Before we jump on the police here... if she was not at fault and got questioned by police, the expected reaction would be her yelling "the other driver hit me!" But instead she goes silent and refuses to talk to police. That obviously looks like a hit-and-run. Combine that with the fact that the damage is on her car's front and the other car's rear... Combine that with the fact that the damage seems a bit high for a typical car in reverse... Everything here will look at first glance like she did a hit-and-run If you were the victim of a hit-and-run, I'm sure you would want the police to come down hard on the MF that did it to you And then the husband is talking about pedantic stuff like "they never read our rights" and claiming to be arrest proof because of children. The meat of this matter is "did she do a hit-and-run?" or "is the other driver committing perjury?" Do I think she did a hit-and-run? No. They got out of their vehicles and exchanged information (though this alone might not exclude a hit-and-run). Also based on the damage it looks like the other driver is at fault. The angle of impact is almost parallel to the back of their vehicle. While it's possible to get that angle of damage if the woman turned sharply more-so than she braked (in which case it could be argued that the other car had already backed up enough to give her ample time to brake), that doesn't appear to be the case here. If you look at the photo of the damage to her vehicle, the photo is taken in the same parking lot as the photo of the other driver's car (you can tell by the lines between sections of concrete). The parking stripes are parallel/perpendicular to those lines. We see her car likely sitting in the position it was in when impact occurred. Her car is too parallel to that line in the parking lot for the damage pattern on the other vehicle to make sense if this was her fault. So this is not her fault. Is the other driver likely committing perjury in some way in his description of the accident to the police? Probably. Is the other driver a scumbag? Probably. But he could easily trick himself into believing "hey, this wasn't actually my fault and she must have been speeding or something, because why else would she not want to call the police?". He could genuinely believe he is the victim after reflecting on the matter The police want to talk to her in hopes they can figure out exactly what happened. The other driver might have told the police that she took photos right after the accident. The behavior of this family towards the police who are trying to do an investigation (especially when the evidence they could produce would EXONERATE them) is despicable and unbelievable. And they are sueing the police for 25 million? They should personally pay the police 25 thousand for wasting everyone's time There are REAL instances of police abuse on youtube like Tayvin Galanakis obviously passing a field sobriety test but getting charged with a DWI. He had to do the field test after blowing zero on a breathalyzer. But he aced the field test despite the convoluted and poorly communicated instructions given to him. The police claimed he failed the test, but he did better than a typical sober person would have done in the same situation But youtube commenters are treating these low lifers like they are the next Tayvin Galanakis. Yup, there's definitely some "inside baseball" going on here. That damage is WAY MORE than a car backing into another car. The car with all the rear bumper damage was already damaged and the driver is double dipping which could be fraud. Maybe this is the crux of the investigation. Either way, the Houston P.D. need to work on getting real criminals off the streets and not people involved in fender benders. How weak can you get?!
Qualified immunity has to go. Citizens are held responsible for their actions why should cops not be. Every cop should carry insurance like doctors need to. Then every time they loose a case over harassing (or abusing) a citizen, their premiums will go up. Those who constantly violate citizens rights could no longer afford to be cops.
They can not be held criminally liable. They are protected by qualified immunity so they can do anything they want whenever they want to whomever they want. It is very difficult and expensive to try and do anything, so most people just have to take their abuse. They courts allow cops to use the "oops, sorry" defense.
This issue is they cannot be because they're funded by taxpayer dollars. When they screw up we all pay for it. They need to carry something like a malpractice insurance imo.

I can’t believe those cops said the kids would be fine by themselves. I guarantee you if the parents had gone away overnight and someone called the cops they would have taken those kids away and put them in foster care.
Those kids could have ended up in some foster care home all split up. That would have been another ordeal to get them back. The issue was the kids immediate needs. Was there food in the house. What if they had school. Not to mention I’m sure they were terrified and confused.

This is why auditors are actually valuable. They push back on the line between what is legally acceptable and what is not for cops. And there are legal things you can do to officers, such as giving them the middle finger, swearing at them, or filming them more than 10 feet away, all ruled legal by the supreme court. Auditors put them in check and make sure they behave very carefully in their interactions with the public.

