    First, sorry for the dirty lens. I was out photographing the starts in the bush late at night recently and it looks like I got something on that lens. I don't have time to record it again as I want to spend that time on our clients.
    Today we had the much anticipated webinar with INZ. We didn't really get much from it, and it probably could have been a 5 minute call rather than an hour.
    We heard about the new INZ system that is coming through later this year which all applications will be moved to.
    We heard a little about the new work visa, though it was the first new information we've heard in a long time.
    We didn't really get anything about SMC. Waiting for an announcement about if the draw restart will be delayed further.
    That was about it.
    In the video we also look at the Living Together criteria, and mention some discussions we've had with INZ recently on this.

    I dont know why govt is pretending fake they are doing little little process why don't they clearly mention tht this year we r going to be lazy in name of covid so accordingly plan it -either you wait caz we will make you more wait or forget nz.
    That will be more helpful for us dont you think.

      Hi Madhuri,
      We agree. We'd love to see the government be honest with what it is planning. It may change, as the world is a little crazy, but if they gave at least an idea of what they are planning and when, it would at least give people some clarity. People can then decide if they want to wait, or look at other options. This current process of saying nothing is just insulting to those who chose to came to NZ to study and contribute.

    Students have applied to New Zealand with a high hope as it is a reputed country. But it feels unsecured country now for international education. Students are seeking different countries now except New Zealand as it does not take fare decision for the students. This is irritating and students have no more reputation to the country

    My partner is a NZ citizen and I am American. We've been in a long distance relationship for 1.5 years. The only reason we aren't living together now is because of border closure. What is the best way to begin the process of joining him? Should I get an ETA first and apply for partnership visa once there, or apply for visa first? Should I purchase a round trip ticket on ETA? We won't meet the living together criteria until I can get there.

      Hi Rowan,
      If you qualify for a CPVV under H6 (partner from a visa waiver country), then the path INZ will expect you to take is to complete an EOI to get an ITA, apply for a CPVV, come to NZ and then, once here, apply for a PWV.
      Unfortuntely, if you don't meet the living together criteria to get the CPVV then that is where your problem will be. INZ is becomming more and more strict about the need to have lived together at some point, and on how that living together is to be judged.
      If you want to email us at visa@shlaw.co.nz we can look at what history you do have. However, if you have never lived together then you won't meet the requirements for H6. That would leave H5.25.15.f as an option, but it is something you should discuss with an expert before it is attempted.

      Not saying it is your case, but could be the cause of delay. Immigration NZ is always suspicious when someone is applying for partnership from a third world country. We have seen this so many times.

    Thanks for this! I was worried about the new employer-assisted visa...as you say, no info has been released for a long time and INZ website still says 'mid-2021' - very little time for employers to prepare, even if they had all the info today! Looks like I'll be applying for another Essential Skills until EOI selections reopen.

      That is why I was getting so frustrated with all of these videos from people talking about the upcoming visas, when we honestly just have so little information, and a lot of work to get employers approved to employ. We think ESWV will be here for at least most of 2021.

    What about if you are an nz citizen? can your partner come live with you on an ETA if they haven't lived with you previously? How does that process work? Do they apply for visa once here? Do they need a return ticket?

      Hi,
      Unfortunatley not. The same living together standard applies to citizens, residents, and critical workers. Most partners coming in are those of citizens/residents. They need to meet the same criteria. If the criteria can be met, they need a CPVV to get to NZ, and then can apply for a further visa once here. They don't need a return ticket as INZ knows that for 99% of them, there is no intention to leave NZ, at least not in the short term. We did a one hour video on the CPVV process about a month or two ago which goes through the process. You might find it helpful. Otherwise please feel free to contact us at visa@shlaw.co.nz.

    Hi Arran, 2 questions - have you done any clips on the key differences between Employer Assisted Work Visa and the Talent Visa (accredited employer). ie: Will the EAVV limit the ability of eventual Permanent Residency for skilled professionals who are offered employment in NZ? & I read that there is slow vaccine rollout in NZ (compared to rest of developed world) any comments on why -as this would naturally exacerbate the MIQ delays..? Thanks!

