    1. As explained in the video, if you are a family, employment, or diversity-based applicant you MUST ANSWER YES to question 61.
    2. Any question asking about household income, debt, etc. - you must provide information for ~all people you counted in your household~ Any questions that do not literally say “household” are asking about the primary applicant.

      How do I know if I am subject to public charge ground of inadmissibility?
      "Only public cash assistance for income maintenance or long-term institutionalization at government expense provided to the applicant, where the applicant is listed as a named beneficiary, are considered in a public charge inadmissibility determination".
      The above is from USCIS website.. I don't know why I am still confused 😐. Thank you @Kseniya

    Thank you ❤ for this video. Really helpful. I don’t understand how some lawyers can say that if you have a good job and never asked public benefits, you are not subject to the public charge. I have been told that I was almost filling wrong my i-485, answering ‘No“ to this question. Thank you for clarifying that!

    I did submit this form for my Mom unfortunately I selected NO to question 61 and now they sent me a notice of evidence or an explanation why the NO 😢. Now I have to refill the application and send it back to them luckily I made a copy of the previous application. I am a subscriber to this channel and this women helped me a lot mostly where to send these applications and stuffs . Thanks for all you do God bless you 🥰.

    Your explanation is great. Sadly I only learned about this after filling No and I got a letter of request for evidence from USCIS today saying I failed to answer the public charge questions😞 but I’m able to fill it out quickly thanks to your video. Going to mail out immediately and hopefully it’s just a small delay🤞🏼

      @@osongavi3166 yes I have checked all the pages and wrote them a letter of list which are including the changes on the form. After I submitted that, they approved the case just today so it took their 7 days to approve it. But i dont wanna give you hope, hopefully it will happen to you too

    I really cant believe that I missed this video of yours when filling my husbands I-485.thankfully that USCIS were very nice and sent me rfe to correct this question.     So if a mother (with no dependents and not claimed as dependent in tax return) lives with her adult independent son (who is sponsoring her) and their son's spouse, the household size would be just 1? The son and his wife wouldn't be included in the household size even though he is the one sponsoring her?
    And does that mean that in the next question when they ask "household income" it only includes her income? What if she doesnt have an income?
    These new questions really confused me.

      Sounds like you’re correct. Based on the form instructions she would only count her son (the sponsor) if he was a child based on the INA definition,
      According to INA 101(b) (1) and 8 U.S.C. 1101(b)(1), a child is defined as: an “unmarried person under 21 years of age

    Regarding these new questions:
    But i have not any household expenses or any valuable in USA ! Im UK citizen here on Esta Visa visiting and siblings to US citizen - my brother filled I-130 that got approved And received letter asking me to filled up form I-485 . And i don't work here in US And nether i have any valuable here to show income 🤔
    so how i going to be answering these questions 😵‍💫

    What about parents ( living with children on B2), who are adjusting their status and are unemployed, do not file taxes, and are not in anyone's tax return as dependents?

      exactly, my dad is filling out this form but he doesnt declare taxes, i am the one who does with my husband and we live together all with our 2 kids so not sure what to put in, and my sister is over 21 and she lives abroad

    Please the question on public charge.
    1. Let say am B2 visitor and my spouse is filling for me should I select yes?
    2. And from question 62 - 65 who is suppose to answer me or my wife or the two of us?
    3.And question 66 - 67 who is the
    suppose to answer me or my wife.
    And lastly about if one had worked without authorization, what if I’ve worked as a cleaner before but on many different addresses what employers name and addresses should I use? Thank you.

I just have one doubt, if you or anyone here can help... if I am adjusting status , married to U.S citizen currently in U.S living together, I worked here and we will file taxes separately, in size of household, shall I include him (by him I mean, his income, debts ,etc together with mine) even though we treated finances separately or shall I include only myself thanks in advanced for your help!

      Any question that asks about household income, assets, and liabilities must include people who are counted in the household in Q62.

    Hi! we really appreciate all the videos you uploaded to help us through the process. This part of the form is really misleading and confusing and I thank you for making a video regarding this to straighten things out. I do have questions and I hope you can help me out. I am currently filling for my wife's I-485, she got here in the US with a K1 visa (fiancé visa) and we are already married that means number 61 is a yes for her? am I correct?     Question 65: does household liabilities include the liabilities of the applicant or the liabilities of all people in the household . Example: applicant and child living together , household of 2: does the amount of liabilities have to be for both Individuals or just the applicant?

    For question 64 isn't assets more than just cash in the bank. If you own your vehicle outright or have a bar of gold in your safe isn't that considered an asset???
    Also question 65 mentions secured debt which for example is a car loan so shouldn't you list that? You only listed unsecured debt in your examples.

I'm not working yet, I don't have debts so I'm not sure if my husbands is, let's say, still paying for his car, is that part of a liability?

