Hey. For the Income for the last 3 years, you mentioned it would be line 9 on the 1040 which is “Total Income”. , however the I-864 explicitly states “Adjusted Gross Income” which is actually line 11 on the 1040 form. I think it should be the AGI?

I got an RFE on this form. What I didn’t realize originally was the form is broken and that the household size automatically says 1. I’ve gone through all my documents and can’t understand how anything is wrong except for that. It’s crazy how the USCIS can’t just tell you what was wrong they have to sent a 3 pages document saying one or more of these things is wrong with the form. If this is the problem first of all they should just say your household size isn’t accurate please redo or just fix their damn form on their government site.

Hello! I know you already answered this question in the video but I can't help but ask it in person because two lawyers that I spoke two got me confused. Situation: I'm an legal permanent resident, currently filling out the I-864 to bring my wife to the US (she lives abroad). I am self-employed (I have a 1099 contract as a web developer, and I have all the needed evidence to prove that). I am NOT filling out the I-864A or I-864EZ, simply the I-864. I do have the tax return statements of the last 3 years. Question: When entering the total income for the last 3 years, should I take the line that says "total income" or "adjusted gross income"? Everything suggests that it should be former but for whatever reason two lawyers that I spoke two said that I should use "adjusted gross income". I am relying on your feedback because your channel played a HUGE part in helping me and my wife successfully filling out the I-130 2 years ago which got accepted without any issues whatsoever. Thanks for all your efforts.

@@davidalexander8786 Thanks David, I already did that and placed the total income. Just a few days after submitting the Affidavit of Support and DS-260 they got accepted without needing an RFE. So, for anybody who found themselves in a similar situation and is reading this: Always follow the instructions, don't care what lawyers might say. Submit all required evidence exactly as they want it, and the rest should be easy.

I am completing the form I-864 form and I am not sure what to do for this section . On part 5 Sponsor’s Household Size , the number 1 is listed ‘ Yourself’ which makes sense . However, at the part where you add all the numbers it’s showing 1 as the household size . Should I mark the 1 out to place the correct number there since it’s pre-populated?

Hi, if you see this comment please reply !! I am a US citizen and my spouse is working on a student visa and soon will receive H1B visa. We would also like to apply for adjustment of status but our issue is that because he's on a student visa, he can't quit his job and move to live with me and I have taken a huge scholarship from a medical organization that involves working for that organization for 3 years at least !! And If I quit I lose the scholarship! Having said that, we're only 40 miles apart but we don't have same address! I have a house in my name and he has an apartment! We do live 4 days a week together but our primary address is different! Is this a problem? Would having different addresses matter on our application?
My total income is $40,000 out of it $20,000 are house allowance. So according to what you said on page 5, 24a, b, c we have to write as is it in 1040 line 9. of total income. Hi, my husband received an RFE for I-864 saying that they couldn’t determine if the petitioning sponsor is qualified. That if needed we could use a co sponsor which we did! We sent 3 years of the co sponsor’s tax records and w-2’s. It was a lot of paper. And he makes 81,000, is married and has 2 kids. Hasn’t co sponsored anyone else and no other dependents. He files taxes separate from his wife and she claims their kids as dependents. Should he still count her and their kids in this form? We did, we total 5, him, wife, 2 kids and my husband who he’s sponsoring. This time we’re thinking on just sending the last year of tax returns and w-2. Do you think we should send I-864 for the petitioner again as well? He’s our son, 21. He filed taxes for 2022 and 2020 but not 2021, he was required to file but didn’t. Is that a problem? What should we answer where it says if he was required to file or not? This form I complicated. We had sent the petitioner’s 2years of tax transcripts and w-2’s.
The sponsor/co-sponsor must always count their spouse and children regardless where they live and even if they’re not claimed on returns. Only send whatever USCIS is asking for. If they mention that there are issues with petitioner’s I-864, then you must also send it.

