      Hi Anthony James,I’m recently completing the form online as well I have one question my wife and I completed the form on my uscis account but it doesn’t let us submit it because my birthday shows up on the account. Does my wife need to make an account with uscis and fill out the form for her account?

      Congratulations. As Kes has helped you can you please assist me? i just have few questions. I submitted my i-485 already can i send my medical to uscis to add the medical to my documents or do you think it wil affect it ?

      @@austinisibor9910 I sent my medical right away with the rest of the paperwork, some lawyers advise to wait until interview and bring it in person or wait for a RFE notice and submit it, since it’s only valid for 6 months. I did my exam first week of March and i submitted my application on March 17 (official notice date from USCIS), got approved September 29th. In my case it was a bit over 6 months until decision (no interview) and I wasn’t asked to re-do the medical.
      I have a friend who filed her paperwork along with the medical, after about 8 months she got a RFE notice and was asked to submit a fresh medical, once they received it she was approved, no interview.
      I guess it varies from case to case, but I’m pretty sure you have the option to submit additional evidence or forms once your USCIS online profile is set up and linked to the case, if you want to you can go for it, I am not sure if it will effect the timeline though.

    For an online wedding, the "place" of the wedding is the jurisdiction which certified and permanently recognized the wedding. If you got married under the laws of the state of UTAH the place of the wedding is Utah. If the officiant was standing in a Brazilian town square and performed the wedding remotely under the authority of the state of Utah, then the place of the wedding is still UTAH . If the Captain of a Canadian Cruise ship performs the wedding via Satellite on open water , the ship is Canadian and the wedding is verified by the country of CANADA, so the place is CANADA. Another way to think about it is to ask the most appropriate question. What courthouse holds the original wedding document? The officiant carries and represents the authority of the PLACE.
    I am placing this information here since it is a convenient place do so and it seems like there is little knowledge on the subject.

    At 28:33, this part must only be filled out if the beneficiary is currently in the US. If you are filing from abroad you have to leave this page blank, very important information I would add!

I recently went through the marriage based green card process and followed your videos step by step for each form and without these videos I wouldn't of known where to start.       Additional question 🙋🏼‍♂️ 1) can you address the optional "Cover Letter?" Advantages, disadvantages, etc?
      Also, a suggestion which may be slightly outside of the wheelhouse, however, if you could create a "How To" video of how to create a PDF document that you mentioned that would display all of the evidence photos in one document, I would have clicked the link and watched that video. 👍🏽

    Kseniya, thank you for such a detailed video. This is the most helpful tool I have found for filling out the I-130. Your time is so appreciated! Would you please answer these two questions:
    1-Do you answer "YES" to EVER visiting the US if it was just as a tourist? And do you fill out the status part of how the beneficiary entered if this is the case and they are not currently in the US?
    2-Do you include children who are older than 21 years of age under the beneficiary's family info?

      Hi, Yes you have to answer if you've ever been in the US. However you do not have to provide information like "Class of admission" etc. because you are currently not here.
      Yes you must include all children

Does she need to open an account or can she use my account for the form?

    Hey Kseniya! Thank you for this helpful video!! I have a quick question. If I have already submit I-130 online, can I still assemble I-485 and other forms together and mail it to USCIS and have it considered as concurrent filing? I wasn't sure if I have to submit I-485 and I-130 both by mail to have it considered as concurrent filing.

      Yes, you can submit the I-130 online and file the I-485 by mail. The I-485 has a section to include your I-130 receipt number from the online filing. This is still considered concurrent filing. The section on the I-485 where you input this receipt number is Part 2 item 3.

    Kseniya, I hope you don't mind one more quick question :). We're at the tail end of filling out the i-130 but in the review portion, it's giving us a red flag (hard stop, can't proceed further) because it says there are inconsistencies with the beneficiary's address. But, we've triple checked and they are correct. Have you heard of glitches in this regard?. And, secondly my American husband and I live in Canada. So, on the i-130, is the petitioner supposed to put an American mailing address for himself? I know that doesn't sound logical but someone told me that is correct. I have tried the form with various address combinations to see where the error is, but cannot figure it out.

    Hi Kseniya, thank you for posting this video! A few questions:
    1) If my spouse submits the form I-130, online from his USCIS account, can we still do concurrent filing? If so, how can we do it?
    2) From which account do we have to file the form I-485 online if we’re doing concurrent filing?
    3) Is it better to do online or paper filing if we decide to do concurrent filling? Would processing times be different?

