Here's the kicker - they didn't have an arrest warrant they only had a search warrant. So they could have just knocked on the door and shown him the search warrant. This man was not a violent criminal but an actual functional member of society and they executed him.

No knock busting into a mans home at 0600 and expecting him not to wake up thinking theres a robbery is outrageous.

Bottom line. Had he gone to trial before a judge or jury of his peers, would the death penalty have been on the table as a possible outcome? No. He had no criminal history whatsoever, a respectable job , and a known daily schedule. There was no reason for a no knock warrant. The judge needs to be looked into along with the agents and the supervisor who signed off on this raid.

In this day and age, there is NO reason for no-knock raids. None. Absolutely none.
In very rare cases , involving repeated violent offenders.
Everyone involved in this raid need to be held accountable including the judge that signed the warrant, there was no reason for the raid in the first place.
Never gonna happen. The trigger man is probably still in the field. Probably will get a promotion.

Not sure the judge did much wrong here. The warrant specified that it was to be executed at daylight, but the ATF ignored that part. I don't know for certain if the warrant mentioned anything about it being a no-knock tough.

@@vinezero as others have mentioned, they could have executed the warrant in a manner that was safer for everyone involved. He had a right to a trial, but instead he was executed by the feds before that was possible.
Suspicion of running guns for a criminal organization is not grounds for violation of constitutional rights. That comes after the trial where he's found guilty.
People need to go to prison for this. Zero reason for a no knock warrant in this case. Totally excessive force and abuse of power.

A search warrant shouldn't be a death warrant.
If I'm not mistaken, the AFT said they couldn't arrest him at work because they couldn't get the key to the fence around the parking lot. Getting through a chain link fence, too hard, let's bust through a door & no knock raid a house at 6am.
Apparently it was too difficult to stop and arrest him at the gate to the parking lot, too. So many ways they could have done this better.

There was no dog shot, his wife survived, and his house wasn't burned to the ground, so I guess it's no harm no foul according to the Guestapo.
His wife was coved in his blood and brain matter and she was immediately handcuffed, placed in a car and ignored. She said she needed to go to the bathroom and she wanted a change of clothes and they refused her both requests! WHY?
ATF was afraid he was going to flush his ARs down the toilet.
As far as I understand it but local PD doesn't have to assist in their unlawful raids. They don't have to be silent on it. They don't have to pull security, or be accommodating. They even have the right to say "No, that operation is illegal and you can't do it in my county." Have some balls chiefs and sheriff's.
The ATF has no jurisdiction without accompaniment of the local enforcement agency.
I don't know where you heard that bullship, a federal agent has jurisdiction anywhere in the United states of America. Because they are Federal.
The thing is the ATFE said a agent saw him selling handguns illegally way back in 2017, they started investigating him full time started in 2018. The ATFE sent agents and CIs to make buys from him at gun shows. Since 2021 the ATFE had him under 24/7 surveillance, they had trackers on his vehicles. they complained to higher ups that they could not sit in the gated and secure parking lot at his work. But that they posted outside the entrances/ exits of parking lot. They had agents inside the airport to keep him under surveillance. So the ATFE had agents at his residence, agents folloing him when ever he drove anywhere, and agents at his work. Anytime he went to a gun show the AFTE had agents there to buy from him and to watch him, taking note of who he sold to. WHY did they need to preform a NO-KNOCK warrant at 6:30am . They could have just KNOCKED and announced their presence at 6:30am and still caught everybody off guard. They seized every firearm , every piece of ammo, an entire collection of COINS, electronics, paperwork, Money. Used to be search warrants had to specify items to be seized. The ATFE was investigating the man for years, they could have presented a list of items for search warrant. Not just any items that might be involved in a crime.
They killed him and took the Gold. Simple as that.
Imagine if they put in that much work against real criminals instead of people doing completely legal transactions.
IMO this is premeditated murder. The AFT didn't prove they need more funding. Instead, they showed us exactly why they need to be abolished.
Something else to consider with these raids. The agents put the neighbors in danger, too. You're a neighbor to this house with your wife and kids asleep, and suddenly bullets are flying next door at 6am. Who's taking accountability when someone completely innocent and uninvolved on the sidelines is negligently shot?
In this case a non violent crime, a no knock raid is unlawful, unjust and uncalled for, and now a good man is dead
Even if it were theoretically concerning a "violent crime"/criminal, it was only a SEARCH warrant. There was no warrant for his arrest.
You have to also remember when this raid took place, it was still dark at 6:00 AM in Little Rock Arkansas.
He was likely not even awake at that time in the morning, and regardless of how these federal agents or cops in general think that it's safer for everyone if they can catch you off guard in order to bust you, that is not necessary the case at all, especially when dealing with someone who actually knows how to use a firearm, and are extremely familiar with them, and you are breaking into his castle!
They did this for shock and awe, and didn't care who got killed in the end as long as it was not any members of law enforcement!

6 a.m. or 6:30 (I've seen both reported), is not the middle of the night for working people with day jobs. Most people are up by then. Maybe not at their peak alertness until they've had coffee, but not dead asleep by any stretch.
6 a.m. is only the middle of the night for shift workers, retirees and crackheads.
This is a great life lesson on why hardened doors and windows are a great investment.

I've seen the warrant. It is a simple search warrant and didn't authorize no-knock or forced entry.
This gentleman the ATF killed never showed any violent tendencies. What did his criminal record contain that necessitated a “no knock” warrant? This was a planned attack on a citizen to show FORCE and make us afraid. It’s a wonder the agent wasn’t killed.
They didn’t arrest him because they didn’t have the necessary proof and he wasn’t engaging in illegal activities at the time. Unless sleeping has become a felonious activity.

Not always. It depends on the city. If they think someone in local government will alert the suspect or won't go along with a possible cover up they won't involve them.
Even the local fire dept was involved. Really surprising how no one thought this wasn't a good idea. Absolutely nuts!!!

Again! See the case of the FBI raid in Sunrise, Florida where 2 FBI agents died and the suspect killed. A suspect they claimed scrubbed his social media DURING the gun battle.
And it's nothing new for feds not to warn local law enforcement. It's been done for decades in cases where they think local law enforcement is corrupt and connected to the suspects. It was routinely done in the south when investigating race crimes where local law were suspected of being members of the KKK.
Sometimes yes, other times no. Most sheriff's departments would have nothing to do with this, and have even removed the ATF /FBI from peoples property on occasion. Maybe the city police in a very blue state/city tho.

It's crazy that the guns he sold supposedly used in a crime were all three for being pulled over with "suspected" marijuana. And besides that gun crimes do not reflect on the seller. That's like blaming GM for dwi related deaths while in Chevy trucks

The warrant was for searching for evidence. It was NOT an arrest warrant. So they could have raided his house while he and his wife were out to dinner!

You don't need an FFL to sell guns privately in most states, so the ATF is breaking the law right here depending on state laws. The ATF only cares about its own rules, not Federal or State laws.

If law enforcement and the judges involved in a no knock warrant sign off on something like this that results in the death of an innocent person they should be charged with murder, period. NO reasonable person would’ve used a no-knock in a case like this, there was zero justification.

Was there a history of attempted communication with the murder victim in this case before the warrant was served? Had they given him a chance previously to surrender or turn himself in and he refused?

No Knock raids should only happen for Capital crimes. They use to be Peace officers now they are LEO. That's a big difference.
