    I’m a National Guard Mday with 21 years of service.Glad you posted this today, I have my separation exam tomorrow for my MEB along with C&P Exams for a bunch of conditions. IBS, GERD, and Hemorrhoids, amongst them.

      I have suffered from IBS for 50 years. Had my gallbladder removed and my IBS became turbo charged. I'm almost basically housebound now.

      @@rmyrvold My GI doctor prescribed Nortriptyline 50MG. Don't think it's really helping much. I had better results take 2 imodium tablets daily. It's the anxiety from having IBS that's difficult to over come when out, afraid of crapping myself. Also had my Gall bladder removed. It was gangrene when they removed it.

    Glad I put an intent to file in February for GERD. Esophageal stricture sounds like the opposite problem of GERD where the esophagus relaxes and allows acid to come back up.
    ETA: the final rule linked by Clay clarifies there was a typo in the initial proposal. The criteria should say dilatation, not dilation. Thanks for posting the source document Clay!

    They checked for GERD but never checked for IBS, even though I mentioned bloating from nearly everything I put in my body. I'm glad you mentioned this. I believe I need to see the doctor and get this sorted out.

    I filed my claim for IBS/Gerd January 29, 2023. I was just awarded a 10% rating for combined GERD/IBS. I def meet the 30% rating for IBS on the old and new rating schedule.
    Any tips on how to go about getting the higher rating for that? Can I get a new CP exam or how does that work?

    How do you suggest dealing with VBA denials citing rationale based on gastro symptoms “diagnosed before primary PTSD diagnosis?” Nam vets and others deal with PTSD being recognized in the DSM in 1980 therefore this “rationale” is used to deny many of us… even thought the primary PTSD recognizes Nam as a “qualified event.”

    I came across this video today 10/11. I have an intent to file submitted on 4/18. I plan to use it for GERD. Clay, do you know if VA has been granting most favorable rating when comparing old and new criteria if intent to file was submitted before 5/19/24?

    Anyone been successful with the separation of IBS and GERD?
    I just got my letter stating they’ve rated each at 30% but are combined due to pyramiding. Any pointers to get them split up?

    My claim for GERD had been at the BVA since July of 2021. My claim for IBS was awarded 0% just this past week. But was resubmitted on my behalf for an increase. Don't know yet who did it. I'm contacting my VSO tomorrow.

    I’m confused by the premise of this video. I don’t understand why you are saying GERD and IBS are “combined” in the current codes (i.e. prior to the new codes becoming effective), because they are not. GERD was rated analogously as DC 7346 (hiatal hernia). IBS was rated analogously as DC 7319 (irritable colon syndrome).
    Those two DCs have distinct symptoms. What am I missing?

      I definitely understand your confusion because I have been diagnosed with both. Submitted 2 separate claims in 2021, rated for both (10% & 30%), but I'm only compensated for the GERD at 30%. I believe my award letter spoke about pyramiding, as I had overlapping symptoms 😳
      I didn't sweat it because that rating alone put me at 100% P&T. If you are not rated as such, it might benefit you to look into it further.

      Because they are (were). Different DCs but the VA would only award the higher rating of the 2. Now they are not.
      The VA combined GERD/IBS because they are the same body system.
      Before May 19 - same same
      After May 19 - not same same

    I have had Gerd for many years and have been on prescriptions for it for around 10 years .. before that I took over the counter, Zantex/ tums etc. I have been out of the military for 20 plus years...when I file for a claim do I have to submit medical paperwork from Doctors/ Hospitals or can I give them the name of the Private Hospital where I went for scans and tests ? I'm really just want to be rated at 0%, not planning to get a monthly check.. if I get more it will be good.

    @3:11 you say the "INTENT TO FILE" prior to rule change locks in the old or new rule depending on what's more favorable to the Veteran. Do you have a source on this? I have heard contradicting information. Even a VA rater I knew had no idea.

      3.951 and you’ll need to dig a bit. Rators also receive training (I’m not sure what that looks like) when it comes to CFR changes.

    I just came here to learn about the conditions I think I have. I'm not applying anything, just asking, if I were applying, I don't have esophagial stricture, but I do take daily madication, so that kinda isn't a 10, but isn't a 0 either...

    If the increase was within the last 12 months. Does the VA require a new c&p exam or would the increase be automatically with the increase request?

    I think the VA only used the new rating schedule. I was only granted 10 percent with GERD with dysphagia and chronic gastritis.

    My claims for both are pending to be submitted. Looks like I need to review what I have. The gerd doesn't look any better, but the ibs is a real s#itshow and might rate up there.

    I filed for GERD Feb 2024, got rated 10% just last week June 2024. They used old rating criteria to adjudicate my claim. If I file a supplemental claim for increase will they still use old GERD criteria?

    they denied my GERD recently and I take meds for it. I'm going to have to claim it as a secondary for my metal health meds.

    So, strange question here. Filed for GERD in June 2022, rated 0% in December 2023. Planned on filing a HLR or supplemental and having my private gastro fill out a DBQ and letter explaining my symptoms on and off meds and how they affect my life. Just found out about this change for GERD. If I file the supplemental, do you think I'll be rated under the old or new rating schedule? I should be at least 10% under the old one (possibly even 30%), and could possibly be 10% under the new one.

