I Hope You Dance. The True Story of Why She Pushed.

  • 5/14/22. "It appears the pilot pushed forward on the yoke in the last 20 seconds of the flight, for reasons that may never be known."
    But now we know. Follow through with me on this one, suffer through the banjo music, and you decide for yourself. It's a one hour video that took 50 hours to create. Stay 'til the very end where Dan gets to play music with Lee Ann Womack.
    This is a long video, it took a lot to understand the accident, obtain the documents, form a hypothesis, go to the site and test it, and create this video. When I visited the crash site, the aircraft and the collapsed offending steam stack had been removed from the roof of the building. The smoke stack tower was stored on public State of Idaho railway easement property next to the state train tracks - obviously in preparation for being hauled off by rail car to a scrap yard. NTSB and FAA have long since completed their site visits. There was no yellow tape or public access restriction on my visit. Suspecting that a typical cover up effort by possible future defendants is imminent, I am taking my effort to guarantee that the light is not "lost", and that it will be properly retained and documented as future evidence for all entities to examine. The mandatory max stack height limits, minimum paint markings and lack of proper warning lights, lack of displaced threshold, and lack of NOTAM for unpredictable hot steam release all appear to me to be both unsafe and illegal, and not in compliance with FAA rules, or basic due care by the owners. I will be waiting for the future release of the NTSB conclusion and docket to see their pictures of the tower and the light hopefully captured by them long before my visit. I am hopeful of a swift NTSB conclusion, and a recommendation by them that could prevent a repeat accident at the same site. The potato factory is exactly on the IFR approach.
    This is a long video. I hope that you will give it 65 minutes of your Time to learn what I learned.
    When this crash happened, we all looked at it and concluded that the pilot busted minimum's and went low. It turns out that there is much more to the story, including what we learned about Garmin in cockpit vertical path guidance provided to a pilot on a standard non precision approach such as this that had no certified vertical guidance. (Not an LNAV+V or an LPV)

      The victims of aircraft accidents often cannot speak for themselves. Agencies tasked with maintaining safe airspace appear to be asleep at the switch. Dan, you have stepped in to give a voice to those who cannot speak so that others may live. You are to be commended.. once again. Without a budget, staff or technical resources you have vividly illustrated that quality safety advisories can be put out quickly simply by having appropriate people looking closely at an incident and not automatically blaming the pilot. Big budgets are not always needed, just competency. Well done.

      @@DerekJohnson-us7vy I disagree with part of your critique. I believe Dan has realized that "just the facts" reporting is often overlooked. The way to get change in most incidents is to humanize them. Put faces, history and facts together so the whole story has been told. He has done this on quite a few videos as of late. When the system fails a person and they die it is arguably worse. The errors by the city, airport, plant and FAA killed this pilot, yet she is being blamed by many. It is important to humanize her so that the death is not just a stat.
      It's idiotic and endemic of our societies failing that identity politics is even being mentioned in your #5. Who cares who they sleep with or how much melanin is in their skin. Those factors are irrelevant.

    Dan, I have flown this approach a handful of times over the last 15 years.
    Last time I flew it was 5 months ago in a PC12 47E with the Honeywell Apex suite. I broke out 200 above mins and actually had to side step the approach. I was absolutely shocked when I saw the stack that had not been there before. I called my company and informed them I would never fly that approach to mins under any circumstances. KBYI is already a big challenge without having to fly that gauntlet. It was bad before that stack was constructed, but now it’s just suicidal. I very much regret not taking it to the FAA. I should have. That approach is incredibly dangerous and wouldn’t make terps even if they took that stack down. It’s a shocking thing to see on short final!
    My condolences to her family. In my opinion bureaucracy killed her. I’d be suing city hall, the FAA and the potato factory if I was them.

      I have thousands of hours in the same model of Caravan, often in low IFR weather. If given the same circumstances on the Burley, Idaho GPS Runway 20 approach, I am not confident of a successful approach and landing. The freight should be handled at Twin Falls (TWF) not Burley (BYI), Idaho.

    After listening to Dan’s evidence and studying the approach I have an opinion also. FYI, I am a retired Air Traffic Controller, retired USAF pilot, corp pilot and part 135 pilot , ATP and many type ratings. The responsible here are the FAA and the potato processing plant....the totally not at fault is Brittany....to her family: very sorry for your loss...too Dan, excellent analysis....keep it up and more of us will stay alive.