This is way Qualified Immunity needs to be removed from Police. They need to be held accountable for their actions. Camera and Audio need to be on and a Law needs to be Passed and Inforced that they remain on at all times. As well as being worn by all Law Enforcement Agencies. These lawsuits need to end in police accountability and jail the commanders that allow this type of corruption. Settling a suit and paying out with tax payer funds does not hold the department accountable at all.
We just need to eliminate qualified immunity, and make the individual officers personally liable for their conduct. The problem with these big lawsuits is that it's the city tax payers who are handed the bill, if any. So, in this case this guy isn't going to get 25 million, maybe he gets $50k. The individual cops pay zero of their own money. The department pays zero. The city is who gets the bill, and that means tax payers, home owners, business owners, anyone contributing to the city budget. They declined because of SCOTUS rulling in Thompson v Clark 596 _(2022) a interesting case. I think a lot of such cases will never be prosecuted because of this decision.
There was a warrant and there was a person impeding the officer. Both are arrestable offenses. Furthermore if your 15 year old and 13 year old are not capable of caring for a 10 year old you are failing as a parent.

THey weren't illegally jailed. The supreme court long ago ruled that you can be arrested for literally ANY offense, including parking tickets and 1 mile over the speed limit. It's stupid, abusive, and corrupt, but it's legal.

Police do not have to show you a warrant. In fact, they may have never seen a warrant and are acting on another officer's word that one exists. If so, the arrest is still legal, even if the charges are later thrown out because no warrant existed! It is assumed that so long as they have word that a warrant exists, they may continue to operate "in good faith". On the other hand, if they know that no warrant exists and conduct a warrantless arrest anyway, not only is the arrest invalid but they may face civil liability (lawsuit from the person wrongly arrested).

It will be settled for a lesser amount. Cops don't have a leg to stand on but they'll stretch it out as long as they can before settling. Meantime, they will still go after the wife as a means to intimidate. It should be two separate lawsuits.
Never talk to the police or agree to give them a statement at their station. If the police knock on your front door do not answer it and never talk to them from behind your door. Never ever assume the police are trustworthy or truthfull.
This whole ordeal is sad & unfortunate. Rachel Hall was sadly taken advantage of and scammed by the low- life who hit her. The entire story was reported in the Daily News. After hitting her, he convinced her not to call the police stating" they wouldn't come because the accident occurred on private property ". It happened at a strip mall. The low-life pretended to take responsibility for the accident. She left thinking everything was okay. He then went to a doctor, faked injuries & himself contacted the police. Putting all the blame on her.

They did have law on their side. She broke the law when she didn’t provide her information to the other driver. The charges against the husband is hard to prove but he did convince her to say nothing.

I have been in the military for over 24 years and it has always been drilled into my mind that we (military) are held to a higher standard. Do something wrong and someone (you, leadership, the unit) will be punished. Will never understand why it is different with police.

Poor people are easy prey and less trouble. But at the end of the day this police ( when they do wrong or act with malice and revenge) will suffer very little. There are exceptions of course. They are protected by law and DAs . When police lose lawsuits , they take out their guns and force others to pay for their mistakes and lawlessness. something similar happened to my mother by our local police department. This was also in Texas and occurred at a local HEB grocery store. Luckly the company had security footage that covered the parking lot. But that didn't matter much to the officer who harassed my mother over the span of a week where this one particular officer kept showing up, demanding she pay for the damages while making threats of arrest. It wasn't until the store pulled the security footage that my mom was proven innocent. No proper investigation was ever done
I would record those threats and go straight to a lawyer and then the police. That cop belongs in the criminal justice system as a defendant. It's that simple. It can be wise to arm yourself with knowledge and a camera to keep criminal cops in check.

This should go all the way up to the governors office along with the attorney general’s office. They need to eliminate qualified immunity! One thing to point out here - if someone who caused damage to YOUR car agrees to not involve police, get them to sign a statement with another witness to sign. That was obviously over $200 to the offender's rear-end, and they probably called it in later as a hit & run rear-ending.
The police union should start shouldering the bulk of these lawsuits. Most of the time the issue isn't the first time and the union just sweeps it under the rug.

