Hi Tom, For a lot of people, they just need a little bit of information, just to point them in the right direction, clarify what terms mean etc. We think that the immigration process should be easy enough for most people that they don't need lawyers or advisers. So, instead of charging lots of clients small amounts for those little bits of information, it just seemed easier to provide it free through RUclips (and spending an hour a day responding to enquiries). It means that people may be able to do it on their own (saving themselves money and stress), and we can then focus our time on clients who need more help (and hope that people then come to us when they do have those more complicated issues). Hello Arran, Thank you for your continious updates. We always had hopes that INZ will roll out the updates on SMC and resume EOI selections. I have submitted in my EOI with a score of 165 as an offshore applicant 8 months ago and my skill is on the shortage list. But unfortunately, given these updates and after I watched the the parliament review on the new legislation extending the government powers, I think we have a very long way to go… If resolving basic issues like bringing family of healthcare workers are now considered a "big leap", then RIP INZ.
Hi Omar, We're of much the same view. The focus seems to be off. For us, even if they gave a plan, a schedule of when things are expected to take place, then people could make plans. But nothing, just bringing in changes to fix what they call an anomaly, but in reality it was an issue they created because they didn't give it enough thought (and even now, they forgot about the family of NZ citizens and resident health care workers who won't be allowed to enter). We submitted to the select committee that the government cannot delay the SMC draws, as they right to delay only allows for offshore applicants. We'll have to see if they correct it, or whether they just ignore it. Arran

Hi Alistair, Haha thanks, you are too kind. Honestly, if the Immigration Act allowed us to get the current policy reviewed in a court (especially the living together interpretation being taken by INZ), we expect we would be there. We find it hard to understand some of the decisions being made by INZ when it comes to those offshore, but expect it is created by pressure from the government. The recent ombudsman decision recommended INZ refund applications on request for those who had applied for SMC before 24 February 2020. We're looking at going to the ombudsman on a matter for a client offshore, so maybe we can angle for something similar. Arran
Hi Gagandeep, It's a situation where we need to bite things off in bits. The government was never going to open the border to all partners and families. So we took the approach of doing it in chunks, looking at one group and fighting for them. Hi Balkan, CAP students are considered critical health workers so, come 30 April, from what they've said, your husband should be able to apply as the partner of someone considered as a critical health worker. However, we want to see the official wording before we can be certain so, at the moment, it looks likely, but we haven't seen the official rules yet. We'll post a video when they come through. Arran
Hi Prerepa, The last we heard was from about a month ago, that the Minister would make an announcement in the next few weeks. Originally there was meant to be an announcement at the end of March, but that never came. We believe that the announced review is their attempt at justification for delaying it further, and on Monday that review was stated as occuring "some time this year". We did raise the legalities of the delay in our submission which isn't yet available online. We really don't believe it should be delayed further, but expect that the government may do just that. Hi Dhruval, We'd need to look at your employment agreement to confirm that the role fits a role deemed as being critical health. However, we would need to check, especially as you are on an open work visa so INZ has not looked at your role previously to see what ANZSCO role fits best. Arran

Hi Japdeep, We're expecting changes, but we've been expecting changes for a while now and INZ keep delaying them. We may see the point requirement move up or down, but we will also likely see the point scores for different categories change. So they may keep the points the same, but put a greater focus on one area over another. I don't want to make suggestions as people may think I'm suggesting that, and then a new rumour starts. Hi Stace, My Fiancée and I are in this exact situation. I have been refused a critical purpose visa for failing to produce living together evidence. They wont even give me an invitation to apply now. We both work on yachts but have 6 months leave per year which we spend together. In immigrations eyes, the past 4 years of our relationship count towards nothing due to these circumstances. Now being told by a lawyer that we should quit our jobs and live together in the UK just to build more evidence. We both earn good money and this is our careers. Hi Simmi, We really can't comment on whether a course or particular job is in demand, apart from directing people to look at the Long Term Skill Shortage List and the Regional Skill Shortage List. As to when people can enter NZ, that is something that nobody knows yet. Hi Peter, INZ will argue that you aren't buying the visa, but instead paying for the cost of processing the visa, but we do know what you mean. In the past INZ have been great in helping to get things pushed through to prevent the need for another visa (if there was perhaps a few weeks difference). However, with the government restricting residence numbers, its slowed things down. The delay comes down to the government reducing the number of residence visas that INZ can grant, in what they call the NZPR number. A new number is due in July so we're hoping for an increase in the residence visas that INZ can grant, which should make things faster. Arran