      After seeing the family portraits and Brittanys beautiful smile coming right at yoiu I could see how devastated the whole family must have been And to know their sister and daughter wouldn't ever be coming home again. I would never want any family member involved bin aviation. For godsake we had a 23 yr old cousin Erin .She died in a farming accident in Oregon. It hollowed me out for several months.

      They would never get this level of detail from an NTSB report and even if they did never so soon. When tragedy strikes answers and explanations like this video even if they point to the futility of what happened at least should provide some short term respite.

      @@relativenormality Juan browns channel even concluded the pilot of the Cessna was likely unaware of the tower was directly in center of her approach and was obscured by steam flume. She clipped it at the last second. The runway looks deceptively like a piece of cake when the sky is clear and the steam is being blown perpendicular to the beginning of the final approach.

    This has been an issue for some time. I live in Burley and have witnessed 2 crashes. For years now attempts have been made to find a location to relocate this airport, which is vital to our area. Every time a location is found the public rises up and says NO. A few years ago the city of Heyburn removed the vegetation on the north river bank claiming it was a danger to the approach. The FAA has threatened tp pull the federal funding and even to pull the license of the airport yet here we are. This accident took a life and thank God there was no fire. Several years ago there was a Cessna that crashed on departure and almost hit the fuel storage tanks at the south end and across Hwy 30. It angers me that the construction and build up that was allowed to happen and then overlooked (some would say intentionally and that is a complete different story) has cost a life.

    I am a retired airline captain who now flies single pilot in a King Air 300/350. I am appalled at the lack of oversight with the FAA regarding the parameters of this approach during IMC conditions. This tragic loss of life could’ve been prevented and it should be the upmost priority to have those towers removed before another tragedy takes place.

      I am likewise a retired airline captain. We've both seen all kinds of weather in all kinds of places and , My God! It could have been you or me. That lovely young woman's life was cut short by inexcusable negligence! To her parents, you brought an angel into this world. I can't imagine the pain having to let her go.

      @@atsdroid Well stated. A few points I am not sure of, but I think she probably had a visual on the runway at MDA. 2300 ft ceiling, so she was well under the overcast, 1 mile visibility in snow. I suspect she had the runway, realized the obvious need for a slightly steep approach, and then entered the steam cloud, never seeing the tower. She would have been blind for that brief instant. The one other question I have is had she flown into Burley previously, or was this her first time there? That's one of those airports where everyone should make a few entries under CAVU first, or at least be thouroughly briefed and made hyper aware of that damned tower.

      @@atsdroid That's very well thought out. We'll never know exactly what she saw in those last seconds. One thing is for sure. She didnt' see the tower, even if she did have the runway upon leaving MDA. I suspect she did have the runway, then lost it in the steam, as can happen in ground fog.

      @@atsdroid Good question. I'm sure there's a legal definition somewhere, but I'd say at the point at which the pilot transitions to visual reference. So to relate that to this tragedy, one can speculate that Brittany saw the runway, went visual, then lost it in the steam cloud

    Calculus, trig and physics teachers should be pulling up the math session when kids ask "why would I ever use this in real life." Practical math application. Thank you for all of this investigating, Dan. You're saving lives by bringing more attention to this and pressing the very people that should have taken care of this issue before this poor pilot's death. Absolutely tragic.     To the Family: You have my Sincere Condolences, this should have never happened. The Plant and the City as well as the FAA should be held responsible. I believe Dan is doing the best on this matter and he is right on the money with this. Again I am so Sorry............

      The plant understated the height to the FAA and overstated the height to the EPA .
      Both statements would be on record so a prosecution will take place I guess……….hmmm?

      Time for jail time for the criminals resposible, cutting wires to the VASI is an unbelievable action of sabotage.
      The responsible FAA persons must be dismissed, fined and lose all pension benefits.

      @@arturoeugster2377 No ! The approach plate (and NOTAM) would no longer indicate (withdrawal) a VASIS system for the AD……concurrently.
      The illegality was false statements by the potato company re heightS to two separate government departments .
      The statements indicate the stacks aren’t infringing because of the MULTIPLE declared hightS !!!
      Underfunding oversight bodies is something that should be highlighted as ultimately dangerous……unless the private sector never exploits a situation……..surely not ?

