    I respectfully disagree with your analysis on GERD, because the new rating criteria does not address the symptoms of GERD. Dilation(stretching) of the esophagus is not a testament for GERD, It is for slowing problems food getting stuck. Gerd is excess acid in stomach that comes up into the esophagus from a week stomach sphincter (valve at top of stomach), which this new rating suggests the opposite type of treatment this is putting GERD in an unrelated category which will make it almost impossible to get rated for with actual GERD symptoms. I hope this helps

      I am screwed since i currently have all the symptoms for Gerd for 30% but rated at 10% right now. This final proposal is horrible.

      ​@TheCivDiv it is not. The final is not stating any real symptoms of Gerd. As a gerd my self. Symptoms are regurgitation, acid reflux, heartburn, chest pain, and difficulty swallowing. Your assessment is horrible.

      @@Harlem139Convent1 it can but not always. You can have severe GERD symptoms without esophagus restrictions. Under this new rule, your moderate to severe GERD symptoms do not matter if you do not have a restriction.

    Not at all favorable for Veterans with GERD. Glad I got my claim in before this change. No rating for severe GERD symptoms without esophagus constriction.

      Yeah I see that and lots have spoken towards that piece. I totally agree but overall, with the separation…I think the changes are favorable. We will most likely see lower ratings GERD (10%) but see higher ratings for IBS.
      Although GERD/IBS are not 1 for 1, most people who have one, has the other. The separation is what makes it favorable.

    Awesome overview and analysis as always, Clay. Thank you for what you do!
    I wanted to mention my thoughts on the GERD changes. GERD is a separate disease/syndrome from esophageal stricture. One can have GERD without esophageal stricture - in fact, GERD most often presents without a stricture on endoscopy. Typically, on endoscopy for patients with GERD, the scope will visualize one of many possibilities including esophagitis (inflammation), and at other times the endoscopy will be normal. Rather than require an esophageal stricture for GERD - if the VA wanted an objective evaluation for GERD, they could have required an ambulatory acid probe, Barium swallow test, or esophageal manometry. Instead, the VA is requiring esophageal stricture to be present within GERD - which does not make sense from a pathophysiology standpoint about what GERD actually is.
    It's important to note that in recent studies, less than HALF of patients with GERD had ANY abnormalities on endoscopy. So more than half of patients with GERD have a normal endoscopy. And even in patients with abnormalities, esophagitis is most common, not strictures. I disagree with the VA's decision to rate GERD in this way. I did read their rationale in the PDF file - they state that they want to measure "functional impairment" with esophageal strictures. However, GERD with the currently rated symptoms does cause significant functional impairment. I think one of the most significant impairment I have seen in Veterans is being woken up at night because of acid reflux and food regurgitation. It even sometimes progresses to vomiting. This is bothersome and causes fatigue during the day due to lost sleep. The IBS guidelines look good, but I must say, I disagree with the VA's decision to rely on esophageal strictures wholly to determine functional impairment from GERD. (yes I know I am a psychiatrist, but this is drawing from my time as a primary care doc in the AF lol 😅 )

    So they pretty much made GERD near impossible to recd 30% or higher and made IBS easier to get 30%. Since you can’t get both most will cap at IBS for 30% whereas before you could cap w/ GERD at 60%

      @@TheCivDiv ahh gotcha. Still though they made GERD near impossible for 30% or higher to where I wouldn’t bother with a claim. IBS is obtainable but caps at 30% with Va math it hardly moves the needle. Prefer the 60% GERD criteria much more than this new rating requirements

    Semper FI fellow Devil DOG!! MCRD San Diego - Sep 1983. Need some advice
    2001 - 2002 musculoskeletal issues, service connected in 2007
    2004 weight gain started, injuries got worse
    2014 finally went to get VA ordered Barium swallow that confirmed Hiatal Hernia. reached 247 lbs, BMI of 31
    April 2024 Gastro Intestinal Dr did Endoscopy and gave great IMO/nexus letter, diagnosed hiatal hernia, esophageal stricture/GERD with weight gain aggravated my service connected musculoskeletal injuries as an intermediate step. Made claim for Hiatal hernia, GERD, esophageal stricture with obesity as intermediate step, current weight 222 lbs, overweight BMI 27.9
    Sep 12, 2024 denied, C&P examiner opined my fat ass was due to stuffing my face and not service connected musculoskeletal issues since I was able to lost 25 lbs in the last 10 years.
    How do I argue with that? Do I have to stay obese to get it granted? I am still overweight, BMI was 31 (2014) now 27.9.