Hi Mohamed, Your visa will only go as long as your job. So if you contract ends in October then you won't be able to get a longer visa. You'll need to either get a new contract, or a permnent role, after which your family should be able to apply. However, we are basing this just on the Minister's announcement today. Our residence approved while we were offshore. Due to covid we could not enter to activate our RV and it expired in july 2020 but then minister extended it to sept 2021 but no travel exemprions were granted to resident visa holders offshore. Hi Beenish, At the moment the Minister has not extended it further. However, the Minister is seeking a two year extension to the power that allowed him to extend it previously, and we expect that he will gain it. He will then be able to extend it further. We expect that this is more likely what will occur. If he doesn't extend it further, it makes the earlier extension pointless, which is why we expect he will extend them. Arran

Hi Vishal, INZ can chose if they will apply any changes to those who have already submitted or not, they get that choice (well, the government will make that choice). Once applications are drawn then that is when the law in place sticks, until then it can change. So if they change then the application will need to fill the new requirements. INZ haven't said what will happen if they don't, as it has never happened before, as they always give warning, and do at least one draw, before things change. But we've also never had a one year delay in draws before. Arran

Hi Ramandeep, There is a difference between essential workers and the exemptions that we are about to see INZ release. The exemptions are based around critical health workers and those who can be classified as being other critical workers which typically requires proving that they have a unique technical speciality that NZ needs and that they earn at least twice the median wage (we are simplifying the rules a little, but it is a high threshold that few people will meet). Unfortunately, that will possible mean that the changes will not cover you. However, we will be doing a video breakdown of the changes to the operational manual as soon as they are available, which we hope will be today or tomorrow, as they come in to effect in three days time. Hi, There hasn't been any announcement about these visa types, and likely there won't be. As student visas are largely still blocked, and post study work visa holders can't enter, it's unlikely that the government will see their partners as a priority. The question as to what will happen to those whose visas have expired is one that the government has been asked about but refused to comment on. It is unlikely that the government will extend already expired visas, as this doesn't fit in with how they are handling things for other visas types. Neither can we see the government offering a new application at a discount, as the visa fee is there to cover the cost of processing the visa. The government may look at allowing people with those visa types to apply for another, though if they do we don't believe it will be this year, as the government is not wanting us to rush the borders open. Hi, People in NZ without a visa need to lodge an application under s61, being a paper based application to a specialist team who handle that situation. If you are offshore then you won't be able to apply at the moment without a valid border exception. Arran
Hi, At the moment, very few people can apply for a student visa due to the border being closed. When the border is opened, there is no set English language ability set by INZ. Rather, it is judged by the education provider under U3.5.c which requires the education provider to determine if the English level is sufficient for the study program. This will differ depending on the course, so some will require higher English levels, while others will require lower English levels. The education provider is the one who will set the requirements. Hi Abdullah, Thanks for the compliment :) INZ is currently only processing a small number, but those studying level 7 or higher who were in NZ studying for the same qualificaiton in 2019 or 2020. So it's to allow students who were already studying to return and complete their qualifications. For everyone else, processing is not occuring. Visas being granted now have a border exception allowance (as INZ can't grant a visa that cannot be used), so once visa processing is occuring, every person who gets a visa will have the right to travel to NZ. Hi, As you've lived together, and you're pregnant with his child, he would likely have a good chance under H5.25.15.f and H6 to get a border exception. There is still a need to provide a lot of evidence, and he's need to get medicals, FBI clearance etc. By AirNZ's rules (we assume other airlines will have similar rules) you can fly back until your 36th week, not giving him much time if he was to fly back to NZ with you, so he's want to get moving asap. I am so disappointed that INZ wouldn't approve my request back to nz to reunion with my partner who is a citizen just because we didn't live together. I left nz because my dad passed away out of sudden. Now I am suffering from the death of my dad and not living with my partner both. Hi Rovarn, There is no requirement to have lived together for 12 months for a partnership visa, that is only for residency. The requirement for CPVV and partnership work visas is that you have lived together long enough to satsfy the immigration officer that you are in a genuine and stable relationship. Hi Marcus, We're not going to defend the government. We used to, but then we saw them denying partners while letting in any entertainer who wanted to arrive. Their application of the Living Together criteria on some applications does not follow the operaitonal manual, and we believe would be rejected if we were able to get a court to review (which we can't under the Immigration Act). Hi Jini, Do you mean whether care givers can apply for residency through Skilled Migrant Category? A recent change has added Aged or Disabled Carer as an exception, meaning that while they are classified as unskilled by ANZSCO, INZ is now classifying that role as skilled. Hi Sowmen, It's often hard to offset one against the other. I do know that I'd rather see partners in NZ than entertainers who are coming to perform once or twice. Simiarly, post study work visa holders have dedicated time to this country, studied here, and now are looking to build a future here. They've shown loyalty to this country, and provided value. We with the government would see that and, if they won't open the border, at least give a timetable and the promise to extend that work visa to allow those people a chance at a future in NZ once the border opens. Hi, You don't need 12 months of evidence. You just need enough to show that you have lived together ina genuine and stable relationship. I applied for a request to travel this month but got denied. My partner is a filipino and an NZ resident as well. Hi Grace, It is so frustrating for us, as we talk to such amazing people, people who want to come to NZ to be with their partners, people who want to come to NZ to study, to build a life here. Yet, the government has decided that a long term commitment to NZ is worth less than someone who wants to perform at a concert, or play some sport. Hi Harpreet, Big doesn't necessarily mean an increase, it just means that there are a number of changes occuring. Yes, Canada, a country with 8x NZ's population, and about 1000x the number of deaths from Covid19, are giving out a lot of residencies as, unlike NZ, they don't have much chance of keeping Covid19 out. They had 11,787 new cases yesterday. So it isn't an easy comparison. If they could keep Canada safe then you'd likely see a similar response to that of New Zealand. However they can't, so they are using residence visas to bring in new talent. Arran

