This is just legal stealing. How in the world can they justify seizing property without charges and/or convictions ?

    Asset forfeiture should only be legal if it's determined by a court and after all appeals that the property was used in furtherance of a criminal enterprise.
    You can't honestly expect the average citizen to have money for private attorneys to fight on their behalf, in an effort to retrieve their property. Where's the due process in these seemingly unconstitutional laws?
    I'm sure law enforcement agencies have been victimizing and terrorizing individuals for decades, especially American Africans.
    Georgia claims to be a "constitution" state.... well maybe that's only for gun rights... The Federal Court must step in and rule against the real criminal enterprises from permanently depriving people of their property without due process.

    The Fifth Amendment says to the federal government that no one shall be "deprived of life, liberty or property without due process of law." The Fourteenth Amendment, ratified in 1868, uses the same eleven words, called the Due Process Clause, to describe a legal obligation of all states.

    And their last paychecks can go to the people to buy new vehicles and plus they can keep working somewheres else to continue to pay for the vehicles that they stolen.
    And then go to jail for about 20 years.