    I usually don't reply to videos but as a healthcare provider, if I had a patient come to me and describe all of the symptoms of gerd I am not going to evaluate them under esophageal stricture. They are going to be diagnosed and treated for gerd. Esophageal stricture is its own workup and unique diagnosis, I genuinely do not understand how they can equate gerd symptoms to stricture. The only thing that would make sense to me is they do not want to give gerd its own diagnosis code despite the rest of the medical community coding gerd under k21.9 virtually every day.

      Solid solid solid insight and thank you for sharing. The VAs argument for these changes to GERD is ‘functional impairment’. They are arguing GERD can still be rated but based on functional impairment, those symptoms (GERD symptoms) do not equate to functional impairment. At least that’s how I read that.

      How do you suggest dealing with VBA denials citing rationale based on gastro symptoms “diagnosed before primary PTSD diagnosis?” Nam vets and others deal with PTSD being recognized in the DSM in 1980 therefore this “rationale” is used to deny many of us… even thought the primary PTSD recognizes Nam as a “qualified event.”

    Dilation- usually it’s when something opens up so that when the stomach acid is allowed to come up into the esophagus
    PEG- is a tube that they place from the outside and f the stomach and you can use it to feed or medications.
    Dysphagia - difficulty swallowing not to be confused with dysphasia difficulties talking

    I recently became 100 p&t through other conditions. For a condition mentioned on this video I was rated 0% , I submitted the condition in January 2023 and in May 2023 I was rated. I submitted the increase before the 1 year cutoff in 2024. I submit for the increase and the Va is requesting a c&p exam, I have a feeling it’s because they don’t want to pay back pay to January 2023. Is the Va attempting to play games? Does the paperwork from the last increase be sufficient to automatically rate since it has been within the year ? The year expires may 23, 2024. Any feedback would be greatly appreciated.

    CivDiv, If I do my Intent to Claim today, will this keep me in the grandfather category for GERD? I have nothing in my STR for GERD and the new criteria seems tougher than the older one.

    Thanks for the info and great content as always. I’ve already submitted a claim for GERD. Judging by the length of time it takes to get through a claim, what’s your take on veterans who have a claim through now. Would they fall under the old rating criteria if they submitted prior to these changes, but it doesn’t get adjudicated until after the date of these new changes? That stuff always seems fuzzy to me and dont see many folks talking about the timing with new changes.

      Of note, IF the VA processes your claim prior to the effective date (May 19, 2024) then you will only be rated on the current (old) rating schedule. For GERD, probably best. If you have GERD and the other conditions covered under the change, then this would be bad (generally speaking).
      Regardless, once effective, if you believe you would rate higher or have separate ratings and that would be higher…you can always sink it the increase.

    These changes are looking pretty good. There are a few IBS tracking apps, similar to a migraine tracker to fully track the frequency, symptoms, and form.

      @@TheCivDiv Absolutely! I have been using a migraine tracker for a few years, but that got me thinking once IBS was listed as presumptive with the PACT act if you were in the applicable areas. Huge thanks to you and veterans info tap, I almost went through one of those paid services and now am tackling everything myself. So much I didn’t know and wasn’t told in taps and by the veteran services person I used when I got out in 2011.

    From someone who got it in MCRD PI boot camp 28 years ago I'm on the fence about this change. Mine is rated under hiatal hernia (different DC) and its actually called eosinophilic esophagitis and my symptoms are directly in line between the 50-80% rating criteria of this change... (go figure I am low rated at 10% currently) Main point being I find this change odd to begin with because my GI doc has stated numerous times, I cannot continue to receive dilation due to the walls of the esophagus thinning and scarring, not sure how anyone else could receive that treatment three times a year (or more) without tearing their esophagus all to hell smh

      😂 yeah I’ve had a few comments about how I should learn what these words are first but hey…I am a husband and dad of 4 who also works full-time. I ain’t got time for all that. If these conditions/symptoms apply to the Veteran, with the link provided, the Veteran can figure all that out.
      I don’t think it’s a big deal and tbh, it shows I’m just a real dude, in his basement, making videos.
      Veterans don’t need to understand the ins and outs of every little thing…just the baseline.

      VA prescribed Omeprazole, been retired 20 years and it's the best treatment for my GERD. Need to supplement with tums on rare occasions - spicy food and alcohol. Give it a try brother!