This , and situations of this type involving people in positions of “public trust”, infuriate me. The police officials in charge of these law officers need to hold them accountable and, if they’ve in fact acted wrongfully, make a PUBLIC example of them to ensure the public knows they can still trust that their local law force can be trusted.

I think you underestimate the long-standing protection that police have from lawsuits. If the cops are acting within the powers that are afforded them, then they’ll easily be able to claim immunity. Furthermore for you as a victim to overcome their immunity, you have to prove that there’s already been a successful lawsuit against cops in that state, under the same exact circumstances. It’s impossible because there will never be a prior successful lawsuit, since that prior lawsuit can only be won if they based their case on a successful prior lawsuit prior to their lawsuit. It’s a fallacy.

Before we jump on the police here... if she was not at fault and got questioned by police, the expected reaction would be her yelling "the other driver hit me!" But instead she goes silent and refuses to talk to police. That obviously looks like a hit-and-run. Combine that with the fact that the damage is on her car's front and the other car's rear... Combine that with the fact that the damage seems a bit high for a typical car in reverse... Everything here will look at first glance like she did a hit-and-run
If you were the victim of a hit-and-run, I'm sure you would want the police to come down hard on the MF that did it to you
And then the husband is talking about pedantic stuff like "they never read our rights" and claiming to be arrest proof because of children. The meat of this matter is "did she do a hit-and-run?" or "is the other driver committing perjury?"
Do I think she did a hit-and-run? No. They got out of their vehicles and exchanged information (though this alone might not exclude a hit-and-run). Also based on the damage it looks like the other driver is at fault. The angle of impact is almost parallel to the back of their vehicle. While it's possible to get that angle of damage if the woman turned sharply more-so than she braked (in which case it could be argued that the other car had already backed up enough to give her ample time to brake), that doesn't appear to be the case here. If you look at the photo of the damage to her vehicle, the photo is taken in the same parking lot as the photo of the other driver's car (you can tell by the lines between sections of concrete). The parking stripes are parallel/perpendicular to those lines. We see her car likely sitting in the position it was in when impact occurred. Her car is too parallel to that line in the parking lot for the damage pattern on the other vehicle to make sense if this was her fault. So this is not her fault. Is the other driver likely committing perjury in some way in his description of the accident to the police? Probably. Is the other driver a scumbag? Probably. But he could easily trick himself into believing "hey, this wasn't actually my fault and she must have been speeding or something, because why else would she not want to call the police?". He could genuinely believe he is the victim after reflecting on the matter
The police want to talk to her in hopes they can figure out exactly what happened. The other driver might have told the police that she took photos right after the accident. The behavior of this family towards the police who are trying to do an investigation (especially when the evidence they could produce would EXONERATE them) is despicable and unbelievable. And they are sueing the police for 25 million? They should personally pay the police 25 thousand for wasting everyone's time
There are REAL instances of police abuse on youtube like Tayvin Galanakis obviously passing a field sobriety test but getting charged with a DWI. He had to do the field test after blowing zero on a breathalyzer. But he aced the field test despite the convoluted and poorly communicated instructions given to him. The police claimed he failed the test, but he did better than a typical sober person would have done in the same situation

The car with all the rear bumper damage was already damaged and the driver is double dipping which could be fraud. Maybe this is the crux of the investigation. It is very difficult and expensive to try and do anything, so most people just have to take their abuse. They courts allow cops to use the "oops, sorry" defense.

I can’t believe those cops said the kids would be fine by themselves. I guarantee you if the parents had gone away overnight and someone called the cops they would have taken those kids away and put them in foster care.
Those kids could have ended up in some foster care home all split up. That would have been another ordeal to get them back. The issue was the kids immediate needs. Was there food in the house. What if they had school. Not to mention I’m sure they were terrified and confused.