      Glass cockpits are lovely in smooth flight but like my Tesla a pita when it’s rough I’m thinking.

      nice low wing aiplane 0-360 ,I assume, what kind of a turnrate indicator do you have, Turn and slip? What is your IAS in Mph or knots? Why? Because as a memory item ,there is an easy way to determine TAS in knots. depending on altitude , if you are interested I'll tell you, also if you lose altitude due to altimeter failure, (broken internal chain), can show you how to get altitude in 12 seconds.

    My deepest condolences for Brittany’s family. I did not know her personally, my friend Tyler flew with her at Gem air. I did see her around Jackson jet center often, she always had a smile on her face, I had heard nothing but praises about her pilot abilities. My prayers are with the family.

    I am still a licensed CFI, CFII, MEI, and now an ATP flying wide-bodies. When I was a young pilot, for a brief stint, flew single pilot IFR in a C210 in icing conditions. I know exactly the stresses Brittany felt doing her job. We are all trained, and I trained all of my students that the approach plates guarantee your safety. It is unfathomable that this trust was broken, and it breaks the entire system that the FAA allowed this to happen. This is at the level that people should go to prison over. This cannot go unpunished, and should trigger a nationwide audit of ALL approaches.

      @@atsdroid watching Dan's video on the flight portion you'll notice they were very high on the approach, but he did show just how critical it would be to follow the diamond to ensure you will be at a safe point to continue to land. Notice that they essentially went missed, they were way too high to continue to land.

      @@atsdroid You sure seem like you might have ties to this situation. Dan is on the money with his findings. The tower was illegal and illegal again with no lights. Not a chance in hell this had anything to do with pilot error. That beautiful young lady was one hell of a pilot and died because of a Potato factory whom paid of the city manger to allow this tower to happen. What we are going to find here is a little thing called pay to play. Short term gain for a long term loss. Some serious action needs taken against all involved. When the dust settles I should go whoop that city managers ass!!! 🤬

      This is the symptom of a problem that started 50 years ago. The Vietnam war had two bad aftershocks. One was the high cost that led to inflation in the 1970s. The second was that many young men refused to join the military. The military was where many learned their trade. And, if a young man was washing dishes in Canada, he was not learning to operate a milling machine. Also, there was the cultural phenomenon that young ppl graduated from HS, boughr a hippy van, and set off to Haight Ashbury.
      Then, in the early 1980s , the govt jacked up interest rates to arrest inflation. This led to a major recession. This is a word we hear all the time now, but back then it was a new thing. Guys who'd had steady jobs for 20 years suddenly couldn't find work. Large companies, with the mantra make money today don't think about tomorrow, cut out their apprenticeship programs. When things picked up they didn't hire apprentices, they rehired older workers and foreign workers. Something else was that they simply changed job requirements. If a job required a licensed technician, they changed it so less qualified workers could be employed. If a project required a stamp by an engineer, they hired lawyers to get around the requirement. The payoff is the well known problems at boeing, general motors, etc. This is how jennifer hannity can be chief of ntsb.

      @@atsdroid as to your assertion that Dan "did not conclusively show"...1) you answered the first by acknowledging that the certification of the approach was rendered null and void by construction that violated TERPS manual standards. The No-Pen buffer below the approach path was blown. This should've resulted in an immediate "..Approach NA.." NOTAM, following the correspondence from the FAA Airport Management Assistant (Englebrecht?) to the city manager's office stating same. The interruption of VASI/PAPI further presses the point (that Dan made - follow the trig), which you brought up and inadvertently answered/confirmed by acknowledgement. 2) Showing the approach and the instrumentation indications, corresponding to the trigonometric explanation does show that the pilot did indeed have several of 10 possible things allowing to continue below MDA along with the field and runway in sight; not all are required.
      The fact that the No-Pen line was violated automatically invalidates the approach. Pilots have no way of knowing that from the cockpit. A NOTAM is required to notify the Aviation community that the specific approach has been invalidated or at least modifying the approach until remediation occurs. That didn't happen. Remediation (physically altering the offending stacks and obstacles penetrating the aforementioned buffer) had to occur in order to re-establish the validity of the unaltered (by the FAA) approach. That didn't happen. The "VASI/PAPI decommissioned" condition should've been corrected. That didn't happen.
      If you're looking for a flight data recorder for proof that the pilot did everything by the book...; not required on these airplanes. However, we DO know that the pilot was known to be a "by the book" aviator, the equipment that WAS installed was not activated (light on the stack), the approach procedure was blown; should've been rescinded, pending review of remediation. Primary responsibility rests on the FAA upon acknowledging the obstacles invalidating the no penetration buffer zone below the approach path. The city manager's office took no action to comply with the standards pointed out by the FAA; probably a political/economical hot potato (all pun intended) during an economically stressed time. Not a litigiously oriented kind of guy, but the FAA Airport Management office and city/airport managers have a lot to answer for.
      Safety standards enforcement is the domain of the FAA. Past that, accepting fraud/fudging/lying falls upon the city's leadership.