    I filed my claim right before the change. I should have gotten 30% under the old rules but only received 10%. The VA didn't use my hiatal hernia diagnosis that they gave me 2 days after my C&P exam. I explained to my examiner that I would be getting an endoscopy. This was all in May. I wasn't awarded until last Aug. What are my options to get them to use my diagnosis under the old rules?

    I just got 30% for asthma ( under pact act) and supposedly the medicine can cause GERD which I been taking medicine for it. I filed for GERD last week

    I have IBS @30%. I also have GERD diagnosed as well as Hemeroids. I submitted my GERD and Hemeroids as secondaries last week. Will these still be pyramiding if the VA determines I have sufficient evidence to connect as secondary? I don't have the "Stricture" word for GERD in my evidence and diagnosis from my doctor.

    i have IBD ( crohn’s disease ) in a MEB. my paper work has not been sent up yet. but my exams were reviewed under the old criteria does that mean now it will be under the new criteria?

    I was rated 30 percent GERD under Old rating Effected Date Dec 2023. I file for IBS under the New Ratings June 12 2024. They combined it with my old GERD rating and effected date 2023. I did not file IBS and GERD at the same time Dec2023. Shouldn’t I have two different ratings?

      It sounds like your ITF for IBS was pre May 19 and if that’s the case…I probably wouldn’t touch it unless your GERD symptoms meet the esophageal structure criteria.

    I’m at 0% for IBS my rate lied on my DBQ so filed for an increase in March…since it’s May 19 will they look at both CFR38s from before today and the updated to see how I’ll be rated?

    If I have not fully submitted my GERD claim by today (19 May) but I have had an intent to file in for a month or two, will I still be grandfathered into the old standards? Thank you for ALL you do!

    Have IBS & GERD at 30%. Got P&T with a couple more items, under the new rules, I should be more. Not sure if it would behoove me to attempt increase.

    So if I have documented gerd, take daily medication for it, but haven't had a barium swallow or endoscopy to document stricture. I cannot claim it for any percentage? About to file bdd So still active duty

    I will be filing a few more claims soon. I’m going to make sure my doctor annotates current IBS schedule for my rating to stay at 30%,which I meet,if they decide to look at that. Will now do an increase to my hemorrhoids to get the 10%,with new schedule.With my others I should get to that hard to reach 100

    I was previously at 90% overall, in Feb I was awarded - Gerd 30% & IBS 30% bringing my total rating to 93%
    I submitted for higher level review Feb 26 and am waiting to hear back on that.
    This stuff makes no sense to me, I really don't understand this video. Should I do anything about this or just wait?

      You have a current claim in and what should happen is the Rator considers both schedules. Good news you have 30% for IBS and unless you have the ES (and other symptoms) of GERD, you will most likely be capped at 30%.
      What that means to you? Nothing. You have a current claim in. Let it go through the process.

    Hey bro can you help explain what "abdominal pain related to defecation" means? Does this mean I have to have abdominal pain because of defecation or while defecating? Because i'd hate to file and dont meet the criteria over some dumb criteria verbage. I have IBS and im glad i filed a file to intent on May 17th, so I dont have to fall under this new criteria.

      @TheCivDiv I mean I have abdominal pain all the time and my defecation is different, different form and stool colors. So that wouldn't work? It's bs they come up with these new rules, that does not always represent the condition.

    My GERD and IBS are awaiting a rater to pick up and finish my claim. They were sent back from an HLR to get another medical opinion, since they screwed it up the first time.

    Off topic but if someone has 100% p&t For both mental health and chronic fatigue is that full health coverage For everything or anything??? Or do they have to file claims for for migrains, ibs, gerd, sleep apnea, Arthitis, carpal tunnel, feet and back??? Literally two days ago I just received my one hundred percent p&t which is why I am asking. Because I hear Don't poke the Bear.But I wanna make sure that I am covered for the rest of the health

    What does it mean to get your condition documented? Does it mean to have a personal dairy or be seen for it and have it medically documened? I 💯 know I'm 80%
    Edit: I haven't had surgery, I may not get 80%😢

    If they separated and I got 30 percent on my Ibs but I got gerd on my military medical record and va medical record and recieve a treatment from them . Can I file for gerd ? Even I got rated already for ibs? Thanks

      You’re going to want evidence from your primary/referred care. Notice how these say documented symptoms with the time frame.

      Concur, I documented my symptoms with every consultation I had with my primary doctor and my VA Healthcare doctor. I was service connected and rated at 30% for IBS. My claim was a supplemental claim for gastritis, but I had relevant evidence for IBS. The rater opened a new claim for gastroenteritis with the service connection for IBS under the 3.317 presumption. My gastritis was denied afterwards.

      @TheCivDiv I'm helping my ex husband with his claim. He has GERD & IBS, is currently rated at 80 % for migraine, urinary issues and lower back, tinnitus. Med service record has "pain in chest, shortness of breath". Just got denied for asthma due to examiner error. I had "stomach issues" listed as it's deferred. MOS was artillery. Thus stuff isn't easy to figure out. I watch all your videos. Thank you!
