It is a civil punishment from the DA ! The lady will have to bond out $, go to court ( miss work) $, secure a lawyer $, get her car out of impound $ ! It will be just a matter of shuffling papers for them , but she will be out at least a thousand dollars for absolutely no crime ! Is this conidered justice these days ? Great video with one exception, Texas is a Duty to Report state. In a legal stop, cops ask about weapons, you are required by law to truthfully answer. Gun laws vary by state, and Duty to Report may be unconstitutional, but it’s the law in multiple states.

To be clear, a pat down (or frisk) IS absolutely a search. It’s a limited search. It’s the only type of search that’s legal without probable cause. And cops must have a reasonable belief that the detainee is both armed and dangerous.

He doesn’t care because he gets paid either way. He knows they will lose the case but it’s irrelevant to him because he still gets paid. Since there are very few cases of malicious prosecution that get decided in the defendant’s favor he isn’t afraid to go forward with charges.

@@Mike-om4tvyou file for millions but settle for 6 figures and its best anyways as you don't have to actually take your chances and endure the entire trial duration etc. It'll be easy 6 figures though, then you can sue it personally as it loses qualified immunity per multiple established case laws, so you can sue it personally too, on average it will be about $5k-$25k depending suing actual offending cops and they typically are set on payment arrangement.

The DA after reading the laws and telling the officer "She would be eaten alive by the defense attorney" then said "Legally you are right, but morally" Wait wait... if she was legally right a defense attorney couldn't "eat you alive". The DA needs to be removed from his position. He told the officer You're wrong on two accounts, but I'll defend you. Also, the female cop needs to be put on 30 days UNPAID leave. Illegal detainment, illegal search. She should be required to write two 1000-word papers, first on the laws of "obscured" license plates and the second on "proper searches" before returning to road duty. The documents must remain in her permanent file ( even if she changes departments) to be used against her in future cases.

The prosecutor told the cop why he wouldn't do it and gave the legal reasons. Then proceeded to tell the cop that if she wanted to proceed he would be "with you". Dirty prosecutor should also be sued.