      Hi Mitesh,
      For the first question, nobody knows. INZ haven't provided the policies yet. They told us yesterday that we would get the poliies in April, and then we will be able to tell. What we do know is that the Talent Visa (accredited employer) scheme is being retired, and there will be a new residence visa based on those earning twice the media wage, How that will work we haven't been told yet, but that is what has been reported by INZ at the start of this year. The Skilled Migrant scheme will remain, but is also being reviewed, again.
      For the second question, NZ has gone through the pandemic on the mantra of "be kind". That extended to the vaccine where the government felt it was better for it to go to countries that desperately needed it than for NZ, a country with only 5 deaths per million (compared to over 1,000 deaths per million in other countries). I compare it to the idea that you give the medicine to the sick person before you give it to the healthy person. What it means is the we are only just starting to roll out the vaccines now, and won't start large rollouts until later. I'm in the lowest level of prority so go last, with my group starting in July but likely to take a few months. So we don't expect to be finished until October/November. This will mean that NZ does stay closed for longer, and MIQ will stay in place. We may get to a point where we look at other options, such as self issolation for those from Covid19 free coutnries who have been vaccinated, though the government hasn't made any announcements (our government has a habit of not saying anything important until the last moment, even recently it made an announced that it would make an announcement on 6 April about opening up our border to Australia). So they haven't given a game plan on how they plan to handle things.

    Hi, I just want to ask. My family applied for resident visa under WTR (talent accredited visa) last November 2020 since my father stayed already in NZ for 2 years. I'm here in the Philippines and my family lives in NZ. How months do we wait for our resident visa to be approved?

      Hi Raylar,
      The residence visas from the WTR process are taking the same allocation time as SMC. So for non-priority they are currently allocating application from August 2019. If things don't change, and it continues at the same pace, we'd expect allocation at some point in late 2022. That is when an immigration officer will start looking at it. Of course things are likely to change between now and then, we just don't know how.

    This just exaggerates the uncertainties specially for workers making it in NZ regardless of holding a valid visa

      Hi Veronica,
      Every worker in NZ should be holding a visa, otherwise it takes a lot of work to fix. Yes, the dragged out lack of information helps no-one. If INZ announce they are going to do something then they should do it. We expect it is government meddling that is causing the issues as, until the current government came in, INZ was reasonablly good at sticking to schedules.

    Hi Stace! Why is there a delay during the processing of residency for a nurse working in the public hospital as those compared to aged care?

      Hi Sherin,
      I'm not quite sure what you're asking? If you mean SMC then a nurse is a roll that requires registration, so it is given priority meaning it is allocated within two weeks of the application being made (and with all applications now due in since draws stopped, these should now all be allocated). Aged care work often won't require registration so isn't eligible for priority, meaning that SMC application under aged care have to wait for allocation, which is currently taking 19 months (and getting slower).

      At present the draws are meant to restart in April. However, on Friday they said that the Minister would be making an announcement soon. We expect the announcement will be a further delay, but we'll post something as soon as we know more.

    How much time of living together is required for partnership visitor visa ?
    Me and my husband got married in 2018 December, stayed together around 24 days then he left for NZ due to work commitments due to corona we didn't met from then till now
    He just received his visa few days back
    He holds residence visa now
    He is coming home for 2 months is that time enough for us to apply for my partnership visitor visa ?

      Hi Shenal,
      I'm assuming you are offshore (as if you are onshore than INZ have dropped the ball). Offshore work visa applications are only being processed if there is a border exception, as INZ can only grant a visa that can be used to enter NZ, and with the border closed only those with border exceptions can enter NZ. So that is likely why it is in queue, as INZ can't grant it.

      Yes im from offshore. Its almost a year now that my application is in queue. When INZ start processing my application, Do they ask for labour market test again? And what about the new rules for work visas like accredited employer rule.Those rules applicable for previously lodged work visa applications? My lodging date is 30 th april 2020.

    Hi aaron , we have applied for PVV as its the Fourth applicable and all the Time issue is for Living Together as my Husband is NZ citizen . Moroever due to Covid it became and much more issue . So does NZ immigration is thinking to sort issues for split families as well .

      Hi Shikha,
      Unfortunately it isn't INZ that makes those decisions but the government (INZ are generally a very nice group of people who want to help people, but they have to follow the government's orders). MP Erica Stanford has been asking the Minister of Immigration again and again about split families, but keeps getting back the "we're keeping NZ safe" response. Of course, that doesn't explain why a Queen tribute band just got visas.
      So the government has its head in the sand about split families, but we, the MP, and the media, are doing what we can to remind them. If they announce a bubble with Australia then it is the perfect time to allow more families to be reunited. However, apart from the usual rumours we hear, there has been nothing definite from the government about the rules changing.

    I have submitted my application for Skill Migrate Category last year, and currently the application is awaiting for the allocation of case-officer. This application is in general bucket, and there is no or little information on how the things are processing at this moment.
    Question:
    1. Will this new visa which are you referring above impact the SMC application which are currently in pool? (Sorry if you already provided an answer) :)
    2. From your experience and current situation, what time-frame do you suggest/see for the such application which are currently in pool?