    My heartfelt sympathy goes out to the Infanger family for their tragic loss. It is mind blowing to know this stack was erected by Gem State when they knew it was illegal. How shameful for the many agencies involved allowing this hazard to remain. Thank you Dan for making this video. We can all pray this tragic loss of life due to these circumstances never happens again.

      I’ve already donated my ex-wife and her stupid cat. The cat isn’t worth much but the ex could be sold to some circus for $50-$100k. She could be the circus fat lady AND the bearded lady.

    Dan,
    This video is amazing, not only because of the way you have uncovered the probable cause of the accident but the compassion you display while doing it. I am an avid supporter of your channel and I echo what most have said before me....you have done more for aviation safety then all of the government agencies tasked for that specific purpose combined! Keep up the great work. My condolences to Brittney's family. She was a beautiful soul and I hope some good can come out this senseless tragedy.

      What was she doing well below 200', diving for the runway, left of center by a wide margin, and still a half mile from safe touchdown zone? If she was on the numbers she goes home. Off the numbers by that much on this approach, she crashes. She is no different than any other driver of flying machines.

      @@thomasmartin7425 The tower that she hit is EXACTLY on the centerline. Standard descent rate is 300 feet per nautical mile. The tower was at .43nm so at a standard slope that looked normal out the window, she should have been at 129 feet to be red over white. If the airport still had a standard VASI she would have been red over white and still hit it.

      I think equally important is the unexpected change in descent slope. ANY pilot would assume they had drifted high, not that the guidance slope had altered. So diving is an unnecessarily strong assumption. She likely increased her descent rate as a result of an inaccurate approach plate with unclear, hazardous obstacles on approach. In aviation, we don't aim to clear obstacles by 200 feet... It's clear that what Dan is driving at here is that there's an unseen input to push you down and an unseen danger waiting for you at the bottom. That's not how we build safety.

      @@ProbableCause-DanGryder ok. So every other IFR landing on that runway was PURE luck? Wow. Those are some miracle odds!!! No other pilot saw stacks so close out the side window that they ran to the FAA/NTSB and declared a MAJOR navigational error. No pilots declared in a NOTAM that those stacks are chipping paint off my plane or that I may have left rubber marks on the top of one.
      Suddenly one plane face plants BELOW the top of the tower into a known obstacle and the pilot is right and all other IFR landings were miraculously lucky?
      I'm not going to further a fruitless debate about right or wrong. But I think you are making a pretzel out of a pole when you declare she was on a perfect line for a fine IFR landing save for the tower that jumped up and grabbed her off a perfect glide slope.
      What happened to you? I blushed watching your video trying make the towers taller and landing zone closer and all kinds of mish-mash.
      Oddly enough I agree with all you many assessments of "probable cause." But this one I just can't. She was PIC. She knew of the obstacles flew into them.

    I'm only on my private stage for this piloting experience, but this whole case is extremely eye opening. The fact that an unregistered/improperly registered unlit obstacle can be right on centerline for a runway sickens me. I may not live in Idaho, but if there's anything else like this out there we're all in danger. It's a shame that Brittney had to lose her life to bring attention to this issue.

      @@atsdroid As I understand it, the weather was misty and foggy perhaps Brittany could guess the runway but overlooked the tower because it was hidden in vapor from the potato factory 🏭? We'll never know for sure but it should be forbidden to errect a tower right at the centerline of a short final - that's a recipe for disaster! Even in VMC in an engine out situation when you try your best to make it to the runway this tower could stand between you making it back healthy or dy by smashing into that potato tower!

    It's always difficult to watch an explainer video of the aftermath to a preventable incident. I never knew who Brittany was until I saw the report of this accident and followed up watching the videos that Dan produces. She is beautiful, intelligent and way too young to depart to her eternal destination. I don't even know her, but I miss her and give my condolences and prayers for her Mom, Dad and family. Rest peacefully Brittany.

    A wonderful tribute to Brittney Infanger, and at the same time turning on a floodlight to illustrate a completely obvious careless and reckless act by our FAA of not pursuing the details they uncovered concerning this airport and it’s approach. Thank God for Dan Gryder and his courage!