But I worked until last year in October on STEM -OPT before my second master's began, so I had income and filled taxes to show for the last 3 years, which is above the federal poverty threshold. So my qtns is in the form I-864: 24. c. 3rd Most Recent? My wife started working professionally around mid-2022 and has a 1040 total income higher than the federal poverty threshold for 2022. and 2023. but 2021's total income (~10k) was way below the fed poverty threshold. So, what do you think you could recommend? Should we enter that total income (10k) into 24.c. in the 3rd most recent total income box a no?

I filed for my parents. Their paperwork is at NVC. I am aware that I need to do two separate DS-260 and two separate I-864. For my 2021 tax return I fall below and did not make enough 2022 and 2023 is above the poverty line. I live with my boyfriend and I am aware that I need to do an additional affidavit of support. Will my boyfriend be considered part of my household and do I need to fill out the form I-864A for him or do I include him on my I-864? Please help?

Is it advisable to leave those other 2 boxes blank since they are below the poverty guidelines and I won’t be sending the paperwork for those anyway?

@@damilolaola6249 not necessarily. Per form instructions only the most recent year and proof of current income counts but it doesn’t mean they won’t consider previous years.

Do not wait for USCIS to request a joint sponsor. If you’re using a joint sponsor, you must include their affidavit of support and all the evidence in the initial packet.
So my letter from my job doesn’t include the bonuses i make and my income is based highly on bonuses do i attach my letter and also explain why i make so much more than what my hourly pay is. I will attach 3 yrs taxes and 3 months paystubs. I was thinking of leaving our employer letter or should i just add it then explain

you will most likely receive an RFE for it, by the time they review the packet it will be well past 4/15 most likely.

How many people should be counted in the household on my I-864 and my son's I-864? Do I need to count my son on my form? Should the total household size be 2 or 3 on each form? Thanks!

Since the time is so close to file 2023 tax, should we include 2023 tax info? We haven't submitted the 2023 tax info yet but have the 2022 tax info for joint sponsor and petitioner. Should wait to file 2023 or go ahead with just 2022? it's just that my medical exam signed date is close to be 60 days since civil surgeon has signed. I am completing the form I-864 form and I am not sure what to do for this section . On part 5 Sponsor’s Household Size , the number 1 is listed ‘ Yourself’ which makes sense . However, at the part where you add all the numbers it’s showing 1 as the household size . Should I mark the 1 out to place the correct number there since it’s pre-populated?

I am a US citizen and my spouse is working on a student visa and soon will receive H1B visa. We would also like to apply for adjustment of status but our issue is that because he's on a student visa, he can't quit his job and move to live with me and I have taken a huge scholarship from a medical organization that involves working for that organization for 3 years at least !! And If I quit I lose the scholarship! Having said that, we're only 40 miles apart but we don't have same address! I have a house in my name and he has an apartment! We do live 4 days a week together but our primary address is different! Is this a problem? Would having different addresses matter on our application?

My total income is $40,000 out of it $20,000 are house allowance. So according to what you said on page 5, 24a, b, c we have to write as is it in 1040 line 9. of total income. So in my tax return 1040 line 9 my total income is only $20,000 so what should I do to prove that my total income is $40,000? Thank you for your response in advance.
Like I mentioned in the video, they will most likely send a request for evidence if line 9 does not reflect what they want to see.

Hi, my husband received an RFE for I-864 saying that they couldn’t determine if the petitioning sponsor is qualified. That if needed we could use a co sponsor which we did! We sent 3 years of the co sponsor’s tax records and w-2’s. It was a lot of paper. And he makes 81,000, is married and has 2 kids. Hasn’t co sponsored anyone else and no other dependents. He files taxes separate from his wife and she claims their kids as dependents. Should he still count her and their kids in this form? We did, we total 5, him, wife, 2 kids and my husband who he’s sponsoring. This time we’re thinking on just sending the last year of tax returns and w-2. Do you think we should send I-864 for the petitioner again as well? He’s our son, 21. He filed taxes for 2022 and 2020 but not 2021, he was required to file but didn’t. Is that a problem? What should we answer where it says if he was required to file or not? This form I complicated. We had sent the petitioner’s 2years of tax transcripts and w-2’s.
The sponsor/co-sponsor must always count their spouse and children regardless where they live and even if they’re not claimed on returns. Only send whatever USCIS is asking for. If they mention that there are issues with petitioner’s I-864, then you must also send it.

