  • Florida Gov. Ron DeSantis has signed a bill that will allow squatters in the state to be immediately evicted.
    DeSantis signed the bill, HB 621, during a news conference Wednesday in Orlando, promising that Florida is "ending the squatter scam."

      My landowner friend had to wait an entire year to evict non-paying renters who literally were so shameless they scraped off the DMC sticker from her car to save money with a lawsuit. They stole all the furniture the way out, but they somehow kept the costs down during the first lawsuit, so my friend decided that it costs more money to pursue them, plus the time and energy. This is in California.

      I think Tennessee's new law is going to do that. The property owner only has to prove they own it and the police will arrest the squatters. The owner probably has to press charges. It seems Florida's new law can be bypassed if they have a fake lease. Then you have to consider they could believe they are legit renters if they have been scammed by a Facebook scammer ad..

      Because there are certain situations where it makes sense. For example, a child who has been living in a senior living community with their grandparents getting kicked out by the HOA because they passed away would be a situation where squatters rights should be applied. This was a real case btw

When a person occupies a structure or land they don't own they are squatting. The squatters that just break into a house and change the lock are NOT abusing squatter's rights, they are abusing tenant's rights. That is a major difference that most people, like you included, don't understand. The new age squatters are abusing tenant's rights, and if you try and say tenant's rights should have never been a thing, you are completely wrong and your take is completely invalid.

      In that context, you’re right but that’s not what’s happening here. A squatter definition changed here in Florida. You couldn’t be called a squatter if the landlord gave you the keys. But evictions became hard when those people stopped paying. So that’s what they changed. It also includes fraudulently finding reasons to stay in a place that you’ve been asked to leave.

      Usually the case is that houses are being bought up by corporations as an investment and unoccupied for decades. Squatters who can’t pay rent somewhere else end up moving in. It’s time to give corporations the right to remove squatters from their investment properties and the squatters need to be jailed and forced into labor thay benefits society.

      It's because in America it is hard to prove someone is a squatter without due process. If you and I sign a lease and I'm really mad at you for some reason and I tell cops "this person is a squatter," the police don't have the right to remove you from the home. It goes through the court and proved that way. It applies the other way around since it's a he-said, she-said situation. Squatters rights cases are incredibly rare as it takes a pretty mentally sick individual to go into someone's house and pretend it's theirs

      Unfortunately evictions can be a very complex issue. Sometimes the tenant can be bad, sometimes the landlord can be bad.

      All states have laws that protect squatters in some form or fashion. Sqatting should have NEVER had any protective laws. All states need to revoke their squatter laws and invoke immediate eviction laws.

      @@lwb8326 There is a huge difference between being a Tennent in a property (under control of a Land Lord) and someone moving into an unoccupied property aka Squatters. Example. If I lived in an apartment or rented housed, i must have a lease for that permission to be there. Squatters, when they move into a property illegally, have no lease that allows them. The problem was that there typically isn't any laws that give the police any ability to take action as requested by the lawful owners. If i understand the article correctly, Fla codified that, so then the cops can help in forcible evictions (presumably with the ability to NOT be sued by the squatters. Before that, if the owner tried to evict the squatters, the squatters COULD sue... in a way, squatting is another means of getting rich quick?

      good luck with that. Federal government is on a finger pointing, mud slinging, anti-bipartisan, break. Even when they agree on a bipartisan plan, like they did with immigration a few months back, someone decides that despite it's what the country needs it's not politically expedient. We've been tossing things back to the states (RvW) which comes 'round again and back to SCOTUS, who has evolved from a bipartisan purpose to one that is also partisan and getting little done. Term limits in all things.

      I doubt the law will stand as it clearly was established as a means to deprive people of due process. Not just squatters, as I seriously doubt the real reason for the passage of the law was for that cause, but for the tenants, as now a landlord is able to employ a police officer to enforce evictions prior to any civil proceeding. Meaning that the tenant is no longer afforded the opportunity to prove legal tenancy until after the eviction, and be charged with trespassing if they fail to leave when told to do so by the police, further it removes their residency status as a defense in said trespassing case. So even if your a legal tenant, or home owner under a mortgage, you are now subject to being evicted from your property, risk being charged with trespass, and responsible for any suit necessary to redress any grievances caused by those actions.

That governor is presenting the problem as only targeting squatters, yet the legislation does not mention squatters, instead defining them as transient occupants, and requiring all leases be notarized, and that renters must produce receipt,, or that making it so people are unable to use their permanent residency as a defense for trespassing that officer my charge them with when told to leave under that legislation.

      The point was that if a property was abandoned or unused a person could come in and take it over and make it useful. It also protected people who had a good faith belief that they owned a piece of property.
      The issue is that malicious squatters have been taking advantage of the laws to just move into people's homes. The laws need to be strengthened for cases like this rather than abandoned.

      Fake title deads are submitted all the time and the government doesn't question if they are fake. That's why I have "title lock " insurance. If there is any change to your title , you are informed and legal fees are paid.