      Hi Sanjay,
      Just to clarify, with SMC the application does not take place until after the draw. I did a breakdown of the process here migrationpartners.co.nz/skilled-migrant-reisdence-visa-process/ and the application isn't considered made until after the ITA has been provided.
      1. So for application that have been made, and are awaiting allocation, then no, any SMC application already made will continue on the rules that were in place when the application was made. Any changes to the rules won't impact them (this is how INZ have always handled things, so that people can be certain as to what the rules are for their application). So if you've
      2. EOIs that are still sitting in the pool will be waiting for the draw to restart. This is supposed to be in April but we expect it will be delayed another 3 or 6 months. For those application that have been made (so post-ITA), non-priority applications are currently taking 19 months, but it is getting slower by about 1-2 weeks each month, so in June we expect it will be take 20 months, in August 21 months. They have started allocating non-priority applications made in August 2019.

    Hi Arran, my boyfriend is currently holding working visa in New Zealand. Last year I left Italy because I plan to move in with him in Nz. Unfortunately the pandemic arrived unexpectedly. Every year my boyfriend and I went to philippines and we’ve stayed together in our house during our holidays since we both working different country. But we have property together we have also joint accounts. Is there any possibility we can apply living together cpvv?

      Hi Maricris,
      The issue will be whether you can enter due to your boyfriend. Partners of work visa holders are not generally given a border exception. The only opportunity would be either if he can gain a border exception and then bring you in as his partner or if you can gain a border exception through your employment. Both of these are unlikely, but they are options. If it's based purely on your partnership with a work visa holder, then there is no border exceptions currently available based just on that.

    Hi Arran, just a few questions, I am a NZ citizen living in Mexico with my Mexican partner. We just recently applied for a EOI to request to travel for a CPVV on the basis of partnership which was denied because we haven't demonstrated our relationship meets the criteria of INZ. However, on the online form, there is no opportunity given to attach any supporting documents to show any evidence of having a genuine, stable relationship (which we have). We had our application denied very fast (one day), and feel like we had no due process to prove our situation. Any advice is appreciated, thanks!

      Hi Michael,
      It is a frustrating process, as they give you 3,000 character to justify the basis of your relationship. So they're judging your relationship on E4.5.20-35 that are listed here www.immigration.govt.nz/opsmanual/#46512.htm, and you need to satisfy them that your relationship meets that criteria in that 3,000 characters. For most this issue is the living together requirements. INZ do have a lot of discretion, meaning that what one person may decline another may accept. The opportunity to provide evidence only comes once you've justified it in 3,000 characters. We have assisted people in Mexico with the CPVV process if that helps.

      They haven't said, and haven't given any indication of whether this is something they would consider before the border opens. So, from that, at the moment all we can say is when the border opens.

      Hi Aaron,
      If you're onshore then it should be processed as normal, so about 1 month for most. If you're offshore then it won't be processed until the border opens, unless a border exception is granted (and they aren't granted based on accreditation), as INZ cannot grant a visa that cannot be used which, with the border closed, is most visas.

    New Zealand should open its borders for students and tourism sector for International tourists with "exemption of Covid Vaccination certificate". Becoz if they see the covid situation Internationally, vaccination has been started in most of the countries. And this will go long, and if they close borders for long, it will itself damage to New Zealand's economy. But with vaccination certificate they can start to boost their economy once again with tourism and international students. and we all know that tourism is the major earning sector for New Zealand.

      The government could certainly be doing more, even if it's just a plan, some idea as to when things will open and to whom. At the moment, all we see is the government extending it's own powers, and the Prime Minister helping the Wiggles, and no helping the nurses and doctors, or the universities, or anyone who isn't famous.

      Yes you are absolutely right. But i think if NZ Govt is vaccinating the borders front line workers first and their families.. what is that mean by the way...we can take this as they definitely have some plan to open borders, that's why they putting border workers on priority for vaccination.     Hi, I now hold a limited visa, because I still have a problem that hasn't been resolved, I have a question, can I apply for another visa if my limited visa has expired? If possible, what visa should I apply for? thanks

      Hi,
      As you'll know, a limited visa has strict criteria including being unable to apply for another visa while still in New Zealand. It's granted for a specific purpose, an INZ provide it on the basis that it is a one off. We'd need to look in to it and your situation, which is something we'd only be able to do by being engaged.       Hi Ravi,
      We can really only give you an example of an IPT residency appeal we handled recently to give you idea of timeframes. We applied 5 November 2020. A decision was received on 2 February 2021 granting a visa. The visa was then received on 8 March. So IPT has certainly gotten faster than it was a few years ago. That wasn't an SMC appeal, but it should be relatively similar for time.