I recently got married to a US citizen. She is an RN and has been working in the hospital since mid-2022.
I am on an F1 visa. I am currently pursuing my 2nd master's here in the US, and I currently don't work. (No CPT). But I worked until last year in October on STEM -OPT before my second master's began, so I had income and filled taxes to show for the last 3 years, which is above the federal poverty threshold.
So my qtns is in the form I-864: 24. c. 3rd Most Recent?
My wife started working professionally around mid-2022 and has a 1040 total income higher than the federal poverty threshold for 2022. and 2023. but 2021's total income (~10k) was way below the fed poverty threshold.
So, what do you think you could recommend? Should we enter that total income (10k) into 24.c. in the 3rd most recent total income box a no?
USCIS primarily considers most recently filed tax returns and proof of current income

Hi...so i am filling i-864 for my mom and dad who is living abroad .so we are going thru consular process ..i have few quastions ,
1. Since i have 2 seperate petitions for mom and dad ..each AOS ..the household size comes as 3 (myself, my husband and the parent listed in that perticular petion ) is this correct ?
2.after filling out the form in adobe acrobat could i use a scanned image of my ink signed signsture and use it at the place of sign ..adobe has a feature as draw, initial or insert an image of the signature ..would this be an issue ? Should i print the filled out form and hand sign it take a pictures of the printed and signed form and scan and upload back ?
3. Should i hand write the date of submission as well or could i just type it ?

My spouse is my Beneficary he came off of the parole program. He have been working for 6mth now. So does Part 6 applies for him. Or should I just keep it as zero. He came here 7mths ago. He have his work permit.
I filed for my parents. Their paperwork is at NVC. I am aware that I need to do two separate DS-260 and two separate I-864.
For my 2021 tax return I fall below and did not make enough 2022 and 2023 is above the poverty line.
I live with my boyfriend and I am aware that I need to do an additional affidavit of support. Will my boyfriend be considered part of my household and do I need to fill out the form I-864A for him or do I include him on my I-864? Please help?

Do you have a video about what Schedules of the 1040 should be submitted to CEAC? And if all of them should be submitted can they be uploaded as separate files? Altogether the file is 6 MB after compressing, which is too big
All schedules yes. If the file is too big try obtaining an IRS transcript instead
Thank you so much for your videos Kseniya. I have about this I-864, I made above the poverty guidelines last year and I have the tax documents. But the 2 years before I didn’t make enough. Is it advisable to leave those other 2 boxes blank since they are below the poverty guidelines and I won’t be sending the paperwork for those anyway?
Do not leave them blank even if you’re not planning to provide those documents

@@damilolaola6249 not necessarily. Per form instructions only the most recent year and proof of current income counts but it doesn’t mean they won’t consider previous years.

You are the petitioner you always have to fill out I-864 first, then your husband would fill I-864A. Check out the playlist I have dedicated to this form specifically :)
If the Spouse Beneficiary works outside of the USA and does not file any US Tax, do we have still fill-in Part 5 - Item 8, 9, 10? and Part 6 - item 22?

She's not looking to work right now, but she is taking English classes.

Do not wait for USCIS to request a joint sponsor. If you’re using a joint sponsor, you must include their affidavit of support and all the evidence in the initial packet.

So my letter from my job doesn’t include the bonuses i make and my income is based highly on bonuses do i attach my letter and also explain why i make so much more than what my hourly pay is. I will attach 3 yrs taxes and 3 months paystubs. I was thinking of leaving our employer letter or should i just add it then explain
