Important Immigration NZ Update, Work Visas in 2021, & my engagement proposal!! - 19 December 2020

    As always, this video should not be seen as legal advice, but just information about changes occurring related to Immigration New Zealand and migration to New Zealand.     Apologies if I seem a little nervous, and I talk a little fast, in this video. I think it's obvious why.
    We cover three things in today's video.
    1:15 First is the changes provided in a 3:55pm "Friday Special" from INZ yesterday, although one of them was leaked a day or so before that. These are the suspension extension of most offshore applications to May 2021. The second is a new health requirement that is coming next week and which will apply to ALL temporary entry visas from the moment the email goes out. We'll cover this when it comes through (so there will be at least one more video next week).
    5:00 Next we cover the re-announced changes to the temporary work visa scheme in 2021. We say re-announced as they were announced at the start of 2020, and the new announcement doesn't actually provide any real detail. The latest post on this from INZ is at www.immigratio...

      Thanks Madhuri. We only had seven weeks apart in lockdown level four, so we can't imagine what so many of you are going through. That's why we are here, to help where we can, even if it's just to answer questions and clarify what can be confusing rules.

      The latest number's we've seen unfortunately show INZ declining most of the border exception partnership applications that they have received. We believe they are being overly harsh with their handling of many of these applications, and are just trying to provide what clarity we can on the situation.

      Thanks for that. I saw your comment on Sunday morning, and it's honestly the one I think I've appreciated the most. I spend 10-15 hours a week doing this, I don't get paid for it (it gets me very few clients) but it's just such craziness and confusion out there, I just want to try and help people out. Amongst those who do seem to think I'm there just to answer questions, there are some nice ones who I've hopefully provided some help to. But thanks again, your comment really did make me smile when I saw it.

      Thank Able. Yes she did :) I waited all day before uploading the video just before we had dinner, so that there was no risk of her seeing it without my being there with the ring. It was a very long day waiting.

    We have just received a number of emails related to the health changes mentioned in the video. We'll try and get a video out today on this, otherwise tomorrow morning, but essentially it is the right for temporary entry visas to be deported if they break any Covid19 rule.

    They will process student visa for July/2021 intake, I have applied since 5 months and until now no processing.
    I need to wait until May/2021 to start processing my application or they may process if before that date?

      At the moment the May 2021 date is NOT the date that things will definitely start. It is the date that the suspension has been extended to, but it is being reviewed monthly and could be extended further if the situation doesn't change. The world is still being hit hard, a bubble with Australia is looking less likely, so it will be unlikely for NZ to make changes any time soon now.

    Is this suspension applied on offshore unuse partnership based visitor visa also who already got visa prior to border restrictions? Or there are some hope of exemptions of such visas?

      Hi Bharti,
      This brings up the issue we have with Y3.30 of the operational manual. www.immigration.govt.nz/opsmanual/#73518.htm This list is meant to be who can travel to NZ without needing to apply for an exception. Included in that list are people who have been granted a visa based on partnership.
      However, on that list are people travelling with their NZ citizen/resident partner. These people we know do need a border exception. So Y3.30 isn't clear as to whether a border exception is needed for those travelling on a partnership visitor visa or not. We would recommend that guidance is sought from INZ, as we haven't had to handle this situation yet, and the operational manual isn't clear.

      In the video there is an update for international students, as they are temporary entry visa applicants, and the information was first found on an INZ page about international students.

      Hi Hardeep,
      With the issues we are all seeing in so many countries, NZ has taken the approach of closing the border and being very cautious of how many people come in and the quarantine they must go through. This is being done to protect people in New Zealand as well as NZ citizens and residents who are returning home. These people are the primary focus of the NZ government, to see to their security and health. For that reason, they're continuing to restrict MIQ, which means that partners of work visa holders aren't allowed in, and probably won't be for some time. As we've seen in Australia, one case can spread quickly, especially with this new strain that is being seen in the UK. So we don't believe the government will be changing their approach any time soon.

      @@ImmigrationNZLaw but government allows to celebrities, cricketers and other rich people and govt. has a capacity for these people in isolation systems but they don't have capacity for partners of work visa holders.. wow! hats off to labour party🙏

      Hi Ruwani,
      Based on what the Hon Chris Hipkins has stated, it's unlikely there will be visitors from outside NZ in 2021. However, it is a long year and lots of changes will occur, so that may change. However, at the moment it looks unlikely it will open for family apart from some partners.

      My husband's application for PR is at it's final stage also from Samoa. This was from October 17th and the case officer is waiting for the report to clear the border as he was unlawful here🤦.. Congratulations to you two.

      Unless there is a border exception, these are suspended until at least May, but it's likely to be extended further, possibly until the border reopens.

      Yes, you can apply for visas early, you don't need to wait until they have almost expired (at which point the WTR visa may have finally be removed).

      Hi,
      I can't say I've seen anything about that. My first reaction would be no, as it wouldn't fit under any of the exceptions or allowances. Depending on the circumstances there could be grounds for a humanitarian border exception, but we'd need to look at the situation in more depth to see if that might be possible.

      There are some pacific workers coming in under RSE, but that is about all. The other usual visas are currently on hold.

      Hi Ria,
      There won't be aby international students coming to NZ in January. MIQ is currently booked out until March, and INZ is not processing student visas as the border to students remains closed. At present there is still a possibility of students being allowed in for the July 2021 intake, but nothing has been confirmed yet.
      IELTS may be necessary for such a course, we'd need to look at that directly to confirm.