So, in this case this guy isn't going to get 25 million, maybe he gets $50k. The individual cops pay zero of their own money. The department pays zero. The city is who gets the bill, and that means tax payers, home owners, business owners, anyone contributing to the city budget.

They declined because of SCOTUS rulling in Thompson v Clark 596 _(2022) a interesting case. I think a lot of such cases will never be prosecuted because of this decision.
There was a warrant and there was a person impeding the officer. Both are arrestable offenses. Furthermore if your 15 year old and 13 year old are not capable of caring for a 10 year old you are failing as a parent.

Police do not have to show you a warrant. In fact, they may have never seen a warrant and are acting on another officer's word that one exists. If so, the arrest is still legal, even if the charges are later thrown out because no warrant existed! It is assumed that so long as they have word that a warrant exists, they may continue to operate "in good faith". On the other hand, if they know that no warrant exists and conduct a warrantless arrest anyway, not only is the arrest invalid but they may face civil liability (lawsuit from the person wrongly arrested).

This whole ordeal is sad & unfortunate. Rachel Hall was sadly taken advantage of and scammed by the low- life who hit her. The entire story was reported in the Daily News. After hitting her, he convinced her not to call the police stating" they wouldn't come because the accident occurred on private property ". It happened at a strip mall. The low-life pretended to take responsibility for the accident. She left thinking everything was okay. He then went to a doctor, faked injuries & himself contacted the police. Putting all the blame on her.
What a low life. What's his position in the community? Doctor, lawyer, cop etc etc. Sounds like he's used to being sneaky and has no qualms in lying to police & courts.

Unbelievable that a judge dismissed this lawsuit. Qualified immunity needs to be done away with. Law enforcement should be held to a higher standard, not a lower one. Police settlements also need to come from their pockets or pensions, not out of our taxes.

I have been in the military for over 24 years and it has always been drilled into my mind that we (military) are held to a higher standard. Do something wrong and someone (you, leadership, the unit) will be punished. Will never understand why it is different with police.
In the Military you receive substantial training , cops don't . Also the IQ of cops is kept below a certain value by hiring tests etc , they don't want intelligent cops on the force and from what I see they have achieved that enormously !

1. It's fishy that she didn't call cops to document the collision. Insurance always asks for a police report.
2. This news "report" doesn't bother to explain what the charge was for the man's arrest or how the arrest could be justified. So between the criminal gang police and poor reporting, it's a bad story all around.

something similar happened to my mother by our local police department. This was also in Texas and occurred at a local HEB grocery store. Luckly the company had security footage that covered the parking lot. But that didn't matter much to the officer who harassed my mother over the span of a week where this one particular officer kept showing up, demanding she pay for the damages while making threats of arrest. It wasn't until the store pulled the security footage that my mom was proven innocent. No proper investigation was ever done
I would record those threats and go straight to a lawyer and then the police. That cop belongs in the criminal justice system as a defendant. It's that simple. It can be wise to arm yourself with knowledge and a camera to keep criminal cops in check.

Charges were dropped against him and his wife and the judge dismissed the lawsuit for the arrest. They plan to appeal the lawsuit.

Having a dashcam would have helped tremendously in this case. Installed them in both my vehicles just for the extra peace of mind

One thing to point out here - if someone who caused damage to YOUR car agrees to not involve police, get them to sign a statement with another witness to sign. That was obviously over $200 to the offender's rear-end, and they probably called it in later as a hit & run rear-ending.

This , and situations of this type involving people in positions of “public trust”, infuriate me. The police officials in charge of these law officers need to hold them accountable and, if they’ve in fact acted wrongfully, make a PUBLIC example of them to ensure the public knows they can still trust that their local law force can be trusted.

I think you underestimate the long-standing protection that police have from lawsuits. If the cops are acting within the powers that are afforded them, then they’ll easily be able to claim immunity. Furthermore for you as a victim to overcome their immunity, you have to prove that there’s already been a successful lawsuit against cops in that state, under the same exact circumstances. It’s impossible because there will never be a prior successful lawsuit, since that prior lawsuit can only be won if they based their case on a successful prior lawsuit prior to their lawsuit. It’s a fallacy.