      Hi Sherwyn,
      Unfortunately it means that INZ won't see your relationship as genuine and stable. It is something we have raised with them several times, as we have had clients from several different religions, and different parts of the world, caught out because they've followed religious or cultural beliefs. We don't believe it makes a relationship any less genuine or stable, but the government disagrees.
      Unfortunately there is no exemptions for that, as there are so many people who have been caught by this issue. The only option would be to apply on humanitarian grounds, and this is highly unlikely to meet the threshold. We're sure many have tried.

    If I applied for a EOI under a partner visa but it was denied due to lack of living together because of covid, does that mean I could never apply for another partner visa if later down the line I meet the requirements?

      Hi Jess,
      A decline doesn't mean you are prevented from applying again. Just make sure that, when you apply again, you tick the box to confirm you were previously declined. Being declined can happen for a number of reasons, and most shouldn't impact future applications. We often see INZ granting visas to people who were previously declined.

    I applied for residence under the Skilled migrant category on February 2020 (with all documents and fees paid) as I'm offshore how, I understand from your videos that my application is not being processed, what I want to know is: Will it be affected by any changes on requirements? are my documents and point still valid?       No, as your application has already been submitted, any changes to the requirements shouldn't impact you as the rules that are applied are those that were in place when the application was lodged. This has been INZ's process to date (at one point they offered people the chance to chose whether to go by the new or old rules, but they've never applied news rules on old applications).

It is NOT a visa, and is only usable when the border is not closed, and only for people from visa waiver countries. Some people are using it as part of scams, telling people that it is a visa when it isn't. All it means is that the person on the NZETA has paid a small amount to help keep NZ's parks clean.

      Hi Saravanan,
      Offshore SMC applications are not currently being processed while the border is closed, as INZ cannot grant a visa that cannot be used. So while the onshore allocations are now up to those applications files in August 2019, the offshore queue is sitting somewhere in late 2018/early 2019 but isn't moving. Most likely it wont move until the border opens.

      Hi Sellote,
      It will come down to how long he was in the Philippines, for what reason and what kind of evidence you can find for it. If it is was a visit and was short then INZ may not be satisifed about the living together criteria. I asked the border exception head about what discretion INZ have regarding living together, as we had a client who had other evidence of the relationship, but the response suggested there wasn't much discretion. INZ are looking for evidence of living together, and there isn't much that will replace that if anything.
      As the Philippines isn't a visa waiver country, your partner would need to go to the Philippines to collect you, which could also be difficult (and we wouldn't recommend he tries without knowing if you can get a visa).
      For VVs there isn't much change. General visitor visas are not being processed and won't be until the border opens. Partnership Visitor Visas require the partners to be living together at the time the visa is applied for and processed, so that won't be an option. That is why the CPVV for partners was created as it provided an easier pathway, as it didn't need the couple to be living together at the time they applied.

But we are offering to check visas for people if they email them through. Same with employment agreements, we can confirm if they are fake. General rule is that two year visas are fake, as there is no two year work visas at INZ (they were phased out a couple of years ago).

    I have a friend in myanmar who's in a really bad situation right now. she's 20 and lives with her abusive partner and she has no access to education or how to fund herself. she's been sexually abused in the past and has no support from her parents who are also abusive. They are persecuting people in the streets of Myanmar and might go to war. she's living in fear and has no where to go. is she eligible for asylum in NZ?

      While NZ does have humanitarian visa options available, with 5,500-6,600 humanitarian residence visas allocated to the current 18 month period. However, there needs to be some form of strong connection to New Zealand. Unfortunately it can't be based solely on the situation alone. H5.30.25 gives a good listing of what INZ would be looking for to grant a humanitarian border exception www.immigration.govt.nz/opsmanual/#73514.htm which excludes most people.

      Unfortunately they haven't said. Most likely, when they look at opening up for more students, they will target first at those studying level7 and above so that the border isn't too overloaded. Level 5 may need to wait until the border opens.

      Hi Anuj,
      Not really. PVVs require the parties to be living together so, if that was the case, then a CPVV would be the more obvious choice. Otherwise, if not residents/citizens, then one of you would need a border exception and the other to be included as a partner. PVVs are generally only used if an NZ citizen or resident was looking to visit NZ temporarily and wanted to bring their partner, something which isn't happening at the moment, so people are using CPVVs. Other than that they really have no purpose.