    My IBS explanation was like this B4 it was a presumptive... Hey Doc somwthing not right in my gut. I eat and within minutes my gut is like vibrating but not in a good way it like starts about my belly button and then I feel the rolling sting circling around my waist line. I can literally feel my meal going to my butt hole until it explodes like a volcanic eruption.
    Doc the entire time oh oh my dear god oh my. Well i think we need a Colonoscopy Prostate exam Upper GI exam and let just see what we can find in the middle. 6 months of effing testing to be told well you have IBS and we will redo this again in 5 yrs. Sure enough 5yrs later boom same shit. All of this happened b4 PACT Act was even a thing. Soooo Glad my guts paved the way for the others behind me. Because trust me the testing to disprove Service Connected sucked as bad as having this awful illness. I now flip flop between Constipated and Erupting anal squirts.

      Thank you for paving the way. I was service connected with IBS in 2022, doc said i had something to the affect of stool problems while I was in, but still received a 0% rating for IBS but service connected? What can I do with the now since the pact act has been implemented?

    I would say this is definitely bad because for all those ratings it requires “esophageal strictures” which is not always present in all cases of GERD. So you could have GERD with all those symptoms but if you don’t have esophageal strictures than sounds like a big 0 rating

    I have 60 for GURD and IBS my medication has been doubled. Most of what you said applies to me. I considered filing a claim but worry crap could go south. Thoughts.

      Both. That is scenario 1.
      The VA is forced to award the Veteran the rating from both rating schedules that is HIGHER. Whether that is old (current) or the new change after May 19.

    I'm at 30 percent rating on ibs. (Tmi and I'm sorry) but my stools come on fast with diarrhea to start and cramping constipation following shortly after. I've changed my diet several times over the years and the only real help was when I would fast for a week and had nothing to come out after the first 3 days or so. My wife carries a few diapers for the kids and a change of underware for me in her purse...I'm 35 and crap my pants more than my infant and 2 year old do. Somehow I don't think 30 percent is enough. I take baby wipes to work with me...

      ive taken baby wipes every where just because of the amount of wiping to clean up... the sudden urge to go is your gastrocolic reflex. prob from something you ate prior.. cutting garlic and fried greasy foods has been my biggest help.. and also not being stressed and sleeping good.. if i mess with any of that i have painful diarhea and cramping.. ive been dealing with it since 21 but never saw a doc about it in service because it wasnt and still isnt crazy bad .. i do have days tho. how did you get rated? they denied mine because of no service connection but when i did the claim i never even saw a person for it..

    If you are trying to put out information to veterans and educate them which I think for the most part you do a good job in presenting. Do yourself a favor in your video prep and read through the material ahead of time and if you don’t know the meaning of a word look it up. Google and WebMD are free. You will come off as a much more knowledgeable presenter of information and will lend to your credibility. If you want to be taken seriously you have to put in the effort, especially if you are just reading off the rating schedule. Not trying to be critical just trying to lend a hand.

    My VA summary shows Gastroenteritis repoted while I was in. I was recently diagnosed with IBS. Any chance I could use my VA Summary as medical evidence?

      Sure. That’s pretty decent for the GI system. Keep in mind that is only 1 of the Big 3. I am more curious of your in-service event (evidence from service) for this condition. Without that, your claim is poop water (pun).

    Last year I logged my IBS symptoms. Three times I have no pain while defecting. Three times in the entire year. I have not filed for IBS yet. I might hit 100 from other issues so I might not need to. In my case the nexus may be my service connected GERD.

    If I do supplemental claim beyond May 19. Will I still be rated under the old rating or new one? I was recently denied claim to GERD secondary to PTSD but at the same time was awarded 50% Sleep apnea. The VA doctors stated that there's allot of medical Journals linking GERD Secondary to Sleep apnea.

    Mine is so bad that cramping you’re talking about. I literally pass out from it sometimes. That crap sucks already at 30% for it which is bad as I have it I don’t see why it can’t be higher because it almost makes it impossible to do stuff anymore. The medicine helps that they give me but it doesn’t stop it.

    Any idea of these 3 (GERD, IBS, HEMEROIDS) are now pyramiding? I have all 3 but only IBS at 30%. I easily meet the 10% for GERD and HEMEROIDS. Don't want to open any new cases if not Going to increase my overall ratings (83%)

      I totally understand this one. A good friend of mine has a pretty severe TBI and had they not gotten the help they needed, which was a solid VSO and in-person meeting, they would not have gotten the benefits that they deserve. SMC-T has a HUGE pay out upwards of 11k-ish.

    I just went to the docotor for ibs to get a diagnosis because i was denied previously for not having one. Should i wait to sumit a supplement claim until this becomes effective or it does not matter? How do i go about asking my doctor to write a nexus letter for me for the claim. Sadly im under contract with VG, im just waiting to get my decision for MH to cancel with them. Should i wait until i cancel with them to sumit?

