    Its not just critical health workers whole world applied to nz on partner base visas are suffering from separation and stress PAIN OF EVERY PARTNER's ARE SAME!!

      A lot of migrants blame the Government for separating families. But when a migrant emigrates they are the one who begin the process of separating their own family. So do not blame the Government. If you really miss your family you can return to your home country. It is your own choice to emigrate and to remain overseas.

      @@tomhu1745 it’s easy for u to talk mate people move in search for a better life we as people understand situation rn but the borders have been closed for a year now when they can easily quarantine and further government have refused o build more MIQs and aren’t even let companies or universities build MIQS for their employees or students

      @@vipulabarnes9443 Well Vipula Barnes I have heard that line "We are in search of a better life" many times. But why do you migrants not try and improve your own country? Instead of abandoning your own country and abandoning your own family to try and seek your fortunes in a foreign country? Why would you want to contribute to a foreign country and not your own country?
      Personally I view most migrates are selfish minded people and are just thinking of themselves, and that includes New Zealanders who have migrated to other countries. They say they are proud New Zealanders but not proud enough to live here.

    Arran I am a New Zealand Citizen with a partner from a non waver country . Who worked through the level 4 period as an "essential worker" . I too wish to be reunited with may Partner after being 14 months apart .
    But I feel a little forgotten in this media campaign , which by the way I do support .
    Citizens/Residents with partners from non waver country's are suffering a real injustice as opposed to Citizens/Residents with partners from waver country's .

      Hi Mark,
      The media report did seem to focus on the workers, but our campaign has included NZ citizens and residents as well, and I've taken NZ citizen medical staff to the Minister, seeking their partners to get border exceptions. We think that partners of critical health workers should be here, including of course those of citizens, and we're still working on making that happen.

    Sir Mumbai NZ immigration offices closing in March I already have New Zealand student visa. Now where they work to grant our visa.

      Hi Simran,
      The government hasn't announced how they are going to handle all of those tens of thousands of visas that were unable to be used. We would hope that there is some time of extension or allowance etc so that people don't have to apply again. However, at the moment, we are blind as the government hasn't given its plan.

    I'm a post study work visa holder and came visit my family one week before the borders close. I might not go back to NZ since then. Everything I struggled to get in 2 years living in Auckland is melting from my hands and I can't do anything to stop it. :(

      Hi Alberto,
      Unfortunately the border closures have hit the post study work visa holders hard, as the government hasn't allowed for visa holders of that time in the border exceptions. We don't believe it is something they are going to do, with MIQ so overloaded. We're hoping that the minimum the government will do is allow for extensions of visas to cover the border closure period. However, the government has refused to provide details on how they are going to handle it. So at the moment there isn't much we can do but wait.

    Thanks for your update very informative l found it difficult to understand why a health worker is granted a critical purpose visa in response to covid 19 but not given priority in managed isolation system and why they have to pay more for their isolation.

      Hi Sarah,
      We agree that there could be some better way of allocating MIQ. However, it may get to a point that it just becomes to complicated, so we can also understand that perhaps this could be the easiest way. We would like to see, perhaps, some more discretion away from people travelling for non-critical purposes, so that people travelling for a holiday get spots last. However, it just makes things more complicated the more rules you apply, so we can understand why perhaps they haven't taken that path. The Australian approach is just to ban non-essential travel, something we wouldn't be against during a pandemic, which would certainly free up some MIQ space. We've seen people in the media who travelled to virus hot spots for activities such as taking a 1 year old baby to meet her grandparents, something which the child will never remember, and could have waited until later..

    Thanks for your updates, which is highly appreciated. Why is the NZ Goverment not extending Work Visa Holders that are still emplyed and stuck offshore that have been working towards Permanent Residency? My Talent Accredted Employer Work Visa expires 30 Apr 21. We will loose everything we own and worked for. All my EOI border exceptions have been unsuccessful. Im a Civil Engineer, work for Downer, maintaining Auckland roads.

      Hi Deon,
      They've focused on people who are in NZ, to give them security and safety in NZ. That is the approach they've taken. There needs to be some sort of announcement from the government as to how they will handle people in your situation. At the moment we've had no announcements or idea of how the government will handle situations such as yours.

    I'm a NZ citizen with a partner from non waiver country who obviously has a visitor visa but going home to be with family has stopped us from being able to fulfill what immigration nz accepts as partnership criteria?

      Hi Lorenzo,
      There is an allowance under H5.25.15.f for them to travel with you in to NZ, but they'll need to be granted a border exception. www.immigration.govt.nz/opsmanual/#73513.htm is the H5.25.15.f rules. The partnership needs to be seen as being genuine and stable under E4, and they are looking at living together in the past as being a part of being genuine and stable.

    How long is the average time you are seeing for a partner visa to be granted (excellent evidence, etc.) The partner is from a non waiver country to a NZ citzen

      Hi,
      It varies. The fastest we have seen is one week from the day it was applied for (that was a couple of weeks ago). The slowest can take months. With excellent evidence, and good time spent living together, it could be processed in a week.