      It is so sad that she died this way... What is so bad is the city and the Gem State PPP allowed this whole situation to unfold the way it did... Circumventing procedures, dis-abling necessary equipment to avoid the PPP, that never should have been allowed to be put there in the first place... The FAA advises what to do, the city and the PPP chose to ignore that advice... The court of law is where the city fathers and the PPP people need to go - to explain their irresponsible actions...

      It's not all on the FAA. The potato factory for misrepresenting the stack to two government agencies, the airport for disabling the VASI and not following up with the FAA on the published approach documentation.

The worst part of this situation is; The way the Potato-Heads decided to put that plant in that particular spot in the first place... It is almost as if they were TRYING to create a hazard for the planes coming into that airport... They could have located it elsewhere... Why there? What was the motive to do that? It is time to do an investigation into a Possible Plan of the Potato-Heads, to get involved in a scheme of a Leveraged/Hostile Land acquisition, for HUGE Profits in a Real Estate Venture... Getting rid of that airport would line their pockets with Large amounts of Cash and Power... Not only should that Plant and the remains of it, be removed, and the materials/rubble from the remains of it be turned into raw materials, but it should be done entirely at the expense of the Owners of Gem State Potato Processing Company... I'm originally from California, and have seen things like this happen before, Numerous times, throughout the state...Some of the greedy ones, call it the price of progress, others who see the big picture, often think of it as turning a nice place into a ghetto... To line the pockets of a few Greedy individuals, with a LOT of cash $.... The river is right there, so that is a source of water, The train tracks can provide plenty of transportation of supplies for a Boom town... The only thing stopping a huge land-grab is that airport... So they create a situation that is KNOWN to kill people and their planes, to get rid of it... That seems like what is ACTUALLY happening here...

Too little space around site for realistic aircraft safety but plenty for development and would explain the probable financial inducements/lubrication to facilitate bending regs en-route.     A great piece of investigation, Dan and a wonderful tribute to a young woman pursuing a career doing what she loved. It makes me weep to think she died because of the incompetence of others and their failure to act to prevent it when they knew the risks that these structures posed to aircraft. But it also makes me wonder why we asking pilots to risk their lives in this way just so that people can get their parcels a few hours sooner. An utter tragedy but I hope your work prevents the causes of this accident from being swept under the carpet and helps to ensure that all the guilty parties are brought to justice. I hope they are all truly ashamed of what they have allowed to happen.

    Very well researched. The arrogance and greed of big business killed this pilot just doing their job. I hope that there is some accountability and the wilful disregard for others safely puts those responsible in jail and those who were complicite in circumventing the rules have their bank accounts drained. They have robbed this young women of her life and her family of the joy of her presence. You Dan are the "Erin Brockovich" of the aviation community. I live in NZ and had the privilege of flying around the Midwest and into Oshkosh in 1985, one landing in heavy rain and total darkness and I understand how important being able to trust pre tested flight slopes are. I hope this helps the family come to terms with loosing their daughter but of course nothing will ever take away the loss. Sincere condolences to those who loved her.

    Dan thanks for taking the time to validate Brittany and her flying skills she was an awesome person and a good pilot,and to her Dad Jim Bob I am so sorry you lost your daughter Brittany, I had the privilege to meet her at the SLC Airport on a cold rainy night after completing her cargo run she asked us for a ride to her car in our maintenance service van, I had a chance to talk with her and she said she loved flying for gem air and that they were a good company to fly for and that she loved the people in salmon idaho her hometown and family.God Bless you in your time of sorrow may he heal your pain ,peace to you and your family.