    Hi, what happen to EOI submitted while INZ is close for Offshore applicant. This is for SMC pathway. Is that affected in 2021 changes? Thank you arran.

      Hi Nico,
      EOIs are still sitting in the pool and will stay there until the draws restart, which we don't have a date for yet (it's delayed until at least April, but could be delayed further). It also isn't clear if they will apply the SMC policy changes that are coming to the applications already in the pool, but they are allowed to and we expect that they will. We've never had this situation before, with such a long time between draws, so we have no precedent to work from.

    Firstly Congratulations to both of you... I lodged my ESWV application as an automobile mechanic in last April. I already got application received email from inz. Then scan my passport too. Did they inform anything about processing already lodged ESWV applications?

      Hi Shenal,
      Thanks :) Are you offshore? If so then your application won't be processed any further while the border is closed, unless you get a border exception. With the exception of partnership visas that were submitted before 10 August, offshore applications aren't being processed without a border exception. So you will need to see if you meet the requirements.

    Is it right time to submit EOI ? My husband comes in long-time skilled shortage list. He is getting 165 point without job offer. Can we submit EOI?

      It isn't clear how INZ is going to handle the coming SMC changes. There is nothing to stop you from submitting the EOI. We don't know yet what the updated policies will be.

      We may be able to help with a visa, but you'll need to find a job offer first. With the border closed, most job offers though won't lead to a visa.

      At the moment our best guess is possibly in 2022? We don't see it happening in 2021, apart from perhaps some selected countries who don't have Covid19 in the community and even then it will be later in the year (apart from some pacific islands which could be earlier).

    Congratulations to both of you. I am a MBBS qualified doctor from Sri Lanka. and I will be coming to NZ to study Master of Public Health course. After I complete my Public Health COURSE , I will have enough points to apply for PR without a job offer ,if I can claim points for my employment in Sri Lanka as a DOCTOR. Can I apply PR as General Practitioner or as a health promotion officer and still claim points for experience in absolute skill shortage?(I will be eligible for NZ registration as a doctor by then after passing NZREX exam) This is before I start to work as a doctor or during first two years as a doctor in NZ? cheers..

      Hi Pathumi,
      We would need to see the work experience to state if it can be included. However, the general rule is that work experience points from what they call a non-comparable labour market(there are only a few countries that NZ considers to be comparable for experience) are only claimable if it relates to a job offer. So to claim those points you will need a job offer in NZ. More information can be found in the operational manual under SM7.15 www.immigration.govt.nz/opsmanual/#66800.htm
      So you will need to have a job offer in NZ to claim that work experience.

      Hi Shareek,
      New offshore applications are suspended without a border exception. There is processing of partnership visas taking place if they were lodged before the ban started, but they are being processed very slowly. For most people it may be faster to apply for a CPVV, just to get the partner in to New Zealand, but this will depend on whether the criteria can be met. But yes, partnership work and visitor visas are temporary entry visas, so these applications cannot be made from offshore at the moment.

      Online applications made after 10 August aren't generally being processed. We would need to talk to INZ directly to confirm the status, as it's too hard to tell without further details and speaking with them.

      I have applied my wife visa on sept 26th. I am speaking to immigration twice a week. At present they are processing visas in the month of june. I am not sure how they said to you that case officer is allocated to your file. Immigration is doing process seriously for partners of NZ citizen and PR. If i am not wrong sept month visa process will be done in feb. my file is in hamilton branch waiting for an immigration officer to assign. Dont be low. All the best .

      Nobody knows yet, as the government will not have decided. It depends on how well the world goes with fighting Covid19, as well as vaccinations. It will probably be closed for most or all of 2021.

      No news for students, and we don't expect any news for a while. NZ shuts down over Christmas/New Year, so it's going to be a quiet period for news. With the border controls, rising infections in a number of countries, we also can't see the government relaxing the border any time soon.

      Hi,
      Only if that employment provides a border exception, or if there is a change in government policy. Otherwise the border is closed, and is likely to remain closed for much of 2021 if not all of the year.

      Hi John,
      I'm assuming you mean an offer from an education provider? If so then no, as with the border closed INZ is not allowed to grant student visas at the moment. If you mean an offer of a job then it will depend on the job, and whether the employer can get you a border exception (only a small number will be able to get this). We are seeing some fake job offers being put out as scams in Asia and will be covering that in a video today.

      Hi Nana,
      Visas for most farm work won't be available in NZ at the moment due to the border being closed. There is some seasonal work but they're only issuing a small number of those so they will likely be taken already. It will probably be some time before it opens.

      @@DhruvPatel-yx7iq July intake is not possible because the immigration have already extended the suspension on offshore applicants until MAY 2021, so between MAY and JULY 2021-only 2 months gap is not gonna help us for JULY intake.

      Hi,
      I do mention an update on international students in the video, as international students are temporary entry visa applicants, which has been delayed until May 2021.
      As Brijesh says, it will be difficult to get applications open in May for people to be in NZ by July, especially with MIQ being booked out months in advance (and Australia messing up badly making a travel bubble less likely in the short term). So, unless there is an exception, and with no travel bubble that is looking less likely, July may be difficult.

      You would need to talk to the various companies in New Zealand, or keep an eye on the job advertising websites. However, the border is currently closed so it would be very difficult for you to get entry in to New Zealand at the moment.

      Hi Vinayak,
      I know that for many of people it feels that way. However, there is small changes happening. We do see some partners being reunited, others are being allowed to enter NZ to work. However, we also see massive virus outbreaks all over the world. So NZ continues it's approach of safety first, and limiting arrivals.
