  • The plaintiff rented a condo from the defendant, but she claims the defendant harassed her and refuses to return her security deposit, so the plaintiff is suing. The defendant insists she had to evict the plaintiff because she failed to pay rent, and she was a complete nightmare. The defendant is countersuing for back rent and legal costs

      I really don't know how anyone would want to be a landlord in the North East! The liberal judges have destroyed the rental market. 42% of all NYC apartments are now section 8 housing.. that means that WE hard working people, are paying their rent. This old hag is the typical nightmare. Imagine this woman as your tenant!

      What?!? Once a tenant signs a written lease (assuming that's the case here), it becomes BINDING. Trying to reject the lease after signing it is a breach. Plaintiff is batsh*t crazy.

    I SIGNED the lease and I rejected it. What does she think a lease is?!? I think her son stalled on the work so his mother could use it as an excuse not to pay the full rent. Six months is a long time to install some tile and toilets. The Plaintiff seems insufferable.

      these folks should sell the place.. get their money and run.. being a landlord will take years off your life in America. No protection for a landlord.. Can take 18 months to remove a tenant in NYC, rent free. Then the tenant sue you and the judge awards them stress $$$.

    If a landlord gives you a notice to move out at the end of your lease, move unless you really have no other place to go. Having an eviction on your record can make renting elsewhere difficult.

      Legally in California, if it is an illegal dwelling (think converted garage)
      You don't have to pay.
      Renters need and have protection here in California.

    Oh hell no!! When I rented, I always read EVERY damn bit of the ENTIRE lease, just like I have EVERY other contract I have had to sign! Every number in every amount, every paragraph, sentence, word, and letter in that damn thing! Look buddy, you hand me a 12 page lease, you might want to grab yourself lunch! This is going to take a while!
    If I find a typo, or an ambiguous statement, I tell them they either need to redo the lease, which I will read thoroughly again, or you can just type up an addendum, while I wait, but in either case, THIS lease STAYS with me, so I can make sure they didn't "accidentally" change anything else on it!
    They may be frustrated, but they quickly learn that I always pay my rent on time, the place is ALWAYS spotless, and I don't cause any problems! I also make sure ALL correspondence is by text, or email!
    I video the walk through process at the beginning, pointing out any issues, and at the end of the lease, and I also take detailed pictures. I usually get back my entire security deposit!
    It took getting burned too many times, and overcoming my anxiety over confrontation! It was a slow process, one step at a time, but TOTALLY worth it! These court shows have taught me SO much!

      Great explanation! I'm sure that landlords are very happy to have you, too! I worked in property management for 7 years and I always knew when I had a tenant who thoroughly read the lease, that we were off to a great tenancy!

      @@sweet2sunshine I'm no lawyer, but the only instance of such a condition that I'm aware of relates to the 72-hour period after a door-to-door purchase, and that's because of the pressure-to-buy tactics such salespeople tend to use. On a lease or regular contract without an explicit clause permitting it? Ya sign it, ya bought it.
      And I find it interesting that the plaintiff apparently didn't even bother to research if six days was within such a period, or she would have found out it's not permitted.

      the plaintiff really knew how to work the system. With her son dragging out the repairs, the landlord couldn't get a C O and often the plaintiff doesn't have to pay rent. All the best to you!!

      not necessarily. I was being evicted from the last property I lived at before I rented my current apartment. doesn't mean I was causing any issues or that I didn't pay etc. sometimes things aren't always as they seem. that's the problem with generic evictions being filed, they don't say "why".

      @@jimh4167 millions of evictions happen all the time to people who bought the property they're living in. Many like myself, I bought my house in 2004, paid my mortgage every month, never missed a payment, my mortgage company committed fraud on my loan & foreclosed on me, in 2021 a local investor bought my home & filed an eviction on me & I had to leave after living there for almost 20 years. It was my house, no one else's. Eviction often happens due to this, more than people think, millions, thousands per day. When the homeowner cannot afford an attorney & they have to defend themselves in court pro se this is what happens, this is our justice system. Unfortunately the public associates "eviction" with mainly renters and that's very far from what's actually happening out there.

    I could have sworn that in other cases, the judge said that you can’t sue for damages if it’s an illegal apartment. Is it more a state by state regulation?

      Yes there are certain things you need to have to rent the place legally. You need to have the following a stove fridge a toilet bathtub or shower smoke detector windows and one has to be an emergency window to get out incase of a fire. The place needs to be safe and free of structural damage bugs or water damage. And you need to provide gas water heat and power.

    The landlord/lady said the plaintiff was getting thrown out of her old apartment, and she wanted to help her out. The fact the defendant was getting “thrown out” of another apartment should’ve been a huge red flag!

    If land lords would do a very thorough rental history on potential renters they would find that bad renters leave a trail of rental trouble behind themselves. You can save yourself a lot of headaches.

    Regarding the washing machines, Geddy used to have his amps back there, but then he started just plugging his bass into the PA system so there was this huge empty space behind him. One night the roadies decided to just put random stuff behind him, and it was funny and the fans loved it, so they started doing it from then on, and they chose washing machines for that tour.
    There were over 200,000 people at that concert!

    Back in the 70's and 80's when I rented apartments we I.E. the land Lord and I we shake on our agreement, never had a problem, made shore the place was return as I got it.

    When you sign a lease, you are agreeing to the terms like how much the rent is every month, deposit and if it is a six-month lease. And when you pay less on the rent, that is breaking the lease and can be evicted. Plaintiff did damage to the stove and believes that stainless steel stove is inexpensive. Defendant opened the freezer door hard and broke the handle. She is really carless with people's appliances. And then the plaintiff wanted to keep talking while the judge was thinking. Never disturb a judge when he/she is thinking. And the plaintiff lost.

      landlord spent the deposit, this is a textbook case where landlord spends the funds then landlord conjures up damages to either break even or not have to give anything back. oldest trick in the book.

    The judge tried to throw the plaintiff a bone at 10:30 by asking the defendant if she had proof, first (she usually asks for a response then asks for proof). The plaintiff was paying so little attention that she then admitted to the damages, rightfully so, but still, a quick denial and she may have actually gotten her money back.

    The plaintiff is full of excuses - first said she asked for the original lease but never received it, then she says she handed it to her in the middle of "toilets being replaced" etc - i guess meaning that's why she said she never read it, then the second lease she signed it then she rejected it? Makes no sense. Then after admitting to damages the new appliances - she said they were cheap appliances anyway. So entitled.