    Fantastic video Dan... It is amazing how many regulations were broken at this GEM STATE Potato Processing Plant that concern the approach, and departure of this runway (02 /20 - BYI), and maybe other runways at this airport... The initial placement (JULY, 2010) of the GEM STATE PPP is ridiculous, and it became worse as time went on... What is interesting, is that the GEM STATE PPP claimed the high pole that was hit, was 150' AGL , to the EPA, to satisfy their requirements, but the same pole-apparently became shorter- when after this accident, it was claimed to be 80' AGL to the FAA... It is NO MYSTERY WHY the people at the GEM STATE PPP, quickly removed the obstruction that was struck, probably to cover-up their false claims dealing with the height and position of that unlit pole... And the supposed light that was put on top of that pole (at the Gem State PPP) was the wrong type and was not even powered when the accident took place. It appears that an un-approved lamp was put there, but only as an ornamint, and NOT as a functioning FAA approved ground collision avoidance device for this purpose. The VASI was de-activated, which should have NEVER happened... The steam stacks and the high pole that was struck, were NOT listed on the plate, as they were ILLEGALLY INSTALLED AFTER the approval to authorise the installation of the approach equipment & procedures on that runway, and maybe other runways at that airport... The inconsistent decent angle is very bad, which BTW does not take into consideration that the steam stacks and the 118' AGL high-unlit pole that are practically centerline of the runway, and were NOT reported to the FAA, when they were ILLEGALLY installed, AFTER the approval was authorised (11/2017, by the FAA) for the installation of the non-precision approach equipment... There were a Lot of things that caused this accident to happen. Now the city (Heyburn, Id.) officials there, seem to be scrambling to cover-up their inappropriate and illegal actions, regarding the circumvented procedures that they made - regarding the airport safety, in regards to the authorization of the initial placement of the Gem State Potato Processing Plant (July-2010) and it's unauthorised installation of the equipment that is obstructing a safe runway approach/departure path of the Burley (BYI) airport runway 02 / 20 (which was founded in July, 1930)... It is now becoming PAINFULLY OBVIOUS, that this definitely was NOT the fault of the pilot... She was following procedures... The people who are responsible for maintaining that airport (City of Heyburn, Id.) and those who were adding unauthorised equipment at the GEM STATE PPP were NOT following procedures... NEVER should the VASI equipment have been shut-off, without shutting down the runway. THE City (Heyburn, Id.) Officials , and the people at the GEM STATE PPP need to explain WHY they did this, in court, IN FRONT OF A JURY (WHO are NOT FROM THAT AREA), of people who are presented with the facts, like the ones shown here, by Dan...... Our condolences go out to Brittany's family & friends, for this tragic event that probably would NOT have taken place, if only the City (Heyburn, Id.) Reps, and the people who are responsible for ILLEGALLY building these obstructions (at the GEM STATE PPP, sometime AFTER Nov. 2017), which should NEVER have been built at that location (July 2010) , to begin with.....

    Dan, I've shared this video by all the means I have so that as many people as possible see it - including my representative and senator (not that I expect much from them). This incompetence from the FAA as well as the local planning department is inexcusable. Keep up the good work.

    As overly simplified as this might sound, her young life was cut short way too early--as a father myself I can only imagine the pain--but it won't be in vain. ...so then others may live.       Unfortunately, the FAA seems to have very restricted authority to apply legal action in situations like this, but they can advise those who are in violation. I believe that the City officials and the PPP upper mgmt. will first be facing criminal charges in court, then a severe civil lawsuit will take place... I feel so bad for the friends & family of Brittany... Hopefully this will set an example of WHY it is NOT a good idea to circumvent procedures-especially with aviation...

      @@michaelmartinez1345 I agree with you they will go to court and be found guilty of falsification of legal documents. Lying to the FAA and the EPA about the tower hight.
      You can't get a jury conviction for her cause of death because she went below the MDA.
      The most they will face is finds for not filing proper paperwork to build without notification with the FAA, ATC, and EPA. Now a Civil law suit will be different if they can prove negligence.
      Which they won't.
      I am sure the potato factory has insurance to cover anyone getting hurt or dying on the facilities property.
      This will drag on for awhile until the family's lawyer gets them to settle out of court.
      Your forgetting one thing this plant pays taxes to the city and state as well as providing jobs for a few hundred employees, where the Airport is a money pit the state and city have to throw money at to keep it operational.
      The potato factory will be their pumping out French fries long after you and I are dead and gone.
      You can keep fantasizing about them shutting down this plant and throwing 300 people out of work but you and I both know it's never going to happen.