      Both. That is scenario 1.
      The VA is forced to award the Veteran the rating from both rating schedules that is HIGHER. Whether that is old (current) or the new change after May 19.

    Honest Question, I am rated IBS, my pain happens only once per month during a constipation phase, But.. lasts at least 4 days during. Would that be considered 1 day per week???
    And yes it hurts, no mistakes on that.

      The rating isn’t for a single day…if your pain is consistent throughout 4 days…then that is 4 days per week. I’d recommend you give this information to your healthcare team and start documenting your symptoms if you haven’t already. As for the increase, YOU need to figure out YOU.       Under the new info GERD, the only diagnosis that would apply is esphogeal stricture, all of the old GERD symptoms such as nausea, vomiting, regurgitation, sub sternal pain, etc are now classified under the peptic ulcer diagnosis . So, don’t put it past the VA to review everyone with a SC for GERD and reduce/remove everyone who doesn’t have an esphogeal stricture diagnosis.

    Now that there is a specific DC for GERD, I didnt see any language addressing whether they will stop pyramid GERD and IBS. If they are going to be separate I wonder if they will separate the grandfathered grants.

I will have to do more researching since the original grant is not the language that this will turn into. Hopefully it as easy as being a straight designation of DC but I doubt it.     I have been out of the service for 20 years now...I have Gerd and had it for a long while.. however I can only get medical records for the last 10 years as my previous Dr. closed down his practice and 20 years ago , I didn't go to the dr. that much. I have never been to a VA Hospital but only had private Dr. and had an Ulcer .. was treated at a private Hospital appx 8 years ago. I have been on Meds for a while for Gerd. Can I file a claim and would my chances getting rated be very low ?

      I just went through something similar-without a direct service connection it will be very difficult, could maybe try a secondary connection if you have it. In my case, I had it listed as a "claimed condition" on my final physical and had already been taking tons of OTC meds which I mentioned all of that on exit physical also. Good luck.

      You can submit the claim b it there are a few factors to consider…what is your evidence from service (if any) that would lead to GERD? Example: documented heartburn. If that’s the case…then direct and that’s fairly simple. If not, then you either make the argument that it is directly from service or you start building a secondary claim. I’d really like to know when you left service and when you started seeking treatment. I’m sure your current evidence at a minimum notes your medical history with GERD that is lost.
      You have the current dx and current evidence - not an issue. You either need the in-service event or start working towards building the nexus to be secondary.

      If you file a symptom under GERD the VA would simply show the DC as GERD assuming you are/will be diagnosed with GERD. Kind of like claiming lower back pain and then the VA changes the DC to lumbosacral strain or whatever diagnosis the veteran ha/gets during the exam.

      No. Not unless you want it to. Our ratings are protected when there is a change to the schedule of ratings UNLESS the veteran asks the VA to change the rating. For you, that would be an increase on your IBS.

      Keep in mind…I ONLY recommend considering IMOS/DBQs when you’ve been denied AND you have the evidence.
      If you’re sitting on a stack of money and don’t care, then do what you think is best for your claim. At the end of the day, IMOs/DBQs only strengthen your claim (assuming the IMO/DBQ is ‘good’ and ‘complete’).

      Most likely, yes. Keep in mind I always recommend submitting EVIDENCE of documented symptoms for increase claims.
      It’s one thing to self-report your symptoms to your C&P examiner. It’s a whole other level when the veteran has HARD medical evidence that can’t be refuted from the C&P examiner.
      Speak with your healthcare team about your symptoms, seek treatment, and submit the claim when ready. In your case, that would be no earlier than May 19, 2024.

    If im rated at 0 for hemorrhoids would i have to refile my claim? I also think I fall under the IBS categories but didn't have it checked while in service should I file for it?

      You absolutely can. I would recommend you start gathering any and all evidence supporting your secondary claim.

      @@TheCivDiv what evidence would be needed? I have a GERD diagnosis and the VA prescribed meds are documented in my VHA record. There are studies that link pain relievers to GERD and I take those OTC on the regular. Do I need a Doc letter?

      NO..the examiner got an eyeful of mine and the bloody maxi pad stuck in my shorts. After 2 failed surgerys ya kinda lose your dignity. Tell your friend.

      Regardless, YOU have to decide what is best for YOU. Depending on that scenario, which I hope I answered in this video, you at least have a direction to start making a plan.       They were and overwhelmingly 0%. Now they will be rated at 10/20% AND separated - that’s the kicker. In my opinion, absolute SOLID change from the VA. BIG win.