    What about if I entered the U.S unlawfully and got married to a Us citizen who is also a member of military and apply for military parole in place, it’s approved.
    So for the question where they ask if i have ever entered into the country unlawfully, should i answer no or yes?
    Again when they ask what’s my current immigration status ?
    What should i put?

    When the public charge section asks the applicant for household income and assets, this refers to the income of both the applicant and her (American) spouse (assuming they are now married)? Or does this only refer to the income and assets of the applicant alone? Thanks. My wife and I love your channel so much.

      I'm not an expert and this isn't legal advice. I can say that in our case we responded to this issue with the income and assets of both the applicant and the American spouse. The application was eventually approved. We Wishing you good luck.

    What if back applicant live in with their child while she/he submits an un answered “No” than to resubmit. Applicant now is live independently, will the answer have to be updated or base on original.

    Good afternoon Kseniya, great video. Two questions: My fiancée is now getting ready to finalize and submit the Form I-485 and was wondering if you could answer the following questions, pertaining to Public Charge. If she just moved to the U.S. and we just got married, that means the size of the Household is now 2 people, me and her, right? No kids or any additional people living with us.
    Finally, since she is new to the U.S. and doesn't have an income or assets, and currently relying solely on my support (Form I-864 will also be submitted), the last question is, do we use my income, assets, and liabilities as the Annual Household Income, Value of Assets and Liabilities?     An LPR got his immediate family paroled in USA. His wife and a child got SQ.. visa on their passports. However, they got paroled from Afghanistan before the process to get green card completed.     Hello,
    I am an American citizen and my wife is an immigrant and we used a notary business that was acting as a if they are a laywer and really messed up our forms. We certainly have my I-130 that is pending denial due lack of affidavits and other supporting evidence of the validity of the marrige and we now have all that and are about to send it however, my wife's i-485 was denied due to answering no the public charge question. Should I fill out and I-290b or should we just file a other i495? If we file another i495, do we have do all the blood work and other documents to go with it again? Please help. Thank you,

My father and mother need to have a separate application for i130 and i485 right? Also for their i485, the answer for public charge question 61 is yes? I am confused since they don't have an income.     However, I'm still confused at question 67, mainly because I have no work skills (last job was 2017), and I have no certifications or licenses. The last thing I ever really did was be a carer for my Grandma with dementia while she still lived at home. How do I even fill out question 67? Could i just leave it blank?

    Hi Kseniya your videos are so helpful! On form I-485 “Public charge section” question 62, it ask about the household size. Since I am applying for my parents should I also include myself since I am their child? This would make a total household size of 3 which excludes my husband and child, correct?
    Second question, on question 64 it asks about the total value of your household assets. Would this mean my parents would have to include any assets, savings, or property they own over seas?

    Hi! I have two question. I am applying as family-based aplicants but I am living in the country with Temporary Protected Status approved and have my work authoration card. Do I have to put yes to the public charge anyway? and regarding to question about household, I live with my parents, sister, brother and my brother-in-law so I have to put 6 persons included me? they all are working.     I’m applying for adjustment of status for my wife and 2 kids(12 and 8). She doesn’t work, she is a home stay mom. I’m a US citizen so I will be submitting i130 and i485 together but the public charge question is giving me troubles. What should I mark for my wife and for my kids? Do I have to use my income for all of them?

    Hello k, I am organizing the documents to send them to USCIS, and today I find that there is no related information about the joint payment of the i-485 and the I-765, last week it appeared on the USCIS page that if I paid the I-485 I should not pay the I-765 if I presented them together.     For question 64 and 65, if you own a house that’s not paid off how would you put that in? For assets would it be the full value of the house or only the equity in the house? And for liabilities would it be what’s left on the mortgage?

      The way I understand it is assets would be equity and liabilities - remaining mortgage

    So I am a USC, and we're filing this for my mother who is currently in the US on a tourist visa. I have my wife and my son and my mother living with me right now. I also have a brother who is living in another country. So who would be counted in applicant's household here? My mother, myself and my brother even though he lives in another country? Or my mother, myself, my wife and my son?

    Hi,
    My husband came through a K1 visa and now we are doing the adjustment of status. We are stuck on a section and need help. It’s Part 8: General and inadmissibility Grounds #61 regarding Public Charge. From my awareness it is a yes based on research, but the questions after that such as household size and income will it be all my info? I live with my mom, dad, brother and now my husband. No one is depending on my parents but will 5 be the household size! However I have no one dependent on me and since my husband can’t work it’s my information right? Also, the income will that be whoever is working in my house combined? Please I need help! Thank you!

    Trying to help out a friend. He is stuck at question 62 what is the household size? He lives with his wife and her 2 children aged 19 and 21 years, and he does not claim anyone on tax returns.