But because of the falsification of information given on objects that violate the laws of safe travel in navigable airspace, the MDA that YOU think is accurate, is actually highly likely to be bogus... Therefore, the supposed 'Busted MDA' that You & Some-others who probably never ACTUALLY encountered this approach, probably won't even be considered in the trial, because of the falsified/absent/contradictory critical height information of the unlit Methane gas vent tower.located directly in the CL of the runway...Several people who have ACTUALLY made that same approach, Said that they did NOT know the UNLIT methane gas vent tower (hidden by the un-authorised steam stacks) were even there, and numerous people who ACTUALLY made that approach, claimed to have almost hit that GD UNLIT Methane gas vent tower ... These are probably going to be the statements along with the documented falsified information of illegal obstructions of navigable airspace, directly inline with that approach/departure path, which will be probably be taken into consideration at that trial...For those violations, along with the resultant fatal collision and other near collisions of witness's who made that same approach, prison sentences will probably result, as this has now become a FEDERAL OFFENCE of Falsifying CRITICAL Information that violates 14 CFR § 77.39 -as gross interference of navigable airspace that was directly in the middle of a flight path to & from a FEDERALLY designated airport runway (KBYI) that was not properly reported to the Local FSDO, FAA, ATC.. Public donations should be made for the Infanger Family... Maybe You Leonard Marlin, can find how to help these people? Hopefully, a court order will be issued to completely remove that entire potato processing plant, and the broken down building materials will be shipped to appropriate recycling facilities, entirely at the expense of the PPP owners-of coarse... This will set a strong example to OBTAIN PERMISSION to erect buildings, and buildments, EVEN Before Buying the Land to do that... The PPP People should have thought of this BEFORE they began to build this place, at that particular location... Meanwhile, the criminals who LIED about the HEIGHT of that methane gas vent tower should be getting ready to spend some 'quality time' with Bubba, the 'Love Sponge' while being 'romanced' in the slammer... That just might make an interesting subject for a reality documentary... Maybe even more shocking/convincing/effective then 'Scared Straight'... The take-away from this is: Circumventing procedures - ESPECIALLY with aviation, is NOT WORTH THE RISK!!! For those who feel circumventing procedures, with aviation is a joke, maybe You Too (& Tom Vu) can star in a reality show, on cable T.V. from one of the big crowded houses, 🏠 of inmates , along with other has-been stars of the info-mercial airwaves, who are still serving time....

Thank you for putting these wilfully careless, buck passing functionaries under notice, it is the only way to shake them out of their persistent comfort zone and into the real world.     Dan as a new pilot but older man I really want to thank you for the information you provide.     Great work. Thank you Dan. I got my IFR rating 50 years ago, in a no glide slope Cessna 150. Dive and drive was all I had, along with local knowledge of the landmarks that led to the threshold. Your work on Brittany’s last approach was masterful, sensitive and useful. I hope her sacrifice helps many others stay at the MDA, miss the approach, and live to grumble about it.

      Flying can have scary moments but then so does driving a road vehicle, we all have to balance risk. This crash is so sad because so many ignored the warnings.

      @@garybrindle6715 Not only were the warnings ignored, but in this case- HIDING the fact that they ILLEGALLY built obstructions that are surely going to cause an accident... Lieing about the actual height of those obstructions, not properly lighting the obstructions, and worst of all, not reporting those obstructions to the FAA, causing a dangerous absence of those structures in the charts & approach plates... Criminal negligence - is closer to the mark in this situation... Time-in prison might be the end result for those who are respossible, for their irresponsible actions in this case...

    I am so glad you're digging into this Dan! It never should of been allowed to happen, and it really angers me that in order to get this FAA Sanctioned corrected that this poor family, and indeed a huge community that knew and loved her had to suffer this tragic loss!!!
    She was obviously a huge bright star in so many lives thar now has been turned off because the factory, and FAA and who knows who else just cheaped out for their own benefit or to avoid dealing with it. My sincere condolences to all who knew and loved her and to those who never will get to now. Heart breaking story!

    In my opinion this is one of the best videos of an accident review I have seen. Thank you for bringing to light the failings that resulted in a senseless loss of life.     To the family… my utmost sincere condolences. Words can’t express how I feel and the sadness I have for the family over the loss of your precious Brittney. I was once a young freight pilot many years ago and it was a very humbling experience. I was gaining hours to go to the airlines. I was a lucky one to get through it and go to the airlines in the end. So many personal freight flying experiences flooded back to me after I heard this terrible tragedy. I pray for your strength to overcome this and know that she was doing the very thing that made her so happy. I would have loved to have met her and listened to her talk about her passion for flying.     Think of all of the joy Brittney experienced with all of the special moments captured in this video. These now serve as memories for Brittney’s family to remember and cherish their daughter. What a tragic loss.
    Dan, your tireless efforts to investigate these accidents, get to the bottom of how they happened and, most importantly, provide clear and concise guidance on how to avoid these situations in the first place is truly commendable. Thank you so much for producing your videos. We are all flying safer because of them.