Hi Enock, Unfortunately social work is not on any of the critical lists, so even if you had a job offer, it's unlikely you would be allowed to enter. Once the border is open, if you had a job offer, you may be able to enter. Social work now required registration, so you may want to look at that in advance to see if and how you can gain registration. Arran

For a lot of people, they just need a little bit of information, just to point them in the right direction, clarify what terms mean etc. We think that the immigration process should be easy enough for most people that they don't need lawyers or advisers. So, instead of charging lots of clients small amounts for those little bits of information, it just seemed easier to provide it free through RUclips (and spending an hour a day responding to enquiries). It means that people may be able to do it on their own (saving themselves money and stress), and we can then focus our time on clients who need more help (and hope that people then come to us when they do have those more complicated issues).

I have submitted in my EOI with a score of 165 as an offshore applicant 8 months ago and my skill is on the shortage list. But unfortunately, given these updates and after I watched the the parliament review on the new legislation extending the government powers, I think we have a very long way to go…

We're of much the same view. The focus seems to be off. For us, even if they gave a plan, a schedule of when things are expected to take place, then people could make plans. But nothing, just bringing in changes to fix what they call an anomaly, but in reality it was an issue they created because they didn't give it enough thought (and even now, they forgot about the family of NZ citizens and resident health care workers who won't be allowed to enter).
We submitted to the select committee that the government cannot delay the SMC draws, as they right to delay only allows for offshore applicants. We'll have to see if they correct it, or whether they just ignore it.