      Hi Simran,
      India isn't a visa waiver country, meaning that you would only be able to get a border exception allowing you to travel with your partner. However, if you've only had one month together, and your partner then returned to New Zealand, you may have difficulty meeting INZ's living together standards. We would recommend you get legal advice before your partner tried to collect you.

      Hi Sadaf,
      You can submit EOIs now. The question we all have is when will the government will start the draws again. At the moment the draws are on pause until this month, April 2021. However, we are waiting for an announcement from the Minister of Immigration as to when those draws will restart, whether they will restart this month or, more likely, whether they will be delayed further.
      The issue that so many have, and it's completely understandable, is that the government is not providing any sort of plan. They seen to be reacting when required. This keeps INZ blind, it keeps lawyers and advisers blind, and it keeps visa holders and applicants blind. All we do know is that if you are a celebrity, the government, including the Prime Minister, will get involved. If you are anybody else, including a doctor or a nurse, the government will not get involved, they will sit back and not provide any assistance or useful information.

      So the LTSSL is the Long Term Skill Shortage Visa, which means that there is a recognised shortage of people with that experience in NZ, making visa applications easier. However, it doesn't allow a border exception, so those applying for jobs under the LTSSL from outside NZ are having troubles entering.

    My wife is having essential skill work visa working as a caregiver in Bupa NZ services Ltd in Newzealand coming mid skilled category expiring on May 4 2023.
    I would like to know whether my wife's occupation is considered as critical health worker. If so, whether my son who is 9 years old staying in India currently can travel to newzealand under border exception rule.what are the options available?
    Note: My son,me and my wife where together in newzealand from September 2015 to Jan 18 2018.

      Hi Krishna,
      We'd need to have you as clients, and to see the documents, to be able to give advice as to what path you should take, and to ensure that your wifes job does fall under critical health worker. Without that we can't give that advice.
      However, we can talk about the process in general terms. If people can show living together, and there is a critical health worker role, then the worker, partner, and children, can apply for a CPVV as a critical health worker, partner and dependants (the partner doesn't need to be included). However, the critical health worker needs to be with them when they apply, meaning they need to leave NZ to be with their family. With MIQ delays, this could mean months out of NZ, as well as costs for MIQ.
      For that reason, we strongly recommend that anyone looking at trying to leave NZ to bring their family back get legal advice before they try, as it will cost them a lot of money to try and fail. That's one of the reasons we can't give advice without seeing the documents.

      If you mean just general visitor visas, we expect these will start again at the end of this year or early next year. We're expecting a staggered border opening.
      If you mean resident visas, most likely the government won't look at starting the parent resident visa draw until after the border opens, and even then it may be a few months after. This was a visa type that was paused 4-5 years ago and was due to reopen at the start of 2020, but that was delayed. The government has mentioned that they do want to reopen it, and make it easier for parents, but that it will need to wait for things to return to normal. Whether that means normal as in open border, or normal as in back to how things were in 2019, isn't clear. Our best assumption is that we're looking at the parent resident visa starting in mid/late 2022, with perhaps a reduction in the high salary requirements.

      For SMC? It's hard to say. There are four scenarios:
      1. If you don't apply, but they don't apply any changes to those in the pool, then you may miss out on being able to use the current point schedule.
      2. If you do apply, and they don't apply any changes to those in the pool, then you may be able to use the currently point system.
      3. If you do apply, but they change the points and require the new points, you may find that you've pay an application fee for nothing (INZ are not good with refunding fees).
      4. If you don't apply, but they change the points and require the new points, you've saved the fee and can still look at applying.
      So applying now may mean being judged by the current points, or they could just apply any new set of points they want. So pros and cons both ways.

      Unfortunately, INZ is not currently processing visitor visas for partners of work visa holders (except for CPVVs where a border excetion is available). For you this will mean that your application is probably sitting untouched, and it won't be looked at until the border reopens. We dont expect the government to chage this in July.

      If you husband is a resident or citizen then you could look at a CPVV. He would need to be with you, and whether you are successful will likely fall upon whether you meet the criteria for living together. If he was to spend six month with you then it is possible that a CPVV will be granted. However, in six months we may also be close to the border opening.

      It has been constantly moving targets, so migrants really don't know where they stand. If there was a set of rules that could be followed, it may be easier, but as we see partners to healthcare workers denied (forcing the healthcare workers to leave NZ to get them) on the basis of "keeping NZ safe", we see the government letting in tribute acts and children's entertainers. We force the medical staff out, while letting in entertainers, on the basis of "keeping NZ safe".
      The government seems to be doing very little planning. It seems to be a lot of reacting, rather than being proactive.