    Is it mandatory to submit a valid language test result for the application of critical purpose visiting visa and if it so what is the needed score.

      Hi Silvy,
      Under the operational manual, no it isn't, as CPVVs are short term visas that don't have language requirements. Language tests are required for most residence class visas.

      Hi,
      Yes. People need to have their visas varied to state that they are allowed to enter New Zealand, and such variations are only granted to a limited number of people. Having a visa itself isn't enough to enter NZ while the border is closed.

    So I applied for a partnership based visitors visa, Im from South Africa and my partner is a New Zealand citizen, AND we have a child together whose just been registered as an NZ citizen. It's been almost 3 months since applying for the visa. They initially contacted me for more evidence, which I provided but that was in January. Haven't heard a thing since then

      Hi,
      That is because you are an offshore applicant, who are getting processed more slowly than applicants onshore. They are still be processed, but it is taking more time.

    I am here on work to residence talent visa. I am living here without family for last 1.5 years. I applied for PARTNER and kids visa last year in march, they have not allocated any immigration office to our case. What are prospects for us with current rules?

      Hi Varus,
      As the partner and dependents of a work visa holder, their application won't be processed until either the law changes (which is unlikely) or the border opens. So, unfortunately, you will most likely have to wait for the border to open before those visas can be granted.

    I am working in healthcare NZ on my work visa and waiting for my spouse to reunite from last year.I have applied to critical purpose visa twice but unsuccessfull.He also got his covid 19 vaccination and working in healthcare .So ,any hope this year.?

      Hi Shivani,
      If he can get a job offer in healthcare in NZ then he may be able to get a CPVV himself. Otherwise he may need you to travel with him depending on where he is from, and you'd need to show living together which is getting more difficult. Otherwise, it will likely ne later in the month.

      That is strange. I know that they were looking to release June at some point this week, but the server was hammered by users late last week due to poor communication. So this could either be a sever issue, or they're limiting it to March while they prepare June. Neither makes much sense.

    its just confusing me...in media its just mentioning about Nurses to reunite with families. is that included all heath workers..i mean health care worker or support worker...please clarify me...hope we all reunite with our families soon.

      The article spoke about nurses, but it was about all critical health workers, those that INZ define as being critical health workers. This includes more people than just nurses.     I thought things have improved, l personally applied for my self and husband under critical purpose visa and l was granted in less than two weeks but the managed isolation with no priority to health workers l think need review. Thanks

      They haven't said yet what their plans are. However, we expect that they won't be opening next month. Last week the minister announced a review of SMC, which we take as being his suggestion that he wants to look at it first before reopening it.

      Email us a copy of your wok visa to visa@shlaw.co.nz as we have been seeing many fake work visas that people have been receiving. We've done videos on it here ruclips.net/video/ZQMlXbI4rK4/видео.html and here ruclips.net/video/yoQuzdcOC-0/видео.html which might give you some more clarity. But we are offering to check visas for people if they email them through. Same with employment agreements, we can confirm if they are fake. We can say that there is no 2 year work visa in NZ. INZ does not grant a 2 year work visa.

      Hi,
      If she is already in NZ then, at the moment, there is no easy path for family to be with her without her leaving the country, something we encourage everyone to get legal advice on before they take that path, just to make sure it is not a wasted trip. Otherwise it will need to be once the border opens which could be some time away.

      Sadly there hasn't been a change for offshore applications, so they need to fall within one of the border exceptions. We don't expect this to change any time soon.

      Hi Rokshana,
      As you won't be able to practice here without doing a course to meet NZ medical council standards, your husband may need to travel with you. That would require you to be able to prove what INZ is classifying as a genuine and stable relationship including having lived together previously. We'd need to look at it in more depth before we could advise on whether this is a path that would be open to you or not.

    Been waiting for years now for my partner that works in Hong Kong she is a nanny for not nice employers ....so frustrating. I see the countries that are not locked down no masks they have no problems these restrictions for that this is is madness

      Hi Jason,
      Countries that aren't in lockdown and people aren't wearing masks typically have high death rates. The countries that have low rates of mask usage instead have more deaths. And many countries are in lockdown, if not for the population but instead at the border, not allowing travel. It is madness, but it's a mad world and a bad virus.

      Hi Chhanda,
      Applications for most people offshore, including partners of people in NZ on work visas, are not being processed. When the border closed in March 2020, that processing stopped. We expect that it will start again when the border opens which isn't likely to occur until the end of 2021 or early 2022. They haven't announced when/how the border will open. Visas like the one you applied for won't be processed/granted until then.

    A Lot of Culturally arranged marriages has been put on hold. There has been arrangements, preparations that needs to be completed. Some culturally arranged marriages needs to be completed between 2 families for continuity of religion. Covod19 should not be a factor to stop 2 healthy persons to continue their lives under Culturally arranged arrangements. Visa should be granted to those that arranged prior to Covid 19 pandemic.