Haha thanks, you are too kind. Honestly, if the Immigration Act allowed us to get the current policy reviewed in a court (especially the living together interpretation being taken by INZ), we expect we would be there. We find it hard to understand some of the decisions being made by INZ when it comes to those offshore, but expect it is created by pressure from the government. The recent ombudsman decision recommended INZ refund applications on request for those who had applied for SMC before 24 February 2020. We're looking at going to the ombudsman on a matter for a client offshore, so maybe we can angle for something similar.

It's a situation where we need to bite things off in bits. The government was never going to open the border to all partners and families. So we took the approach of doing it in chunks, looking at one group and fighting for them. Now we'll shift our focus to help other groups (and continue to help the partners of citizen/resident critical health workers who have been forgotten here).

I have a two-year open work visa and am currently a CAP course student for my nursing registration. I am aiming to get my registration on 10 June 2021. My question is about my husband, who has also a work visa partner of a worker and is now outside of NZ. Additionally, our current visa will expire in October 2021. CAP students are considered critical health workers so, come 30 April, from what they've said, your husband should be able to apply as the partner of someone considered as a critical health worker. However, we want to see the official wording before we can be certain so, at the moment, it looks likely, but we haven't seen the official rules yet. We'll post a video when they come through.

The last we heard was from about a month ago, that the Minister would make an announcement in the next few weeks. Originally there was meant to be an announcement at the end of March, but that never came. We believe that the announced review is their attempt at justification for delaying it further, and on Monday that review was stated as occuring "some time this year". We did raise the legalities of the delay in our submission which isn't yet available online. We really don't believe it should be delayed further, but expect that the government may do just that.

Dammit! i wish i found this channel last year! we wish we had gotten a lawyer or service to have helped us, we just couldnt afford it, but as soon as we contact a Labour Mp who referred us to a lawyer, the ball starts rolling and we now have a partnership residency, after 5 years of being told different information from INZ phone line 🤦🏽♀️

We'd need to look at your employment agreement to confirm that the role fits a role deemed as being critical health. However, we would need to check, especially as you are on an open work visa so INZ has not looked at your role previously to see what ANZSCO role fits best.

We're expecting changes, but we've been expecting changes for a while now and INZ keep delaying them. We may see the point requirement move up or down, but we will also likely see the point scores for different categories change. So they may keep the points the same, but put a greater focus on one area over another. I don't want to make suggestions as people may think I'm suggesting that, and then a new rumour starts. So we're saying that the best things to do is wait for something to be released. We'll be covering it as soon as it is.

We both work on yachts but have 6 months leave per year which we spend together. In immigrations eyes, the past 4 years of our relationship count towards nothing due to these circumstances. Now being told by a lawyer that we should quit our jobs and live together in the UK just to build more evidence. We both earn good money and this is our careers. We really can't comment on whether a course or particular job is in demand, apart from directing people to look at the Long Term Skill Shortage List and the Regional Skill Shortage List. As to when people can enter NZ, that is something that nobody knows yet. We don't believe the border will open this year, though the government is slowly adding more exceptions as to who can enter over time.

INZ will argue that you aren't buying the visa, but instead paying for the cost of processing the visa, but we do know what you mean. In the past INZ have been great in helping to get things pushed through to prevent the need for another visa (if there was perhaps a few weeks difference). However, with the government restricting residence numbers, its slowed things down. The delay comes down to the government reducing the number of residence visas that INZ can grant, in what they call the NZPR number. A new number is due in July so we're hoping for an increase in the residence visas that INZ can grant, which should make things faster.

Your visa will only go as long as your job. So if you contract ends in October then you won't be able to get a longer visa. You'll need to either get a new contract, or a permnent role, after which your family should be able to apply. However, we are basing this just on the Minister's announcement today. We need to see the official rule changes to be certain.

Our residence approved while we were offshore. Due to covid we could not enter to activate our RV and it expired in july 2020 but then minister extended it to sept 2021 but no travel exemprions were granted to resident visa holders offshore. I am worried that will govt further extend our visas until the borders open or will our visas expire again without entering nz. Very stressed

At the moment the Minister has not extended it further. However, the Minister is seeking a two year extension to the power that allowed him to extend it previously, and we expect that he will gain it. He will then be able to extend it further. We expect that this is more likely what will occur. If he doesn't extend it further, it makes the earlier extension pointless, which is why we expect he will extend them.