This encroachment into obstacle clearance paths is a world wide problem, and we have the same thing happening as more development happens closer to our airports here at home in New Zealand.     Dan, I live in PTC, GA, I'm a retired FAA ASI and I am going to email my congressman about this bureaucratic fornicated approach procedure and the lackadaisical response of our FAA. I would hope that if I had come across a similar situation I would have raised hell until they took action or fired me! That approach should have been decommissioned when they removed the VASI! My opinion. My condolences to Brittany's family.

      @ Bob theGrape, there are at least 4 different guess's at what the height of the Methane gas vent was-before it was removed... One claim was 60' AGL, Another claim was 80' AGL , Another claim was 118' AGL, STILL ANOTHER claim placed it at 150' AGL... That alone is a bunch of information, and only 25% could possibly be accurate... At least 75% of those height figures are inaccurate... So many other things have been hidden and lied about, regarding this RIDICULOUS approach/departure that was ENTIRELY created by the RIDICULOUS PLACEMENT of that potato processing plant, starting in July of 2010... And yes, my guess is the removal of the VASI should have closed down that approach/departure all-together... It will all come out in COURT... Personally, I feel that the Potato Processing Plant should be given - a court order to be destroyed and the remains be transported to appropriate re-cycling facilities, entirely at the expense of: 1)The City of Heyburn that originally approved it to be there, and 2) The Gem State processing plant owners & managers who LIED and quite possibly did not accurately report the the ACTUAL height and unlit status of the Methane Gas vent tower , that was directly inline to the BYI 02/20 approach/departure critical terrain & obstruction info. (to at least 2-seperate govmnt. agencies). The idea of putting the plant there (July 2010) was a BAD IDEA to begin with, that literally became an accident waiting to happen... And after the criminal trial is finished, the legal council of the finances of a civil trial and the awards that could be granted to the plaintiffs, to settle a lawsuit that the Infangers should file, should be the entire financial responsibility of the defendants of that case... This case should serve as a strong example of NOT putting lives in danger by interfering with Navigable Airspace - up to a distance of 20,000' (3.75 miles) of an airport runway threshold (14 CFR § 77.39)...

    Damn it Dan, you made me cry at the end of this one. My heart goes out to the parents, family, and friends of Brittney. Your loss is truly unmeasurable. The potato plant company officials, and the all the bureaucrats who signed off on that tower, are the ones directly responsible for the tragic and untimely death of this talented and much loved woman. Thank you Dan. You do good work.

    Dan, you've done an excellent job factually verifying this was a senseless tragedy. Unfortunately it leaves a family with even more unanswered questions as to why this was allowed. Condelences to her family and friends .. she was an obvious ray of light. I hope Brittany's family considers consulting with an attorney over wrongful death damages. It won't bring her back, but it might save another pilot from the same fateful experience.

    Firstly deepest condolences to Jim Bob, Sharon and family.
    Interesting point around the the deeply ingrained concept of “constant” in terms of descent angle and how a pilot expecting the descent angle to be constant then during the approach the Garmin starts showing the pilot they are above the slope, the trained response is to get the aircraft back onto the slope (push the stick forward).
    I’m from NZ and we still clearly remember TE901 and all the questions about how could a highly experienced pilot fly an airliner into the side of Mt Erebus while in VFR conditions.
    Some strong similarities around what the pilot has in their mind and how this influences what the pilot consciously “sees”.
    Hope the family can keep the positive memories of Brittney front of mind, our thoughts are with them.

      Fred, I think Dan clearly answered the question about using a computer-generated "advisory glideslope". The goal is to fly a stabilized constant angle/constant rate of descent vertical and horizontal flight path to a designated visual descent point from which a safe landing may be accomplished with adequate visual references, or if not, a safe missed approach can be executed. That is clearly the intent of the FAA advisory circular's guidance on nonprecision approaches. The computer-generated "poor man's glideslope" is used to guide the pilot to the missed approach point in the best flight condition for a safe landing if visibility at the MAP permits, NOT to continue descent below the MDA if still in instrument metereolgical conditions. All instrument rated pilots know that the constant angle of descent technique and a stabilized approach gives them the best and safest shot at breaking out of the weather at or above minimums and landing safely. "Dive and drive", particularly when hand flown, is challenging and disorienting to the pilot, and it's easy to see why everyone concerned embraced constant angle of descent for non-precision approaches, so long as the pilot fully understands the conceptual and procedural differences between "precision" and "non-precision"!