      Not all uscis forms allow online filing, for example form i -485 is not yet open for online filing. Therefore, for concurrent filing, you may file form i-130 online.. and paper file form i-485. Thank you.

    Does anyone keep going in circles when clicking the "file online" link? Everytime I am in the "I-130, Petition for Alien Relative" page, I click on the blue "file online" button that is the link. It always keeps sending me to "Submit a FOIA or PA Request" page.

    Best presentation I’ve seen since I decided to bring my mother from Cuba.
    But I have a question: For the case of my Mom, the only proof requested related to her is my Birth Certificate, not even her Birth Certificate. It’s that ok, or am I missing something?

    Thank you so much for your videos. I'm hoping you may be able to answer a question, if you've come across this situation before. I am the petitioner and I work on a civilian contract in Iraq. I met my husband here and we were married in Erbil, Iraq. I own a home in Arizona, and I go there 2-3 times a year. I work on an Iraqi air force base and am not permitted to leave the base unless I am going out of country for vacation. My husband works on the base (which is how we met) and he has a home just outside the base. He stays with me on base 3-4 days a week. I'm wondering 2 things: 1. Is my home considered Arizona or Iraq in this situation? 2. If my home is considered Arizona, then obviously I wouldn't state that he lives with me. If, however, it's considered Iraq, would I state that he lives with me on the base? This part is confusing to me.

      That’s just my preference, USCIS allows both capitals and non capitals

    Hi! I have a question about section: Your Beneficiary: immigration information:
    1) what was the beneficiary's class of admission?
    2) when does the beneficiary authorized stay expire?.
    I entered the US on a B2 tourist visa, so the expiration date of my I-94 was January 2024. During that time, I applied for an E2 investor visa and received a new I-94 valid until September 2025.
    My question is, what I spouse to answer about the 2 questions above? and what I-94 number should I fill out?
    I ask because they inquire about the type of visa I entered the US with and the validity I was given. However, if I write the date from my visitor visa, it appears as though I've passed my expiration date... How, where I can add that I am currently on a different type of visa with a different validity?

    When you fill out for your spouse and children, do you got a pay separate fees for both I130 and if kid is not your kid only spouse. 😅

      See form instructions on page 1. US citizens must file a separate application for each, including stepchildren

    Thanks so much for this explicit video of the application process. For previously filled petition under "Other information", what if you cannot find or remember the date you petitioned for a relative in the past, or have filled multiple petitions, what do you do in that situation?

    I think they were updating their system around the April 25-30 timeframe because whenever I log in to update it would give the error: We were unable to retrieve your form. I tried using another browser and also creating a new account. I spent so many hours on this and now have to start all over. I even tweeted and tried calling USCIS but no help from them. Has anybody encountered the same issue? I do see now the online form has changed a little so they definitely were in the process of changing something.

      You need to include the most recent time when you and your now spouse lived together, married or not

      We have been together for 16 years. We lived together for 8 years (2007-2015) before his petition was approved. After that, he only takes a vacation of 3-4 months. We were only married in April 2023.

    Hi Kseniya! Thanks for all the great work you are doing for everyone on this channel. Just a quick question if don't mind: my mom applies for me under adult daughter category. The online form automatically lists evidences of end of prior marriage for both her and her current husband in the Evidence Attachments section. Is this type of evidence needed for parent-child petition category or should be skipped in our case?

    I'm filing an I-130 petition for both parents (believe this needs to be done separately). At the end of the form for the 1st parent, I'll be answering "Yes" to the question "Are you submitting separate petitions for other relatives?"
    The next question is "What is your relationship to this relative?"
    Should I be answering with "child" or "parent"? Are they asking who I am or who they are to me (parent)?

For the past few years, I've worked as an Uber driver, so for the employee information, should I list myself as an independent contractor or UBER INC? What about the address if I list myself as an independent contractor?

    At 23:20 - One question, what if the beneficiary doesn't have an address in the US that they intend to live at? Meaning, they're outside of the US currently and they don't know what address they'll live in once they move to the US.

    Thank you for this information it is very helpful so far but I have a question. At 28:30 you get to the portion where the petition asks what was the beneficiaries class of admission. But in our case my spouse has never been admitted to visit the United States so I would assume that I leave that part blank. Am I right about that? Because with everything else you would give us other options. But this time you never gave us the option of leaving it blank if it doesn't apply. But the petition does say What 'WAS' the beneficiaries class of admission. And in this case I'm not sure that I will be prompted this question because of my previous answers to questions.

      Make sure you're using a browser that supports the features and make sure that the browser is up to date, a good browser is Chrome, or Fire Fox.