INZ can chose if they will apply any changes to those who have already submitted or not, they get that choice (well, the government will make that choice). Once applications are drawn then that is when the law in place sticks, until then it can change. So if they change then the application will need to fill the new requirements. INZ haven't said what will happen if they don't, as it has never happened before, as they always give warning, and do at least one draw, before things change. But we've also never had a one year delay in draws before.

The govermnment hasn't set a date that things will open. We've asked for it. The opposition party has asked for it. At the moment, it's all just guesses. We're hoping that it'll start later this year or early 2022, and will almost certainly be after vaccinations have taken place (which are due to be completed by December 2021). However, there is no official date yet, or even a plan or guide.

There is a difference between essential workers and the exemptions that we are about to see INZ release. The exemptions are based around critical health workers and those who can be classified as being other critical workers which typically requires proving that they have a unique technical speciality that NZ needs and that they earn at least twice the median wage (we are simplifying the rules a little, but it is a high threshold that few people will meet). Unfortunately, that will possible mean that the changes will not cover you. However, we will be doing a video breakdown of the changes to the operational manual as soon as they are available, which we hope will be today or tomorrow, as they come in to effect in three days time.

There hasn't been any announcement about these visa types, and likely there won't be. As student visas are largely still blocked, and post study work visa holders can't enter, it's unlikely that the government will see their partners as a priority.
The question as to what will happen to those whose visas have expired is one that the government has been asked about but refused to comment on. It is unlikely that the government will extend already expired visas, as this doesn't fit in with how they are handling things for other visas types. Neither can we see the government offering a new application at a discount, as the visa fee is there to cover the cost of processing the visa. The government may look at allowing people with those visa types to apply for another, though if they do we don't believe it will be this year, as the government is not wanting us to rush the borders open.

People in NZ without a visa need to lodge an application under s61, being a paper based application to a specialist team who handle that situation. If you are offshore then you won't be able to apply at the moment without a valid border exception.

At the moment, very few people can apply for a student visa due to the border being closed. When the border is opened, there is no set English language ability set by INZ. Rather, it is judged by the education provider under U3.5.c which requires the education provider to determine if the English level is sufficient for the study program. This will differ depending on the course, so some will require higher English levels, while others will require lower English levels. The education provider is the one who will set the requirements.

Thanks for the compliment :) INZ is currently only processing a small number, but those studying level 7 or higher who were in NZ studying for the same qualificaiton in 2019 or 2020. So it's to allow students who were already studying to return and complete their qualifications. For everyone else, processing is not occuring.
Visas being granted now have a border exception allowance (as INZ can't grant a visa that cannot be used), so once visa processing is occuring, every person who gets a visa will have the right to travel to NZ.

As you've lived together, and you're pregnant with his child, he would likely have a good chance under H5.25.15.f and H6 to get a border exception. There is still a need to provide a lot of evidence, and he's need to get medicals, FBI clearance etc. By AirNZ's rules (we assume other airlines will have similar rules) you can fly back until your 36th week, not giving him much time if he was to fly back to NZ with you, so he's want to get moving asap. I am so disappointed that INZ wouldn't approve my request back to nz to reunion with my partner who is a citizen just because we didn't live together. I left nz because my dad passed away out of sudden. Now I am suffering from the death of my dad and not living with my partner both. There is no requirement to have lived together for 12 months for a partnership visa, that is only for residency. The requirement for CPVV and partnership work visas is that you have lived together long enough to satsfy the immigration officer that you are in a genuine and stable relationship. Recently we've seen people with a couple of months living together getting visas.

We're not going to defend the government. We used to, but then we saw them denying partners while letting in any entertainer who wanted to arrive. Their application of the Living Together criteria on some applications does not follow the operaitonal manual, and we believe would be rejected if we were able to get a court to review (which we can't under the Immigration Act).