      Hi Rukshar,
      We agree. We see a number of relationships that due to religion have meant the couples haven't lived together (most of India, but also some Christian couples from other countries) who have trouble meeting this standard that is being imposed. It comes down to the government at setting a limit for MIQ, and looking at the best ways to distribute those MIQ numbers. We believe that there are too many citizens and residents travelling for non-essential purposes, taking up MIQ, so if it was up to us that would stop, freeing up more space for partners, workers, students etc. However, that is a choice that the government has made.

    Meanwhile in Auckland, we are in another lockdown. South Auckland is basically the Border fence of New Zealand. We are suffering because of it. Why cant they take the new incoming to more remote isolation city, May be Dunedin or CHCH.

      Hi Richard,
      They do take some there, such as Christchurch, Wellington, and Rotorua. South Auckland does contain our largest airport, so naturally it is the airport where most flights enter. Being our largest city, it's also where most of the airline support industries are based. It's possible, though I can't confirm, that places like Dunedin won't have the staff there to handle certain tasks such as maintenance of the larger planes coming in. That's why Auckland is the obvious choice. They need to fly in to some city, so the risk will still be somewhere (and I say this while locked down in my apartment). It's frustrating, but part of living in by far the largest city.

      Student visa applications are currently on hold, apart from the PhD and 1,000 student visas for those who were already studying in NZ. Otherwise, all other applications aren't being progressed, and probably won't be until we see the border opening.

      It depends on if he holds a visa for NZ. If he holds a student/visitor visa then he may be able to apply for a CPVV border exception. If he doesn't then humanitarian may be an option if we can show that he has no way to survive there and needs to be with his family. We'd need to look at the situation in more depth.

      Have you got a job offer in NZ? If its in a border exception area then it should be handled fairly quickly, if it isn't then INZ won't look at it until the border opens or the law changes, most likely when the border opens. So it could be some time.

      At the moment not really. We expect that you'll need to do further study to be able to practice here, and lawyers are really considered essential workers for border exception purposes.

      You may be able to get a work visa, but first you'll need a job offer. If you did get a job offer then you may be able to get a border exception. It all comes down to getting a job offer.

    Hii Arren,I applied for partnership based visitor visa at October 2020.My husband is NZ citizen but immigration denied for that visa..They replied me for visitor visa until border opens..I am a doctor n you know this pandemic time doctor passes a very tough time.Moreover I am so upset after rejecting the visa..For last one year I have been separated from my husband due to immigration rules...I don't know when we will meet again😔

      Hi,
      Nobody knows when the border will open, and how it will open. There are possible ways for your husband to bring you in to the country, though they may require him to leave NZ to do it. We'd need to look at it in more depth. Unfortunately the government hasn't prioritised partners, instead looking at allowing NZers to keep travelling during a pandemic (which we think is ridiculous).

      Hi Bryan,
      While we don't have nuclear power plants in New Zealand, your experience would likely be applicable in other areas, such as as hydro or thermal power stations. You'd probably want to be either looking out for roles on trademe.co.nz or seek.co.nz or getting in touch with some of our larger energy producers. There is border exceptions available for people with exceptional abilities that cannot be found in NZ and, once here, and once the Skilled Migrant resident program reopened, you'd likely have a good shot at residence as well. So it all comes down to finding employment.

      Is it the accent, or am I speaking too fast? I can't help with the accent, it's just how NZers speak (more similar to those in the UK when many people are taught to understand an American accent). For the speed, I need to get through these videos quickly as they do take time out from working on files for clients, but I do try and not speak at full speed.

      Hi,
      Generally, permanent residence can be applied for after someone has been a resident for two years. Residence is a certain type of visa that not everyone can get, some can get it quickly, others may never meet the requirements. Once someone has been a resident for five years, subject to meeting some requirements, they may be able to become a citizen.

    During these these uncertain COVID times I do not understand why so many people are so intent on leaving their home countries? Shouldn't they remain in their home countries to support their family members and rebuild and contribute to their own country's economy instead of moving to another country and being separated from family and abandoning their own country?
    A lot of New Zealanders have returned home to New Zealand for this very reason. Yet many immigrants are wanting to migrate to New Zealand and criticize the NZ Government when they don't meet the policies. Coming to New Zealand is not a right.

      It isn't a right, but often NZ is asking them to come. There is a number of jobs NZ can't fill without migrants, such a in the health sector. So we ask them to come here to help in those jobs. For others, they are the partners of NZ citizens and residents, so the NZ citizen wants to be with their partner, and has a right to be here. It isn't about abandoning their own country, its about NZ needing their skills and experience.

      @@ImmigrationNZLaw Yes I am fully aware that there are skilled jobs which New Zealand needs to fill by qualified migrants. Or lower skilled jobs in the farming or health care sector where we need migrant workers. But I am also aware of many migrants who come here with questionable qualifications obtained from overseas as well as questionable Diplomas obtained in New Zealand who are in New Zealand working low value jobs like delivering pizza or working in liquor shops or people who have paid tens of thousands of dollars for their fake jobs. We do not need these sorts of applicants in our country.