Do you mean whether care givers can apply for residency through Skilled Migrant Category? A recent change has added Aged or Disabled Carer as an exception, meaning that while they are classified as unskilled by ANZSCO, INZ is now classifying that role as skilled. It's often hard to offset one against the other. I do know that I'd rather see partners in NZ than entertainers who are coming to perform once or twice. Simiarly, post study work visa holders have dedicated time to this country, studied here, and now are looking to build a future here. They've shown loyalty to this country, and provided value. We with the government would see that and, if they won't open the border, at least give a timetable and the promise to extend that work visa to allow those people a chance at a future in NZ once the border opens.

My partner is a nurse there in NZ. However, we dont have evidence living together for 12months. I’m a registered nurse here in the Philippines but we are not advised to take CAP as of the moment. Is there any chance I can visit my partner in NZ?

You don't need 12 months of evidence. You just need enough to show that you have lived together ina genuine and stable relationship. This can differ from couple to couple, so it will come down as to how much time you've lived together and what evidence you have.
Why aren't you considering CAP at the moment?

@@ImmigrationNZLaw Unfortunately Sir, we started in a long distance relationship last Jan 2020. We met and been together from March to April of 2020. I applied for a request to travel this month but got denied. My partner is a filipino and an NZ resident as well.
In regards with CAP, Filipinos especially who are here in the Philippines are not advised to apply for CAP as of the moment since there is an ongoing negotiation between Philippine Embassy in New Zealand and New Zealand Government on CAP and other Nursing Concerns.

The Minister hasn't said yet. The last we heard was from about a month ago, that the Minister would make an announcement in the next few weeks about EOI draws. Originally there was meant to be an announcement at the end of March, but that never came. We believe that the announced review is their attempt at justification for delaying it further, and on Monday that review was stated as occuring "some time this year". We did raise the legalities of the delay in our submission which isn't yet available online. We really don't believe it should be delayed further, but expect that the government may do just that.

Those movie stars and sports people are different, they play sports here no difference to people who want to bring their partners to live here most probably from a country who came from high pandemic countries, oh well glad that immigration has the last say, be a while.

It is so frustrating for us, as we talk to such amazing people, people who want to come to NZ to be with their partners, people who want to come to NZ to study, to build a life here. Yet, the government has decided that a long term commitment to NZ is worth less than someone who wants to perform at a concert, or play some sport. It isn't a decision based on keeping NZ healthy, which is the excuse we often see, but rather in giving the population distractions. If people are entertained, they may not notice the issues.

@@ImmigrationNZLaw Hellow, i know what you mean by amazing people, i use to work in a supermarket in NW in wellington Thorndon, the whole staff are all from different countries, india, sri lankans, fillipinos, chinese, all sorts of cultures, countries, there is one thing i can say is that they are hard workers and family, i do enjoyed working with them and to know them, oh well it would be interesting to see what happens with immigration, good luck.

This is not a big IMNZ changes if you want to look it just have a glance on canadian immigration system where they invited approximately 90,000 people to get Permanant residency.

Big doesn't necessarily mean an increase, it just means that there are a number of changes occuring. Yes, Canada, a country with 8x NZ's population, and about 1000x the number of deaths from Covid19, are giving out a lot of residencies as, unlike NZ, they don't have much chance of keeping Covid19 out. They had 11,787 new cases yesterday. So it isn't an easy comparison. If they could keep Canada safe then you'd likely see a similar response to that of New Zealand. However they can't, so they are using residence visas to bring in new talent.

We'd need to look at your employment agreement to make sure you are classified as a criitcal health worker. We also want to ensure that post study work visa holders will be included (we think they will be but we want to make sure in the operational manual changes which we should have soon). There is also the requirements around showing you are genuine and stable and have have lived together. So it's a possible yes, but we can't say for certain without looking your information and documents.

Unfortunately social work is not on any of the critical lists, so even if you had a job offer, it's unlikely you would be allowed to enter. Once the border is open, if you had a job offer, you may be able to enter. Social work now required registration, so you may want to look at that in advance to see if and how you can gain registration.
